Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Civil Servants, Public Officials, and Military Personnel;
CONSIDERING THE PROPOSAL OF THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT,
DECISION:
Article 1. Scope and Applicability
This Decision stipulates the allowance system for professionals with technical expertise classified according to the salary regulations set forth in Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for cadres, civil servants, public officials, and armed forces personnel who directly perform tasks such as meteorological and hydrological observation and measurement, marine meteorology, radio sounding, weather radar, atmospheric and water environmental monitoring (hereinafter referred to collectively as meteorological and hydrological tasks); meteorological and hydrological investigation and survey; meteorological and hydrological forecasting; meteorological and hydrological control; ensuring information systems serving meteorological and hydrological forecasting work.
Article 2. Allowance levels and payment methods
1. The allowance level for the meteorological and hydrological profession for technical professionals in the natural resources and environment sector shall be specified as follows:
a) A rate of 30% shall apply to technical professionals performing tasks such as meteorological and hydrological observation and measurement; meteorological and hydrological investigation and survey in areas with regional allowances of 0.1 or higher;
b) A rate of 25% shall apply to: - Technical professionals performing tasks such as meteorological and hydrological observation and measurement; meteorological and hydrological investigation and survey in areas without regional allowances; - Technical professionals performing meteorological and hydrological forecasting tasks in areas with regional allowances of 0.1 or higher.
c) A rate of 20% shall apply to: - Technical professionals performing meteorological and hydrological forecasting tasks in areas without regional allowances; - Technical professionals performing tasks such as meteorological and hydrological control; ensuring information systems serving meteorological and hydrological forecasting work in areas with regional allowances of 0.1 or higher.
d) A rate of 15% shall apply to technical professionals performing tasks such as meteorological and hydrological control; ensuring information systems serving meteorological and hydrological forecasting work in areas without regional allowances.
2. The professional allowance stipulated in Clause 1 of this Article shall be calculated based on the current grade and rank salary plus leadership position allowance and seniority allowance exceeding the ceiling, if applicable.
3. The subjects specified in Article 1 of this Decision shall not enjoy professional allowances during the following periods:
a) Time spent working abroad, studying, or training outside the country receiving 40% of the salary as prescribed in Clause 4, Article 8 of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for cadres, civil servants, public officials, and armed forces personnel;
b) Time spent working or studying within the country continuously for three months or more without performing meteorological and hydrological tasks;
c) Time off for personal reasons without pay continuously for one month or more;
d) Time off due to illness or maternity leave receiving social insurance benefits as prescribed by laws on social insurance;
e) Time when suspended from work or suspended from performing meteorological and hydrological tasks.
4. The professional allowances stipulated in this Decision shall be paid together with monthly salaries and shall not be used to calculate contributions or benefits under mandatory social insurance, unemployment insurance, or health insurance.
Article 3. Sources of Funds
1. The State budget shall provide funding for the payment of professional allowances for agencies and units whose operating costs are fully covered by the State budget or partially self-funded according to the provisions of the State Budget Law.
2. The source of funds for the payment of professional allowances for agencies and units that fully self-fund their regular operating expenses shall be paid from the funds used to implement the self-management and financial responsibility system as prescribed by law.
Article 4. Effective date
This Decision takes effect from November 1, 2011, and replaces Decision No. 83/2006/QĐ-TTg dated April 17, 2006 of the Prime Minister on the preferential system for the meteorological and hydrological profession under the Natural Resources and Environment sector.
Article 5. Responsibilities for Implementation
THE MINISTERS, HEADS OF GOVERNMENT-LEVEL MINISTRIES, HEADS OF GOVERNMENT-LEVEL AGENCIES, AND CHAIRMEN OF PROVINCE AND CITY PEOPLE'S COMMITTEES DIRECTLY UNDER THE CENTRAL GOVERNMENT SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION./.
