The Ministry of Agriculture and Rural Development guides the implementation of piloting agricultural insurance in crop cultivation, animal husbandry, and aquaculture according to Decision No. 315/QD-TTg dated March 1, 2011 of the Prime Minister as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability

This Circular provides guidance on the provisions at Clause 5, Article 1 of Decision No. 315/QD-TTg dated March 1, 2011 of the Prime Minister regarding criteria for production scale, production process; types of natural disasters and epidemics, and determination of damage levels for irrigated rice; cattle breeding (meat, draft, reproductive) and dairy cows; pig breeding (meat, sow, boar); poultry breeding (egg-laying, meat) and aquaculture (tra fish, black tiger shrimp, whiteleg shrimp) selected to participate in piloting agricultural insurance during the period from 2011 to 2013 in 20 centrally-administered provinces (hereinafter referred to as province).

a) Subjects eligible for pilot insurance support:
Farmers, fishermen, farm owners, cooperative groups, cooperatives, enterprises, and other organizations and individuals engaged in agricultural and aquaculture production (hereinafter referred to as producers) participating in piloting agricultural insurance during the period from 2011 to 2013 according to Clause 2, Article 1 of Decision No. 315/QD-TTg dated March 1, 2011 of the Prime Minister.
b) Subjects eligible for insurance and areas for pilot insurance implementation:
- Implementing insurance for irrigated rice in Nam Dinh, Thai Binh, Nghe An, Ha Tinh, Binh Thuan, An Giang, Dong Thap;
- Implementing insurance for livestock breeding: Pigs (meat, sow, boar) in Hanoi, Vinh Phuc, Hai Phong, Bac Ninh, Thanh Hoa, Nghe An, Binh Dinh, Binh Duong, Dong Nai; Chickens (meat, egg-laying) in Bac Ninh, Hai Phong, Vinh Phuc, Dong Nai; Ducks (meat, egg-laying) in Bac Ninh, Hai Phong, Dong Nai; Cattle (meat, draft, reproductive) in Vinh Phuc, Thanh Hoa, Nghe An, Binh Dinh, Dong Nai; Dairy cows in Hanoi, Binh Dinh, Binh Duong, Dong Nai; Water buffaloes (meat, draft, reproductive) in Vinh Phuc, Thanh Hoa, Nghe An;
- Implementing insurance for aquaculture: Tra fish in Ben Tre, Tra Vinh; Black tiger shrimp, Whiteleg shrimp in Ben Tre, Bac Lieu, Ca Mau, Soc Trang.
Article 2. Principles for selecting areas for implementation and conditions for pilot insurance support
1. Principles for selecting areas for implementation
a) Each province selects pilot insurance areas with production scales representative of the insured subjects in the locality;
b) Selected districts and communes must ensure representativeness and rationality within the region; facilitate interim assessment, final evaluation, monitoring, experience sharing, and replication;
c) Ensure the principle of majority compensating minority;
d) Be consistent with national policies on agricultural development, farmers, and rural areas.
2. Conditions for receiving pilot insurance support
a) Implemented according to Clause 4, Article 1 of Decision No. 315/QD-TTg of the Prime Minister;
b) Insured subjects must submit voluntary applications and commit to participating in the pilot insurance program; Follow crop cultivation, livestock breeding, aquaculture procedures, disease prevention procedures as stipulated in this Circular or approved by the provincial People's Committee through the Department of Agriculture and Rural Development.
Chapter II
SPECIFIC PROVISIONS
Article 3. Provisions on types of natural disasters, dangerous epidemics, and determination of damage levels for pilot agricultural insurance support
1. Types of natural disasters: Typhoons, floods, droughts, severe cold, frost damage, frostbite, salinity intrusion, tsunamis.
2. Types of epidemics:
a) For rice plants: Dwarf disease, yellow dwarf disease, black streaked dwarf disease; brown planthopper epidemic;
b) For cattle: Foot-and-mouth disease;
c) For pigs: Blue ear disease, foot-and-mouth disease;
d) For chickens and ducks: Avian influenza;
đ) For tra catfish: Hepato-renal necrosis;
e) For white shrimp: White spot syndrome, yellow head disease, atrophy and pancreatic necrosis;
g) For whiteleg shrimp: White spot syndrome, yellow head disease, Taura syndrome, atrophy and pancreatic necrosis.
3. Authority to announce natural disasters and epidemics
The Chairman of the Provincial People's Committee issues a decision to announce and confirm the type of natural disaster or epidemic occurring in the locality according to Clause 1 and 2 of Article 3 of this Circular.
4. Responsibilities of participants in the pilot agricultural insurance program: When damage occurs due to natural disasters or epidemics, the producer must report to the commune-level local authority to organize confirmation of the damage; simultaneously cooperate with relevant parties to minimize losses and implement compensation procedures as prescribed.
5. Insurance coverage levels
a) Due to the influence of the types of natural disasters and epidemics specified in Clause 1 and 2 of Article 3 of this Circular, causing the yield of harvested rice in the region to be less than 75% (<75%) of the average yield of the production season in the last three years; livestock losses at 20%; aquaculture losses at 30% or more (in economic value) are eligible for insurance.
The Chairman of the Provincial People's Committee confirms the level of damage in the locality as the basis for resolving compensation according to the conditions of the insurance contract approved by the Ministry of Finance.
b) For irrigated rice crops, livestock, and aquaculture participating in the pilot insurance program that suffer from diseases and are treated by veterinary agencies, plant protection agencies, or producers, the cost of medicine and labor for treatment will be reimbursed up to 20% of the insurance value.
Article 4. Provisions on criteria for scale and production process for irrigated rice crops
1. Criteria and scale, production area for irrigated rice crops
a) Scale and production area: Each province selects three districts; the insurance scale covers the entire district for specialized irrigated rice crop areas (minimum cultivated land area of five hectares) during the main rice production seasons: Winter-Spring, Summer, Autumn-Autumn;
b) Infrastructure in the irrigated rice production area: Convenient transportation routes; basic irrigation system capable of supporting rice production and harvesting under normal weather conditions in the locality.
2. Production process for irrigated rice crops: Follow the provisions set out in Appendix 1 issued together with this Circular or the production process approved by the provincial Department of Agriculture and Rural Development.
Article 5. Provisions on criteria for scale and production process for livestock farming
1. Criteria and scale, production area for livestock farming: Each province selects three districts, each district selects three communes; the insurance scale covers the entire commune.
2. For cattle and buffalo farming (meat, draft, breeding) and dairy cows.
a) Livestock farming scale: Households raising cattle and buffalo through stall feeding or controlled grazing (excluding free-range cattle and buffalo) with one animal or more.
b) Livestock farming process: Follow the provisions set out in Appendix II issued together with this Circular.
c) Insurance calculation period:
- For cattle and buffalo (meat, draft): Calculated from six months old onwards, regardless of sex, in good health, without congenital defects;
- For cattle and buffalo (breeding), dairy cows: Calculated from twelve months old onwards with clear sexual characteristics, meeting breed standards.
3. For pig farming (meat, sows, boars)
a) Livestock farming scale: Households raising meat pigs with two or more per batch; sows with one or more; boars with one or more.
b) Livestock farming process: Follow the provisions set out in Appendix III issued together with this Circular.
c) Insurance calculation period:
- Pig meat farming: Maximum insurance period is 150 days (for foreign breeds, from 50 days old when introduced for fattening until 200 days old when slaughtered; for crossbreeds, from 60 days old when introduced for fattening until 210 days old when slaughtered);
- Sow farming: Maximum insurance period is 180 days (from when the sow is bred and pregnant until weaning);
- Boar farming: Insurance starts from eight months old for native breeds and ten months old for foreign and crossbred breeds. The insurance calculation period does not exceed 34 months for boars used in artificial insemination and 28 months for direct mating boars.
4. Chicken and duck farming (meat, egg-laying)
a) Livestock farming scale: Total flock size of 200 or more for meat chickens and ducks, and 100 or more for egg-laying chickens and ducks.
b) Livestock farming process: Follow the provisions set out in Appendix IV issued together with this Circular.
c) Insurance calculation period
- Meat chicken and duck farming: From one to 50 days for industrial chickens and ducks; one to 70 days for dual-purpose chickens and ducks and one to 150 days for indigenous chickens and ducks;
- Egg-laying chicken and duck farming: From one to 365 days for laying hens and 700 days for laying ducks.
Article 6. Criteria for scale and production process for farmed aquatic products (catfish, black tiger shrimp, whiteleg shrimp).
1. Criteria for selecting breeding areas and breeding facilities
a) Scale and breeding area: Each province selects three districts, each district selects three communes, each commune chooses breeding areas; the insurance scale covers the entire commune.
b) Conditions for breeding facilities and breeding areas:
- Intensive catfish breeding areas must have an area of 05 hectares or more;
- Intensive black tiger shrimp and whiteleg shrimp breeding areas must have an area of 05 hectares or more; semi-intensive breeding areas must have an area of 10 hectares, improved extensive breeding areas must have an area of 15 hectares or more;
- Catfish, black tiger shrimp, and whiteleg shrimp breeding areas must ensure transportation routes; basic irrigation systems must meet production requirements.
2. Production process:
a) For intensive catfish farming: Apply according to Appendix V attached to this Circular.
b) For black tiger shrimp: Apply according to the provisions of Appendix VI (intensive farming), Appendix VII (semi-intensive farming), and Appendix VIII (improved extensive farming) attached to this Circular.
c) For intensive and semi-intensive whiteleg shrimp farming: Apply according to Appendix IX attached to this Circular.
Chapter III
IMPLEMENTATION
Article 7. Responsibilities of agencies
1. Responsibilities of Departments, Bureaus, and General Department of Fisheries
a) Department of Cooperative and Rural Development Economy:
- Take the lead and coordinate with relevant Departments, Bureaus, and the General Department of Fisheries to implement tasks within the scope of responsibility of the Ministry of Agriculture and Rural Development as stipulated in Decision No. 315/QĐ-TTg of the Prime Minister;
- Organize inspections, supervision, and evaluation of the implementation of agricultural insurance pilot projects within the assigned scope;
- Quarterly compile and prepare reports on the implementation of agricultural insurance pilot projects for the Ministry of Agriculture and Rural Development and submit them to the Ministry of Finance.
b) Relevant Departments, Bureaus, and the General Department of Fisheries:
Direct, guide, and organize inspections, supervision, and evaluation of the implementation of agricultural insurance pilot projects within the assigned scope and quarterly report back to the Department of Cooperative and Rural Development Economy.
2. Responsibilities of Provincial People's Committees
a) Direct and organize the implementation of agricultural insurance pilot projects;
b) Announce and confirm types of natural disasters and diseases occurring in specific local areas;
c) Direct the Provincial Statistics Bureau to announce actual rice yields after each crop, the latest rice price, and economic values from livestock and aquaculture as the basis for calculating premiums and insurance compensation;
d) Direct the Provincial Department of Agriculture and Rural Development, Provincial Finance Department, People's Committees at all levels in insured areas, participants in agricultural insurance pilot projects, and related agencies to implement according to guidance content and production processes specified in this Circular;
đ) Organize inspections, supervision, and evaluation of the implementation of agricultural insurance pilot projects at the local level;
e) Quarterly report on the evaluation of implementation and propose measures for implementing agricultural insurance pilot projects to the Ministry of Finance and the Ministry of Agriculture and Rural Development.
3. Responsibilities of Insurance Enterprises
a) Implement agricultural insurance pilot projects within the scope and application objects as prescribed in Article 1 of this Circular;
b) Coordinate with the Ministry of Agriculture and Rural Development, the Ministry of Finance, and People's Committees at all levels in participating provinces to serve the participants in agricultural insurance pilot projects in accordance with regulations;
c) Quarterly report on implementation results and propose measures for implementation to the Ministry of Finance, the Ministry of Agriculture and Rural Development, and the People's Committee of the province implementing agricultural insurance pilot projects.
Article 8. Effective Date
This Circular takes effect from July 1, 2011.
During the implementation process, if there are difficulties, People's Committees at all levels and producers participating in agricultural insurance pilot projects should reflect issues to the Ministry of Agriculture and Rural Development, the Ministry of Finance, and insurance enterprises implementing agricultural insurance pilot projects for research and supplementation as appropriate./.

b) Livestock farming process: Follow the provisions set out in Appendix III issued together with this Circular.
c) Insurance calculation period:
- Pig meat farming: Maximum insurance period is 150 days (for foreign breeds, from 50 days old when introduced for fattening until 200 days old when slaughtered; for crossbreeds, from 60 days old when introduced for fattening until 210 days old when slaughtered);
- Sow farming: Maximum insurance period is 180 days (from when the sow is bred and pregnant until weaning);
- Boar farming: Insurance starts from eight months old for native breeds and ten months old for foreign and crossbred breeds. The insurance calculation period does not exceed 34 months for boars used in artificial insemination and 28 months for direct mating boars.
4. Chicken and duck farming (meat, egg-laying)
a) Livestock farming scale: Total flock size of 200 or more for meat chickens and ducks, and 100 or more for egg-laying chickens and ducks.
b) Livestock farming process: Follow the provisions set out in Appendix IV issued together with this Circular.
c) Insurance calculation period
- Meat chicken and duck farming: From one to 50 days for industrial chickens and ducks; one to 70 days for dual-purpose chickens and ducks and one to 150 days for indigenous chickens and ducks;
- Egg-laying chicken and duck farming: From one to 365 days for laying hens and 700 days for laying ducks.
Article 6. Criteria for scale and production process for farmed aquatic products (catfish, black tiger shrimp, whiteleg shrimp).
1. Criteria for selecting breeding areas and breeding facilities
a) Scale and breeding area: Each province selects three districts, each district selects three communes, each commune chooses breeding areas; the insurance scale covers the entire commune.
b) Conditions for breeding facilities and breeding areas:
- Intensive catfish breeding areas must have an area of 05 hectares or more;
- Intensive black tiger shrimp and whiteleg shrimp breeding areas must have an area of 05 hectares or more; semi-intensive breeding areas must have an area of 10 hectares, improved extensive breeding areas must have an area of 15 hectares or more;
- Catfish, black tiger shrimp, and whiteleg shrimp breeding areas must ensure transportation routes; basic irrigation systems must meet production requirements.
2. Production process:
a) For intensive catfish farming: Apply according to Appendix V attached to this Circular.
b) For black tiger shrimp: Apply according to the provisions of Appendix VI (intensive farming), Appendix VII (semi-intensive farming), and Appendix VIII (improved extensive farming) attached to this Circular.
c) For intensive and semi-intensive whiteleg shrimp farming: Apply according to Appendix IX attached to this Circular.
Chapter III
IMPLEMENTATION
Article 7. Responsibilities of agencies
1. Responsibilities of Departments, Bureaus, and General Department of Fisheries
a) Department of Cooperative and Rural Development Economy:
- Take the lead and coordinate with relevant Departments, Bureaus, and the General Department of Fisheries to implement tasks within the scope of responsibility of the Ministry of Agriculture and Rural Development as stipulated in Decision No. 315/QĐ-TTg of the Prime Minister;
- Organize inspections, supervision, and evaluation of the implementation of agricultural insurance pilot projects within the assigned scope;
- Quarterly compile and prepare reports on the implementation of agricultural insurance pilot projects for the Ministry of Agriculture and Rural Development and submit them to the Ministry of Finance.
b) Relevant Departments, Bureaus, and the General Department of Fisheries:
Direct, guide, and organize inspections, supervision, and evaluation of the implementation of agricultural insurance pilot projects within the assigned scope and quarterly report back to the Department of Cooperative and Rural Development Economy.
2. Responsibilities of Provincial People's Committees
a) Direct and organize the implementation of agricultural insurance pilot projects;
b) Announce and confirm types of natural disasters and diseases occurring in specific local areas;
c) Direct the Provincial Statistics Bureau to announce actual rice yields after each crop, the latest rice price, and economic values from livestock and aquaculture as the basis for calculating premiums and insurance compensation;
d) Direct the Provincial Department of Agriculture and Rural Development, Provincial Finance Department, People's Committees at all levels in insured areas, participants in agricultural insurance pilot projects, and related agencies to implement according to guidance content and production processes specified in this Circular;
đ) Organize inspections, supervision, and evaluation of the implementation of agricultural insurance pilot projects at the local level;
e) Quarterly report on the evaluation of implementation and propose measures for implementing agricultural insurance pilot projects to the Ministry of Finance and the Ministry of Agriculture and Rural Development.
3. Responsibilities of Insurance Enterprises
a) Implement agricultural insurance pilot projects within the scope and application objects as prescribed in Article 1 of this Circular;
b) Coordinate with the Ministry of Agriculture and Rural Development, the Ministry of Finance, and People's Committees at all levels in participating provinces to serve the participants in agricultural insurance pilot projects in accordance with regulations;
c) Quarterly report on implementation results and propose measures for implementation to the Ministry of Finance, the Ministry of Agriculture and Rural Development, and the People's Committee of the province implementing agricultural insurance pilot projects.
Article 8. Effective Date
This Circular takes effect from July 1, 2011.
During the implementation process, if there are difficulties, People's Committees at all levels and producers participating in agricultural insurance pilot projects should reflect issues to the Ministry of Agriculture and Rural Development, the Ministry of Finance, and insurance enterprises implementing agricultural insurance pilot projects for research and supplementation as appropriate./.
