Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating functions, tasks, powers, and organizational structure, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP concerning the functions of the Ministry of Transport;

GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 2. Applicability

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

Chapter II

DUTIES OF ROUTE PATROLLING AND INSPECTION FOR THE PROTECTION OF ROAD INFRASTRUCTURE

Article 4. General Provisions

1. Route patrolling work:

a) Route patrol staff are assigned to Road Maintenance Units on a full-time basis;

b) The duties of route patrolling include: Monitoring traffic conditions, traffic accidents, the status of road works; promptly detecting damage or acts of infringement against road works, encroachment, and illegal use of road land and road safety zones; handling or reporting to competent authorities for handling;, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP duties related to traffic, traffic accidents, and the condition of road construction projects; promptly detect damage or acts of infringement on road construction projects, encroachment, and unauthorized use of road land and road safety zones;g handle or report to competent authorities for handling;shall ENVIRONMENTrime Minister c|||

Competent authorities, in accordance with the law, cooperate with relevant agencies and local authorities to prevent and handle acts strictly prohibited as stipulated in Clause 1, 2, 3 Article 8 and Clause 2 Article 35 of the Road Traffic Law.d) Participate in regular and spot inspections of road works; propose repair plans to the Road Management Zone, Department of Transport.n lArticle 6. Route Patrolling and Inspection of Road Safety Zones

Article 5. Patrol and inspection of highway land areas

1. Highway patrol staff:

a) Detect abnormal conditions, incidents of highway infrastructure, other structures affecting traffic safety and traffic accidents, congestion (take photos of the current damage status, accidents, and report promptly);

b) For highway infrastructure:

- Statistically track and be familiar with the quantity, location, detailed condition of highway infrastructure within the assigned section; inspect tra regularly to detect damages and encroachments on the infrastructure; report to the Highway Maintenance Unit and the Inspector for appropriate measures;

- In cases of minor damage that does not require materials or equipment (inclined warning posts, signs; loose or missing bolts; debris,June 2024; rolling, trees i, b, scattered materials on the roadg or similar damages), the highway patrol staff shall handle it themselves or request regular maintenance workers to address it immediately;In cases of major damage requiring materials and equipment for repair, measures must be taken to warn traffic participants; simultaneously, report to the Highway Maintenance Unit and the Inspector for timely solutions;

- For traffic on the route: trWhen traffic congestion or accidents occur, the highway patrol staff must be presentThis Resolution takes effect from the date it is adopted by the National Assembly..

c) to collect information, preliminarily determine the cause, and propose solutions;

- implement or coordinate with relevant authorities to guide and manage traffic;development Monitor construction works on operational highways, remind contractors to ensure traffic safety; if any actions that endanger traffic safety are discovered, report immediately to the Inspector for prompt handling;g Management and protection of highway land areas: session numberTimely detect, record violations, report to the Highway Maintenance Unit and the Inspector for handling violations as stipulated in Clauses 1, 2, 3 of Article 8 and Clause 2 of Article 35 of the Road Traffic Law;No.Inspector:

d) Stop illegal activities, record violations according to the authority granted by law, coordinate with relevant agencies and local authorities to prevent and handle violations as stipulated in Clauses 1, 2, 3 of Article 8 and Clause 2 of Article 35 of the Road Traffic Law;

d) Participate in periodic and spot inspections of highway infrastructure; propose repair plans to the Road Management Zone and the Department of Transport;Article 6. Patrol and inspection of highway safety zones

2. Statistically track and be familiar with the system of boundary markers, road boundary markers, and the current status of highway safety zone areas

a) within the assigned section under management;

b) Timely detect violations of regulations concerning the management and protection of highway safety zones; record violations, confirm them, and report to the Highway Maintenance Unit and the Inspector;developmentInspector:

All instructions and resolutions during the shift are detailed recorded in the leadership of the Road Maintenance Unit;

In areas with high risk of traffic safety incidents, locations frequently violating regulations on protecting road infrastructure, inspections must be conducted at least twice.

1. Highway patrol staff:

a) Record and understand the system of boundary markers for land clearance, road boundary markers, and the current status of the road safety zone's scope for the assigned section; road |||policiesmanagement;n l|||

b) Inspection Patrol Officer;n lEquipment required according to Article 14 of this Circular; Route Patrol Staff must wear identification badges on the right chest pocket and have a duty assignment decision from the Road Maintenance Unit.

2. Inspection personnel are assigned full-time positions to carry out road inspection duties;developmentImplementing the duties of Route Patrol Staff and Road Maintenance Units;

a) Report to the Road Management Zone, Department of Transport about the results of duty implementation;

b) Wear identification badges on the right chest pocket and have a duty assignment decision from the Road Management Zone, Department of Transport.t Tload andNo.cooperate with relevant agencies and local authorities to handle violations concerning the management and protection of road traffic infrastructure;

Article 7. Responsibilities of Road Patrol Officers and Inspection Officers

1. Highway patrol staff:

a) Proactively remind, explain, and guide violators to comply with legal regulations to prevent violations from the outset.

b) Timely report violations, traffic safety incidents, and initial handling results to the Road Maintenance Unit and Inspection Officer.development Take timely measures to handle the situation.

c) All weather conditions, bridge and road conditions, violation situations of construction works, and road safety zones (including all records and resolutions) during the shift must be detailed recorded.n lincidents and resolution opinions during the work shift must be detailed recorded in the logbook of the Road Maintenance Unit; schedules In the Road Patrol Logbook according to Model I of this Circular. Article 8. Tasks of the Road Maintenance Unit

1. The Road Maintenance Unit arranges sufficient numbers of road patrol officers as stipulated in this Circular and issues task assignment decisions to road patrol officers.

2. Daily, the Road Maintenance Unit processes recommendations and contents in the Road Patrol Logbook.Autumn and winter uniforms: one set every year;

3. Monthly, compile and report on road maintenance work, the condition of road construction works, road land, road safety zones, and store documents as prescribed.

4. The Road Maintenance Unit coordinates with the Road Management Zone, Department of Transport, and local authorities to implement measures to prevent acts of damaging road transportation works and violating road safety zones; provide manpower and motorcycles to support local authorities in enforcing violations. 3. Coordinate with local authorities, instruct Road Maintenance Units to take measures to prevent acts of damaging road transport infrastructure works and violations of road safety zones. Road Patrol Officers must have a vocational education level from a mid-level vocational program specializing in roads or a worker grade 5 (five) or higher; understand laws, possess the ability to disseminate, popularize, guide, and explain traffic laws. The Road Inspection Officers must have a college education level or higher in bridge and road engineering.development Article 12. Organization of road patrol and inspection activities

Chapter III

Road Patrol Officers are responsible for a section of road or tunnel suitable for the content and tasks of road patrols; the length of the section is defined as follows:

Class I and II roads: from 20 to 25 km per person;

Class III roads: from 25 to 30 km per person for urban roads; from 30 to 35 km per person for non-urban roads;in Class IV, V, and VI roads: from 30 to 35 km per person for mountainous areas; from 40 to 45 km per person for plains and midlands., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP Road Inspection Officers are responsible for a section of road according to the decision assigning tasks by the Highway Management Zone and Department of Transport.

2. Article 13. Uniforms and equipment for road inspection activities

Article 14. Uniforms and equipment for road patrol duties

1. When performing their duties, road patrol officers must wear uniforms and carry the following equipment:

a) A grayish-blue suit, grayish-blue trousers; a grayish-blue shirt with the logo "Road Maintenance Unit" or the company name and the words "Road Patrol" in dark slate blue on the upper pocket of the shirt; trwith the logo "Road Maintenance Unit" or company name and the phrase "Road Patrol" in dark navy blue;

b) One yellow reflective vest to be worn when working at the scene; in workplace;

c) Work tools: A canvas bag containing one wrench, one machete, one 5-meter tape measure, one flashlight, and one trenching shovel;

Chapter IV

IMPLEMENTING PROVISIONS

Article 15. Effective Date
