Provisions on the dissemination and popularization of laws

in the transportation sector

Based on the Law on Dissemination and Popularization of Laws dated August 21, 2013 law on the 20thJune 2024;2012;

Chapter I

GENERAL PROVISIONS

Article 1. Scope of Regulation

2. Enhance awareness of compliance with laws and contribute to building traffic culture among traffic participants.

Article 2. Applicability

Socialization of the dissemination and popularization of laws

Article 3. The Ministry of Transportation encourages and creates conditions for organizations and individuals to participate in the dissemination and popularization of laws in the transportation sector and proactively mobilize social resources to implement these activities.

CONTENTS OF THE DISSEMINATION AND POPULARIZATION OF LAWS

IN THE TRANSPORTATION SECTOR

Article 4. Article 5. Classification of subjects to be disseminated and educated about lawsAt the request of the Inspectorate of the1. Group 1:

a) Civil servants, officials, and employees currently working in agencies and units under the Ministry of Transportation;

b) Civil servants, officials, and employees of provincial Departments of Transportation.

2. Group 2: Students and pupils of educational and training institutions under the Ministry of Transportation, General Departments, Bureaus under the Ministry, Provincial Departments of Transportation, and students and pupils of schools at all levels nationwide.

3. Group 3: Organizations and individuals engaged in the transportation sector, focusing on businesses providing passenger and cargo transport services.national4. Group 4: Traffic participants and other related entities.

Article 6. Contents of the dissemination and popularization of laws

The contents of the dissemination and popularization of laws are constitutional provisions and regulatory legal documents (hereinafter referred to as regulatory legal documents) suitable for each group of subjects specified in Article 5 of this Circular, specifically as follows:

1. For subjects belonging to Group 1

a) Disseminate regulatory legal documents directly related to the rights and obligations of civil servants, officials, and employees; regulations on the duties and powers of state management agencies; civil service systems; regulations on complaint and denunciation procedures; reception rules for citizens; regulations on administrative reform; regulations on thrift and waste prevention; anti-corruption regulations and other relevant regulatory legal documents;

b) Disseminate regulatory legal documents related to the transportation sector; particularly those concerning traffic order and safety, environmental protection in the transportation sector.

2. For subjects belonging to Group 2

a) For schools under the Ministry, General Departments, Bureaus under the Ministry, and Provincial Departments of Transportation:

Integrate and incorporate specialized transportation regulatory legal documents into subject courses, linking them to specific professional fields and training content.

b) For schools at various levels within the national education system:

Coordinate with relevant agencies under the Ministry of Education and Training to direct schools to organize extracurricular activities to disseminate the contents of regulatory legal documents on traffic safety to students and pupils.

3. For subjects belonging to Group 3

Focus on disseminating regulatory legal documents concerning traffic order and safety, environmental protection laws in the transportation sector to businesses engaged in cargo and passenger transport.

4. For subjects belonging to Group 4

Disseminate specialized regulatory legal documents in road, railway, maritime, inland waterway, and aviation sectors; particularly emphasizing laws on traffic safety, protection of traffic safety zones, environmental protection laws in the transportation sector for traffic participants and other related entities.

5. Specialized legal contents that need to be disseminated and educated to the subjects

a) In the road sector: The Road Traffic Law and regulatory legal documents guiding the implementation of the Road Traffic Law: documents regulating the management and protection of road infrastructure; management of vehicles and drivers; technical safety and environmental protection regulations; management of road transport and supporting services; administrative penalties in the road transport sector; international agreements to which Vietnam is a party and other relevant regulations;

b) In the maritime sector: The Maritime Code of Vietnam and regulatory legal documents guiding the implementation of the Maritime Code of Vietnam: documents regulating the management and protection of maritime infrastructure; regulations on maritime safety and security and environmental protection; administrative penalties in the maritime sector; international agreements to which Vietnam is a party and other relevant regulations;

c) In the aviation sector: The Civil Aviation Law of Vietnam and regulatory legal documents guiding the implementation of the Civil Aviation Law of Vietnam: documents regulating the management and protection of aviation infrastructure; regulations on aviation safety and security and environmental protection; administrative penalties in the aviation sector; international agreements to which Vietnam is a party and other relevant regulations;

4. For subjects belonging to group 4

Popularize specialized legal documents in the fields of road traffic, railways, maritime transport, inland waterways, and aviation; particularly focusing on laws related to traffic safety, protection of traffic safety zones, and environmental protection laws in the field of transportation for participants in traffic and other relevant subjects.

5. The contents of specialized laws that need to be popularized and educated for the subjects

a) In the field of road traffic: The Road Traffic Law and guiding legal documents for the implementation of the Road Traffic Law: documents regulating management and protection of road traffic infrastructure; management of vehicles and drivers; technical safety and environmental protection regulations; regulations on road transport management and support services; administrative penalties in the field of road traffic; international treaties to which Vietnam is a party and other relevant provisions;

b) In the field of maritime transport: The Vietnamese Maritime Code and guiding documents for the implementation of the Vietnamese Maritime Code: documents regulating management and protection of maritime transport infrastructure; regulations on maritime safety, security, and environmental protection; administrative penalties in the field of maritime transport; international treaties to which Vietnam is a party and other relevant provisions;

c) In the field of aviation: The Civil Aviation Law of Vietnam and guiding documents for the implementation of the Civil Aviation Law of Vietnam: documents regulating management and protection of aviation transport infrastructure; regulations on aviation safety, security, and environmental protection; administrative penalties in the field of aviation; international treaties to which Vietnam is a party and other relevant provisions;

d) In the field of inland waterways: The Law on Inland Waterway Transport and guiding documents for the implementation of the Law on Inland Waterway Transport: regulations on management and protection of inland waterway transport infrastructure; provisions on inland waterway traffic safety and environmental protection; administrative penalties for violations in the field of inland waterway transport; relevant international treaties to which Vietnam is a party and other related provisions.

đ) In the field of railways: The Law on Railways and guiding documents for the implementation of the Law on Railways: regulations on management and protection of railway transport infrastructure; provisions on railway traffic safety and environmental protection; administrative penalties for violations in the field of railway transport; relevant international treaties to which Vietnam is a party and other related provisions.

, Clause 1, Clause 2 Article 7a of this Regulation.. Forms of popularizing and educating the law

1. Press conferences, press releases.

2. Direct dissemination of laws; legal counseling and guidance; provision of legal information and materials.

3. Through mass media, loudspeakers, the Internet, posters, banners, propaganda paintings; publication in the Official Gazette; posting of legal information on electronic websites; display at offices, bulletin boards of agencies and units.

4. Organizing legal knowledge contests.

5. Through administrative violation handling work, citizen reception activities, complaint and denunciation resolution, and other activities of agencies and units; through legal aid and grassroots mediation activities.

6. Integration into cultural, artistic, and organizational activities of agencies, units, clubs, legal libraries, and other grassroots cultural institutions.

7. Through legal education programs in national education institutions.

8. Other forms of popularizing and educating the law suitable for specific audiences to ensure the effectiveness of legal dissemination and education work.

Article 8. Building plans for popularizing and educating the lawpoliciesn, gin, g

1. Before November 1st each year, agencies and units under the Ministry of Transport shall be responsible for building plans for popularizing and educating the law, training needs for staff working on legal dissemination and education for their respective agencies and units, and submitting them to the Ministry of Transport (through the Legal Department) for consolidation into the Ministry's overall plan.

The outline of the plan for popularizing and educating the law shall be implemented according to the model prescribed in the Appendix of this Circular.

2. Based on proposals from agencies and units, the Legal Department shall be responsible for consolidating and advising the Minister to issue the annual plan for popularizing and educating the law of the Ministry.

3. The construction and adjustment of the plan for popularizing and educating the law of the Ministry must be approved by the Popularization and Education of Law Council of the Ministry before being submitted to the Minister for consideration and decision.

4. Provincial Departments of Transport shall base their plans for popularizing and educating the law on the annual plan of the Ministry of Transport and the People's Committees of provinces and centrally-administered cities.

Article 9. Funding implementing legal dissemination and education work

1. The annual budget for legal dissemination and education of the Ministry of Transport shall be allocated as a separate item in the annual state budget estimate of the Ministry and mobilized from other legitimate sources (if any).

2. The preparation of budget estimates and final accounts for specific expenditure items and amounts serving legal dissemination and education work at agencies and units shall be carried out in accordance with the guidelines of the Ministry of Justice and the Ministry of Finance.

3. Before May 30th each year, subordinate agencies and units of the Ministry of Transport shall submit their budget estimates for implementing the plan for legal dissemination and education of the following year to the Ministry (through the Legal Department and the Financial Department) for consolidation into the annual state budget estimate of the Ministry.

Article 10. Legal lecturers

Standards for legal lecturers; authority, procedures, and formalities for recognizing and relieving legal lecturers who are civil servants or employees in the transportation sector shall be implemented in accordance with the guidelines of the Ministry of Justice.

Article 11. Law Day

The content and form of implementing Law Day in the Transport Industry shall be carried out in accordance with the guidance of the Ministry of Justice.

Chapter III

IMPLEMENTATION

Article 12. Council coordinate for the dissemination and popularization of law of the Ministry of Transport

The Council for the coordination of the dissemination and popularization of law of the Ministry of Transport shall be established and operate on a part-time basis by the Minister of Transport, and shall have the following tasks and powers:

1. Implementing guiding documents of the Party, Government, Prime Minister, National Traffic Safety Committee, and the Council for the dissemination and popularization of law of the Government regarding the dissemination and popularization of law in the Transport Industry.

2. Directing the development and implementation of the Long-term and Annual Programs and Plans for the Dissemination and Popularization of Law of the Ministry of Transport.

3. Regularly listening to reports and inspecting, urging subordinate agencies and units under the Ministry, and Provincial Departments of Transport to implement the Ministry's Plan for the Dissemination and Popularization of Law.

4. Organizing the mobilization of funds from sources outside the budget allocated for the dissemination and popularization of law to support such activities in the Transport Industry.

5. Organizing inspections and surveys of the practical activities of the dissemination and popularization of law annually in the Transport Industry to promptly identify issues and make timely adjustments and corrections; proposing solutions to enhance the dissemination and popularization of law to the Government's Council for the Coordination of the Dissemination and Popularization of Law and the Ministry of Justice.

6. Directing the cooperation in the dissemination and popularization of law between the Ministry of Transport and other Ministries, the National Traffic Safety Committee, and People's Committees of provinces and centrally-administered cities.

7. Directing training and capacity building for staff involved in the dissemination and popularization of law in the Transport Industry.

8. Directing international cooperation in the dissemination and popularization of law in the Transport Industry.

9. Conducting mid-term and final reviews of the Ministry's Plan for the Dissemination and Popularization of Law; examining and deciding on rewards and disciplinary actions for organizations and individuals in this work.

10. Supporting the Council for the Dissemination and Popularization of Law of the Ministry with a Standing Office, whose members represent relevant advisory and specialized departments within the Ministry. The Head of the Standing Office is the Leader of the Legal Department. The tasks of the Standing Office are assigned by the Chairman of the Council.

11. The operating costs of the Council and the Standing Office are allocated from the state budget and other legitimate sources to serve the dissemination and popularization of traffic laws. The management and use of these funds shall comply with the provisions of the law.

12. The Council operates according to the Charter issued by the Minister of Transport and may use the seal of the Ministry of Transport to perform its assigned tasks and powers.

Article 13. Responsibilities of subordinate agencies and units of the Ministry of Transportiin the dissemination and popularization of law in the Transport Industryi1. Subordinate agencies and units of the Ministry:"Article 7. Specific Prices for Using Road Services a) Based on this Circular, subordinate agencies and units of the Ministry shall proactively develop annual plans for the dissemination and popularization of law to implement at their units and submit them to the Ministry for consolidation into the Ministry's annual plan for the dissemination and popularization of law; they shall organize implementation after the Ministry's plan for the dissemination and popularization of law has been issued;ngb) Agencies and units tasked by the leadership of the Ministry to draft normative legal documents to be submitted to the Minister for approval within their authority or to the Minister for submission to the Government or the National Assembly, or the Standing Committee of the National Assembly for issuance shall proactively disseminate those documents after they have been signed and issued by the competent authority; lc) Prepare budgets to ensure funding for the dissemination and popularization of law at their agencies and units and submit them for consolidation and approval by the competent authority;i1. During the suspension period of Circulars No. 08/2022/TT-BKHĐT and No. 10/2022/TT-BKHĐT, the following legal documents and regulations continue to be effective: transportation

d) Allocate sufficient budget according to the approved plan to ensure the dissemination and popularization of law at their agencies and units;

đ) Assign civil servants and officials responsible for the dissemination and popularization of law at their agencies and units and act as liaison points to closely coordinate with the Legal Department to implement dissemination and popularization activities;

e) Coordinate with the Legal Department in the dissemination of specialized normative legal documents;

g) Heads of agencies and units directly direct and ensure the quality of the dissemination and popularization of law at their units.

2. Legal Department:

a) Lead and coordinate with subordinate agencies and units of the Ministry to implement the dissemination and popularization of law;

b) Lead in presenting proposals on the dissemination and popularization of law to the leadership of the Ministry;

c) Lead in guiding, urging, consolidating, and monitoring subordinate agencies and units of the Ministry to effectively implement the dissemination and popularization of law;

d) Coordinate with the Information Technology Center to maintain a dedicated section for the dissemination and popularization of law on the Ministry of Transport's website;

đ) Serve as the standing office of the Council for the coordination of the dissemination and popularization of law of the Ministry of Transport;

e) Coordinate with the Finance Department to propose and allocate the budget for the dissemination and popularization of law of the Ministry to subordinate agencies and units, and submit it for review and decision by the leadership of the Ministry;

g) Coordinate with the Cadre and Civil Servant Organization Department to organize inspections, mid-term and final reviews, and propose rewards for outstanding collectives and individuals in the dissemination and popularization of law in the Transport Industry; propose criticism for collectives and individuals who fail to complete their dissemination and popularization of law tasks;

h) Advise the leadership of the Ministry on lists of cadres, civil servants, and officials from subordinate agencies and units of the Ministry who meet the criteria for recognition as legal propagandists;

i) Advise the leadership of the Ministry to organize Law Day annually according to the guidance of the Ministry of Justice;

k) Serve as the focal point of the Ministry of Transport to coordinate with relevant agencies and units of other ministries and sectors on the dissemination and popularization of law.

3. Finance Department:

h) Advise the Ministry's leadership to compile a list of officials, civil servants, and employees from subordinate agencies and units who meet the criteria for recognition as Legal Reporters;

i) Advise the Ministry's leadership to organize the National Law Day annually according to the guidelines of the Ministry of Justice;

k) Serve as the focal point of the Ministry of Transport to coordinate with relevant agencies and units under other ministries and sectors regarding legal dissemination and education work.

3. Department of Finance:

a) Prepare the budget for funding the dissemination and legal education activities of the Ministry;

b) Take the lead and coordinate with the Legal Department and relevant agencies to propose the allocation of funds for the dissemination and legal education activities of the Ministry and its subordinate agencies;

c) Guide the management and use of funds for the dissemination and legal education according to the current financial regulations.

4. The Cadre and Civil Servant Organization Department:

a) Based on the annual training needs for personnel engaged in the dissemination and legal education activities of the Ministry's agencies compiled by the Legal Department, organize training courses and programs to enhance the quality of human resources involved in these activities and legal lecturers within the transportation sector;

b) Coordinate with the Legal Department to propose appropriate forms of reward for organizations and individuals who have outstanding achievements in the dissemination and legal education activities.

5. The Information Technology Center, Transport Journal, Transport Newspaper:

Diversify the presentation formats and improve the quality of articles on the Legal Dissemination and Education Special Page; focus on disseminating specialized legal documents, laws related to state management functions in the transportation sector, traffic safety and order, and legal documents related to the activities of subordinate agencies of the Ministry.

6. The Ministry Office:

Coordinate with the Information Technology Center and the Legal Department to ensure information technology infrastructure for the dissemination and legal education activities.

7. Subordinate Schools:

Coordinate with the Legal Department and the Cadre and Civil Servant Organization Department to develop training programs on legal knowledge to be implemented at the schools; introduce legal documents of the transportation sector on the school's website.

8. State-owned Enterprises under the Ministry:

a) Proactively develop annual plans for the dissemination and legal education activities to implement within their own agencies;

b) Allocate sufficient funds and staff to carry out the dissemination and legal education activities of their own agencies;

c) Coordinate with the Ministry's agencies to organize the implementation of the dissemination and legal education activities.

9. Provincial Departments of Transport under Central Cities and Provinces:

a) Advise the provincial People's Committees to issue Programs for the dissemination and legal education on transportation at the local level, particularly focusing on the dissemination of regulations concerning traffic safety and order;

b) Implement the dissemination and legal education activities for civil servants, employees, workers in the transportation sector, and local residents regarding laws related to the transportation sector, policies, and other relevant laws;

c) Direct schools and training institutions under the Provincial Departments of Transport to conduct legal dissemination and education activities for lecturers and students according to the annual legal dissemination and education plan of the Provincial Department, in compliance with this Circular;

d) Coordinate with the Justice Departments, Radio and Television Stations, political and social organizations, departments, and related entities at the local level to disseminate legal education on transportation to businesses and traffic participants in the locality.

Article 14. Reporting System và check

1. Annually, subordinate agencies of the Ministry are responsible for reporting to the Ministry of Transport (through the Legal Department) the results of their legal dissemination and education activities; Provincial Departments of Transport report their legal dissemination and education activities to the provincial People's Committees and simultaneously send them to the Ministry of Transport (through the Legal Department) for monitoring.

2. Annually, the Ministry of Transport (Legal Department) will inform the Ministry of Justice about the results of the legal dissemination and education activities of the Ministry.

Article 15. Effective Date

This Circular takes effect from January 25, 2014.

Article 16. Responsibility for Implementation

2. The Director of the Ministry's Office, the Director of the Ministry's Inspectorate, the Heads of all Departments, the General Directors of Vietnam Highway Administration, the Directors of all Bureaus under the Ministry, the General Managers of all Project Management Boards for Transportation, the General Managers of all State-owned Enterprises under the Ministry, the Principals of all Schools under the Ministry, the Heads of all Agencies and Units, and related individuals are responsible for implementing this Circular./.
