CIRCULAR

Issuing the forensic medical examination procedures

Pursuant to the Law on Forensic Appraisal No. 13/2012/QH13 dated June 20, 2012 2012;

Pursuant to the Government Decree No. 85/2013/NĐ-CP dated July 29, 2013 detailing and guiding the implementation of the Forensic Appraisal Law;

This Circular prescribes procedures for receiving, providing health care for domestic violence victims and statistical reports on domestic violence victims at medical facilities.

At the proposal of the Director of the Department of Medical Examination and Treatment;

The Minister of Health issues this Circular on the Forensic Medical Examination Procedures.

Article 1. Issuing the Forensic Medical Examination Procedures

Attached to this Circular are the Forensic Medical Examination Procedures, including:

Part I: Forensic Medical Examination Procedures (54 procedures);

Part II: Chemical Forensic Examination Procedures (29 procedures);

Part III: DNA Forensic Examination Procedures (10 procedures).

Article 2. Forms used in forensic medical examinations

Attached to this Circular are forms used in forensic medical examinations, including:

1. Form of forensic medical examination conclusion;

a) Form No. 1a: Forensic medical examination conclusion on injuries;

b) Form No. 1b: Second forensic medical examination conclusion on injuries;

c) Form No. 2a: Forensic medical examination conclusion on corpses;

d) Form No. 2b: Second forensic medical examination conclusion on corpses;

đ) Form No. 3a: Forensic medical examination conclusion on sexual matters;

e) Form No. 3b: Second forensic medical examination conclusion on sexual matters;

g) Form No. 4a: Forensic medical examination conclusion on gender;

h) Form No. 4b: Second forensic medical examination conclusion on gender;

i) Form No. 5a: Forensic medical examination conclusion on age;

k) Form No. 5b: Second forensic medical examination conclusion on age;

l) Form No. 6a: Forensic chemical examination conclusion;

Article 3. Effectiveness

This Circular takes effect from April 15, 2014.

Article 4. Responsibilities for Implementation

1. The Department of Medical Examination and Treatment shall take the lead and coordinate with the Legal Affairs Department and relevant Departments and Bureaus to guide and instruct the National Institute of Forensic Medicine, Provincial Health Departments under central cities to implement in accordance with the provisions of this Circular.

2. The National Institute of Forensic Medicine shall guide the Military Institute of Forensic Medicine under the Ministry of Defense, the Forensic Science Center under the Ministry of Public Security, and provincial forensic medicine centers under central cities to implement in accordance with the provisions of this Circular.

Any difficulties encountered during implementation should be reported to the Ministry of Health for consideration and resolution.
