Pursuant to the Law on Government Organization dated February 18, 2025;"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."hereinafter referred to as the DecreeDeputy ministers of ministerial-level agencies, December 25, 2001;

Based on the Inspection Law dated November 15, 2010;

Pursuant to the Fisheries Law on December 26, 11 2003;

The Government issues this Decree on mechanisms and policies to encourage forest protection, encirclement and regeneration of forests, afforestation, development of non-timber forest products, and increased income in connection with policies to quickly reduce poverty, sustainably and to support ethnic minority groups during the period 2015-2020.

At the proposal of promulgates this Decree on the organization and operation of inspection in the Ministry of Agriculture and Rural Development.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates the organization and operation of agencies performing inspection functions in the agriculture and rural development sector; inspectors, persons assigned to perform specialized inspection tasks, and inspection assistants in the agriculture and rural development sector; responsibilities of agencies, organizations, and individuals in inspection activities in the agriculture and rural development sector.

Article 2. Inspection Objects

1. Agencies, organizations, and individuals under the management authority of the Ministry of Agriculture and Rural Development, Provincial Departments of Agriculture and Rural Development.

2. Domestic and foreign agencies, organizations, and individuals participating in activities within the agriculture and rural development sector have the obligation to comply with legal regulations in areas under the state management of the Ministry of Agriculture and Rural Development and Provincial Departments of Agriculture and Rural Development.

Chapter II

ORGANIZATION, TASKS, POWERS OF INSPECTION IN THE AGRICULTURE SECTOR

AND RURAL DEVELOPMENT

Article 3. Agencies performing inspection functions in the agriculture and rural development sector

1. State Inspection Agencies, including:

a) The Inspectorate of the Ministry of Agriculture and Rural Development (hereinafter referred to as the Inspectorate of the Ministry);

b) Inspectorates of provincial Departments of Agriculture and Rural Development (hereinafter referred to as the Inspectorate of the Department).

b) Market Management Sub-Department under the Department of Industry and Trade (hereinafter referred to collectively as the Sub-Department).

a) General Directorate of Irrigation; General Directorate of Forestry; General Directorate of Fisheries; Animal Health Service; Plant Protection Service; Crop Production Service; Livestock Service; Quality Management Service for Agricultural, Forest, and Fishery Products; Cooperative Economic and Rural Development Service; Processing and Salt Industry Service;

b) Crop Production and Plant Protection Sub-directorates; Livestock and Animal Health Sub-directorates; Forest Protection Sub-directorates; Fisheries Sub-directorates; Irrigation Sub-directorates; Rural Development Sub-directorates; Quality Management Sub-directorates for Agricultural, Forest, and Fishery Products.

Article 4. Organizational structure of the Inspectorate of the Ministry

1. The Inspectorate of the Ministry has an Inspector General, Deputy Inspector General, Inspectors, and other civil servants.

The Inspector General is appointed, relieved, or dismissed by the Minister of Agriculture and Rural Development after consultation with the Chief Inspector General of the Government.

The Deputy Inspector General is appointed, relieved, or dismissed by the Minister of Agriculture and Rural Development upon the recommendation of the Inspector General. The Deputy Inspector General assists the Inspector General in carrying out tasks as assigned by the Inspector General.

2. The Inspectorate of the Ministry has departments to carry out assigned tasks. The Minister of Agriculture and Rural Development decides to establish departments under the Inspectorate of the Ministry.

3. The Inspectorate of the Ministry has its own seal and separate account.

The Ministry Inspection performs duties and authorities stipulated in Article 18 of the Inspection Law and Article 7 of the Government's Decree No. 86/2011/ND-CP dated September 22, 2011 detailing and guiding the implementation of certain articles of the Inspection Law, and the following tasks and powers:

The Inspectorate of the Ministry performs tasks and powers as prescribed in Article 18 of the Inspection Law, Article 7 of Decree No. 86/2011/ND-CP dated September 22, 2011 detailing and guiding certain provisions of the Inspection Law, and the following tasks and powers:

1. To take the lead or participate in drafting regulatory legal documents according to the assignment of the Minister of Agriculture and Rural Development.

2. To receive citizens, handle complaints and denunciations, and prevent and combat corruption as prescribed by law.

3. To organize training and professional development for inspectors, civil servants assigned to perform specialized inspection tasks, and inspection assistants.

4. To direct and guide on professional matters related to specialized inspection for agencies assigned to perform specialized inspection functions under the Ministry of Agriculture and Rural Development, Provincial Departments of Agriculture and Rural Development; to guide, inspect, and urge agencies assigned to perform specialized inspection functions under the Ministry to implement legal regulations on inspection, receiving citizens, handling complaints and denunciations, and preventing and combating corruption.

5. To compile and report on the results of inspection work, receiving citizens, handling complaints and denunciations, and preventing and combating corruption within the scope of state management of the Ministry of Agriculture and Rural Development.

6. To request the Inspectorate of the Department to report on specialized inspection work within the scope of state management of the Ministry of Agriculture and Rural Development.

7. To summarize and draw lessons from inspection work in the agriculture and rural development sector.

8. Other tasks and powers as prescribed by law.

Article 6. Duties and Authorities of the Inspector General of the Ministry

To perform tasks and powers as prescribed in Article 19 of the Inspection Law, Article 8 of Decree No. 86/2011/ND-CP, and the following tasks and powers:

1. To assist the Minister of Agriculture and Rural Development in directing, urging, and inspecting agencies directly under the Ministry's management in receiving citizens, handling complaints and denunciations, and preventing and combating corruption; to enforce decisions on handling complaints and decisions on resolving denunciations that have become legally binding.

2. To inspect the responsibility of heads of agencies and units under the management authority of the Ministry of Agriculture and Rural Development in implementing laws on inspection, receiving citizens, handling complaints and denunciations, and preventing and combating corruption.

3. To report to the Minister of Agriculture and Rural Development and the Chief Inspector General of the Government on inspection work, receiving citizens, handling complaints and denunciations, and preventing and combating corruption within their scope of responsibility.

4. To decide or propose the Minister of Agriculture and Rural Development to issue a decision to establish an inspection team according to plan or urgently when discovering organizations or individuals suspected of violating the law or according to requests to resolve complaints and denunciations, and prevent and combat corruption assigned by the Minister.

5. Other tasks and powers as prescribed by law.

Article 7. Organizational Structure of the Department Inspectorate

1. The Department Inspectorate consists of the Chief Inspector, Deputy Chief Inspector, Inspectors, and other civil servants.

The Chief Inspector is appointed, dismissed, or removed from office by the Director of the Department of Agriculture and Rural Development after reaching consensus with the Provincial Chief Inspector.

The Deputy Chief Inspector is appointed, dismissed, or removed from office by the Director of the Department of Agriculture and Rural Development upon the recommendation of the Chief Inspector.

2. The Department Inspectorate has its own seal and separate bank account.

Article 8. Duties and Powers of the Department Inspectoratein

Implementing the duties and powers stipulated in Article 24 of the Inspection Law, Article 13 of Decree No. 86/2011/NĐ-CP, and the following duties and powers:

1. Receiving citizens, handling complaints and denunciations, and preventing and combating corruption in accordance with the law.

2. Leading specialized inspection teams when the content involves multiple branches under the Department; leading or participating in inter-departmental inspection teams at the request of the Department Director; participating in inspection teams when requested by the Minister or the Chief Inspector of the Ministry of Agriculture and Rural Development.

3. Summarizing and reporting on the results of inspection work, receiving citizens, handling complaints and denunciations, and preventing and combating corruption within the scope of management of the Department of Agriculture and Rural Development.

4. Other duties and powers as prescribed by law.

Article 9. Duties and Powers of the Chief Inspector of the Departmentin

Implementing the duties and powers stipulated in Article 25 of the Inspection Law, Article 14 of Decree No. 86/2011/NĐ-CP, and the following duties and powers:

1. Reporting to the Director of the Department of Agriculture and Rural Development, the Provincial Chief Inspector, and the Chief Inspector of the Ministry about inspection work within their scope of responsibility.

2. Inspecting the responsibilities of heads of agencies and units under the management authority of the Department of Agriculture and Rural Development regarding the implementation of laws on inspection, receiving citizens, handling complaints and denunciations, and preventing and combating corruption.

3. Other duties and powers as prescribed by law.

Article 10. Duties and Powers of Agencies Assigned to Perform Specialized Inspection Functions Under the Ministry of Agriculture and Rural Development

Agencies assigned to perform specialized inspection functions under the Ministry of Agriculture and Rural Development implement the duties and powers stipulated in Clause 1, Article 10 of Decree No. 07/2012/NĐ-CP dated February 9, 2012, of the Government on agencies assigned to perform specialized inspection functions and specialized inspection activities, and the following duties and powers:

1. Inspecting according to plans, inspecting cases showing signs of law violations within their jurisdiction, or inspecting upon request of the Minister of Agriculture and Rural Development or the Chief Inspector of the Ministry.

2. Monitoring, urging, and checking the implementation of conclusions, recommendations, and decisions on inspections made by their agency.

3. Receiving citizens, handling complaints and denunciations, and preventing and combating corruption within their management scope in accordance with the law.

4. Summarizing and reporting to the Ministry Inspectorate the results of specialized inspection work; receiving citizens, handling complaints and denunciations, and preventing and combating corruption within their management scope.

5. Other tasks and powers as prescribed by law.

Article 11. Duties and Powers of Heads of Agencies Assigned to Perform Specialized Inspection Functions Under the Ministry of Agriculture and Rural Development

Heads of agencies assigned to perform specialized inspection functions under the Ministry of Agriculture and Rural Development implement the duties and powers stipulated in the Inspection Law, Article 11 of Decree No. 07/2012/NĐ-CP, and the following duties and powers:

1. Directing and checking the implementation of inspection work, receiving citizens, handling complaints and denunciations, and preventing and combating corruption within their scope of responsibility.

2. Deciding to conduct inspections when signs of law violations are discovered or upon request of the Minister of Agriculture and Rural Development or the Chief Inspector of the Ministry.

3. Deciding to establish inspection teams according to plans approved by the Minister of Agriculture and Rural Development.

4. Reporting to the Chief Inspector of the Ministry to resolve overlapping issues in inspection activities.

5. Perform other duties and authorities as prescribed by law.

Article 12. Advisory Unit for Specialized Inspection Work

1. The advisory unit for specialized inspection work at the General Department under the Ministry of Agriculture and Rural Development shall be organized in the form of a Department; at the Bureau under the Ministry of Agriculture and Rural Development, it shall be organized in the form of a Division.

2. The advisory unit for specialized inspection work at the District Agricultural Offices under the Provincial Departments of Agriculture and Rural Development shall be organized in the form of a Division, except where the District Office does not organize Divisions.

Chapter III

INSPECTION ACTIVITIES

Section 1

ADMINISTRATIVE INSPECTION ACTIVITIES

Article 13. Content and Objects of Administrative Inspection

The Ministry of Agriculture and Rural Development's Inspectorate and the Inspectorates of Provincial Departments of Agriculture and Rural Development shall inspect the implementation of policies, laws, tasks, and authorities assigned to agencies, organizations, and individuals specified in Clause 1, Article 2 of this Decree.

Article 14. Authority to Issue Administrative Inspection Decisions

The authority to issue administrative inspection decisions shall be implemented according to the provisions of Article 43 of the Law on Inspection, Articles 19 and 20 of Decree No. 86/2011/NĐ-CP.

Article 15. Procedures and Formalities for Administrative Inspections

The procedures and formalities for administrative inspections shall be carried out in accordance with Articles 44 to 50 of the Inspection Law; from Article 19 to Article 31 of Decree No. 86/2011/NĐ-CP.

Section 2

SPECIALIZED INSPECTION ACTIVITIES

Article 16. Objects of Specialized Inspections

The objects of specialized inspections are agencies, organizations, and individuals specified in Clause 2, Article 2 of this Decree.

Article 17. Content of Specialized Inspections on Water Resources, Dikes, Disaster Prevention and Mitigation, Clean Water Supply, and Rural Environmental Sanitation

Inspect compliance with specialized laws on water resources planning, exploitation and protection of water resource works, dikes, disaster prevention and mitigation, clean water supply, and rural environmental sanitation within the management scope of the Ministry of Agriculture and Rural Development; other contents as prescribed by law.

Article 18. Content of Specialized Inspections on Forestry

Inspect compliance with specialized laws on forest management, forest development, forest utilization, forest protection, natural forest conservation, forestry seedlings, and forest environmental services within the management scope of the Ministry of Agriculture and Rural Development; other contents as prescribed by law.

Article 19. Content of Specialized Inspections on Fisheries

Inspect compliance with specialized laws on fishery resource conservation and development, fishing, aquaculture, fish seeds, fish feed, and processing and environmental improvement for aquaculture within the management scope of the Ministry of Agriculture and Rural Development; other contents as prescribed by law.

Article 20. Content of Specialized Inspections on Crop Production

Inspect compliance with specialized laws on crop production, agricultural plant seeds, agricultural land use, organic fertilizers, and other fertilizers within the management scope of the Ministry of Agriculture and Rural Development; other contents as prescribed by law.

Article 21. Content of Specialized Inspections on Plant Protection and Quarantine

Inspect compliance with specialized laws on plant protection, plant quarantine, and plant protection chemicals within the management scope of the Ministry of Agriculture and Rural Development; other contents as prescribed by law.

Article 22. Contents of specialized inspection in the livestock sector            

Inspect compliance with specialized laws on livestock production, agricultural animal breeding, livestock feed, environmental protection in livestock farming, and environmental treatment products for livestock farming under the management of the Ministry of Agriculture and Rural Development; other contents as prescribed by law.

Article 23. Contents of specialized inspection in the veterinary sector

Inspect compliance with specialized laws on prevention and control of terrestrial animal diseases, aquatic animal diseases, animal quarantine, animal slaughter control, veterinary hygiene, veterinary drugs, biological preparations, microorganisms, chemicals used in veterinary medicine under the management of the Ministry of Agriculture and Rural Development; other contents as prescribed by law.

Article 24. Contents of specialized inspection in the quality management of agricultural, forestry, and aquatic products

Inspect compliance with specialized laws on the quality and food safety of agricultural, forestry, and aquatic products throughout the production process, collection, preliminary processing, processing, storage, transportation, and business under the management of the Ministry of Agriculture and Rural Development; other contents as prescribed by law.

Article 25. Contents of specialized inspection in the processing of agricultural, forestry, and aquatic products and salt industry

Inspect compliance with specialized laws on the processing and preservation of agricultural, forestry, and aquatic products, agricultural machinery and equipment, rural craft village development, and salt industry under the management of the Ministry of Agriculture and Rural Development; other contents as prescribed by law.

Article 26. Contents of specialized inspection in investment and construction management

Inspect compliance with specialized laws on project planning, review, approval, pre-feasibility study reports, feasibility reports, investment decisions, technical design approval decisions, general estimates, construction drawings, budgets; tendering procedures; contract implementation processes, acceptance, payment, settlement, handover for use; overall supervision and evaluation of investments in projects under the management of the Ministry of Agriculture and Rural Development; other contents as prescribed by law.

Article 27. Contents of specialized inspection in cooperative economy and rural development

Inspect compliance with specialized laws on cooperative economy in agriculture, population resettlement and stable living arrangements, relocation and resettlement, rural development under the management of the Ministry of Agriculture and Rural Development; other contents as prescribed by law.

Article 28. Authority to issue specialized inspection decisions

The authority to issue specialized inspection decisions shall be implemented according to Article 14 and Article 15 of Decree No. 07/2012/NĐ-CP.

Article 29. Procedures and formalities for specialized inspections

Procedures and formalities for specialized inspections shall be carried out according to the provisions from Article 52 to Article 56 of the Inspection Law and from Article 16 to Article 28 of Decree No. 07/2012/NĐ-CP.

Section 3

INSPECTION PLAN, OVERLAPPING ISSUES IN INSPECTION ACTIVITIES

AND INFORMATION AND REPORTING REGIME

Article 30. Construction and Approval of the Inspection Plan

1. The Inspectorate of the Ministry shall take the lead and coordinate with the General Directorates and Departments under the Ministry of Agriculture and Rural Development, based on the guidance of the Government Inspector General and management requirements, to develop the Inspection Plan and submit it to the Minister of Agriculture and Rural Development no later than November 15 each year. The Minister of Agriculture and Rural Development shall approve the Inspection Plan no later than November 25 each year.

2. No later than December 5 each year, the Head of the Inspectorate of the Department shall take the lead and coordinate with the Heads of the District Inspectorates under the Department of Agriculture and Rural Development, based on the Inspection Plan of the Inspectorate of the Ministry of Agriculture and Rural Development, the provincial inspectorate, and management requirements, to submit the Inspection Plan to the Director of the Department of Agriculture and Rural Development. The Director of the Department of Agriculture and Rural Development shall approve the Inspection Plan no later than December 15 each year.

3. The inspection plans stipulated in Clause 1 and Clause 2 of this Article shall be sent to the inspected entities and relevant agencies and organizations.

Article 31. Handling Overlap in Inspection Activities

1. If the inspection plan of a subordinate agency overlaps with the inspection plan of a superior agency, it shall be implemented according to the inspection plan of the superior agency.

2. The Director of the Ministry's Inspectorate shall take the lead in resolving overlap regarding scope, subjects, content, and time of inspection between agencies assigned to perform specialized inspection functions; coordinate with the Directors of Inspectorates of ministries and ministerial-level agencies to resolve overlap in agricultural and rural development sector inspection activities with inspection agencies of ministries and ministerial-level agencies; coordinate with the Provincial Inspectorate Directors to resolve overlap in agricultural and rural development sector inspection activities with local inspection agencies.

3. The Director of the Departmental Inspectorate shall report to the Provincial Inspectorate Director for handling overlap in inspection activities with local inspection agencies.

Article 32. Inspection Period

1. The inspection period of administrative inspection teams shall be carried out in accordance with Article 45 of the Inspection Law.

2. The inspection period of specialized inspection teams shall be carried out in accordance with Clause 16 of Decree No. 07/2012/ND-CP.

3. The independent specialized inspection period shall be carried out in accordance with Article 30 of Decree No. 07/2012/ND-CP.

Article 33. Re-inspection

1. Authority for Re-inspection

a) The Director of the Ministry's Inspectorate decides on re-inspection of cases that have been concluded by the head of the specialized inspection agency under the Ministry of Agriculture and Rural Development, the Chairman of the People's Committee at the provincial level, but which show signs of violation of laws and have been assigned by the Minister of Agriculture and Rural Development within the scope and authority of state management of the Ministry of Agriculture and Rural Development.

b) The Director of the Departmental Inspectorate decides on re-inspection of cases that have been concluded by the head of the specialized inspection agency under the Department of Agriculture and Rural Development, but which show signs of violation of laws and have been assigned by the Director of the Department of Agriculture and Rural Development.

2. The decision on re-inspection includes the contents prescribed in Articles 44 and 52 of the Inspection Law and Article 49 of Decree No. 86/2011/ND-CP.

Article 34. Information and Reporting System for Inspection Work

1. The Ministry's Inspectorate shall compile and report to the Minister of Agriculture and Rural Development and the Chief Inspector of the Government on inspection work, citizen reception, complaint and denunciation resolution, and anti-corruption within its scope of responsibility.

2. Departments and Bureaus under the Ministry of Agriculture and Rural Development shall report to the Ministry's Inspectorate on inspection work, citizen reception, complaint and denunciation resolution, and anti-corruption within their scope of responsibility.

3. The Departmental Inspectorate shall report to the Provincial Inspectorate Director, the Director of the Department of Agriculture and Rural Development, and the Director of the Ministry's Inspectorate on inspection work, citizen reception, complaint and denunciation resolution, and anti-corruption within its scope of responsibility.

4. Specialized inspection agencies under the Department of Agriculture and Rural Development assigned to perform specialized inspection functions shall report to the Departmental Inspectorate on specialized inspection work within their scope of responsibility.

5. The deadline for collecting data and submitting reports for inspection work, citizen reception, complaint and denunciation resolution, and anti-corruption reports shall be carried out in accordance with the regulations of the Government Inspectorate.

6. Heads of agencies and units under the Ministry of Agriculture and Rural Development, and project sponsors using budget funds managed by the Ministry of Agriculture and Rural Development, upon receiving inspection conclusions from the Government Inspectorate, related ministry inspectorates, and audit reports from the State Audit Office, must send copies of the inspection conclusions and audit reports to the Ministry's Inspectorate within five days from the date of receipt of these documents.

Chapter IV

INSPECTORS AND PERSONS ASSIGNED TO PERFORM SPECIALIZED INSPECTION TASKS

AND INSPECTION COLLABORATORS

Article 35. Agricultural and Rural Development Inspectors

1. Agricultural and Rural Development Inspectors are civil servants of the Ministry's Inspectorate or Department's Inspectorate appointed to the inspector rank to perform inspection tasks as prescribed by law and other tasks assigned by the Head of the Ministry's Inspectorate or the Head of the Department's Inspectorate.

2. Agricultural and Rural Development Inspectors enjoy benefits for cadres and civil servants as stipulated in the Law on Cadres and Civil Servants; they receive salaries, seniority allowances, responsibility allowances according to their profession as inspectors, and other special regimes and policies as prescribed by law; they are provided with inspection uniforms, inspection cards, insignias, and badges.

Article 36. Civil Servants Assigned to Perform Specialized Inspection Tasks

1. Civil servants assigned to perform specialized inspection tasks (hereinafter referred to as specialized inspection civil servants) must meet the standards prescribed in Article 12 of Decree No. 07/2012/ND-CP and other specific standards prescribed by the Minister of Agriculture and Rural Development.

2. Specialized inspection civil servants have specialized inspection uniforms, specialized inspection civil servant cards, and are entitled to subsistence allowances when performing inspection tasks. The specialized inspection civil servant uniforms and cards are prescribed by the Minister of Agriculture and Rural Development.

Article 37. Collaborators in Agricultural and Rural Development Inspection

1. Collaborators in Agricultural and Rural Development Inspection are summoned by the Ministry's Inspectorate or Department's Inspectorate to join inspection teams.

2. Collaborators in inspection are individuals not included in the establishment of state inspection agencies, having good moral character; having a sense of responsibility, professional qualifications suitable for the requirements and tasks of the summoning agency; when performing official duties, they must comply with laws on inspection.

3. The tasks, powers, systems, and policies for collaborators in Agricultural and Rural Development Inspection are implemented in accordance with the provisions of law.

Article 38. Means and Technical Facilities

State inspection agencies in Agricultural and Rural Development have offices, facilities, means, and specialized equipment provided according to prescribed standards and quotas to serve inspection work. Depending on each specialty, agricultural and rural development inspectors and specialized inspection civil servants are equipped with technical means and tools to support them in performing assigned tasks.

Article 39. Operating Budget

1. The operating budget for Agricultural and Rural Development Inspection is funded from the state budget and other sources as prescribed by law.

2. The preparation, management, use, and settlement of the budget are carried out in accordance with the provisions of law.

Chapter V

RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS IN THE INSPECTION ACTIVITY

OF AGRICULTURE AND RURAL DEVELOPMENT

Article 40. Responsibilities of the Minister of Agriculture and Rural Development

1. Organizing and directing inspection activities within the scope of management of the Ministry of Agriculture and Rural Development.

2. Approving the Inspection Plan of the Ministry and specialized inspection agencies under the Ministry of Agriculture and Rural Development.

3. Directing timely handling of conclusions and recommendations regarding inspection work.

4. Timely resolving difficulties and obstacles in inspection work; addressing overlapping issues in inspection and supervision activities within their scope of management.

Article 41. Responsibilities of the Chairman of the Provincial People's Committee

1. Direct the Department of Agriculture and Rural Development to coordinate with the Department of Home Affairs to improve organizational structure and ensure the operation of the Department of Agriculture and Rural Development Inspectorate.

2. Direct specialized agencies under the Provincial People's Committee to coordinate with the Department of Agriculture and Rural Development in implementing inspection activities within the agricultural and rural development sector at the local level.

3. Direct the provincial inspectorate to train and enhance the professional skills of administrative inspection for the Department of Agriculture and Rural Development Inspectorate; receive citizens, handle complaints and denunciations, and prevent corruption.

Article 42. Responsibilities of the Director of the Department of Agriculture and Rural Development

1. Direct inspection activities within the management scope of the Department of Agriculture and Rural Development.

2. Direct the construction and approval of the Inspection Plan of the Department of Agriculture and Rural Development and its subordinate agencies.

3. Timely address conclusions and recommendations regarding inspection work.

4. Improve organizational structure and ensure funding and operational conditions for the Department of Agriculture and Rural Development Inspectorate.

5. Timely resolve difficulties and obstacles related to inspection work; address overlapping issues in inspection and supervision activities within the management scope of the Department of Agriculture and Rural Development.

6. Direct the Department of Agriculture and Rural Development Inspectorate to cooperate with the assigned district-level agencies to develop regulations on cooperation in specialized inspection activities, submit for approval by the Director of the Department of Agriculture and Rural Development.

Article 43. Responsibilities for Cooperation between Agricultural and Rural Development Inspection Agencies and Other Agencies and Organizations

1. The Ministry of Agriculture and Rural Development Inspectorate shall cooperate with units under the Government Inspectorate, inspectors from other ministries, sectors, and agencies assigned specialized inspection functions, provincial inspectors, departments of agriculture and rural development, and relevant agencies in inspection activities, citizen reception, complaint resolution, denunciation handling, and anti-corruption efforts.

2. The Department of Agriculture and Rural Development Inspectorate shall cooperate with the Ministry of Agriculture and Rural Development Inspectorate, provincial inspectors, inspectors from other provincial departments and sectors, and county inspectors in inspection activities, citizen reception, complaint resolution, denunciation handling, and anti-corruption efforts.

3. Agricultural and rural development inspection agencies within their duties and powers shall be responsible for cooperating with other relevant agencies and organizations in inspection activities, citizen reception, complaint resolution, denunciation handling, anti-corruption efforts, and prevention, detection, and punishment of violations of laws.

Chapter VI

IMPLEMENTING PROVISIONS

Article 44. Effective date of implementation

This Decree takes effect from June 30, 2015; replacing Decree No. 153/2005/NĐ-CP dated December 15, 2005 of the Government on the organization and operation of Agricultural and Rural Development Inspectors, and Decree No. 107/2005/NĐ-CP dated August 17, 2005 of the Government on the organization and operation of Fisheries Inspectors.

Article 45. Responsibility for Implementation

1. The Minister of Agriculture and Rural Development is responsible for guiding the implementation of this Decree.

2. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairmen of provincial people's committees directly under the central government, heads of agencies, organizations, and individuals concerned are responsible for implementing this Decree./.
