CIRCULAR

ISSUING THE LIST OF PROHIBITED ACTIVE INGREDIENTS AND RESTRICTED USE IN DOMESTIC AND HEALTHCARE PESTICIDES AND DISINFECTANTS IN VIETNAM

Pursuant to the Government's Decree No. 75/2017/NĐ-CP dated June 20, 2017 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to Decree No. 91/2016/NĐ-CP dated July 1, 2016 of the Government on chemical management, pesticides, and disinfectants for domestic and healthcare use;chemical substances, insecticides, and antibacterial products for household and medical use;

Considering the proposal of the Director of the Department of Environmental Health Management,medical environment management;

The Minister of Health issues this Circular on issuing the List of prohibited active ingredients and restricted use in domestic and healthcare pesticides and disinfectants in Vietnam.Article 1. Active Ingredient List 1. This Circular annexes Appendix No. 01, the List of Prohibited Active Ingredients in domestic and healthcare pesticides and disinfectants in Vietnam.

2. This Circular annexes Appendix No. 02, the List of Restricted Use Active Ingredients in domestic and healthcare pesticides and disinfectants in Vietnam.

2. Circular No. 25/2011/TT-BYT dated June 23, 2011 of the Minister of Health on the List of Chemicals Allowed for Registration and Use, Allowed for Registration but Restricted Use, and Prohibited from Use in Vietnam shall be repealed upon the effective date of this Circular.

Domestic and healthcare products using active ingredients listed in Appendix No. 02 of this Circular that have been granted circulation permits before the effective date of this Circular may only advertise their products according to the scope of efficacy stated on the circulation permit. If they wish to expand the scope of efficacy as defined in Appendix No. 02 of this Circular, they must follow the supplementary registration procedures stipulated in Decree No. 91/2016/NĐ-CP dated July 1, 2016 of the Government on chemical management, pesticides, and disinfectants for domestic and healthcare use.

Article 2. Effective Date

1. This Circular takes effect from February 15, 2018.

The Heads of the Ministry's Office, Department Directors, Bureau Chiefs, General Bureau Chiefs under the Ministry of Health, Provincial Health Directors, Central City Health Directors, Sectoral Health Leaders, and related units are responsible for implementing the provisions of this Circular.

Article 3. Transitional Provisions

During implementation, if there are difficulties or obstacles, relevant agencies, organizations, and individuals are requested to promptly report them to the Ministry of Health for consideration and resolution./.
