Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decree No. 16/2015/NĐ-CP dated February 14, 2015 of the Government stipulating the self-management mechanism of public service units;

Pursuant to Decree No. 141/2016/NĐ-CP dated October 10, 2016 of the Government stipulating the self-management mechanism of public service units in the field of economic affairs and other public services;

Upon the proposal of the Director of the Department of Finance and Business Reform,

The Minister of Industry and Trade issues this Circular prescribing the construction, examination, and issuance of economic-technical norms for public services using state budget funds applicable in the economic public service sector and other public services under the management of the Ministry of Industry and Trade.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular prescribes the construction, examination, and issuance of economic-technical norms for public services using state budget funds applicable in the economic public service sector and other public services under the management of the Ministry of Industry and Trade.

Article 2. This Circular applies to agencies, organizations, and individuals implementing the construction, examination, and issuance of economic-technical norms for public services using state budget funds applicable in the economic public service sector and other public services managed by the Ministry of Industry and Trade.

Article 2. Interpretation of Terms

In this Circular, certain terms are understood as follows:

Economic-technical norms for public services using state budget funds applicable in the economic public service sector and other public services under the management of the Ministry of Industry and Trade (hereinafter referred to as economic-technical norms) include industry-specific economic-technical norms and basic economic-technical norms, which are the quantities of consumption factors such as labor, materials, machinery, and equipment required to complete the provision of a public service meeting the criteria and standards issued by competent authorities. Economic-technical norms consist of three basic components: labor norms, material norms, and machinery and equipment norms.

Point 2. Labor norms are the amount of labor required by professionals to complete the provision of a public service meeting the criteria and standards issued by competent authorities.

Point 3. Material norms are the amounts of each type of raw materials required to complete the provision of a public service meeting the criteria and standards issued by competent authorities.

Point 4. Machinery and equipment norms are the time periods required for the use of each type of machinery and equipment to complete the provision of a public service meeting the criteria and standards issued by competent authorities.

Article 3. Objectives of constructing and issuing economic-technical norms for the industry and trade sector

Point 1. To serve as a basis for determining the prices of public services in the economic public service activities and other public services under the management of the Ministry of Industry and Trade, thereby enhancing effectiveness, thrift, and efficiency.

Point 2. To serve as a basis for planning, economic management, financial management, and quality management in the economic public service activities and other public services under the management of the Ministry of Industry and Trade.

Point 3. To promote socialization in the economic public service sector and other public services in the industry and trade sector, creating a fair operating environment for organizations, enterprises, and individuals.

Article 4. Principles for Establishing Economic and Technical Norms in the Industry and Trade Sector

1. Ensuring accuracy and comprehensiveness to complete the implementation of a public service activity in accordance with current criteria, standards, and quality requirements.

2. Meeting general structural requirements for various types of economic and technical norms, ensuring average advanced levels, stability, and consistency.

Article 5. Basis for establishing economic and technical norms

1. Quality standards, technical parameters, basic requirements, implementation capacity, organizational level, technological infrastructure.

2. Current laws and regulations on working conditions for workers.

3. Actual operating conditions of public institutions regarding human resources, material and equipment facilities, financial resources, land.

4. Annual statistical data and related documents.

5. Economic and technical standards, procedures for determining specialized economic and technical norms, and regulations issued to determine consumption rates for each task, on which basis economic and technical norms are calculated and established.

Article 6. Methods for establishing economic and technical norms

1. Comprehensive Statistical Method

Based on annual statistical data or periodic reports (statistical data must ensure reliability and legality over a continuous three-year period prior to the establishment of economic and technical norms) and relying on practical experience or comparative parameters to establish economic and technical norms.

2. Standard Method

Based on national standards and regulations concerning working hours and rest periods to establish labor norms for each task.

3. Experimental analysis method

On the basis of implementing surveys and experiments according to each process and content of work to analyze and calculate each component of the norm (selecting tasks that cannot be determined through the above two methods or can be determined but not accurately enough, requiring practical testing).

Article 7. Content of economic and technical norms

1. Labor Standard

Labor norm = Direct labor norm (execution) + Indirect labor norm (management, support).

a) Direct labor norm is the time required to complete a public service activity.

b) Indirect labor norm is defined as a percentage (%) of direct labor.

2. Material standard

a) Determine the type of materials.

b) Determine the quantity/volume of each type of material: Based on the type of equipment and the running time of loaded machines (material consumption).

c) Determine the recovery rate (%) of materials: Based on the characteristics and nature of the materials to calculate the recovery rate (%).

d) Determine the basic technical requirements of materials: Describe the technical parameters of each type of material suitable for performing a public service activity.

3. Machinery and Equipment Standard

a) Determine the type of machinery and equipment.

b) Determining the basic technical specifications of machinery and equipment.

c) Determine the usage time of each type of machinery and equipment: Including the running time of loaded machines (material consumption) and unloaded machines (no material consumption).

d) Aggregate machinery and equipment norms.

Chapter II

PROCEDURE FOR ESTABLISHING, REVIEWING AND ISSUING ECONOMIC AND TECHNICAL NORMS FOR PUBLIC SERVICE ACTIVITIES FUNDED BY THE STATE BUDGET IN THE ECONOMIC PUBLIC SERVICE AND OTHER PUBLIC SERVICES UNDER THE STATE MANAGEMENT OF

TECHNICAL AND SERVICE ACTIVITIES OF STATE ADMINISTRATIVE ORGANIZATIONS USING THE STATE BUDGET

THE STATE IN THE ECONOMIC PUBLIC SERVICE AND OTHER PUBLIC SERVICES

BELONGING TO THE FIELD OF STATE MANAGEMENT OF

MINISTRY OF INDUSTRY AND TRADE

Article 8. Authority to Establish and Issue Economic and Technical Norms

1. Units assigned to establish economic and technical norms in the Industry and Trade sector as set out in Appendix I attached to this Circular shall independently establish norms according to their management objectives, functions, tasks, and delegated authorities, and submit them to the Minister of Industry and Trade for issuance.

2. Basic economic and technical norms shall only be issued for industries and professions within the scope of functions, tasks, or registered activities, or when it is necessary to specify industry-level economic and technical norms to suit the conditions and specific characteristics of public institutions. Basic economic and technical norms are established by public institutions and are only applicable within the scope of those institutions.

Article 9. Construction, review, and issuance of economic-technical norms

1. The unit entrusted with the main responsibility shall organize the construction of economic-technical norms for each public service or for the public services specified in Section III - List attached to Decision No. 573/QĐ-TTg dated April 25, 2017 of the Prime Minister promulgating the list of public services funded by the State budget under the management of the Ministry of Industry and Trade.

2. The unit responsible for constructing economic-technical norms must ensure the following steps are carried out:

a) Drafting the general outline and detailed outline. The drafting team shall implement:

- Drafting the general outline and detailed outline;

- Organizing meetings and discussions on the draft outlines and developing implementation plans.

b) Surveying and evaluating economic-technical norms

The drafting team shall conduct surveys at public institutions; production, business, and service units.

c) Constructing economic-technical norms; Establishing service quality criteria and standards, service provision procedures for each public service within the assigned industry or sector and under the management of the unit; Establishing mechanisms for monitoring, evaluating, and certifying the quality of public services.

d) Soliciting opinions on the draft Decision regarding economic-technical norms

- Organizing seminars to finalize economic-technical norms;

- Soliciting independent experts' opinions on economic-technical norms.

đ) Completing the draft for submission to the Review Board

Based on expert opinions and practical survey results, the drafting team shall revise and complete the draft Decision on economic-technical norms according to Model II and III issued together with this Circular, and submit it to the Review Board.

- Content of review: Reviewing the issuance process of norms, criteria, standards, and quality of constructed norms.

- The unit tasked with constructing economic-technical norms shall organize the review of the draft Decision on economic-technical norms.

- Developing a review plan and sending relevant materials to Review Board members.

- Review Board members shall study the draft Decision on economic-technical norms and related materials to prepare written comments and evaluations of the draft Decision and report to the Chairman of the Review Board.

- Conducting the review meeting

+ The drafting team shall report the draft Decision on economic-technical norms;

+ The drafting team shall answer questions from the Review Board;

+ Review Board members shall discuss and publicly evaluate the draft Decision on economic-technical norms;

+ Review Board members shall assess the quality of the draft Decision on economic-technical norms through secret ballot according to the following levels:

Level 1: Meets the requirement for issuance.

Level 2: Meets the requirement but needs revision before issuance.

Level 3: Does not meet the requirement and needs to be rebuilt.

- The Chairman of the Review Board shall compile the evaluation opinions of the Board members and conclude on the quality of the draft Decision based on the consensus of the majority of participating Board members (according to one of the three levels specified above). If the draft Decision on economic-technical norms requires revision, the Chairman will specify the details of the revisions. In case the draft Decision does not meet requirements and needs to be redrafted, the Chairman will decide on the organization of a new review for the drafting team to complete the file according to the conclusion of the Review Board Chairman;

- The Review Board shall compile and report to the Minister the results of reviewing the issuance of the Decision on economic-technical norms for public services funded by the State budget applicable in the fields of economic public services and other public services under the management of the Ministry of Industry and Trade.

e) Issuing economic-technical norms.

Based on the minutes of the review, the conclusions of the review, and the revision reports (if any), the Minister of Industry and Trade shall sign and issue economic-technical norms within the authority stipulated in Model IV issued together with this Circular.

Article 10. Adjustment and supplementation of economic and technical norms

Clause 1. The adjustment and supplementation of economic and technical norms shall be carried out when the issued economic and technical norms are no longer suitable for new conditions regarding organizational implementation and technical standards and quality as prescribed by competent state agencies.

Clause 2. When there is a need to adjust and supplement economic and technical norms, the leading unit shall implement such adjustments and supplements in accordance with the provisions of this Circular.

Chapter III

IMPLEMENTING PROVISIONS

Article 11. Responsibility for organizing implementation

Clause 1. The Department of Finance and Enterprise Renewal is the main unit responsible for consolidating and urging other units to develop and issue economic and technical norms in accordance with the provisions of this Circular.

Clause 2. Units assigned to lead the development of economic and technical norms shall have the responsibility to submit to the Minister of Industry and Trade for issuance of Decisions on economic and technical norms for each public service activity funded by the State budget within the industry and sector specified in Section III - List attached to Decision No. 573/QĐ-TTg, within the functions, tasks, powers, and scope of management of the unit.

Article 12. Implementation Funding

Clause 1. The budget for developing economic and technical norms for the industry of Industry and Trade shall be allocated within the regular expenditure norm for administrative units and self-balanced within the revenue sources of economic public service units and other public service units.

Clause 2. The budget for developing basic economic and technical norms shall be allocated from the self-assured funds of economic public service units and other public service units.

Article 13. Effective Date

The issuance of economic and technical norms for public services funded by the State budget applicable in the fields of economic public services and other public services under the management of the Ministry of Industry and Trade must be completed no later than January 1, 2020.

This Circular takes effect from January 1, 2019.

During the implementation process, if there are difficulties or obstacles, please report to the Ministry of Industry and Trade for guidance and coordination in resolving them./.
