Amending and supplementing some Articles of Circular No. 39/2015/TT-BGTVT dated July 31, 2015 issued by the Minister of Transportguiding the implementation of certain Articles of the Agreement and Protocol

implementing the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia

To implement the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia signed on June 1, 1998 (hereinafter referred to as the "Agreement"); To implement the Protocol implementing the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia signed on October 10, 2005 (hereinafter referred to as the "Protocol");To implement the Protocol amending the Protocol implementing the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia signed on February 26, 2019 (hereinafter referred to as the "2019 Protocol");

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

The Minister of Transport hereby issues this Circular amending and supplementing some Articles of Circular No. 39/2015/TT-BGTVT dated July 31, 2015 of the Minister of Transport guiding the implementation of certain Articles of the Agreement and Protocol implementing the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia.

Article 1. Amending and supplementing some Articles of Circular No. 39/2015/TT-BGTVT dated July 31, 2015 of the Minister of Transport guiding the implementation of certain Articles of the Agreement and Protocol implementing the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia.

"3. Non-commercial vehicles include passenger cars with no more than 09 seats (including the driver) and cargo vehicles that do not charge for transportation, including:

a) Official vehicles under the use of agencies and organizations, including:

Vehicles of central agencies of the Party, National Assembly, and Government, offices of Ministries, agencies at the ministerial level; agencies under the Government, agencies under Ministries, agencies at the ministerial level, agencies under the Government;

2. Amending Clause 3 Article 4 as follows:

Vehicles of diplomatic agencies, consular agencies, agencies representing international organizations headquartered in Vietnam; Vehicles of political organizations, political-social organizations, mass organizations, public institutions at the central and local levels;

b) Vehicles driven by foreigners: vehicles used by individuals holding passports or travel documents valid as passports issued by third countries (passports or travel documents valid as passports not issued by Vietnam or Cambodia);

c) Personal vehicles;

d) Vehicles of enterprises and cooperatives serving their business activities and not participating in the transportation of people and/or goods for profit;

đ) Firefighting vehicles, ambulance vehicles, rescue vehicles, vehicles performing humanitarian missions".

3. Amend Clause 3 of Article 12 as follows:

"3. In case of emergency, vehicles specified in point e of Clause 3 of Article 1 of this Circular are exempted from the Vietnam-Cambodia Combined Transport Permit when crossing the border between the two countries".

4. Amend point đ of Clause 1 of Article 16 as follows:

"đ) Vehicles that have been confiscated or had their license plates revoked; transport units that have been confiscated or had their business licenses revoked for operating road transport services using motor vehicles, or had their international road transport permits for Vietnam-Cambodia revoked".

5. Amend point b of Clause 2 of Article 22 as follows:

"b) Implementing the management of international road transport activities between Vietnam and Cambodia within their jurisdiction and reporting vehicles that have been confiscated or had their license plates revoked, and transport units that have been confiscated or had their business licenses revoked for operating road transport services using motor vehicles to the Vietnam Highway Corporation for revocation of the Vietnam-Cambodia Combined Transport Permit;"

"d) Vehicles whose license plates or signs have been revoked or withdrawn; transport units whose business licenses for road transportation using motor vehicles or international road transport permits between Vietnam and Cambodia have been revoked or withdrawn."

5. Amend point b, Clause 2, Article 22 as follows:

"b) Manage the international road transport activities between Vietnam and Cambodia within their jurisdiction and according to their authority; report vehicles whose license plates or signs have been revoked or withdrawn, and transport units whose business licenses for road transportation using motor vehicles have been revoked or withdrawn to the General Department of Transportation of Vietnam for the revocation of international road transport permits between Vietnam and Cambodia."

Article 2. Repeal Article 9, Clause 4 of Article 10, Point b of Clause 1 of Article 11, Clause 2 of Article 14, Clauses 2 and 3 of Article 16 of Circular No. 39/2015/TT-BGTVT dated January 31, 2015, issued by the Minister of Transport guiding the implementation of certain Articles of the Agreement and Protocol to implement the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia.

Article 3. Effectiveness

This Circular takes effect from January 15, 2020.

The Head of the Ministry’s Office, Heads of Departments, Director of the Vietnam Registration Agency, Heads of agencies, units, and individuals related to this Circular shall be responsible for its enforcement.

The Director of the Office of the Ministry, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Highway Administration, Directors of Provincial Departments of Transport and Construction under centrally governed cities, Heads of agencies, organizations, and individuals related to this Circular shall be responsible for its implementation./.
