Issuing Survey Standards for Design - Estimate Preparation of Postal and Telecommunications Works

Pursuant to the Law on Telecommunications dated November 23, 2009;

Pursuant to the Law on Construction promulgated on June 18, 2014;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Construction Law on January 17 May 14, 2016 Government Decree detailing some provisions and measures to implement the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017, issued by the Government, on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

At the proposal of the Director of the Department of Planning and Finance;

The Minister of Information and Communications issues this Circular on Survey Standards for Design - Estimate Preparation of Postal and Telecommunications Works.

Article 1. This Circular hereby promulgates Survey Standards for Design - Estimate Preparation of Postal and Telecommunications Works.

Article 2. Scope of Regulation

The standards issued along with this Circular stipulate direct costs related to labor, materials, and survey equipment used as a basis for determining the survey costs for design - estimate preparation of postal and telecommunications works for projects using public investment capital, state capital outside public investment, and public-private partnership (PPP) construction projects.

Article 3. Applicability

1. This Circular applies to agencies, organizations, and individuals involved in managing survey costs for design - estimate preparation of postal and telecommunications works for projects using public investment capital, state capital outside public investment, and PPP projects.

2. Organizations and individuals may refer to the provisions of this Circular to manage construction investment costs for projects not covered under Clause 1 of this Article.

Article 4. Transitional Provisions

1. In cases where survey costs for design - estimate preparation of postal and telecommunications works are included in the total investment ceiling or construction budget that have been reviewed or approved before the effective date of this Circular, such costs must be updated according to the subsequent cost management stages.

2. For survey costs for design - estimate preparation of postal and telecommunications works in construction tender packages belonging to investment construction projects that have issued tender documents or request for proposals but have not yet closed bids before the effective date of this Circular, the investment decision-maker shall consider and decide on the application of the provisions of this Circular.

3. In cases where construction tender packages have already closed bids, or selected contractors, or signed contracts before the effective date of this Circular, they shall be implemented according to the tender documents, proposal documents, bidding documents, submission documents, and signed contracts.

1. This Circular takes effect from March 1, 2021.

2. During implementation, if there are difficulties or obstacles, agencies and units are requested to report to the Ministry of Information and Communications for consideration and resolution.
