CIRCULAR
Regulations on the Disciplinary School Rules
Pursuant to the Law on Handling Administrative Violations dated June 20, 2012 June 20, 2012Law amending and supplementing certain articles of the Law on Handling Administrative Violations dated November 13, 2020;
Pursuant to the Criminal Enforcement Law dated June 14, 2019;
Pursuant to Decree No. 140/2021/NĐ-CP dated December 31, 2021 of the Government stipulating the regime for applying administrative measures involving placement in disciplinary schools and compulsory educational facilities;
Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
At the proposal of the Director of the Department of Prison Management, Compulsory Educational Facilities, and Disciplinary Schools under the Ministry of Public Security;
The Minister of Public Security promulgates this Circular prescribing the Disciplinary School Rules.
Article 1. The Disciplinary School Rules accompanying this Circular are hereby issued.
Article 2. Applicability
This Circular applies to:
1. Disciplinary school.
2. Students of the disciplinary school.
3. Officers, non-commissioned officers, soldiers, and workers of the disciplinary school.
4. Local public security units, agencies, organizations, and individuals related thereto.
Article 3. Effectiveness
This Circular takes effect from December 31, 2022, and replaces Circular No. 20/2015/TT-BCA dated May 14, 2015 of the Minister of Public Security prescribing the Disciplinary School Rules.
Article 4. Responsibilities for Implementation
1. The Director of the Department of Prison Management, Compulsory Educational Facilities, and Disciplinary Schools shall be responsible for monitoring, guiding, and inspecting the implementation of this Circular.
2. Heads of units under the Ministry of Public Security, Provincial Police Chiefs, Chief of Municipal Police Departments directly under the Central Government, Principals of disciplinary schools, and related agencies, organizations, and individuals are responsible for implementing this Circular.
During the implementation of this Circular, if there are any difficulties, local public security units, agencies, organizations, and individuals related thereto shall report to the Ministry of Public Security (through the Department of Prison Management, Compulsory Educational Facilities, and Disciplinary Schools) for timely guidance./.
