Pursuant to the Law on Organization of the Government dated December 25, 2001;

To support those with low income and difficult living conditions;

Considering the proposal of the Minister of Finance,

DECISION:

Article 1. Implementing one-time hardship allowances for low-income individuals and those with difficult living conditions, including:

1. Individuals with low salaries and difficult living conditions entitled to hardship allowances under Clause 1 of this Article are those whose salary coefficient (salary based on position or current rank) is 3.00 or lower, including:

a) Civil servants (including probationary civil servants) within the state budget payroll working in state agencies, political organizations, and political-social organizations at the central level; at provincial and centrally-administered city levels; at district, town, and provincial city levels;

b) Public officials within the state budget payroll and other sources of institutional revenue as prescribed by law working in state-run institutions, political organizations, and political-social organizations;

c) Civil servants, public officials, and staff within the state payroll and receiving salaries according to the state-prescribed pay scale who have been assigned by competent authorities to work in associations, non-governmental organizations, projects, and international organizations located in Vietnam;

d) Civil servants and public officials at commune, ward, and town levels as stipulated in Clause 1 and Clause 2 of Article 2 of Decree No. 92/2009/NĐ-CP dated October 22, 2009 of the Government on job titles, staffing levels, and some policies for civil servants and public officials at commune, ward, and town levels and those engaged in part-time activities at the grassroots level;

đ) Kindergarten teachers within the payroll and kindergarten teachers under contract as stipulated in Decision No. 161/2002/QĐ-TTg dated November 15, 2002 of Prime Minister;

e) Health workers at commune, ward, and town levels receiving salaries according to Decision No. 58/TTg dated February 3, 1994 and Decision No. 131/TTg dated March 4, 1995 of Prime Minister;

g) Individuals signing labor contracts as prescribed in Decree No. 68/2000/NĐ-CP dated November 17, 2000 of the Government on implementing certain types of employment contracts in administrative state agencies and state-run institutions, who have been classified according to the salary regulations set forth in Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for civil servants, public officials, and members of the armed forces, currently working in state agencies and state-run institutions, political organizations, and political-social organizations;

h) Personnel engaged in confidential work in confidential organizations;

i) Professional military personnel and civilian employees receiving salaries from the state budget within the Vietnam People's Army;

k) Non-commissioned officers, workers, and staff in the police force receiving salaries from the state budget within the Vietnam People's Public Security Force.

2. Pensioners and social insurance beneficiaries with low pensions and difficult living conditions entitled to hardship allowances under Clause 1 of this Article are those whose monthly pension or social insurance allowance is 2.2 million VND or less, including:

a) Civil servants, public officials, workers, and staff; military personnel, public security personnel, and personnel engaged in confidential work currently receiving monthly pensions.

b) Commune, ward, and town officials as stipulated in Decree No. 92/2009/NĐ-CP dated October 22, 2009, Decree No. 121/2003/NĐ-CP dated October 21, 2003, and Decree No. 09/1998/NĐ-CP dated January 23, 1998 of the Government currently receiving monthly pensions and allowances.

c) Individuals currently receiving monthly disability benefits; individuals currently receiving monthly allowances under Decision No. 91/2000/QĐ-TTg dated August 4, 2000 of the Prime Minister; rubber plantation workers currently receiving monthly allowances.

d) Commune, ward, and town officials currently receiving monthly allowances under Decision No. 130-CP dated June 20, 1975 of the Council of Ministers and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.

đ) Military personnel currently receiving monthly allowances as prescribed in Decision No. 142/2008/QĐ-TTg dated October 27, 2008 of The Prime Minister.

3. Revolution veterans receiving regular allowances (excluding those receiving survivor benefits).

4. Survivors receiving allowances (including those receiving social insurance survivor benefits and survivor benefits for revolution veterans).

5. Poor households according to the new poverty standard as stipulated in Decision No. 09/2011/QĐ-TTg dated January 30, 2011 ofthe Prime Minister.

Article 2. Level of support:

1. A level of 250,000 VND/person for the subjects specified in Clause 1, 2, and 3 of Article 1 of this Decision;

2. A level of 100,000 VND/person for the subjects specified in Clause 4 of Article 1 of this Decision;

3. A level of 250,000 VND/household for the subjects specified in Clause 5 of Article 1 of this Decision.

This support will be implemented in two installments during the second quarter of 2011.

Article 3. The funding for implementing hardship allowances for subjects receiving salaries and allowances from the state budget and poor households as stipulated in this Decision shall be guaranteed from the state budget and legitimate revenue of agencies and units.

Article 4.

1. The Ministry of Labor, Invalids and Social Affairs shall take the lead and coordinate with the Ministry of Finance and relevant ministries to guide the implementation of hardship allowances as prescribed in this Decision.

2. The Ministry of Finance shall guide the funding source and settlement of accounts for the hardship allowances as prescribed in this Decision; supplement funding for implementing hardship allowances for ministries, central agencies, provinces, and centrally-administered cities, and compile and report to the Prime Minister the results of implementation.

3. Chairmen of Provincial People's Committees, centrally-administered city people's committees, and heads of ministries and central agencies shall be responsible for organizing and implementing timely support in accordance with the standards and criteria prescribed in this Decision.

Article 5.

1. State-owned enterprises shall implement hardship allowances for workers from legitimate financial funds of the enterprise.

2. Encourage non-state-owned enterprises to use legitimate financial funds to provide additional support to workers to improve their living conditions.

3. Enterprises that provide support to workers where legitimate funds are insufficient may include such expenses in the production and business costs of the enterprise. The Ministry of Finance shall provide specific guidance.

Article 6. This Decision shall take effect from the date of signing.

Article 7. The Minister, the Head of an agency at the level of a ministry, the Head of a government agency under the central authority, other central agencies, the Chairpersons of the People's Committees of provinces and centrally governed cities, the Chairpersons of the Management Boards and General Directors of state-owned enterprises are responsible for implementing this Decision./.
