JOINT CIRCULAR
Guidelines on policies and financial support for the People's Militia and Self-Defense Force
Pursuant to the Law on Issuing Legal Normative Documents dated November 12, 1996;
Pursuant to the Ordinance on the People's Militia and Self-Defense Force dated January 9, 1996;
Implementing Decree No. 35/CP dated June 14, 1996 of the Government detailing the implementation of the Ordinance on the People's Militia and Self-Defense Force,
The Ministry of National Defense, Ministry of Finance, Ministry of Labor, Invalids and Social Affairs, and Ministry of Health issue guidelines on policies and financial support for the People's Militia and Self-Defense Force as follows:
PART I:
POLICIES AND SUPPORT FOR THE PEOPLE'S MILITIA AND SELF-DEFENSE FORCE
A. LIVING ALLOWANCES, SUBSIDIES, ADDITIONAL PAYMENTS, AND UNIFORMS:
a. For the People's Militia:
1. Full-time and part-time deputy commanders, in addition to the living allowances, subsidies, and additional payments stipulated in Article 10 of Decree No. 35/CP dated June 14, 1996 of the Government ("Detailed Regulations on the Implementation of the Ordinance on the People's Militia and Self-Defense Force" hereinafter referred to as Decree No. 35/CP dated June 14, 1996), if they have continuously held their positions for over five years, from the sixth year onwards, they will also receive an additional monthly allowance equal to 5% of their current living allowance.
2. Full-time and part-time deputy commanders will receive living allowances, subsidies, and monthly additional payments according to the provisions of Article 10 of Decree No. 35/CP dated June 14, 1996 from the date when the Chairman of the People's Committee of the district, city district, or provincial city issues the appointment decision. If the decision takes effect from the first to the fifteenth day of the month, they will receive full living allowances, subsidies, and additional payments for the entire month; if the decision takes effect from the sixteenth day to the end of the month, they will receive half-monthly living allowances, subsidies, and additional payments for that month.
3. Full-time and part-time deputy commanders who have continuously worked for five years or more, without violating discipline at or above the warning level, upon retirement, will be granted a one-time subsidy, with each year of service entitling them to one month's living allowance currently received, including the 5% additional payment (if applicable). The Chairman of the People's Committee of the district, city district, or provincial city will issue a decision regarding those officials entitled to this subsidy.
4. The minimum value of the additional payment for the equivalent of a day's labor for militia officers and soldiers as stipulated in Clause 1, Article 11 of Decree No. 35/CP dated June 14, 1996 shall be equal to the basic daily food allowance of an infantry soldier in the military.
b. For the Self-Defense Force:
Officers and soldiers of the Self-Defense Force during their time performing military training duties, standing ready for combat, engaging in combat, serving combat operations, preventing and mitigating the consequences of natural disasters, enemy threats, and other significant incidents shall receive their full salary and benefits as when working at state administrative agencies, public institutions, political-social organizations, and enterprises.
In cases where officers and soldiers of the Self-Defense Force must perform duties on holidays and festivals and work night shifts, Circular No. 10/LDTB-XH dated April 19, 1995 of the Ministry of Labor, Invalids, and Social Affairs guiding the implementation of certain provisions of Government Decree No. 197/CP dated December 31, 1994 on salaries shall apply.
c. Regarding uniforms:
Members of the People's Militia and Self-Defense Force who undertake rotating duty for continuous readiness for combat for six months or more will be provided with one set of clothing, one pair of canvas shoes, and one hard hat.
B. SICKNESS, ACCIDENTS, AND DEATH BENEFITS:
a. For the People's Militia:
1. When performing tasks as prescribed by the Ordinance on the People's Militia and Self-Defense Force dated January 9, 1996 and Decree No. 35/CP dated June 14, 1996, if members become ill or suffer accidental injuries confirmed by a health organization designated by the Ministry of Health, they will be entitled to a medical examination subsidy once a year, equivalent to 20% of the minimum monthly wage applicable to state administrative agencies as announced by the competent authority, and will also receive the value of days off during treatment, but not exceeding 15 days per year. Members who fall ill due to alcohol intoxication or drug use will not be eligible for illness benefits.
2. When performing tasks as prescribed by the Ordinance on the People's Militia and Self-Defense Force dated January 9, 1996 and Decree No. 35/CP dated June 14, 1996, if members suffer accidents under the following circumstances, they will be entitled to work injury benefits as stipulated in Section III, Chapter II of the Social Insurance Regulation issued together with Government Decree No. 12/CP dated January 26, 1995.
Accidents occurring during working hours, at the workplace, including overtime work required by mission needs.
Accidents occurring outside the workplace while performing tasks as requested by authorized militia self-defense force commanders.
Accidents occurring on the route between home and the workplace during the performance of tasks.
3. During the period of initial care, emergency treatment, and stable treatment of injuries caused by accidents (including recurrence), militia members will be provided with medical expenses and also the value of days off as stipulated in Point 4, Clause A, Part I of this Circular.
4. The procedure and documentation for work injury benefits are handled by the Military Command of the district or town managing the militia officers and soldiers, reported to the Provincial Military Command for submission to the Provincial People's Committee for consideration and issuance of a decision. The documentation includes: + Accident investigation report
Medical assessment report on work capacity by the provincial medical assessment board.
Assessment report by the Military Command of the district, city district, or town.
Request letter from the Provincial Military Command.
5. The People's Committee of the commune, ward, or town will pay work injury benefits (one-time or monthly) according to the decision and budget allocation of the Provincial People's Committee.
6. Militia members who die as a result of work-related accidents as stipulated in Point 2, Clause B, Part I of this Circular will also be entitled to death benefits as stipulated in Section III, Chapter II of the Social Insurance Regulation issued together with Government Decree No. 12/CP dated January 26, 1995.
7. Militia members who die from illness while performing tasks as prescribed by the Ordinance on the People's Militia and Self-Defense Force dated January 9, 1996 and Decree No. 35/CP dated June 14, 1996 will have their families supported with funeral expenses equivalent to three months' minimum wage.
8. The procedure and documentation for death benefits are handled by the Military Command of the district, city district, or town managing the militia officers and soldiers, reported to the Provincial Military Command for submission to the Provincial People's Committee for consideration and issuance of a decision. The documentation includes:
Record of labor accident investigation (or death due to illness)
Death certificate
Family circumstances declaration form
Report of the Military Command Board of the district, town, city
Request letter from the Provincial Military Command.
9. The People's Committee of commune, ward, town shall pay the pension to the survivors according to the decision and budget level of the People's Committee of province, city.
b. For the Self-Defense Force:
Self-defense cadres and soldiers during their duty period in accordance with the Ordinance on Militia and Self-Defense Forces and Decree 35/CP dated June 14, 1996 shall enjoy social insurance and health insurance benefits as if they were working at their agencies or units.
C. POLICY OF PRIVILEGES:
1. Militia and Self-Defense Forces members who meet the conditions stipulated in the Ordinance on Preferential Treatment for Revolutionary Activists, Martyrs and Their Families, War Invalids, Veterans, and Those Who Contributed to the Revolution dated August 29, 1994 and Decree 28/CP dated April 29, 1995 shall be entitled to preferential treatment as prescribed in the Ordinance and Decree.
2. Procedures and documents for implementing preferential policies for Militia and Self-Defense Forces members shall be carried out in accordance with Circular No. 22/LDTB-XH-TT dated August 29, 1995 issued by the Ministry of Labor, Invalids and Social Affairs and current regulations. Localities and units managing militia and self-defense forces have the responsibility to coordinate with the Labor - Invalids and Social Affairs authorities at the same level to implement uniformly.
Commendation and awarding of organizations and individuals with achievements in activities and organization of building militia and self-defense forces shall be conducted according to the guidelines set forth in Directive No. 174/TĐKT-TCCT dated July 28, 1993 issued by the State Competition and Reward Institute - General Political Department and the provisions in Section IV of Decision No. 320/QĐ-CT dated October 7, 1992 issued by the General Political Department - Ministry of Defense. Awards include commendation, certificates of merit, medals, orders, and flags (for groups). The Chairman of the People's Committee and military agencies may award or propose higher-level awards promptly and accurately based on their authority.
PART II:
SOURCES OF FUNDS TO ENSURE IMPLEMENTATION
A. EXPENSES FOR THE RANKED MILITIA ARE AS FOLLOWS
a. Provincial and municipal budgets allocate:
1. Allowance for the families of village, ward, town military commanders when attending provincial military training school as stipulated in Article 10 of Decree 35/CP dated June 14, 1996.
2. Preferential policies and benefits for militia as stipulated in Clause 2, Article 11 of Decree 35/CP dated June 14, 1996 and detailed in Point C, Section I of this Circular.
3. Work injury allowance; medical expenses and work day value allowance during first aid, emergency care, and stable treatment of injuries caused by accidents (including recurrence); survivor benefits for Militia and Self-Defense Forces members as stipulated in Clause 2, Article 11 of Decree 35/CP dated June 14, 1996 and detailed in Points 2 to 9, Section B, Section I of this Circular.
4. Ensuring weapons supply, political education, military training, and administrative expenses for Militia and Self-Defense Forces annually.
b. Village, ward, town budgets allocate:
1. Monthly living expenses including a 5% seniority allowance (if applicable) and one-time allowance for full-time and part-time deputy commanders of village, ward, town military commands as stipulated in Article 10 of Decree 35/CP dated June 14, 1996 and detailed in Points 1, 2, 3, Section A, Section I of this Circular.
2. Work day value allowance when performing duties and military training as stipulated in Clause 1, Article 11 of Decree 35/CP dated June 14, 1996 and detailed in Point 4, Section A, Section I of this Circular.
3. Illness allowance when performing duties and military training as stipulated in Clause 2, Article 11 of Decree 35/CP dated June 14, 1996 and detailed in Point 1, Section B, Section I of this Circular.
4. Ensuring activities related to registration, management, selection, and meetings of Militia annually.
B - EXPENSES FOR SELF-DEFENSE FORCES:
1. AT Administrative and public service units, political-social organizations under local government levels shall be guaranteed from local government budgets based on approved annual expenditure plans.
2. AT Administrative and public service units, political-social organizations under Ministries, Departments, and Central Agencies shall be guaranteed from the Central Budget within the total annual state budget allocation to Ministries, Departments, and Central Agencies.
3. AT Enterprises of all economic sectors shall include these expenses in their production management costs.
C. OTHER EXPENSES GUARANTEED:
Uniform clothing as stated in Part c, Section A, Section I of this Circular; work day value allowance and illness allowance for Militia and Self-Defense Forces members when performing duties other than military training (standing guard, serving combat, fighting, disaster prevention and mitigation...) shall be guaranteed by the budget of the level issuing the mobilization decision (including Ministries and Departments mobilizing).
Annually, the Military Command Boards of villages, wards, towns, administrative and public service units, political-social organizations, and enterprises shall base their expense estimates on their training, standing guard, serving combat, and fighting tasks, consolidate them into their unit's budget estimate, and report for approval according to current regulations and the guidelines in Section II of this Circular.
PART III:
IMPLEMENTATION
This Circular takes effect from June 14, 1996, and revokes previous guidelines that conflict with it.
During implementation, if there are difficulties, please promptly reflect them to the Ministry of National Defense for consideration and resolution./.
