DECISION

Regarding permission for Vietnamese and foreign sea and river vessels to enter and exit the Caltex wharfof Caltex Vietnam Limited Company

THE MINISTER OF TRANSPORTATION

Pursuant to Decree No. 22/CP dated March 22, 1994 of the Government stipulating the tasks, powers, responsibilities for state management and organizational structure of the Ministry of Transport;

Based on the files and inspection results of competent state management agencies regarding the dedicated Caltex wharf of Caltex Vietnam Limited Company;

Considering the proposal of the Director of the Legal Transportation Department;

 

DECISION:

Article 1:

Permit Vietnamese and foreign sea and river vessels carrying liquid asphalt with a draft not exceeding 5 meters and a deadweight tonnage not exceeding 4000 DWT to enter, exit, and load/unload at the dedicated Caltex wharf of Caltex Vietnam Limited Company located on the Giá River in Tam Hưng Commune, Thủy Nguyên District, Haiphong City.

Article 2:

Depending on specific tidal water levels on the Bach Dang and Giá Rivers, the Port Authority shall consider and decide on the permission for sea and river vessels specified in Article 1 of this Decision to enter, exit, and load/unload at the Caltex wharf.

Article 3:

The Vietnam Maritime Administration and the Vietnam Inland Waterways Administration shall direct the Haiphong Port Authority and the Inland Waterways Port Authority Region I to closely cooperate and facilitate the entry and exit of vessels to the dedicated Caltex wharf in accordance with the law.

Article 4:

1. Within the waters under its jurisdiction, the agency responsible for state management of sea and river vessels entering and exiting the dedicated Caltex wharf may collect the following fees:

Tonnage fee, Procedure fee

Channel fee or maritime safety guarantee fee

Other types of fees as prescribed by law.

2. Caltex Vietnam Limited Company shall be responsible for investing in equipment and facilities; maintaining and repairing the wharf; dredging the water area in front of the wharf and participating in dredging the channel leading to the wharf; maintaining signals; ensuring fire prevention and environmental safety of the wharf in accordance with the law and may collect the following charges and fees:

Wharf fee

Other types of freight charges if the Company directly provides services.

Article 5:

This Decision takes effect fifteen days from the date of signature.

Any previous regulations contrary to this Decision are hereby abolished.

Article 6

The Heads of the Ministry's Office, the Director of the Legal Department, the Directors of the Vietnam Inland Waterways Administration, the Vietnam Maritime Administration, Caltex Vietnam Limited Company, and the Heads of other relevant agencies and organizations are responsible for implementing this Decision./.
