DECREE
Regulations on functions, tasks, powers, and organizational structure
of the Ho Chi Minh National Academy of Politics
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decision No. 224-QĐ/TW dated January 6, 2014 of the Politburo on the functions, tasks, organizational structure of the Ho Chi Minh National Academy of Politics;
At the proposal of the Director of the Ho Chi Minh National Academy of Politics and Public Administration;
The Government promulgates this Decree stipulating the functions, tasks, powers, and organizational structure of the Ho Chi Minh National Academy of Politics.
Article 1. Position and Functions
1. The Ho Chi Minh National Academy of Politics is a subordinate agency under the Central Committee of the Communist Party of Vietnam and the Government; it operates under the direct leadership and guidance of the Politburo and the Secretariat.
2. The Ho Chi Minh National Academy of Politics is the national center for training and enhancing cadres at intermediate and senior levels, political science researchers within the political system; the national center for researching Marxist-Leninist theory, President Ho Chi Minh's thought, the Party's guidelines, state policies and laws, political sciences, leadership and management sciences.
3. The Ho Chi Minh National Academy of Politics uses a seal with the National Emblem, and is a first-level financial unit.
4. The Ho Chi Minh National Academy of Politics has the international trade name in English as: Ho Chi Minh National Academy of Politics (abbreviated as HCMA).
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Ho Chi Minh National Academy of Politics (hereinafter referred to as the Academy) shall perform the following tasks and powers:
1. Regarding training and enhancing cadres of the Party, State, and political-social organizations:
a) Training and enhancing cadres at intermediate and senior levels within the political system, key leaders of public service units and state-owned enterprises on: Marxism-Leninism, President Ho Chi Minh's thought; the Party's viewpoints, guidelines, and policies, the State's policies and laws; new theoretical and practical issues both domestically and internationally; political sciences; leadership and management sciences;
b) Providing advanced political theory training for incumbent and planned cadre leaders and managers;
c) Enhancing and updating knowledge for cadre leaders and managers in various agencies and organizations within the political system according to assigned and delegated authority;
d) Training and enhancing lecturers, researchers, and other subjects in various fields of political sciences, leadership and management sciences, and some social sciences;
đ) Training and enhancing specialists in journalism and communication, propaganda, organization, inspection, mass mobilization, office work, religion, and foreign affairs within the political system.
2. Regarding scientific research:
a) Researching Marxist-Leninist theory, President Ho Chi Minh's thought, the Party's guidelines and policies, the State's policies and laws; researching political sciences, leadership and management sciences, some social sciences; summarizing practical experiences, developing theories about socialism and the path towards socialism in Vietnam;
b) Researching and compiling the history of the Communist Party of Vietnam and the world revolutionary movement;
c) Researching, building, supplementing programs, contents, organizing the compilation and revision of textbooks and study materials for the Academy's training and enhancement programs;
3. Advising, proposing, and providing theoretical and practical foundations for the Party and State in formulating guidelines for national construction and development, reforming the organizational structure and activities of the political system.
4. Leading and coordinating with relevant agencies in building, guiding, and uniformly managing the implementation of training and enhancement programs and contents; teaching methods and learning methods; scientific research; management regulations for training; training and enhancing lecturers of provincial and centrally-administered city political schools.
5. Leading and coordinating in guiding the research, compilation, and participating in the review of local Party histories, central ministries, sectors, and mass organizations; materials on the life and revolutionary career of President Ho Chi Minh and Party and State leaders.
6. International cooperation in training and enhancing cadres and conducting scientific research with educational and scientific institutions of other countries, communist parties and workers' parties, left-wing and progressive forces, political parties and ruling parties around the world.
7. Managing organizational structures, staffing, and cadres, civil servants, and public officials; implementing systems, policies, training, enhancement, commendation, rewards, and disciplinary measures for cadres, civil servants, and public officials of the Academy according to assigned and delegated authority.
8. Managing finance and assets; deciding and being responsible for investment projects within its jurisdiction as prescribed.
9. Publishing and distributing journals, newsletters, scientific publications, and study materials serving the Academy's cadre training, enhancement, and scientific research activities according to the Party and State's regulations.
10. Performing certain tasks and powers assigned by the Politburo, the Secretariat, and the Government:
a) Undergraduate and postgraduate education within the Academy's training domain;
b) Managing and issuing certificates within the Academy's training and enhancement domain according to the Party and State's regulations;
c) Performing other tasks assigned by the Politburo, the Secretariat, and the Government.

In this Article, units from Clause 1 to Clause 10 are advisory units assisting the Director of the Academy, which shall establish departments; units from Clause 11 to Clause 34 are public service units.
The National Academy of Politics under Ho Chi Minh coordinates with the Central Organization Commission and other competent agencies to submit to the Politburo, the Secretariat, and the Government for decisions on restructuring the Academy's organizational structure.
Article 4. Leadership of the Academy
1. The National Academy of Politics under Ho Chi Minh has a Director and not more than four Deputy Directors. The Academy’s Board of Directors operates under a chief executive system. The Director of the Academy is the head, organizing and managing the Academy's activities, appointed by the Politburo and responsible before the Politburo, the Secretariat, the Government, the Prime Minister, and the law for all Academy activities.
2. Deputy Directors of the Academy are appointed by the Central Party Secretariat upon the recommendation of the Academy Director and are responsible to the Academy Director for their assigned tasks.
3. The Academy Director issues regulations governing Academy operations; defines functions, responsibilities, authorities, organizational structures, and working rules for subordinate units; decides on appointments, dismissals, removals, transfers, rewards, punishments, and other systems and policies for unit heads and deputy heads as stipulated by the Party and State.
Article 5. Effectiveness and responsibility for implementation
1. This Decree takes effect from July 10, 2014.
2. This Decree replaces Decree No. 129/2008/NĐ-CP dated December 17, 2008 of the Government on the functions, responsibilities, authorities, and organizational structure of the National Academy of Public Administration under Ho Chi Minh.
3. The Director of the National Academy of Politics under Ho Chi Minh, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees are responsible for implementing this Decree./.
