CIRCULAR

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to the Vocational Training Law dated November 29, 2006;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Personnel Organization Department and the Director General of the Vietnam Highway Administration,

1. Amend and supplement Article 29 as follows: "Article 29. Validity period of the driver's license

Article 1. 1. Driver's licenses for categories A1, A2, and A3 have no expiration date.

2. Driver's licenses for category B1 are valid until the age of 55 for females and 60 for males; if the applicant is over 45 years old for females and over 50 years old for males, the driver's license will be valid for 10 years from the date of issuance.

3. Driver's licenses for categories A4 and B2 are valid for 10 years from the date of issuance.
4. Driver's licenses for categories C, D, E, FB2, FC, FD, and FE are valid for 5 years from the date of issuance."
2. Amend and supplement Clause 5 of Article 49 as follows:
"5. Foreign individuals or Vietnamese individuals residing abroad who wish to drive in Vietnam shall proceed as follows:

a) If they hold a national driver's license, they must apply to exchange it for a corresponding Vietnamese driver's license;

b) If they hold an international driver's license issued by an authorized agency of a country that has joined the 1968 Road Traffic Convention and it is still valid, they may drive the type of vehicle specified on the license without exchanging it for a Vietnamese driver's license; the content of the international driver's license is regulated in Appendix 32 of this Circular;
c) In cases where an international agreement on driver's licenses to which Vietnam is a party provides otherwise, the provisions of that international agreement shall apply."
3. Amend Clause 2 and Clause 3 of Article 50 as follows:

"2. Conduct verification

a) Verification of the driver's license must be conducted immediately via telephone, email, or fax, followed by a written confirmation;
b) Upon receiving the results of the driver's license verification, the authority receiving the application must update the information about the driver's license into the unified national database for managing driver's licenses. In case of discovering an invalid driver's license that has been issued, the issuing authority must take the following actions: issue a decision to revoke the license; cooperate with the General Department of Vietnam Roads to handle and update the violation on the unified national database for managing driver's licenses; announce on the website of the Department of Transport and the management website for driver's licenses to not recognize the validity of the issued driver's license; handle the violation according to Clause 9 of Article 49 of this Circular.
3. Time limit for verification
a) Within five working days from the receipt of complete and valid documents, the authority receiving the application must send a written request to the General Department of Vietnam Roads or the Department of Transport to verify the issued driver's license;
b) Upon receiving the verification request, the General Department of Vietnam Roads or the Department of Transport must respond to the verification of the issued driver's license immediately."

4. Amend Clause 8 of Article 53 as follows:

"8. Time limit for exchanging driver's licenses
a) Not exceeding five working days from the receipt of complete and valid documents as prescribed;

b) When exchanging a driver's license, the issuing authority must cut the corner of the old driver's license (except for licenses issued by foreign countries)."

Article 2. Effectiveness

5. Supplement Appendix 32 to Circular No. 46/2012/TT-BGTVT as stipulated in the attached Appendix of this Circular.

Article 3. Implementation

This Circular takes effect from December 1, 2014.
