CIRCULAR

REGULATIONS ON THE DETAIL AND GUIDANCE FOR GRANTING LICENSES FOR OPERATING PRINTED PAPERS AND ELECTRONIC NEWSPAPERS, ADDITIONAL PUBLICATION OF IMPRINTS, OPENING SPECIAL SECTIONS OF ELECTRONIC NEWSPAPERS, PUBLISHING SUPPLEMENTS, PUBLISHING NEWSLETTERS, AND PUBLISHING SPECIAL ISSUES

 

 

On the basis of Law onJune 2024;Press dated April 5, 2016;

Based on Decree No. 132/2013/ND-CP dated October 16, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

At the proposal of the Director of the Press Bureau;June 2024;The Minister of Information and Communications promulgates this Circular detailing and guiding the issuance of licenses for operating printed papers and electronic newspapers, additional publication of imprints, opening special sections of electronic newspapers, publishing supplements, publishing newsletters, and publishing special issues.

This Circular details and guides the issuance of licenses for operating printed papers and electronic newspapers, additional publication of imprints, opening special sections of electronic newspapers, publishing supplements, publishing newsletters, and publishing special issues as prescribed in Articles 18, 20, 31, 34, and 35 of the Law on Press.

 

PART I

GENERAL PROVISIONS

 

Article 1. Scope of Regulation

Article 2. Subjects Requesting License Issuance

1. Subjects establishing press agencies as stipulated in Article 14 of the Law on Press that meet the conditions prescribed in Article 17 of the Law on Press may request issuance of licenses for operating printed papers and electronic newspapers, additional publication of imprints, and opening special sections of electronic newspapers, and publishing supplements.

2. Agencies and organizations specified in Clause 3 of Article 34 of the Law on Press may request issuance of licenses for publishing newsletters.

3. Agencies and organizations specified in Clause 2 of Article 35 and Clause 1 of Article 56 of the Law on Press may request issuance of licenses for publishing special issues.

Article 3. Licensing Authority

1. The Minister of Information and Communications shall issue licenses for operating printed papers and electronic newspapers; issue licenses for additional publication of imprints in accordance with the provisions of the law and this Circular.

2. The Director of the Press Bureau shall issue licenses for publishing supplements; issue licenses for special sections of electronic newspapers; issue licenses for publishing special issues; and issue licenses for publishing newsletters for central agencies, foreign representative offices, and foreign organizations in Vietnam in accordance with the provisions of the law and this Circular.

3. The Director of the Department of Information and Communications shall assist the People's Committee of the province to issue licenses for publishing newsletters for agencies and organizations in provinces and centrally-administered cities in accordance with the provisions of the law and this Circular.

Article 4. Acceptance and Examination of Applications

1. Within fifteen days from the date of receipt of the application, the licensing authority shall examine the validity of the application. In case the application is incomplete, the licensing authority shall notify the agency or organization submitting the application to supplement and complete the application.

2. The time for considering the issuance of a license shall be counted from the date the licensing authority receives a complete and valid application from the agency or organization requesting the license.

LICENSE ISSUANCE FOR OPERATING PRINTED PAPERS, ADDITIONAL PUBLICATION OF IMPRINTS, AND PUBLISHING SUPPLEMENTS

 

Chapter II

Article 5. Application Documents and Procedures for Issuing Licenses for Operating Printed Papers

 

1. Agencies and organizations requesting issuance of a license for operating printed papers (including printed newspapers and magazines) shall submit directly or through postal services one set of application documents to the Ministry of Information and Communications. The application documents include:

a) An application form for issuing a license for operating printed papers (Form No. 01);

b) A project on operating printed papers confirmed by the agency or organization, including the following contents:

- The necessity and legal basis;

- A statement of compliance with all conditions prescribed in Article 17 of the Law on Press and accompanying documents;

- The structure and main contents of the imprint.

c) A list of proposed personnel for the printed paper (Form No. 02);

d) A resume of the proposed chief editor (Form No. 03);

đ) A sample presentation of the name of the printed paper imprint confirmed by the agency or organization requesting issuance of a license for operating printed papers.

2. Within ninety days from the date of receiving a complete and valid application, the Ministry of Information and Communications shall issue a license for operating printed papers (Form No. 09); in case of refusal, it must notify in writing and specify the reasons.

2. Within ninety days from the date of receiving complete and valid documents, the Ministry of Information and Communications shall issue the newspaper operation license (Form No. 09); in case of refusal to issue, it must notify in writing and specify the reasons.

Article 6. Amendment of Content Recorded in the Print Newspaper Operation Permit

1. Press agencies that amend the content recorded in the print newspaper operation permit as prescribed in Clause 1, Article 20 of the Press Law shall send a notification letter to the Press Agency Administration and the Provincial Department of Information and Communications (for press agencies located in provinces and centrally-administered cities) no later than five days from the date of change.

2. When amending the contents as prescribed in Clause 2, Article 20 of the Press Law, the press agency’s management body must directly submit or send through the postal system one set of documents requesting the Ministry of Information and Communications to amend and supplement the permit. The documents include:

a) A request letter from the press agency’s management body;

b) A report on the implementation of the objectives and purposes according to the permit (in cases of changing the objectives and purposes);

c) A sample presentation of the press agency's name with confirmation from the press agency’s management body (in cases of changing the press agency's name).

Within thirty days from the date of receiving complete valid documents, the Ministry of Information and Communications shall be responsible for examining and resolving the permit issuance matter (Form No. 10); in case of refusal, the Ministry of Information and Communications must notify in writing and specify the reasons.

3. When amending the contents as prescribed in Clause 3, Article 20 of the Press Law, the press agency’s management body sends a letter accompanied by a sample presentation of the proposed changed publication name with confirmation from the press agency’s management body (in cases where the press agency wishes to change the format or position of the publication name), requesting the Ministry of Information and Communications to approve the change.

Within thirty days from the date of receiving complete valid documents, the Ministry of Information and Communications shall be responsible for examining and resolving the press agency’s management body's change request; in case of non-approval, it must notify in writing and specify the reasons.

Article 7. Documents and Procedures for Issuing and Amending Contents of Additional Publication Permits for Newspapers

1. Press agencies meeting the conditions stipulated in Article 30 of the Press Law that wish to publish additional newspaper publications, the press agency’s management body shall directly submit or send through the postal system one set of documents to the Ministry of Information and Communications. The documents include:

a) A request letter from the press agency’s management body;

b) An application form for issuing an additional publication permit for newspapers (Form No. 04);

c) A publication plan for the additional newspaper publication with confirmation from the press agency’s management body, including the following contents:

- A statement of compliance with all conditions prescribed in Article 17 of the Law on Press and accompanying documents;

- Presentation of compliance with all conditions stipulated in Article 30 of the Press Law and accompanying documents;

- Structure and main contents of the publication;

d) A sample presentation of the publication name with confirmation from the press agency’s management body.

2. Within thirty days from the date of receiving complete valid documents, the Ministry of Information and Communications shall be responsible for issuing the publication permit for the newspaper publication (Form No. 11). In case of refusal, the Ministry of Information and Communications must notify in writing and specify the reasons.

3. Amendments to the contents recorded in the publication permit for newspaper publications shall be carried out in accordance with the provisions of Clauses 2 and 3 of Article 6 of this Circular.

Article 8. Documents and Procedures for Issuing and Amending Contents of Supplementary Publication Permits

1. Press agencies meeting the conditions stipulated in Article 30 of the Press Law that wish to publish supplementary publications, the press agency’s management body shall directly submit or send through the postal system one set of documents to the Press Agency Administration. The documents include:

a) A request letter from the press agency’s management body;

b) An application form for issuing a supplementary publication permit (Form No. 04);

c) A publication plan for the supplementary publication with confirmation from the press agency’s management body, including the following contents:

- A statement of compliance with all conditions prescribed in Article 17 of the Law on Press and accompanying documents;

- Presentation of compliance with all conditions stipulated in Article 30 of the Press Law and accompanying documents;

- Structure and main contents of the supplementary publication;

d) A sample presentation of the supplementary publication name with confirmation from the press agency’s management body.

2. Within thirty days from the date of receiving complete valid documents, the Press Agency Administration shall be responsible for issuing the supplementary publication permit (Form No. 12); in case of refusal, the Press Agency Administration must notify in writing and specify the reasons.

3. Amendments to the contents recorded in the supplementary publication permit shall be carried out in accordance with the provisions of Clauses 2 and 3 of Article 6 of this Circular.

 

Chapter III

ISSUE OF PERMITS FOR ELECTRONIC NEWSPAPER OPERATIONS AND OPENING OF SPECIAL SECTIONS ON ELECTRONIC NEWSPAPERS

 

Article 9. Documents and Procedures for Issuing Electronic Newspaper Operation Permit

1. The agency or organization requesting the issuance of an electronic newspaper operation permit (including electronic newspapers and electronic magazines) shall directly submit or send through postal services one set of documents to the Ministry of Information and Communications. The documents include:

a) Application form for issuing an electronic newspaper operation permit (Form No. 05);

b) Project on the operation of the electronic newspaper with confirmation from the agency or organization, including the following contents:

- A statement of compliance with all conditions prescribed in Article 17 of the Law on Press and accompanying documents;

- The structure and main contents of the imprint.

- Structure and main content of specialized pages and sections of the electronic newspaper; sections of specialized pages of the electronic newspaper;

- Implementation organization, publication process, and content management.

c) List of proposed personnel for the electronic newspaper (Form No. 02).

đ) A sample presentation of the name of the printed paper imprint confirmed by the agency or organization requesting issuance of a license for operating printed papers.

d) Colored printout of the homepage interface of the electronic newspaper with confirmation from the agency or organization requesting the permit. The homepage of the electronic newspaper must display the following information: name of the electronic newspaper; name of the press supervising agency; domain name; license number, date of issue, issuing agency; main office address; phone number, fax, email; full name of the chief editor;

e) Document proving ownership of the domain name with at least six months remaining usage period from the date of application for the permit.

2. Within ninety days from the date of receiving complete and valid documents, the Ministry of Information and Communications shall issue an electronic newspaper operation permit (Form No. 13); in case of refusal, it must notify in writing and specify the reasons.

Article 10. Changes to Content Recorded in the Electronic Newspaper Operation Permit

1. Press agencies changing the content recorded in the electronic newspaper operation permit according to Clause 1, Article 20 of the Press Law must send a notification letter to the Press Bureau and the Provincial Department of Information and Communications (for press agencies in provinces and centrally-administered cities) no later than five days from the date of change.

2. When amending the contents as prescribed in Clause 2, Article 20 of the Press Law, the press agency’s management body must directly submit or send through the postal system one set of documents requesting the Ministry of Information and Communications to amend and supplement the permit. The documents include:

a) A request letter from the press agency’s management body;

b) A report on the implementation of the objectives and purposes according to the permit (in cases of changing the objectives and purposes);

c) A sample presentation of the press agency's name with confirmation from the press agency’s management body (in cases of changing the press agency's name).

d) Document proving ownership of the domain name with at least six months remaining usage period from the date of application for the permit (in cases of changing the domain name).

Within thirty days from the date of receiving complete and valid documents, the Ministry of Information and Communications shall be responsible for examining and resolving the permit issuance (Form No. 14); in case of refusal, the Ministry of Information and Communications must notify in writing and specify the reasons.

3. When changing the contents as stipulated in Clause 3, Article 20 of the Press Law, the press supervising agency shall send a letter accompanied by a form stating the name of the press agency, the name of the specialized page to be changed, confirmed by the press supervising agency (in cases where the press agency wants to change the presentation format or position of the press agency's name, or the specialized page's name), requesting the Ministry of Information and Communications to approve the change.

Within thirty days from the date of receiving complete valid documents, the Ministry of Information and Communications shall be responsible for examining and resolving the press agency’s management body's change request; in case of non-approval, it must notify in writing and specify the reasons.

Article 11. Documents and Procedures for Issuing Permits and Changing Contents of Specialized Pages of Electronic Newspapers

1. Press agencies meeting the conditions stipulated in Article 30 of the Press Law that wish to open specialized pages of electronic newspapers shall directly submit or send through postal services one set of documents to the Press Bureau. The documents include:

a) A request letter from the press agency’s management body;

b) Application form for issuing a permit to open a specialized page of an electronic newspaper (Form No. 06);

c) Project on building a specialized page of an electronic newspaper with confirmation from the press supervising agency, including the following contents:

- A statement of compliance with all conditions prescribed in Article 17 of the Law on Press and accompanying documents;

- Presentation of compliance with all conditions stipulated in Article 30 of the Press Law and accompanying documents;

- Name and domain name of the specialized page (sub-domain of the main domain);

- Structure and main content of sections;

d) Colored printout of the homepage interface of the specialized page with confirmation from the press agency.

2. Within thirty days from the date of receiving complete and valid documents, the Press Bureau shall be responsible for issuing a permit to open a specialized page of an electronic newspaper (Form No. 15). In case of refusal, the Press Bureau must notify in writing and specify the reasons.

3. Changes to the contents recorded in the permit to open a specialized page of an electronic newspaper shall be carried out according to the provisions of Clause 2 and Clause 3, Article 6 of this Circular.

 

Chapter IV

PUBLISHING NEWSLETTERS, SPECIAL EDITIONS

 

Article 12. Documents and procedures for issuing a publication permit for newsletters

1. When there is a need to publish a newsletter, agencies and organizations as stipulated in Clause 3, Article 34 of the Press Law shall directly submit or send through the postal system one set of documents to the Press Department (for central agencies and organizations; foreign representative agencies and organizations in Vietnam) or the People's Committee of the province (for agencies and organizations in provinces and centrally-administered cities). The documents include:

a) Application form for issuance of a publication permit for newsletters (Form No. 07);

b) Certified copy or copy with original for verification of the decision on establishment, license for establishment, business registration certificate, or other legal equivalent documents (for foreign organizations in Vietnam);

c) Curriculum vitae of the person responsible for publishing the newsletter;

d) Sample presentation of the newsletter title and certified Vietnamese translation (for newsletter titles expressed in a foreign language).

2. Within thirty days from the date of receipt of complete and valid documents, the Press Department and the People's Committee of the province shall be responsible for issuing a publication permit for newsletters (Form Nos. 16 and 17); in case of refusal, they must notify in writing and specify the reasons.

Article 13. Changes to the contents recorded in the publication permit for newsletters

1. Agencies and organizations wishing to change any of the contents recorded in the publication permit for newsletters must submit a written request to the Press Department and the People's Committee of the province for permission to make changes. The documents include:

a) Written request for change from the agency or organization;

b) Curriculum vitae of the person responsible for publishing the newsletter (in cases where the person responsible for publishing the newsletter is changed);

c) Sample presentation of the newsletter title and certified Vietnamese translation (in cases where the newsletter title expressed in a foreign language is changed).

Within fifteen days from the date of receipt of complete and valid documents, the Press Department and the People's Committee of the province shall be responsible for examining and resolving the changes requested by the agency or organization; in case of non-approval, they must notify in writing and specify the reasons.

Article 14. Documents and procedures for issuing a publication permit for special issues

1. Agencies and organizations wishing to publish special issues shall directly submit or send through the postal system one set of documents to the Press Department. The documents include:

a) Application form for issuance of a publication permit for special issues (Form No. 08);

b) Certified copy or copy with original for verification of the decision on establishment, license for establishment, business registration certificate, or other legal equivalent documents (for foreign organizations in Vietnam);

c) Curriculum vitae of the person responsible for publishing the special issue;

d) Sample presentation of the special issue title and certified Vietnamese translation (for special issue titles expressed in a foreign language).

2. Within thirty days from the date of receipt of complete and valid documents, the Press Department shall be responsible for issuing a publication permit for special issues (Form No. 18); in case of refusal, it must notify in writing and specify the reasons.

Article 15. Changes to the contents recorded in the publication permit for special issues

1. Agencies and organizations wishing to change any of the contents recorded in the publication permit for special issues must submit a written request to the Press Department for permission to make changes. The documents include:

a) Written request for change from the agency or organization;

b) Curriculum vitae of the person responsible for publishing the special issue (in cases where the person responsible for publishing the special issue is changed);

c) Sample presentation of the special issue title and certified Vietnamese translation (in cases where the special issue title expressed in a foreign language is changed).

Within fifteen days from the date of receipt of complete and valid documents, the Press Department shall be responsible for examining and resolving the changes requested by the agency or organization; in case of non-approval, it must notify in writing and specify the reasons.

 

Chapter V

EFFECTIVE DATE OF IMPLEMENTATION

 

Article 16. Issuing forms

Issued together with this Circular are the following forms:

1. Form No. 01: Application for issuance of license to operate print newspapers.

2. Form No. 02: List of anticipated personnel for print newspapers/electronic newspapers.

3. Form No. 03: Curriculum vitae of the person anticipated to be the chief editor of print newspapers/electronic newspapers.

4. Form No. 04: Application for issuance of license to publish additional press publications/supplements.

5. Form No. 05: Application for issuance of license to operate electronic newspapers.

6. Form No. 06: Application for issuance of license to open special sections of electronic newspapers.

7. Form No. 07: Application for issuance of license to publish news bulletins.

8. Form No. 08: Application for issuance of license to publish special editions.

9. Form No. 09: License to operate print newspapers.

10. Form No. 10: License to amend and supplement provisions in the license to operate print newspapers/Publication license for press publications.

11. Form No. 11: Publication license for press publications.

12. Form No. 12: Publication license for supplements.

13. Form No. 13: License to operate electronic newspapers.

Article 17. Transitional Provisions

When the press agency's operation license expires according to the law, the press agency's management body shall proceed with the procedures to apply for licenses to operate print newspapers, operate electronic newspapers, publish press publications, publish supplements, and open special sections of electronic newspapers in accordance with this Circular.

Article 18. Effective Date

1. This Circular takes effect from February 15, 2017.

2. From the date this Circular takes effect, the following documents shall cease to be effective: Circular No. 16/2010/TT-BTTTT dated July 19, 2010 of the Ministry of Information and Communications detailing and guiding the issuance of licenses for operating print newspapers, publishing supplements, publishing supplements, and publishing special editions; Circular No. 33/2011/TT-BTTTT dated November 1, 2011 of the Ministry of Information and Communications detailing the issuance of licenses for operating electronic newspapers and licenses for special sections of electronic newspapers; Decision No. 53/2003/QĐ-BVHTT dated September 4, 2003 of the Minister of Culture, Sports and Tourism promulgating the Regulations on Publishing News Bulletins and Decision No. 3865/QĐ-BVHTT dated November 4, 2003 of the Minister of Culture, Sports and Tourism regarding the delegation of authority to issue and revoke licenses for publishing news bulletins; The provisions on publishing news bulletins detailed in Decision No. 28/2002/QĐ-BVHTT dated November 21, 2002 of the Minister of Culture, Sports and Tourism promulgating the Regulations on Publishing News Bulletins, Documents, Flyers; Distributing Press Releases; Broadcasting News Bulletins on Electronic Screens of Foreign Agencies and Organizations in Vietnam with Foreign Elements./.
