ON THE TRANSFER OF FOREIGN CURRENCY BY VIETNAMESE RESIDENTS ABROAD TO THE HOME COUNTRY
GOVERNOR OF THE STATE BANK OF VIETNAM
WHEREAS, the State Bank of Vietnam Law promulgated by Decree No. 37/HĐNN8 dated May 24, 1990 of the Chairman of the State Council;
WHEREAS, the Foreign Exchange Management Charter issued together with Decree No. 161/HĐBT dated October 18, 1988 of the Council of Ministers (now the Government);
At the proposal of the Director of the Department of Foreign Exchange Management;
DECISION:
Article 1. The State Bank encourages and creates all favorable conditions for overseas Vietnamese residents, Vietnamese workers, students, and those working abroad (hereinafter referred to as overseas Vietnamese) to transfer foreign currency back to their home country to assist family members or contribute to building their homeland.
Article 2. Overseas Vietnamese who transfer foreign currency back to the country may open foreign currency deposit accounts or make foreign currency savings deposits at permitted commercial banks in Vietnam according to current regulations, and may transfer capital and interest abroad.
Article 3. Vietnamese residing in the country who receive foreign currency from overseas Vietnamese may open foreign currency accounts or make foreign currency savings deposits at permitted commercial banks.
Foreign currency deposited in accounts or savings can be withdrawn in foreign currency cash or converted into Vietnamese Dong at the request of the depositor.
Article 4. This Decision takes effect from the date of issuance. The Director of the Office of the State Bank; the Head of the Department of Foreign Exchange Management; the Heads of relevant Departments and Bureaus of the State Bank; the General Directors of Commercial Banks, Investment and Development Banks; the Directors of State Bank Branches in provinces and centrally-administered cities are responsible for implementing this Decision.
