DECISION OF THE PRIME MINISTER
Regarding the reclassification of Xuân Sơn Nature Reserve
to Xuân Sơn National Park, Phú Thọ Province
PRIME MINISTER
Pursuant to the Law on Government Organization dated December 25, 2001,
Pursuant to the Law on Protection and Development of Forests dated August 12, 1991;
Considering the proposal of the Ministry of Agriculture and Rural Development (document number 844/BNN-KL dated April 1, 2002) and the proposal ofWithin 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the People's Committee of Phú Thọ Province (report number 624/TT-UB dated March 29, 2002),
DECISION:
Article 1. Approves the reclassification of Xuân Sơn Nature Reserve, located in Thanh Sơn District, Phú Thọ Province, to become a national park within the system of special-use forests in Vietnam.
The name of the national park is: Xuân Sơn National Park.
Article 2. Location, geographic coordinates, and area of Xuân Sơn National Park:
1. Geographic location:
The boundaries of Xuân Sơn National Park are defined as follows:
- East: Adjacent to Tân Phú, Minh Đài, and Long Cốc communes, Thanh Sơn District.
- West: Adjacent to Phù Yên District, Sơn La Province, and Đà Bắc District, Hòa Bình Province.
- South: Adjacent to Đà Bắc District, Hòa Bình Province.
- North: Adjacent to Thu Cúc Commune, Thanh Sơn District.
Geographic Coordinates:
- From 21°03' to 21°12' north latitude.
- From 104°51' to 105°01' east longitude.
3. Scale of area and functional zones:
Total area: 15,048 hectares
Including:
- Strictly protected zone: 11,148 hectares
- Ecological restoration and historical relic conservation zone: 3,000 hectares
- Administrative and service zone: 900 hectares
The buffer zone of Xuân Sơn National Park covers an area of 18,639 hectares, including Kiệt Sơn, Lai Đồng, Minh Đài communes, and parts of Đồng Sơn, Tân Sơn, Kim Thượng, and Xuân Đài communes.
Article 3. Objectives and tasks of Xuân Sơn National Park:
1. To conserve the forest ecosystem of oil tree species and evergreen mountainous forests on limestone.
2. To conserve biodiversity, genetic resources of flora and fauna between the Northeast and Northwest ecological regions of Vietnam, particularly rare and endangered plant and animal species, and endemic species.
3. To conserve the use and study of unique cave systems in Vietnam and their ecosystems and landscapes.
4. To contribute to training, scientific research, ecotourism development, maintaining environmental balance, sustainable land use and resource management, and improving local economic and social life.
Article 4. Assigns the People's Committee of Phú Thọ Province to directly manage Xuân Sơn National Park.
The Chairman of the People's Committee of Phú Thọ Province shall be responsible for:
- Directing the preparation, review, and approval of investment projects for the construction and development of Xuân Sơn National Park and its buffer zone according to current regulations.
- Directing the development of an ecotourism project within Xuân Sơn National Park in accordance with Decision No. 08/2001/QĐ-TTg dated January 11, 2001 of the Prime Minister on the management regulations for special-use forests, protective forests, and natural production forests, submitting it to the competent authority for approval and implementation.
Annually, within the provincial budget plan for Phú Thọ Province, the Ministry of Planning and Investment and the Ministry of Agriculture and Rural Development shall clearly specify the funding allocated to projects within Xuân Sơn National Park to ensure that implementation adheres to the approved project content and schedule.
Article 5. Regarding the organization and staffing of Xuân Sơn National Park:
Assigns the Chairman of the People's Committee of Phú Thọ Province to decide on the organization and staffing of Xuân Sơn National Park based on the provisions of the Management Regulations for Special-Use Forests, Protective Forests, and Natural Production Forests issued together with Decision No. 08/2001/QĐ-TTg dated January 11, 2001 of the Prime Minister and the consensus of the Ministry of Agriculture and Rural Development, the Government Organizational Cadre Department.
Article 6. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.
The Ministers, Heads of ministerial-level agencies, and government-affiliated agencies, and the Chairman of the People's Committee of Phú Thọ Province are responsible for implementing this Decision./.
