Article 1. Position and Functions

The Training and Capacity Building Department for State Officials is an organization under the Ministry of Home Affairs with the function of assisting the Minister in managing state affairs related to the training and capacity building of state officials and grassroots officials.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Drafting legal normative documents on the training and capacity building of state officials, grassroots officials, and other relevant subjects according to the division of labor assigned by the Minister.

2. Developing long-term, five-year, and annual plans for the training and capacity building (both domestically and internationally) of state officials, grassroots officials, and other relevant subjects according to the directives of the Minister; assisting the Minister in directing the implementation of these plans after they have been approved.

3. Cooperating with functional agencies under the Ministry of Planning and Investment and the Ministry of Finance to develop standards, indicators, and annual and long-term state budget plans allocated for the training and capacity building of state officials and grassroots officials. Directing, inspecting ministries, sectors, and localities in implementing the annual budget indicators for training and capacity building of officials assigned to them.

4. Assisting the Minister in uniformly managing:

a) Content, framework programs, methods, and forms of training and capacity building for state administrative officials, various positions of administrative officials at all levels, grassroots officials, and reserve officials;

b) Directing the compilation of training and capacity building textbooks for state administrative officials, various positions of administrative officials at all levels, grassroots officials, and reserve officials according to the framework program approved by the Minister;

c) Organizing the review and promulgation of textbooks stipulated in Point b Clause 4 to be uniformly implemented nationwide;

d) Training ethnic languages for officials working in ethnic regions.

5. Assisting the Minister in uniformly managing the capacity building of legal knowledge, state management, and administrative management for National Assembly delegates.

6. Taking the lead and coordinating with units under the Ministry and related agencies:

a) Drafting criteria for assessing the quality of training and capacity building of officials by training institutions of ministries, sectors, and localities, developing and standardizing types of certificates and diplomas on training and capacity building of state officials to be issued by the Minister for uniform management nationwide;

b) Drafting systems of standards for evaluating the quality of training and capacity building of officials by training institutions of ministries, sectors, and localities.

7. Submitting to the Minister for issuance of teacher standards and training plans for teachers at training institutions of state officials of ministries, sectors, and localities.

8. Assisting the Minister in inspecting the implementation of organizational training and capacity building for state administrative officials, various positions of administrative officials at all levels, grassroots officials, and reserve officials of the National Academy of Public Administration.

9. Monitoring, urging, and inspecting the implementation of regulations on sending state officials abroad for training and capacity building using state budgets and other sources of funding. Implementing programs, projects, initiatives... in the field of training and capacity building of officials abroad.

10. Leading or participating in scientific research, participating in vocational training on training and capacity building of civil servants in the organizational sector. Organizing domestic and international conferences and seminars in the field of assigned work according to the directives of the Minister.

11. Submitting pilot project proposals within the scope of responsibility to the Minister for approval and organizing their implementation after approval.

12. Conducting statistical work, compiling information databases on the training and capacity building of state administrative officials and grassroots officials, and cooperating with the Information Technology Center to apply information technology in managing, exploiting, and utilizing information databases to serve the directive management of the Ministry. Summarizing, concluding, and drawing lessons from the training and capacity building of state administrative officials and grassroots officials.

13. Guiding and inspecting the implementation of legal normative documents, planning, and policies on the training and capacity building of state officials by ministries, sectors, and localities; recommending to the Minister for handling violations related to the training and capacity building of state officials.

14. Leading or coordinating in resolving recommendations, complaints related to the training and capacity building of state officials according to the division of authority of the Ministry and legal provisions.

15. Performing other tasks assigned by the Minister.

Article 3. Organization and Working System

1. The Department has a Director, several Deputy Directors, and civil servants;

2. The Director shall be responsible to the Minister for organizing and implementing the tasks specified in Article 2 and shall have the following specific duties and powers:

a) Organizing and directing the implementation of the Department's tasks and being accountable to the Minister for all aspects of the Department's work;

b) Assigning tasks, supervising, urging, and inspecting the implementation of tasks by Deputy Directors and civil servants in the Department;

c) Signing on behalf of the Minister to respond, clarify, and guide professional matters and requests for information from organizations with functions and tasks in managing the training and capacity building of state officials or individuals regarding issues related to the training and capacity building of state officials.

d) Coordinate with organizations within the Ministry and relevant agencies in resolving issues related to the Department's functions, tasks, and powers;

đ) Implement information dissemination for civil servants in the Department according to the Ministry's working regulations;

e) Decide on the contents of reports, summaries, conclusions, and recommendations to the Minister regarding policies and solutions in implementing the Department's tasks;

f) Implement the Ministry's regulations; manage civil servants and assets allocated according to the Ministry's delegation;

3. The Deputy Department Head performs professional tasks and assists the Department Head in managing one or several aspects of work as assigned by the Department Head; is responsible to the Department Head for the assigned tasks.

4. Civil servants carry out specialized tasks assigned by the Director and are accountable to the Director for performing those tasks.

5. The Department operates under a specialist system combined with a chief executive system; in cases where the Ministry leadership directly works with the Deputy Director or specialists, the Deputy Director and specialists are responsible for implementing the leadership's opinions and promptly reporting back to the Director thereafter.

Article 4. Effectiveness and Responsibility for Implementation

1. This Decision takes effect fifteen days from the date of signing;

2. The Director of the Training and Capacity Building Department for State Officials, the Director of the Organization and Cadre Department, the Secretary-General of the Ministry, heads of related organizations under the Ministry, and public officials of these organizations are responsible for enforcing this decision.
