Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 36/CP dated April 24, 1997 of the Government promulgating the Regulations on industrial zones, export processing zones, and high-tech parks;

Upon consideration of the proposal of the Chairman of the People's Committee of Ha Tay Province at Document No. 625/TT-UB dated March 10, 2003, and the Minister of Home Affairs at Document No. 559/TTr-BNV dated March 21, 2003,

DECISION:

Article 1. The Industrial Zone Management Board of Ha Tay Province is established under the Ha Tay Provincial People's Committee to manage industrial zones within the administrative territory of Ha Tay Province.

The Industrial Zone Management Board of Ha Tay Province shall be responsible for performing tasks and exercising powers related to industrial zone management as stipulated in Article 27 of the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government.

The Industrial Zone Management Board of Ha Tay Province shall have legal personality, a bank account, and a seal bearing the national emblem. The staffing and operating budget of the Board shall be included in the state budget allocated to Ha Tay Province.

Article 2. The Head of the Industrial Zone Management Board of Ha Tay Province shall be appointed by the Prime Minister; several Deputy Heads and some Members shall be appointed by the Chairman of the Ha Tay Provincial People's Committee.

The organizational structure of the Industrial Zone Management Board of Ha Tay Province shall be as prescribed in Article 28 of Decree No. 36/CP dated April 24, 1997 of the Government.

Article 3. This Decision takes effect from the date of signature.

Article 4. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, the Chairman of the Ha Tay Provincial People's Committee, and the Head of the Industrial Zone Management Board of Ha Tay Province are responsible for implementing this Decision./.
