CIRCULAR

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade

Pursuant to the Law on Technical Standards and Regulations No. 68/2006/QH11 dated July 21, 2006;

WHEREAS, Law on Product Quality and Commodities No. 05/2007/QH12 dated November 21, 2007;

Based on Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;

Pursuant to Decree No. 107/2009/NĐ-CP dated November 26, 2009, promulgated by the Government on the business of liquefied petroleum gas;

Pursuant to Decree No. 42/2017/NĐ-CP of the Government dated April 5, 2017 amending and supplementing certain articles of Decree No. 59/2015/NĐ-CP of the Government dated June 18, 2015 on project management for construction investment;

Considering the proposal of the Director of the Department of Industrial Safety and Environmental Protection

The Minister of Industry and Trade issues this Circular on the Technical Regulation on safety for liquefied petroleum gas distribution stations.

Article 1. Attached hereto is the Technical Regulation on safety for liquefied petroleum gas distribution stations.

Designation: QCVN 10: 2012/MOT.

Article 2. Effectiveness

This Circular takes effect from February 14, 2013.

Article 3. Transitional Provisions

1. For liquefied petroleum gas distribution stations (LPG distribution stations) that were constructed and operated before the date this Circular takes effect, if they do not meet the requirements of the Technical Regulation on safety for liquefied petroleum gas distribution stations issued together with this Circular, they must apply enhanced safety measures as prescribed in Article 11 of Circular No. 41/2011/TT-BCT dated December 16, 2011 of the Ministry of Industry and Trade on management of safety in the liquefied petroleum gas sector.

2. Within one year from the date this Circular takes effect, owners of LPG distribution stations that do not comply with the provisions of the attached Technical Regulation must report to the People's Committee of the province or centrally governed city where the LPG distribution station is installed for consideration and decision.

Article 4. Provincial People's Committees, municipal people's committees under the central government, heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular./.
