CIRCULAR

Regulations on the import of tobacco leaves

pursuant to the tariff quota for 2015

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decree No. 187/2013/NĐ-CP dated November 20, 2013 of the Government detailing the implementation of the Law on Trade regarding international goods trading activities and related agency buying, selling, processing, and transiting goods with foreign countries;

At the proposal of the Director of the Import-Export Department,

The Minister of Industry and Trade issues this Circular to regulate the importation of tobacco leaves under the tariff quota for 2015.

Article 1. Quantity of quota duty imports in 2015

The quantity of tobacco leaves (HS Code 2401) imported under the tariff quota for 2015 is 46,305 tons.

ARTICLE 2. PRINCIPLES OF ADMINISTRATION

1. Principles of Allocating Import Quota Duties

The allocation of the tariff quota for importing tobacco leaves shall be carried out in accordance with Circular No. 04/2014/TT-BCT dated January 27, 2014 of the Ministry of Industry and Trade detailing certain provisions of Decree No. 187/2013/NĐ-CP dated November 20, 2013 of the Government detailing the implementation of the Law on Trade regarding international goods trading activities and related agency buying, selling, processing, and transiting goods with foreign countries.

2. Recipients of the allocation of the tariff quota for importing tobacco leaves

The tariff quota for importing tobacco leaves will be allocated to traders holding a production license for cigarettes issued by the Ministry of Industry and Trade and having a need to use a certain proportion of imported tobacco leaves for cigarette production, confirmed by the Ministry of Industry and Trade.

Article 3. Effectiveness

This Circular takes effect from January 1, 2015 until December 31, 2015./.
