Pursuant to the Law on Vocational Education dated November 27, 2014;
Article 1. Amending and supplementing some articles of Decree No. 134/2006/NĐ-CP dated November 14, 2006 of the Government on the recruitment system for higher education institutions, colleges, and intermediate-level vocational schools under the national education system as follows:
h"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation.""1. Recruitment without examination is the process of admitting students to universities, colleges, and intermediate-level vocational schools to train civil servants according to job requirements, positions, and staffing quotas; training public service employees according to job needs, positions, occupational standards, and salary funds of public institutions in areas with extremely difficult economic and social conditions and ethnic minorities who have not yet reached or have very few individuals with university, college, or intermediate-level vocational school qualifications."and amended and supplemented by certain articles related to conditions for investment and business and administrative procedures in the field of information and communications on November 7, 20182. Point a Clause 1 Article 5 is amended and supplemented as follows:"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation.""Vietnamese citizens residing continuously for five years or more up to the year of admission in areas with extremely difficult economic and social conditions and having three years of high school education at schools located in that locality (students from boarding schools for ethnic minorities, students from preparatory classes counted based on their household registration at the boarding school) may be recruited to universities, colleges, or intermediate-level vocational schools; or having four years of junior high school education in areas with extremely difficult economic and social conditions may be recruited to intermediate-level vocational schools; priority will be given to ethnic minority candidates. The proportion of Kinh people recruited shall not exceed 15% of the total quota assigned."
3. Amend Clause 3 Article 2 as follows:3. Point a, c Clause 1 Article 7 is amended and supplemented as follows:in "a) Each year when drafting the recruitment plan, the People's Committees of provinces and centrally governed cities (hereinafter referred to collectively as provincial People's Committees) report the results of employment placement for recruited students in the three consecutive years immediately preceding the planning year. Based on job requirements, positions, and staffing quotas for civil servant positions; based on job needs, positions, occupational standards, and salary funds of public institutions for public service employee positions; based on economic and social development orientations, the provincial People's Committee proposes recruitment quotas for undergraduate programs to the Ministry of Education and Training; recruitment quotas for college and intermediate-level vocational programs to the central State management agency for vocational education."
"1. The purpose of the national high school examination is to use the examination results for recognizing high school graduation; provide information to evaluate the quality of secondary education; provide data as a basis for university and vocational education admissions."
"c) The provincial People's Committee organizes the selection and ordering of training under the recruitment system with educational institutions; decides to send people to study according to the specified criteria and quotas; reports the results of recruitment at the undergraduate level to the Ministry of Education and Training, at the college and intermediate-level vocational levels to the central State management agency for vocational education, and the Ethnic Minorities Committee."
Annually, the provincial People's Committee establishes a Recruitment Board to assist the provincial People's Committee in implementing recruitment work. The Recruitment Board consists of: The Chairman of the Board is the Chairman or Vice-Chairman of the provincial People's Committee; the Deputy Chairman in charge of the Board is the Director of the Provincial Department of Home Affairs; the Vice-Chairman of the Board is the Head of the Provincial Ethnic Minority Department; other members include representatives from the leaders of the Provincial Department of Labor, Invalids and Social Affairs, the Provincial Department of Education and Training, the Provincial Department of Planning and Investment, the Provincial Department of Finance, and the Provincial United Front Organization."
4. Clause 2, 3 Article 11 is amended and supplemented as follows:
"2. The provincial People's Committee directs the receipt of applications and examination or forwarding of applications to relevant agencies and units for examination into job positions according to the provisions of the Civil Servants Law and the Public Service Employees Law for those who are sent to study under the recruitment system after graduation."
"3. The maximum time for students studying under the recruitment system to wait for notification of examination according to the provisions of Clause 2 of this Article is twelve months, starting from the date of graduation recognition. If they do not receive a notification of examination within the twelve-month period as stipulated in this Decree, students studying under the recruitment system are not required to compensate for scholarships and training costs."
5. Clause 3 Article 12 is amended and supplemented as follows:
"3. Individuals who have worked in the position designated by the provincial People's Committee after graduation for less than twice the duration of scholarship and training cost support."
6. Clause 1, 2 Article 15 is amended and supplemented as follows:
"1. The Ministry of Education and Training is responsible for directing training and implementing policies for students recruited at the undergraduate level."
"2. The central State management agency for vocational education is responsible for directing training and implementing policies for students recruited at the college and intermediate-level vocational levels."
7. Clause 1, 3, 4, 6 Article 16 is amended and supplemented as follows:
"1. Publicly announce the recruitment plan twelve months before the deadline for submitting recruitment application forms through mass media in the province, ensuring objectivity, fairness, and transparency. Propose quotas, organize selections, and send people to study; direct the examination into job positions according to regulations."
"3. Entrust the Provincial Department of Home Affairs to take the lead in coordinating with educational institutions to manage recruited students during the training period."
"4. Entrust the Provincial Department of Home Affairs to take the lead in receiving applications from recruited students and coordinate with related units to organize examinations or forward applications to relevant agencies and units for examination into job positions."
"2. The central state management agency for vocational education shall be responsible for directing training activities and implementing policies and benefits for candidates selected to study at the college and intermediate levels."
7. Clause 1, 3, 4, and 6 of Article 16 shall be amended and supplemented as follows:
"1. Publicly announce the plan for candidate selection at least twelve months prior to the deadline for submitting application forms for candidate selection through provincial mass media, ensuring objectivity, fairness, and transparency. Propose quotas, organize selection processes, and send candidates to study, direct the organization of recruitment into job positions in accordance with regulations."
"3. Entrust the Department of Home Affairs to take the lead in coordinating with educational institutions to manage candidates under the selection system during the training period."
"4. Entrust the Department of Home Affairs to take the lead in receiving applications from candidates under the selection system and coordinate with relevant units to organize recruitment or forward applications to agencies and units expected to use them for recruitment into job positions."
"6. Annually, report the results of implementing the recruitment system of the locality to the National Ethnic Committee, the Ministry of Education and Training, and the central state management agency for vocational education."

Article 2. Effective Date
This Decree takes effect from July 6, 2015.
Article 3. Responsibility for Implementation
1. The Ministry of Education and Training shall take the lead in coordinating with the central state management agency for vocational education, the National Ethnic Committee, the Ministry of Home Affairs, the Ministry of Planning and Investment, and the Ministry of Finance to guide the implementation of this Decree.
2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees directly under the Central Government, and related agencies, organizations, and individuals are responsible for enforcing this Decree./.
