ConditionsNo.The person must have been mobilized and managed centrally by the Administrative Committee or People's Committee at the commune level or higher, or by an authorized agency or unit, and assigned tasks to serve combat units or serve battlefields during the following periods and areas: tra) Civilian workers participating in the resistance war against France from September 1945 to July 20, 1954; participating in the resistance war against America from July 21, 1954 to April 30, 1975. The area of duty was throughout the country and in Laos and Cambodia.
Article 1. Scope of Regulation
b) Civilian workers participating in the border defense war in the Southwest from May 1975 to January 7, 1979, in the Northern border from February 1979 to December 1988, performing international duties in Laos from May 1975 to December 31, 1988, in Cambodia from January 1979 to August 31, 1989. The area of duty in the border defense war was border districts and districts adjacent to border districts requiring service and support for combat operations.
Article 2. Subjects and Conditions for Application
1. Recipients
Civilian workers who participated in the resistance against France, the United States, the war to protect the country, and international missions.
c) For some special areas, the participation period of civilian workers may be earlier or later than the above periods as specified by the Minister of Defense.
The subjects defined in Article 2 of this Decision shall not be eligible if they fall under any of the following circumstances:
1. Currently receiving retirement benefits, disability benefits, veteran benefits, monthly benefits for those affected by toxic chemicals during the resistance war, or working in state agencies or state-owned enterprises with compulsory social insurance contributions.
2. Deceased but without surviving spouse or children; biological father, biological mother; biological children, adopted children, or legally recognized dependents.
3. Serving a fixed-term prison sentence or life imprisonment; or convicted of crimes endangering national security.
Article 3. Subjects not subject to application
4. Illegally leaving the country, residing abroad illegally, or declared missing by a court; or evading duties, surrendering, betraying, or being recalled.
Article 4. Benefits and Policies Enjoyed
Subjects meeting the conditions stipulated in Article 2 of this Decision shall enjoy the following benefits and policies:
1. One-time Allowance
The amount of the one-time allowance is determined based on the actual time directly serving as civilian workers (if there are different periods of service or interruptions, the periods are accumulated), specifically as follows:
In case the subject has passed away, one of the following relatives of the deceased shall receive the one-time allowance at the corresponding unified rate: spouse; biological father, biological mother; biological children, adopted children, or legally recognized dependents.
2. Health Insurance Benefits
If not already enjoying health insurance benefits, they shall receive health insurance benefits similar to those provided to the subjects defined in Point d Clause 3 Article 12 of the Social Health Insurance Law (amended and supplemented in 2014).
3. Funeral Expenses Allowance
a) Less than one year, the allowance amount is 2,000,000 VND;
b) One year or more but less than two years, the allowance amount is 2,700,000 VND;
c) Two years or more, the allowance amount is 3,500,000 VND.
Upon death, the person handling the funeral shall receive a funeral expenses allowance according to the regulations of the law on social insurance.
Issuance of a "Certificate" of participation as a civilian worker.
3. Funeral allowance regime
Upon death, the person responsible for funeral arrangements shall be entitled to a funeral allowance at the level prescribed by laws on social insurance.
4. Recognition of time served in fireline civilian service
Shall be issued a "Certificate" of participation in fireline civilian service.
Article 5. Documents and procedures for resolving benefits
a) The documents of the subject to be considered for benefit enjoyment include: 01 application form of the subject or the subject's relative (in case the subject has passed away); original or certified copy of the document participating in fireline civilian service (if available).
b) Procedures for resolution
- The subject specified in Article 2 of this Decision or the subject's relative (in case the subject has passed away) shall be responsible for completing the application form and directly submitting 01 set of documents according to the provisions of Point a Clause of this Article to the People's Committee of the commune where the subject is registered; the commune shall organize review in batches, compile and report to the Military Command Board at the district level;
- The Military Command Board at the district level shall review, cross-check, compile, and report; the Military Command Board at the provincial level shall examine and propose the Military Zone Command to issue a decision on enjoying one-time allowance benefits.
The time limit for resolving benefits for the subject according to the responsibility assigned to each level shall not exceed 10 working days from the date of receipt of complete documents as prescribed; if the documents do not meet the conditions for consideration and resolution, the receiving agency must provide a written response stating the reasons;
- After being allocated the one-time allowance funds, within 10 working days, the Military Command Board at the district level shall organize direct payment of the one-time allowance benefits to the subjects.
2. Documents and procedures for issuing health insurance cards
The issuance of health insurance cards shall be carried out similarly in accordance with the laws on health insurance for persons who have rendered meritorious services to the revolution.
3. Documents and procedures for resolving funeral allowance benefits
a) The documents of the subject's relatives include: Extract of the decision of the subject's death who has already enjoyed one-time allowance benefits; death certificate.
- The subject's relatives shall directly submit 01 set of documents according to the provisions of Point a Clause of this Article to the People's Committee of the commune where the subject is registered; within 5 working days, the commune shall compile and report to the Labor - War Invalids and Social Affairs Office;
- The Labor - War Invalids and Social Affairs Office shall check and propose; the Provincial Department of Labor - War Invalids and Social Affairs shall compile and report to the People's Committee of the province to issue a decision on enjoying funeral allowance benefits for the subject's relatives. The time limit for resolving benefits for the subject's relatives according to the responsibility assigned to each level shall not exceed 10 working days from the date of receipt of complete documents as prescribed; if the documents do not meet the conditions for consideration and resolution, the receiving agency must provide a written response stating the reasons;
- After being allocated the funeral allowance funds, within 10 working days, the Labor - War Invalids and Social Affairs Office shall directly pay the funeral allowance benefits to the subject's relatives.
Article 6. Sources of funding for implementation
1. The funds for paying one-time allowance benefits to the subjects as stipulated in this Decision and the funds for implementing benefit payment work shall be guaranteed by the central budget.
2. The funds for implementing health insurance benefits and funeral allowance benefits shall be guaranteed by the local budget.
Article 7. Handling Violations
Organizations and individuals who engage in acts that distort or forge documents to benefit from the regime shall be subject to disciplinary action or criminal responsibility, and must return the amount received; if damage is caused, compensation must be provided according to the provisions of the law.
Article 8. Implementation organization
1. The Ministry of National Defense
b) Direct the organization of review, verification, issuance of decisions to enjoy, and payment of one-time allowance regimes for the subjects and issue the "Certificate" model for participation in fireline civilian workers.
c) Take the lead and coordinate in resolving difficulties and issues arising during the implementation process.
2. The Ministry of Labor, Invalids and Social Affairs is responsible for directing the Labor, Invalids and Social Affairs sector to implement the health insurance regime and funeral allowance for the subjects as stipulated.
3. The Ministry of Finance is responsible for allocating the annual budget to implement the payment of one-time allowance regimes for the subjects and funding for the payment work according to the laws on state budget.
4. The People's Committee of the province is responsible for directing localities to organize the implementation of the regime and policies stipulated in this Decision strictly, democratically, transparently, accurately, conveniently, without errors or corruption.
5. Request the Vietnam Fatherland Front; the Vietnam Veterans Association; the Vietnam Former Volunteer Youth Association at all levels to strengthen propaganda, mobilization, and supervision of the implementation of this Decision.
Article 9. Effective Date
1. This Decision takes effect from December 1, 2015.
2. The regimes and policies stipulated in this Decision shall be implemented from January 1, 2016.
In cases where the subjects meet the conditions stipulated in Article 2 of this Decision and pass away from January 1, 2016 onwards without having a decision to enjoy the one-time allowance regime from the competent authority, when there is a decision to enjoy the one-time allowance regime, the person handling the funeral will be entitled to the funeral allowance as stipulated in Clause 3, Article 4 of this Decision.
Article 10. Responsibility for Implementation
THE MINISTERS, HEADS OF GOVERNMENT-LEVEL MINISTRIES, HEADS OF GOVERNMENT-LEVEL AGENCIES, AND CHAIRMEN OF PROVINCE AND CITY PEOPLE'S COMMITTEES DIRECTLY UNDER THE CENTRAL GOVERNMENT SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION./.
