Pursuant to the Education Law dated June 14, 2019;
Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;organizational structure of the Ministry of Education and Training;
At the proposal of the Director of the Department of Preschool Education;
The Minister of Education and Training issues this Circular stipulating standards and procedures for compiling and revising preschool education programs; organization and activities of the National Council for Reviewing Preschool Education Programs (hereinafter referred to as the Review Council).
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Circular stipulates standards and procedures for compiling and revising preschool education programs; duties, powers, organization and activities, standards, number, and composition of members of the National Council for Reviewing Preschool Education Programs (hereinafter referred to as the Review Council).
Article 2. This Circular applies to the compilation and revision of preschool education programs; the Review Council for Preschool Education Programs; organizations and individuals related thereto.
Article 3. Preschool Education Program
1. The preschool education program reflects educational viewpoints, preschool education goals (overall goals and goals for each age group including nursery and kindergarten children), requirements to be achieved at each age according to development areas, requirements for educational activities, teaching methods, forms of organizing educational activities, educational environment, assessment of child development, conditions to ensure the quality of implementing the preschool education program.
2. The preschool education program includes the nursery program and the kindergarten program, used uniformly throughout the country and organized flexibly in accordance with specific conditions of localities and preschool education institutions.
Chapter II
STANDARDS AND PROCEDURES FOR COMPILE AND REVISE
PRESCHOOL EDUCATION PROGRAMS
Article 4. Principles for Compiling Preschool Education Programs
1. Adhering to the Party's guidelines and viewpoints and complying with the Constitution and laws; ensuring consistency between issuing the program and related regulations.
2. Ensuring scientific accuracy; harmonizing protection, care, nutrition, and education for children; implementing uniformly nationwide while also ensuring appropriate development based on the practical conditions of preschool education institutions, localities, and regions.
3. Ensuring comprehensive development principles, linking different age groups, development areas, and connecting with general education programs.
4. Inheriting the strengths of current programs, while selectively adopting experiences from countries with advanced education systems; meeting international integration requirements.
Article 5. Standards for Preschool Education Programs
1. The viewpoint on compiling preschool education programs shall comply with the provisions of the Education Law and guiding documents of the Party and State regarding reform of preschool education programs.
2. The objectives of the preschool education program must ensure comprehensive development of preschool children in physical, emotional, intellectual, aesthetic, linguistic aspects, forming initial personality factors, preparing children for primary school.
3. The content of the preschool education program must ensure core elements applicable to all children, while providing opportunities for children to access educational content that meets diverse educational needs, suitable to the economic and social development conditions of localities and schools to enhance educational quality; ensuring the objectives of preschool education; free from societal prejudices regarding gender, ethnicity, religion, profession, age, social status; ensuring suitability with the psychological and physiological development of children.
4. Care, nutrition, and education methods in nurseries must create favorable conditions for children to actively engage in activities, play, and emotionally interact with adults; stimulate the development of sensory organs, emotions, and psychological and physiological functions; in kindergartens, conditions must be created for children to play, experience, explore their surroundings through various forms, meeting children's needs and interests.
5. Requirements for children's achievements at the end of each age group must concretize the program's objectives, ensuring scientific accuracy and suitability with the characteristics of children's psychological and physiological development.
6. The duration of the preschool education program must be designed to suit Vietnam's economic, cultural, and social conditions.
7. The preschool education program must provide guidance on educational activities, forms of organizing educational activities, educational environments, and assessing children's development.
8. The preschool education program must have requirements for ensuring the quality of program implementation by preschool education institutions, including: school organization and management; administrative staff, teachers, and personnel; infrastructure, educational equipment, toys, learning materials, supplies, documents; coordination between preschool education institutions and families and communities.
9. There must be provisions for developing school-based education programs linked to culture and the practical conditions of preschool education institutions and localities.
10. Key terms (if any) must be explained; presentation format and techniques must comply with current regulations.
Article 5. Procedure for compiling preschool education programs
1. Evaluate the current preschool education program.
2. Set directions for compiling the preschool education program.
3. Draft the preschool education program.
4. Test and adjust the preschool education program.
5. Review and issue the preschool education program.
Article 6. Procedure for revising the preschool education program
The procedure for revising the preschool education program shall be carried out as the procedure for establishing the preschool education program, except for the provisions on testing the program.
Chapter III
ORGANIZATION AND ACTIVITIES OF THE NATIONAL REVIEW BOARD FOR PRESCHOOL EDUCATION PROGRAMS
Article 7. Review Board
1. The Review Board is an organization assisting the Minister of Education and Training to review preschool education programs; it is responsible for the results of the review.
2. The Review Board includes teachers, educational management officials, scientists with experience and reputation in education, and representatives of relevant agencies and organizations. The Review Board must have at least one-third (1/3) of its total members being management officials of preschool education institutions and core preschool teachers. The number of Review Board members must be odd, with a minimum of seven (07) people.
3. The structure of the Review Board consists of: Chairman, Vice-Chairman, Secretary, and Members.
4. The Minister of Education and Training decides to establish the Review Board.
Article 8. Criteria for Review Board members
1. Review Board members must meet the following criteria:
a) Possess good moral character, ideology, sufficient health, and time to participate in reviewing the program;
b) Hold a bachelor's degree or higher; have experience, reputation, professional qualifications, and understanding of educational science and preschool education programs;
c) Have participated in developing or reviewing preschool education programs or have been involved in related activities contributing to the development or review of such programs, or have at least six (06) years of direct teaching experience at preschool education institutions.
2. Individuals who participate in developing the program shall not participate in reviewing the program.
Article 9. Duties and powers of Review Board members
1. Duties and powers of the Chairman of the Review Board
a) Be responsible to the Minister of Education and Training for the activities of the Review Board;
b) Organize the review of the program according to the required requirements and deadlines;
c) Assign specific tasks to Review Board members;
d) Convene and chair meetings of the board;
e) Propose changes to the membership of the Review Board;
g) Delegate certain specific tasks to the Vice-Chairman of the Review Board. The delegation is documented in writing and kept in the working files of the Review Board;
h) Coordinate with the main organizing unit to handle unusual situations arising during the review process;
i) Perform other duties and powers as stipulated in Clause 4 of this Article.
2. Duties and powers of the Vice-Chairman of the Review Board
a) Be responsible for the contents of work assigned or delegated by the Chairman of the Review Board;
b) Perform other duties and powers as stipulated in Clause 4 of this Article.
3. Duties and powers of the Secretary of the Review Board
a) Assist the Chairman and Vice-Chairman of the Review Board in preparing the agenda and organizing meetings of the Review Board;
b) Draft minutes, compile reports summarizing opinions and recommendations from Review Board meetings; be responsible for the completeness and truthfulness of the content of meeting minutes;
c) Draft conclusions of the Chairman regarding the level of program review results;
d) Within twelve (12) working days after the Review Board issues a conclusion report, collect and transfer all related files to the main organizing unit;
đ) Perform other tasks as stipulated in Clause 4 of this Article.
4. Duties and powers of Review Board Members
a) Have the right to request full provision of relevant materials to serve the review work;
b) Study the draft program and related materials provided by the main organizing unit;
c) Fully participate in Review Board meetings; present comments and evaluations on the draft program during Review Board meetings; write comments and evaluations on the draft program according to the templates of the Review Board. Each member of the Review Board may not miss more than one-third (1/3) of the total number of meetings in a program review process as stipulated in Article 10 of this Circular. In case of absence from a Review Board meeting, they must report to the Chairman of the Review Board and submit written comments and evaluations enclosed in sealed envelopes to the meeting organizer before the meeting;
d) Be responsible for comments and evaluations during the program review process;
đ) Have the right to retain personal opinions; send personal opinions to the main organizing unit by written documentation;
e) Perform tasks assigned by the Chairman and Vice-Chairman of the Review Board.
Article 10. Principles of Operation of the Appraisal Council
1. The Appraisal Council operates on the principles of centralization, democracy, objectivity, and honesty.
2. A meeting of the Appraisal Council shall be considered valid when the Chairperson or Vice-Chairperson (in the absence of the Chairperson), the Secretary, and at least two-thirds (2/3) of the total number of Council members participate, with absent members having submitted their opinions in writing enclosed in sealed envelopes sent to the meeting chairperson. In all meetings of the Appraisal Council, there must be a representative from the unit responsible for organizing the appraisal.
3. The results of each meeting of the Appraisal Council must be recorded in the minutes of the meeting. The minutes of the meeting must bear the signature of the meeting chairperson, the Secretary of the Appraisal Council, and the representative of the unit responsible for organizing the appraisal.
4. During the appraisal process, the Appraisal Council proposes to the unit organizing the appraisal to seek specialized opinions from relevant agencies, organizations, and individuals (if necessary).
Article 11. Appraisal Process for Programs
1. Members of the Appraisal Council review the draft program: At least fifteen (15) days before the first session of the Appraisal Council, the draft program is sent to the members of the Appraisal Council; members of the Appraisal Council read, study the draft, and record their comments on the draft in accordance with Article 4 of this Circular.
2. Hold a meeting of the Appraisal Council to conduct a general discussion on the draft in accordance with Article 4 of this Circular.
3. Members of the Appraisal Council evaluate the draft
a) Evaluate and classify the draft according to each criterion into one of three categories: "Pass", "Pass but Requires Revision", "Fail";
b) Provide an overall evaluation and classify the draft into one of three categories: "Pass", "Pass but Requires Revision", "Fail"; - The draft is classified as "Pass" if the evaluation result according to all criteria is "Pass"; - The draft is classified as "Pass but Requires Revision" if the evaluation result includes both "Pass" and "Pass but Requires Revision" criteria; - The draft is classified as "Fail" in other cases.
4. The Appraisal Council evaluates the draft program
a) If the draft receives classification as "Pass" from at least three-quarters (3/4) of the total number of Appraisal Council members participating in the evaluation, then the draft is sent to the organizing agency for submission to the Minister of Education and Training for issuance;
b) If the draft receives classification as "Pass" and "Pass but Requires Revision" from at least three-quarters (3/4) of the total number of Appraisal Council members participating in the evaluation, within fifteen (15) days from the conclusion of the Chairperson of the Council, the drafting agency needs to submit a revised version and explanation to the Chairperson and two reviewing members of the Council for re-evaluation;
c) For the case of "Fail", after the drafting agency revises and supplements the draft based on the suggestions of the Appraisal Council, the draft is re-appraised in accordance with the provisions of Clause 1, 2, and 3 of this Article.
Article 12. Work Program of the Appraisal Council
1. The Secretary of the Appraisal Council announces the Decision establishing the council.
2. The Appraisal Council approves the work program.
3. A representative from the agency or unit responsible for drafting presents the process of organizing the drafting of the preschool education program.
4. Members of the Appraisal Council present critical opinions and observations on the preschool education program.
5. A representative from the agency or unit responsible for drafting explains issues related to the preschool education program, materials as requested by members of the Appraisal Council.
6. The Appraisal Council elects the Ballot Supervisory Committee and conducts voting in accordance with regulations.
7. The Ballot Supervisory Committee proceeds with counting votes; records the ballot counting minutes; the Head of the Ballot Supervisory Committee announces the vote counting results. In cases where two (02) or three (03) equal voting outcomes occur, the voting result is based on the concluding opinion of the Chairperson of the Appraisal Council.
8. The Chairperson of the Appraisal Council concludes the content of the appraisal meeting.
9. The Appraisal Council approves the minutes of the appraisal meeting.
10. The Appraisal Council sends a report to the Minister within five (05) days after completing the work.
Article 13. Unit organizing the program review
The Early Childhood Education Department shall take the lead in coordinating with relevant units to assist the Minister in organizing the program review and performing the following tasks:
1. Proposing the list of members of the Review Board.
2. Preparing financial and material conditions to serve the activities of the Review Board.
3. Guiding the Review Board to implement the objectives and requirements of the review.
4. Receiving and transferring draft early childhood education programs to each member of the Review Board; receiving files and proposals, recommendations of the Review Board for the Minister's consideration and decision.
5. Submitting to the Minister of Education and Training for consideration and decision on issuing the early childhood education program.
6. Storing the draft, minutes of meetings of the Review Board, and related documents during the organization of the review process, and handing over to the storage department of the Ministry of Education and Training after the Review Board has completed its tasks.
Article 14. Effective Date
This Circular takes effect from March 31, 2021.
Article 15. Responsibility for Implementation
Chairmen of Provincial People's Committees under the Central Government, Directors of Departments of Education and Training, and related organizations and individuals are responsible for implementing this Circular./.
