LIMITATION for the railway project management specialty

 

Pursuant to the Civil Servant Law dated November 15, 2010; and the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Civil Servant Law dated November 25, 2019;

Based on the proposal of the Director of the Cadre and Civil Servant Department;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on wage system for cadres, civil servants, public officials, and armed forces; Decree No. 17/2013/NĐ-CP dated December 19, 2013 of the Government amending and supplementing some articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 on wage system for cadres, civil servants, public officials, and armed forces;

BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;

At the proposal of the Director of the Cadre Organization Department and the Director of the Vietnam Railway Administration;

The Minister of Transport issues this Circular stipulating code numbers, occupational title standards, and salary grading for public officials in the railway project management specialty.

 

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates code numbers, occupational title standards, and salary grading for public officials in the railway project management specialty.

Article 2. This Circular applies to public officials in the railway project management specialty at public service units and related organizations and individuals.

3. Non-public service organizations and related entities may apply this Circular.

Article 3. Code numbers for occupational titles of public officials in the railway project management specialty

1. Railway Project Management Level I Code number: V.12.11.01

2. Railway Project Management Level II Code number: V.12.11.02

3. Railway Project Management Level III Code number: V.12.11.03

4. Railway Project Management Level IV Code number: V.12.11.04

Article 3. General standards for professional ethics

1. Adhering to the Party's guidelines, policies, and State laws.

2. Be honest, objective, and highly responsible for assigned tasks; fulfill all obligations of a civil servant in professional activities.

3. Have a sense of self-improvement in ethics, maintain professional integrity, honor, and reputation; not to abuse work positions or assigned tasks for personal gain; be united, creative, willing to learn new things, and improve their qualifications; have a sense of cooperation, help colleagues, share work experience; actively participate in scientific research topics, technical innovations to develop the profession and enhance qualifications.

Chapter II

OCCUPATIONAL STANDARDS

Article 4. Railway Project Management Level I - Code number: V.12.11.01

1. Tasks

a) Lead the study and implementation of laws and regulations concerning the railway project management specialty;

b) Lead the organization of compiling and systematizing standards and procedures regarding the railway project management specialty;

c) Lead the study or participate in developing railway network plans, proposing investment construction schemes for railway infrastructure that are suitable with national economic and social development policies and directions;

d) Lead the establishment, review, and evaluation of departmental or provincial-level scientific and technological projects or programs in railway project management;

đ) Lead the implementation of railway construction project management tasks within the assigned scope;

e) Lead the preparation of content for domestic and international specialized seminars and workshops;

g) Lead the compilation and development of professional guidance materials in railway project management within the assigned scope; lead the organization of specialized training sessions, vocational training, or dissemination of knowledge and experience in railway project management within the assigned scope.

2. Qualification requirements for education and training

b) Amending and supplementing Point g of Clause 3 of Article 4 as follows:

b) Hold a certificate meeting the occupational title standards for public officials in the railway project management specialty.

3. Professional Qualification Standards

a) Be well-versed in Party guidelines, policies, and state laws on the railway sector;

b) Proficient in railway project management specialty operations; understand the situation and trends of railway industry development both domestically and internationally; capable of organizing research, updating, and applying new technologies, platforms, and standards in professional activities;

c) Possess basic information technology skills, proficiency in foreign languages or ethnic minority languages if working in areas inhabited by ethnic minorities as required by job position.

Public officials can register to take the examination or be considered for promotion to the Railway Project Management Level I occupational title when they meet all the standards and conditions stipulated in Article 32 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 on recruitment, use, and management of public officials and the following standards and conditions:

a) Have held the Railway Project Management Level II occupational title or equivalent for at least six years. In cases of equivalent time, there must be at least one year (twelve months) holding the Railway Project Management Level II occupational title up to the deadline for submitting registration application for examination or promotion;

b) During the period of holding the Railway Project Management Level II occupational title or equivalent, meet at least one of the following standards or conditions:

Lead the development of one scientific and technological program at the ministry or provincial level that has been approved or accepted by the competent authority;

Lead the establishment of two scientific and technological projects or programs at the grassroots level which have been issued or accepted by competent authorities;

Have served as the director of project management for one Class A project or two Class B projects of the same type; or have led the design or review of two Class I projects or three Class II projects;

Has been in charge of or participated in managing one project of Group A or two projects of Group B or one Class I construction project or two Class II construction projects in terms of investment cost management;

Participate in managing one Class A project or two Class B projects of the same type and hold one of the four professional certificates: Level I project management, Level I design construction, Level I construction supervision, or Level I cost estimation.

Article 5. Management of Category II Railways Projects - Code: V.12.11.02

1. Tasks

a) Take the lead in implementing management tasks for railway construction investment projects within the scope of assigned duties as prescribed;

b) Take the lead in compiling and developing specialized technical guidance materials for railway project management; participate in organizing specialized training sessions, vocational training, or disseminating knowledge and experience in railway project management within the scope of assigned duties;

c) Participate in researching, drafting, and implementing legal regulations concerning specialized railway project management;

d) Participate in planning the railway network, proposing investment construction schemes for railway infrastructure that are suitable to the economic and social development situation and orientation of the State and the industry;

đ) Participate in drafting, reviewing research topics, plans, projects, and science and technology programs at the ministry level, provincial level, or higher levels within the scope of project investment construction management;

e) Participate in preparing content for domestic and international specialized and vocational seminars;

g) Organize the compilation and systematization of standards and regulations related to specialized railway project management;

2. Qualification requirements for education and training

b) Amending and supplementing Point g of Clause 3 of Article 4 as follows:

b) Hold a certificate meeting the occupational title standards for public officials in the railway project management specialty.

3. Professional Qualification Standards

a) Proficiently understand the Party's policies and State laws regarding the railway sector;

b) Skilled in specialized railway project management operations; capable of organizing research, updating, and applying new technologies, platforms, and standards in professional activities;

c) Possess basic information technology skills, proficiency in foreign languages or ethnic minority languages if working in areas inhabited by ethnic minorities as required by job position.

A staff member may register to take examinations or be considered for promotion to the title of Railway Project Manager Category II when meeting all the criteria and conditions stipulated in Article 32 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 on the recruitment, utilization, and management of staff members, and the following criteria and conditions:

a) Have held the title of Railway Project Manager Category III or equivalent for at least nine years (excluding probationary and trial periods). In cases with equivalent time, they must have held the title of Railway Project Manager Category III for at least one year (twelve months) up to the deadline for submitting examination registration or promotion consideration applications;

b) During the period holding the title of Railway Project Manager Category III or equivalent, meet at least one of the following criteria:

Participate in building one topic, program, project, or scientific and technological program at the ministry level or provincial level and above that has been issued or accepted by the competent authority;

Participate in drafting two research topics, plans, projects, or science and technology programs at the organizational level, which the employing agency has been assigned to lead and which have been issued or accepted by competent authorities;

Have served as the project manager for at least one Group B project or two Group C projects of the same type; Have led, reviewed, or verified the design of at least two Class II projects or three Class III projects;

Has led the implementation of one of the cost management tasks of one project group B or two projects group C or one class II project or two class III projects;

Have participated in managing at least one Group B project or two Group C projects and hold one of the four professional certificates: Category II Project Management, Category II Design Construction, Category II Construction Supervision, or Category II Cost Estimation for Construction.

Article 6. Management of Class III Rail Projects - Code: V.12.11.03

1. Tasks

a) Participate in compiling and systematizing standards, regulations, and business procedures specified for the specialized management of rail projects;

b) Study and resolve issues within authority or advise on matters to be decided by competent authorities; coordinate with colleagues to perform related tasks;

c) Participate in implementing project management tasks for railway construction investment projects as stipulated within the assigned scope of duties;

d) Participate in building, reviewing research topics, plans, projects, and programs in science and technology at the ministry, provincial, or institutional level or higher in project investment construction management;

đ) Participate in basic research, development research, and application research in the field of project investment construction management;

e) Participate in preparing content for domestic and international specialized and vocational seminars;

g) Participate in compiling professional technical guidance materials for the specialized management of rail projects; participate in specialized training, vocational training, or disseminating knowledge and experience in managing rail projects within the assigned scope of duties.

2. Qualification requirements for education and training

b) Amending and supplementing Point g of Clause 3 of Article 4 as follows:

b) Hold a certificate meeting the occupational title standards for public officials in the railway project management specialty.

3. Professional Qualification Standards

a) Proficiently understand the Party's policies and State laws regarding the railway sector;

b) Skilled in specialized railway project management operations; capable of organizing research, updating, and applying new technologies, platforms, and standards in professional activities;

c) Possess basic information technology skills, proficiency in foreign languages or ethnic minority languages if working in areas inhabited by ethnic minorities as required by job position.

A staff member may register to take examinations or apply for promotion to the title of Class III Rail Project Manager when meeting all the standards and conditions prescribed in Article 32 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 on recruitment, use, and management of staff members and the following standards and conditions:

a) Have held the title of Class IV Rail Project Manager or equivalent for at least three years (excluding probationary and trial periods). In cases of equivalent time, there must be at least one year (twelve months) holding the title of Class IV Rail Project Manager up to the deadline for submitting registration applications for examinations or promotion;

b) During the period of holding the title of Class IV Rail Project Manager or equivalent, meet at least one of the following standards and conditions:

Have participated in managing one Class C project of the same type;

Have led the design or review or verification of two Class III works;

Have led the execution of one of the cost management tasks of one Class C project or one Class III work;

Has participated in managing one Class C investment construction project and holds one of the four professional certificates: Class III Project Management, Class III Construction Design, Class III Construction Supervision, or Class III Construction Valuation.

Article 7. Management of Class IV Rail Projects - Code: V.12.11.04

1. Tasks

a) Perform technical tasks in project management for railway construction investment, regular and repetitive work according to a specific process;

b) Carry out project management tasks for railway construction investment within the assigned scope of duties.

2. Qualification requirements for education and training

a) Hold a college degree or higher in a relevant field of study corresponding to the job position;

b) Hold a certificate meeting the occupational title standards for public officials in the railway project management specialty.

3. Professional Qualification Standards

a) Understand the principles, systems, procedures, and operational guidelines, as well as the management objectives of the specialized management of rail projects; the policies of direct leadership;

b) Possess theoretical knowledge about the specialized field and vocational tasks assigned; have the ability to practice technical tasks assigned;

c) Understand the nature and characteristics of activities of managed objects and management practices.

Chapter III

SALARY FOR THE PROFESSIONAL TITLE OF CIVIL SERVANTS

RAILWAY PROJECT MANAGEMENT SPECIALIZATION

Article 8. Principles for Implementing Salary Assignment for Railway Project Management Specialization Staff Titles

1. The appointment and salary assignment for railway project management specialization staff titles must be based on the job position, professional responsibilities, and vocational tasks being undertaken, and fully meet the standards prescribed in this Circular.

2. When transferring to a corresponding railway project management specialization staff title, it shall not be combined with salary grade advancement or promotion of the staff title.

Article 9. Classification of salary for professional titles of specialized civil servants in project management for railway

1. From the date this Circular takes effect, in cases where civil servants have not yet met the criteria and conditions to be appointed to the professional title of specialized civil servant in project management for railways as stipulated in Articles 4, 5, 6, and 7 of this Circular, the following shall apply:

a) If the civil servant has less than five years (60 months) until retirement, they shall continue to hold their current rank or professional position level and be paid according to the current salary grade.

b) If the civil servant still has a remaining term of service of five years (60 months) or more, within a period of three years (36 months), the employing agency shall be responsible for arranging training to ensure that the civil servant meets the criteria for the rank of the professional title of specialized civil servant in project management for railways as prescribed in this Circular. After the time specified in this point, if the civil servant does not meet the criteria as prescribed in this Circular, the head of the public institution shall consider assigning other suitable work or implementing reduction measures according to regulations.

2. The professional titles of specialized civil servants in project management for railways prescribed in this Circular shall apply the Salary Scale for Professional and Technical Staff in State Public Institutions (Scale 3) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for cadres, civil servants, public officials, and armed forces as follows:

a) The professional title of Project Manager for Railways, Class I, shall apply the salary coefficient for Category A3, Group 1 (A3.1) from coefficient 6.20 to coefficient 8.00;

b) The professional title of Project Manager for Railways, Class II, shall apply the salary coefficient for Category A2, Group 1 (A2.1) from coefficient 4.40 to coefficient 6.78;

c) The professional title of Project Manager for Railways, Class III, shall apply the salary coefficient for Category A1 from coefficient 2.34 to coefficient 4.98;

d) The professional title of Project Manager for Railways, Class IV, shall apply the salary coefficient for Category A0 from coefficient 2.10 to coefficient 4.89.

3. The classification of salary for specialized civil servants in project management for railways currently classified under existing ranks of civil servants and public officials being transferred to the professional titles of specialized civil servants in project management for railways as prescribed in this Circular shall be implemented according to the guidance provided in Clause 2, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs on the classification of salary when upgrading, transferring ranks, and changing categories of civil servants and public officials, specifically as follows:

a) Classification of the professional title of Project Manager for Railways, Class I, code V.12.11.01, for public officials currently classified under Category A3, Group 1 (A3.1);

b) Classification of the professional title of Project Manager for Railways, Class II, code V.12.11.02, for public officials currently classified under Category A2, Group 1 (A2.1);

c) Classification of the professional title of Project Manager for Railways, Class III, code V.12.11.03, for public officials currently classified under Category A1;

d) Classification of the professional title of Project Manager for Railways, Class IV, code V.12.11.04, for public officials currently classified under Category A0.

Chapter IV

IMPLEMENTING PROVISIONS

Article 10. Effective Date

1. This Circular takes effect from March 1, 2023.

2. In cases where the regulatory legal documents cited in this Circular are amended, supplemented, or replaced, implementation shall be in accordance with the provisions of the amended, supplemented, or replacing document.

Article 11. Implementation Organization

The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Heads of agencies, units, organizations, and individuals concerned shall be responsible for implementing this Circular./.
