Dissolution and Termination of Operations of the Overseas Protection Fund for Vietnamese Citizens and Legal Entities

Pursuant to Law on Government Organization No. 63/2025/QH15;

Pursuant to the Law on Legislative Regulatory Acts No. 64/2025/QH15 amended and supplemented by Law No. 87/2025/QH15;

Pursuant to the State Budget Law No. 89/2025/QH15;

Pursuant to Decree No. 78/2025/NĐ-CP dated April 1, 2025 of the Government detailing certain provisions and measures to organize and guide the implementation of the Law on Legislative Regulatory Acts amended and supplemented by Decree No. 187/2025/NĐ-CP dated July 1, 2025;

Pursuant to Decree No. 28/2025/NĐ-CP dated February 24, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs;

Based on the proposal of the Minister of Foreign Affairs at Circular No. 4481/TTr-BNG-LS dated October 9, 2025 and Circular No. 5381/BNG-LS dated December 2, 2025;

The Prime Minister issues this Decision on the dissolution and termination of operations of the Overseas Protection Fund for Vietnamese Citizens and Legal Entities.

Article 1.The Overseas Protection Fund for Vietnamese Citizens and Legal Entities under the Ministry of Foreign Affairs shall be dissolved and its operations terminated.

Article 2. Implementation Organization

1. The Ministry of Foreign Affairs:

a) Shall take over the tasks of the Overseas Protection Fund for Vietnamese Citizens and Legal Entities, ensuring that the protection of Vietnamese citizens and legal entities abroad is not interrupted.

b) Shall lead and coordinate with relevant ministries and agencies in organizing publicity to affirm that the dissolution of the Overseas Protection Fund for Vietnamese Citizens and Legal Entities is a necessary step to improve domestic legal institutions without changing the consistent policies of the Party and State regarding the continued enhancement of the effectiveness of protecting Vietnamese citizens and legal entities abroad.

2. On the basis of the proposal of the Ministry of Foreign Affairs, the Ministry of Finance shall compile and submit to the competent authority for budget allocation to implement the task of protecting Vietnamese citizens and legal entities abroad in the annual state budget estimate according to the laws on the state budget.

Article 3. Responsibility for Enforcement

1. This Decision shall take effect from January 1, 2026.

2. Abolish Decision No. 119/2007/QĐ-TTg dated July 25, 2007 of the Prime Minister on the establishment of the Overseas Protection Fund for Vietnamese Citizens and Legal Entities.

3. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, chairpersons of provincial and centrally-administered city people's committees, organizations, and individuals concerned shall be responsible for implementing this Decision./.
