Regarding the approval of the list of ODA loan items for implementing the international supervision consultancy component for six projects under the second phase loan agreement of the Norway/KfW mixed credit program

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 38/2013/NĐ-CP dated April 23, 2013 of the Government on management and use of official development assistance (ODA) and preferential loans from donors;

Considering the proposal of the Minister of Planning and Investment in Document No. 1373/BKHĐT-KTĐN dated March 12, 2015,

DECISION:

Article 1. Approves the ODA loan amount for six projects under the second phase loan agreement of the Norway/KfW mixed credit program to implement the international supervision consultancy component, specifically as follows:

1. Urban drainage system project in Caolanh City, Dongthap Province: The ODA loan amount is 544,566 Euros and the tax portion is 58,831 Euros; the duration of the International Supervision Consultancy Contract is 47 months.

2. Upgrading and expanding urban water supply system project in Dienbienphu City, Dienbien Province: The ODA loan amount is 209,881 Euros and the tax portion is 22,674 Euros; the duration of the International Supervision Consultancy Contract is 24 months.

3. Construction and renovation of drainage and wastewater treatment system project in Quangtri Town, Quangtri Province: The ODA loan amount is 473,730 Euros and the tax portion is 51,178 Euros; the duration of the International Supervision Consultancy Contract is 42 months.

4. Solid waste treatment plant construction project in SocTrang City and surrounding areas, SocTrang Province: The ODA loan amount is 304,371 Euros and the tax portion is 32,881 Euros; the duration of the International Supervision Consultancy Contract is 30 months.

5. Drainage system renovation and construction project in ThaiBinh City, ThaiBinh Province: The ODA loan amount is 388,728 Euros and the tax portion is 41,995 Euros; the duration of the International Supervision Consultancy Contract is 36 months.

6. Wastewater treatment system construction project in ThuyVan Industrial-Services-Dwelling Complex, Phutho Province (Phase 1): The ODA loan amount is 275,391 Euros and the tax portion is 29,751 Euros; the duration of the International Supervision Consultancy Contract is 28 months.

7. Domestic financial mechanism: The State budget allocates 100% of the ODA loan amount for each project. The tax portion is paid from the counterpart funds of the projects arranged by the localities.

Article 2. The Ministry of Planning and Investment shall issue a diplomatic note to inform the Norwegian Embassy about the Prime Minister's decision on the above approval for coordination purposes.

Article 3. The Ministry of Planning and Investment shall take the lead and coordinate with the Ministry of Finance and relevant agencies to clarify the reasons and responsibilities of the parties involved in implementing the supervision consultancy services for the aforementioned six projects before they were approved by the Prime Minister; analyze the reasons for the delay in completing the procedures to submit to the Prime Minister for approval of the allocation of funds (more than two years after the signing of the second phase loan agreement); based on this, draw lessons learned and propose solutions to accelerate the disbursement progress of the projects and ensure the effective use of foreign ODA loans, and report the results to the Prime Minister in May 2015.

Article 4. This Decision takes effect from the date of signature.

Ministers of the Ministries of Planning and Investment, Finance, Justice, Foreign Affairs; Chairmen of the People's Committees of the provinces of Dongthap, Dienbien, Quangtri, SocTrang, ThaiBinh, and Phutho; and Heads of relevant agencies and units are responsible for implementing this Decision.
