Pursuant to Decree No. 95/CP dated December 4, 1993 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Trade;

Pursuant to Decree No. 20/1999/NĐ-CP dated April 12, 1999 of the Government on trading services of commodity inspection;

Pursuant to Decision No. 651/TTg dated October 10, 1995 of the Prime Minister on the establishment of the National Committee for Coordinating Vietnam's Activities in ASEAN;

Pursuant to Circular No. 356/VPUB dated January 22, 1996 of the Government on the designation of the agency issuing certificates of origin for goods according to the CEPT Agreement;

Article 1:

1\. Amend Clause 2 of Article 5 of the Rules for Issuing Certificates of Origin for ASEAN Goods of Vietnam - Form D to Enjoy Preferential Treatment under the "ASEAN Framework Agreement on Common Effective Preferential Tariff Treatment (CEPT)" issued together with Decision No. 416/TM-ĐB dated May 13, 1996 of the Minister of Trade.

2\. Issue Appendix 4 (amended) on Procedures for Requesting Inspection and Issuing Certificates of Origin Inspection for Form D, replacing Appendix 4 of the aforementioned Rules.

Article 2:

This Decision shall take effect from the date of signing.

Article 3:

The Director of the Import-Export Department, heads of relevant agencies under the Ministry of Trade shall be responsible for implementing and guiding the implementation of this Decision.

Article 5. Documents for requesting issuance of Form D Certificate include:

2\. Certificate of Origin Inspection for goods (in cases where inspection is required). This certificate must meet the following requirements: - Comply with the Origin Regulations stipulated in Appendix 1 attached hereto, and; - Be issued by a business entity engaged in commodity inspection services in accordance with Appendix 4 (amended) of these Rules;
