Article 1.- The attached Decision hereby promulgates the Regulations on the Preparation, Review, and Approval of Construction Project Designs. These Regulations replace the Regulations on the Preparation, Review, and Approval of Construction Project Designs issued together with Decision No. 536/BXD-GĐ dated December 14, 1994, of the Ministry of Construction.
Article 2.- This Decision shall be uniformly implemented throughout the country and shall take effect from the date of signature.
Article 3.- The Ministries, ministerial-level agencies, agencies under the Government, People's Committees of provinces and centrally governed cities are responsible for organizing the implementation of this Decision.

REGULATIONS ON THE PREPARATION, REVIEW, AND APPROVAL OF CONSTRUCTION PROJECT DESIGNS

Chapter 1:
GENERAL PROVISIONS
Article 1.- These Regulations stipulate the contents and procedures for each design stage; responsibilities and authorities of the investors, construction consultancy organizations, specialized agencies, construction management agencies of Ministries and provinces directly under the Central Government in the work of preparing, reviewing, and approving construction project designs funded from all sources in order to implement unified management throughout the country. All construction projects must be organized to prepare, review, and approve designs according to the provisions of these Regulations.
Contents for the preparation, review, and approval of designs for construction projects funded by foreign capital in Vietnam have specific provisions.
Article 2.- Design procedure: Depending on the technical complexity of the project, a one-step or two-step design process will be carried out based on the investment decision document.
For projects requiring high technical standards, constructed in complex geological and environmental conditions, necessitating foundation treatment or complex main structural solutions, a two-step design process must be conducted: technical design and construction drawing design.
For projects with simple technology or having standard designs, uncomplicated foundation treatment, a one-step design process can be conducted: construction technical design.
Article 3.- Basis for designing projects:
- Approved investment project;
- Technical construction survey materials, basic investigations, socio-economic surveys prepared by specialized organizations with legal personality;
- Construction standards, technical standards, unit prices, and standard designs issued by the State.
In cases where foreign construction standards and technical standards are applied, they must be approved by the Ministry of Construction.
Article 4.- Construction survey work: The content and volume of construction surveys must be appropriate to the requirements of each design stage and the characteristics of the project. The design organization is responsible for proposing survey requirements. The survey organization is responsible for the reliability and quality of survey materials before the investor and the law.
Article 5.- Technical design or construction technical design and accompanying general estimate must be prepared by a construction consultancy organization with legal personality and a professional practice certificate. The consultancy organization preparing the design must bear full responsibility for the quality of the design materials according to the classification of the project it prepares before the investor and the law.
Article 6.- The head of the competent authority approving the design may only approve the design after it has been reviewed by the specialized agency and the general estimate has been reviewed by the construction management agency subordinate to it, and bears responsibility for their decisions. Specialized agencies and construction management agencies reviewing the design and general estimate must bear responsibility for the results of their reviews before the approving authority.
Article 7.- Ministries managing construction sectors such as transportation, water resources, mines, power transmission lines and substations, oil and gas, postal services, agriculture and forestry, shall base on the Investment and Construction Management Charter and the provisions of these Regulations to issue specific guidance documents on the content of designing projects within their sectors in accordance with sector-specific construction technical standards. These guidance documents must be agreed upon with the Ministry of Construction before issuance.
Chapter 2:
REGULATIONS ON THE PREPARATION OF CONSTRUCTION PROJECT DESIGNS
Article 8.- Content of technical design.
1. Explanatory section:
1.1 General explanation.
- Basis and grounds for technical design;
- Main content of the investment decision (for state-funded projects) or investment permit (for non-state-funded projects);
- List of construction standards, technical standards, and standard designs used;
- Summary of selected design content and comparative design options (planning, architecture, foundation, structure...);
- Required parameters and performance indicators of the project according to the selected option.
1.2 Materials and explanations on natural and technical conditions influencing the design.
- Topography, geology, hydrogeology, hydrology, meteorology, and seismicity in the construction area;
- Environmental impact;
- Survey and assessment of existing facility quality (for old facilities requiring repair and renovation);
- Other materials.
1.3 Economic and technical indicators:
- Design capacity, production capacity, and other parameters of the project;
- Product plan, product quality, and consumption;
- Economic and technical indicators and investment effectiveness of the plan.
1.4 Technology and equipment:
- Production technology chain, usage capacity;
- Calculation and selection of equipment (type, brand, technical characteristics, country and year of manufacture...);
- Safety measures for labor, production safety, explosion prevention, fire protection, toxic substance control, industrial hygiene, ecological environment protection.
1.5 Architectural and construction solutions:
- Overall layout, land occupation area, construction area of the project;
- Architectural solutions;
- Construction technical solutions: main load-bearing structures, foundation, with calculation details clearly stated (calculation diagrams, load determination, internal force calculation results, cross-section calculation results, displacement, deformation calculation results, predicted settlement...);
- Interior equipment;
- Engineering systems: electricity supply, heat supply, steam supply, oil supply, water supply, drainage, ventilation, lighting, sound, signaling, fire alarm and extinguishing, automatic control, with calculation details clearly stated;
- Construction outside (planting greenery, yards, roads, sidewalks, lighting);
- Summarize the quantities of major construction works, main materials, and technological equipment for each project component and the entire project; compare the economic and technical indicators of various design options.
1.6. Construction organization design:
Main guidelines on construction methods to ensure technical, design, and safety requirements during construction.
2. Section drawings:
2.1. Current status of the site (line) and location on the map of the designed project;
2.2. Detailed layout plan of all project components;
2.3. Technical preparation of the construction site (site leveling, stormwater drainage) and infrastructure works outside buildings: roads, electricity supply, water supply, wastewater discharge, wastewater treatment, environmental protection;
2.4. Production process flow;
2.5. Architectural floor plans, cross-sections, and longitudinal sections of all project components, and elevations of all project components;
2.6. Equipment layout;
2.7. Details of main load-bearing structures (foundations, superstructures, roofs...) and complex parts;
2.8. Interior decoration;
2.9. Overall perspective view of the project;
2.10. Internal building technical systems: electricity supply, water supply, wastewater discharge, ventilation, lighting, sound, air conditioning, information, fire alarm, and immediate firefighting;
2.11. Escape routes and fire prevention solutions for the project;
2.12. External construction (fences, greenery, yards, roads, lighting, signs);
2.13. Construction organization layout and construction layout of special components;
2.14. Overall model of the project or individual components (as required by the investor).
3. Cost estimate section:
- Basis and grounds for preparing the total cost estimate;
- Documentation explaining and summarizing the construction work quantities (forecast);
- The total cost estimate prepared based on the construction work quantities mentioned above and according to the guidance documents issued by the Ministry of Construction for pricing and managing construction costs of projects.
Article 9.- Content of construction drawing design:
1. Construction drawings:
- Detailed site plans and cross-sections of project components, fully showing the positions and dimensions of structural details and technological equipment, with a list of construction work quantities and equipment of that project component, quality specifications of typical materials and prefabricated components, and instructions on construction sequence and labor safety requirements during construction;
- Detailed drawings of project components fully showing positions, dimensions, specifications, and quantities of materials and components, with necessary notes for construction personnel;
- Detailed installation drawings of technological equipment fully showing positions, dimensions, specifications, and quantities of each type of equipment, components, spare parts, and materials, with necessary notes for construction personnel and manufacturer's instructions;
- Installation locations and detailed drawings of technical and technological systems;
- Detailed interior and exterior decoration;
- Summary of construction work quantities, equipment, and materials of each project component and the entire project, fully showing specifications and quantities of each type of material, component, and equipment.
2. Construction drawing cost estimate:
2.1. Basis and grounds for preparing the cost estimate, including forecast explanations, and necessary appendices;
2.2. Forecast-cost estimate of each project component and summary cost estimate of the construction drawing design of all project components or components of each phase.
Article 10.- In case of one-step design: construction technical design content includes: description and total cost estimate according to Sections 1 and 3 of Article 8; drawings according to Section 1 of Article 9.
Article 11.- Design documents: the form of descriptions, scale of drawings, and detailed representation of each type of drawing must comply with standards for preparing design drawing documents.
1. Technical design documents include:
- Description volume (according to Article 8);
- Drawing volume (according to Article 8);
- Forecast-total cost estimate volume (according to Article 8);
- Model (if necessary).
2. Construction drawing design documents for each project component include:
- Drawing volume (according to Article 9);
- Forecast-cost estimate volume (according to Article 9);
3. Construction technical design documents include:
- Construction drawing design drawing volume (according to Article 9);
- Forecast-cost estimate volume (according to Article 9);
- Technical design description volume accompanied by total cost estimate (according to Article 8).
4. Quantity of design documents and receiving agencies are stipulated as follows:
4.1. For technical design: the design organization must prepare and deliver to the investor seven complete sets as prescribed in Article 8 to be sent to:
- Approval authority;
- Investor (two sets);
- Building permit issuing authority;
- Tendering organizations (two sets);

4.3. For construction working drawings design: the design organization must prepare and hand over to the project owner five sets containing all the contents specified in Article 9 for submission to:
- Investor (two sets);
- The contracting organizations (three sets).
The number of files mentioned above is mandatory and has been included in the design cost. If additional copies are required, the project owner may contract for them outside the design cost.
Article 12.- The design consultancy organization shall be responsible for:
1. Signing a contract to undertake the design with the project owner and appointing the head of the design project to be fully responsible for the design of the works. In case of subcontracting specialized design work to other organizations, such specialized design organizations must have legal personality and be responsible before the head of the design project and the law for their own design portion;
2. Proposing requirements, rechecking the results, and accepting survey materials meeting the design requirements;
3. Being responsible for the quality, content, and quantity of all design documents (including the use of supporting design materials and design templates);
4. Ensuring compliance with the design schedule according to the contract, providing design documents on time, and being responsible for supplementing, correcting, or redrafting when the design has not been approved.
5. Implement quality control procedures for products and conduct internal acceptance of documents and data during the design process and before transferring the design to the project sponsor;
6. Present and defend the design during the review, examination, and completion stages according to the requirements of the examining authority;
7. Hold the copyright of the design project (except for standard designs issued by the State), store and manage original documents;
8. Supervise the author during the construction phase of the project;
9. Participate with the project sponsor in the acceptance of the project in accordance with the Quality Management Regulations for Construction Projects;
Article 13.- The Project Investor has the responsibility:
1. Enter into contracts for design tendering with consulting organizations that have legal person status and are qualified in their respective fields based on their professional certificates, monitor and urge compliance with the design as stipulated in the economic contract;
2. Provide necessary documents, data, and legal texts for the consulting organization to base the design on;
3. Prepare files for technical design review and submission for approval;
4. Require the consulting organization to address any issues arising from changes in the design during the construction phase;
5. Pay design fees based on the economic contract between the project sponsor and the consulting organization as prescribed by current regulations;
Article 14.- The design cost of the project shall be determined based on the bidding results for selecting consultants, but it must not exceed the design cost set forth by the Ministry of Construction;
Chapter 3:
TECHNICAL DESIGN REVIEW
Article 15.- Technical design review for projects under Group A investment using state capital:
1. The head of the sectoral management ministry approves the technical design and total budget estimate after they have been reviewed by the specialized agency regarding technical design and by the Ministry of Construction regarding the total budget estimate;
2. In cases where the project has complex technology and domestic consulting organizations lack the capacity to review the design, the head of the sectoral management ministry reports to the Prime Minister to obtain permission to select foreign consultants for design review. Foreign consulting organizations undertaking design review must obtain a tender permit for construction consultancy from the Ministry of Construction in accordance with current regulations;
Article 16. Technical design review for projects under Groups B and C using state capital:
The investment decision maker approves the technical design or construction technical design and total budget estimate after they have been reviewed by the specialized agency and the construction management agency regarding unit prices, estimates, and total budget estimates;
The review process follows Circular Jointly Issued by the Ministry of Construction, Investment Planning, and Finance No. 04/TTLB dated September 10, 1996, "Guidelines for Implementing the Investment and Construction Management Regulations" accompanying Decree No. 42/CP dated July 16, 1996, of the Government;
Article 17.- Technical design review for projects under non-state capital investment:
1. No review of the total budget estimate;
2. The head of the sectoral management ministry approves the technical design of projects under Group A with production and business objectives within the sector managed by the ministry after the design has been reviewed by the specialized agency;
3. The Director of the specialized construction management department of provinces and centrally-administered cities approves the technical design of projects under Groups B and C after the design has been reviewed by the specialized agency;
4. In cases where the project is complex and domestic consulting organizations lack the capacity to review the design, the head of the sectoral management ministry reports to the Prime Minister to obtain permission to select foreign consultants for design review. Foreign consulting organizations undertaking design review must obtain a tender permit for construction consultancy from the Ministry of Construction in accordance with current regulations;
5. House owners with buildings up to three floors (one ground floor, two upper floors) and a floor area not exceeding 200 square meters are exempt from design review but must bear full responsibility for the safety and durability of their own building and adjacent buildings caused by their construction;
Article 18.- The content of technical design review or construction technical design and total budget estimate is specified as follows:
1. For projects under investment using state capital:
1.1. The validity of the design file: the legal person status of the design organization; the conformity of the design with the approved investment project concerning planning and architectural design;
1.2. Compliance with construction standards, technical regulations, norms, unit prices, and relevant policies currently in force;
1.3. The appropriateness and correctness of the design project compared to the approved investment project. Key aspects to consider include:
- Compatibility between the production line or usage requirements and the overall site plan and architectural space;
- Evaluation of the stability and durability of the structure: foundation, main load-bearing structures;
- Evaluation of the safety of infrastructure systems: heating, steam, oil, water supply, drainage, ventilation, signaling, fire alarm and extinguishing, safety in case of explosion;
- Technical and economic indicators compared to the approved project;
1.4. The appropriateness of the total budget estimate relative to the reviewed technical design and determination of a reasonable total cost without exceeding the investment limit recorded in the investment decision;
1.5. Conditions and technical solutions ensuring stability for adjacent structures, environmental protection, and safety during construction;
2. For projects under investment not using state capital:
2.1. The validity of the design file: the legal person status of the design organization; the conformity of the design with the approved investment project concerning planning and architectural design; compliance with construction technical standards;
2.2. Evaluation of the structural safety, environmental protection, fire prevention, and explosion safety of the project during construction and use; ensuring stability for adjacent structures;
3. For large-scale projects under Groups A and B, technical design reviews can be conducted in parts of the project suitable for each tender package or construction phase: architecture, foundation and main load-bearing structures, infrastructure systems.
4. Upon completion of the review, the specialized management agency for construction must prepare a report detailing the errors in the design and conclusions regarding the use of the design, draft documents to be submitted to the competent authority for investment approval of the technical design or construction technical design and total budget estimate.
Article 19.- The time limit for reviewing the technical design or construction technical design and total budget estimate:
Depending on the scale and nature of the project, the review period for the design and total budget estimate is specified as follows:
- For projects under Group A investment: not exceeding 40 days;
- For projects under Group B and C investment: not exceeding 30 days;
- For projects under Group C investment: not exceeding 20 days;
Article 20.- Review costs for the design:
The costs for reviewing the technical design or construction technical design and total budget estimate are included in the total budget estimate of the project according to the regulations of the Ministry of Construction.
Article 21.- Responsibilities of the organization conducting the design review:
The specialized agency responsible for reviewing the design, the construction management agency responsible for reviewing unit prices, total budget estimates, and the consulting organization responsible for checking the design must bear responsibility before the investor, the authorized approver, and the law for the results of their work.
Chapter 4:
REVIEW OF THE DESIGN
Article 22.- Approval of the technical design or construction technical design must be based on the approved investment project and the results of the design review.
Article 23.- Documents for submitting the design for review are submitted by the investor to the designated design review agency as follows:
1. Request for approval of the design;
2. Copy of the document approving the investment project;
3. Design documents at the design stage as stipulated in Articles 8, 9, and 10 of this Regulation.
Article 24.- The competent authority authorized to approve the technical design or construction technical design and total budget estimate is responsible for receiving the documents for submission, conducting the design review and total budget estimate, preparing the approval document for the investment decision maker to approve.
Article 25.- THE APPROVAL OF TECHNICAL DESIGN OR TECHNICAL CONSTRUCTION DESIGN AND TOTAL ESTIMATE IS AS FOLLOWS:
1. For projects under investment using state capital:
1.1. Head of the Ministry managing the approval of the technical design and total budget estimate for projects under Group A;
1.2. Head of the authority with the power to decide on investment approving the technical design or construction technical design and total budget estimate for projects under Groups B and C;
1.3. Chairman of the People's Committee of provinces and centrally governed cities approving the technical design and total budget estimate for projects under Groups B and C invested by localities.
The Chairman of the People's Committee of provinces and centrally governed cities may delegate the Director of the specialized construction management department to approve the technical design and total budget estimate for projects within the investment decision-making authority of the provinces and cities.
2. For projects using non-state capital:
2.1. Head of the industry management ministry approving the technical design for projects under Group A;
2.2. Director of the specialized construction management department approving the technical design for projects under Groups B and C;
2.3. Chairman of the People's Committee of provinces and centrally governed cities may delegate the Chairman of the District or County People's Committee to approve the technical design for individual residential buildings and small projects eligible for construction permits, except as provided in Section 5, Article 17 of this Regulation.
Article 26.- Contents of the decision approving the technical design or construction technical design and total budget estimate include:
1. Basis for approval: Investment project approval decision, submission documents, design files, results of the technical design or construction technical design and total budget estimate review...
2. Content of approval:
2.1. Name of the project;
2.2. Location of construction;
2.3. Main technical parameters: project grade, fire resistance level, total land area, scale of project components (floor area, number of floors, height of each floor)...;
2.4. Main solutions concerning architecture, foundation, structure, technical systems, technology and equipment, environmental protection, fire prevention, ensuring construction and use safety of the project itself and adjacent projects...;
2.5. Total budget estimate (for projects under state-funded investment): the valuation point of the total budget estimate, approved total budget estimate and its structure, consistency with the total investment amount recorded in the investment approval decision;
2.6. Matters requiring attention or deficiencies needing supplementation and adjustment;
2.7. Relevant organizations responsible for implementing the decision.
Article 27.- THE APPROVAL PERIOD FOR TECHNICAL DESIGN STARTS FROM THE DATE OF RECEIVING COMPLETE DOCUMENTS AS STATED IN ARTICLE 23.
- For projects under Groups A and B investment: not exceeding 15 days;
- For projects under Group C investment: not exceeding 10 days.
If the project is not approved within the above period, the reviewing agency must provide a written explanation to the investor about the reasons and return the design documents.
In cases where corrections, supplements, or resubmission of the approval submission documents are required, the review and approval period will be calculated from the date of receipt of the adjusted and supplemented documents.
Article 28.- The approval document for the technical design and construction technical design and total budget estimate of the construction project must be sent to the following agencies for supervision and management:
1. For projects under Group A investment, regardless of the source of funds: Office of the Government, Ministry of Planning and Investment, relevant industry ministry, Ministry of Construction, Ministry of Finance, People's Committee of the province or centrally governed city where the project is located, and the construction permit issuing agency;
2. For projects under Groups B and C investment using state funds: the competent authority for investment decision, planning and finance agency at the same level, People's Committee of the province or centrally governed city where the project is located, Department of Construction, specialized construction management department (for specialized projects), and the construction permit issuing agency;
3. For projects under non-state funded investment: Provincial or centrally governed city People's Committee, Department of Construction, and specialized construction management department (for specialized construction projects) and the construction permit issuing agency.
Article 29.- The validity period of the approved technical design or construction technical design and total budget estimate for projects is two years. After two years, if the project has not commenced construction, it must be reviewed and resubmitted for approval.
Article 30.- The design documents approved must be submitted for national, sectoral, or territorial archives (as per the分级) and sent to relevant agencies as prescribed in Article 11 of this Regulation.
Chapter 5:
IMPLEMENTING PROVISIONS
Article 31.- This Regulation shall take effect from the date of issuance. Other provisions contrary to this Regulation shall be abolished.
Article 32.- The Ministries, ministerial-level agencies, agencies under the Government, People's Committees of provinces and centrally governed cities are responsible for organizing the implementation of this Regulation.
