CIRCULAR
Guidelines for implementing Decision No. 1146/QĐ-TTg dated December 8, 1999
of the Prime Minister on supporting relocation to settle in border communes
of Lào Cai, Lang Son, Cao Bằng, Lai Châu, Ha Giang, and Quang Ninh provinces
To implement Decision No. 1146/QĐ-TTg dated December 8, 1999 of the Prime Minister on supporting relocation to settle in border communes of Lào Cai, Lang Son, Cao Bằng, Lai Châu, Ha Giang, and Quang Ninh provinces; After reaching consensus with the Ministry of Finance, the Ministry of Agriculture and Rural Development guides the provision of financial support for relocation to settle in border communes of these provinces as follows:
I. GENERAL PROVISIONS:
- This Circular applies to households voluntarily relocating according to the annual plan of the State to settle in border communes.
- Organizations relocating people to villages and hamlets in border communes must implement relocation projects approved by the People's Committee of the province aimed at developing the economy and society, contributing to national defense and security in border areas.
- The border communes of the six aforementioned provinces are those listed in Decision No. 1232/QĐ-TTg dated December 24, 1999 of the Prime Minister approving the list of particularly difficult communes and border communes within the framework of the program for economic and social development of particularly difficult mountainous and remote communes. Management of investment and construction of infrastructure in border communes shall be implemented in accordance with Joint Circular No. 416/TTLT/BKH-UBDTMN-TC-XD dated April 29, 1999 of the Ministry of Planning and Investment, the Committee for Ethnic Minorities and Mountainous Areas, the Ministry of Finance, and the Ministry of Construction guiding management of investment and construction of infrastructure in particularly difficult mountainous and remote communes.
II. SPECIFIC PROVISIONS:
1 - Recipients of support: are households voluntarily relocating to live permanently in the project areas of border communes according to the State's plan and local authorities' guidance, including the following categories:
- Households that previously lived in border communes but have since moved elsewhere and are now returning to their original homes;
- Households relocating from other parts of the country;
- Households of military personnel, volunteers, and state employees relocating to rationalize family composition.
2 - Level of support for relocation:
Support for households relocating to the project areas of border communes includes:
2.1 - The subsistence allowance stipulated in Circular No. 15/LĐTBXH dated July 1, 1995 of the Ministry of Labor, Invalids, and Social Affairs;
2.2 - In addition to the above allowance, each household will also receive a one-time support of VND 7,000,000 for:
- Clearing land and restoring it (including costs for clearing work) and purchasing planting materials and livestock: VND 2,000,000 per household.
- Building housing: VND 5,000,000 per household.
3. Management Costs:
Operating expenses of the agency organizing relocation shall be guaranteed by the localities and included in the annual budget allocation.
Management costs may be used for the following purposes: propaganda and mobilization; printing forms and related documents for relocation; inspection; and travel risk costs. Specific cost levels are as follows:
- Relocation within the project area: VND 150,000 per household
- Relocation from outside the project area (within the province and from other provinces) to the project area: VND 300,000 per household.
III. IMPLEMENTATION:
1 - The People's Committees of the provinces mentioned in the Prime Minister's Decision No. 1146/QĐ-TTg dated December 8, 1999 shall implement the following tasks:
- Drafting and approving plans for permanent settlement and economic and social development (including border communes), with the participation of the Ministry of Agriculture and Rural Development.
- Drafting relocation plans, compiling local economic and social development plans, and submitting them to the Ministry of Agriculture and Rural Development, the Ministry of Planning and Investment, and the Ministry of Finance for consolidation and submission to the Government for approval;
- Coordinating with relevant ministries, sectors, and provinces where the relocated population comes from to organize safe relocation, distribute full support benefits to households, and settle accounts according to current regulations;
- Integrating various programs and projects implemented in the same area to ensure that relocated households quickly stabilize their lives and develop production;
- Fully implementing regular reporting requirements to the Ministry of Agriculture and Rural Development, the Ministry of Finance, and the Ministry of Planning and Investment.
2 - The Directorate of Permanent Settlement and New Economic Zones assists the Ministry of Agriculture and Rural Development in liaising and coordinating with relevant ministries and sectors to guide, inspect, and urge the implementation of relocation plans to border communes.
During the implementation process, if there are difficulties, localities are requested to report to the Ministry of Agriculture and Rural Development for research and resolution.
