Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 43/2006/NĐ-CP dated April 25, 2006 of the Government stipulating the autonomy and responsibility for implementing tasks, organizational structure, staffing, and finance for public service units;

Considering the proposal of the Director of the Processing of Forestry Products and Salt Industry Department;

In accordance with the proposal of the Organization and Cadres Department.

Article 1. Position and Function

Article 1. The Technical Safety Inspection Center for the agricultural and rural development sector under the Processing of Forestry Products and Salt Industry Department (hereinafter referred to as the Technical Safety Inspection Center) is a self-financing public service unit that has the function of inspecting, consulting, and providing technical safety support to enterprises, organizations, and individuals using machinery, equipment, materials, and substances with strict requirements for labor safety as prescribed by law.

Article 2. The Technical Safety Inspection Center has legal personality, its own seal, and is authorized to open accounts at banks and state treasuries for its operations and transactions.

Article 3. The headquarters of the Technical Safety Inspection Center is located in Hanoi City. A representative office in the South is located in Ho Chi Minh City. A representative office in Central Vietnam and the Central Highlands is located in Quy Nhon City, Binh Dinh Province.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

Point 1. Conduct inspections of machinery, equipment, materials, and substances with strict requirements for labor safety according to the list issued by the Ministry of Labor, Invalids and Social Affairs or those specific to the agricultural and rural development sector as prescribed by the Ministry of Agriculture and Rural Development. Conduct initial inspections and periodic inspections of gas cylinders and liquefied gas containers.

Point 2. Inspect pressure gauges upon authorization from the General Bureau of Standards, Measurement, and Quality Control.

Point 3. Issue inspection result certificates to inspected objects that meet technical safety standards and inspection procedures as prescribed.

Point 4. Provide technical safety consultation and support for non-destructive metal testing, quality inspection of metal joints, calibration of pressure measuring instruments, electrical safety checks, grounding and lightning protection, and other technical services when approved by relevant specialized management agencies.

Point 5. Organize training and issue certificates on technical safety for managers and operators of boilers, pressure vessels, refrigeration equipment, and lifting equipment. Participate in training inspectors, pressure welding workers, and occupational safety and fire prevention training as required by facilities.

Point 6. Cooperate with domestic and foreign organizations in the field of technical safety inspection and other technical fields.

Point 7. Collect and manage the use of technical safety inspection fees as prescribed by the State.

Point 8. Perform other tasks assigned by the Director of the Processing of Forestry Products and Salt Industry Department to serve the management of manufacturing, installation, repair, and technology transfer of equipment, materials, and substances with strict requirements for labor safety and fire prevention at facilities.

Article 3. Organizational Structure

Section 1. Leadership:

a) The Director of the Technical Safety Inspection Center is appointed by the Director of the Processing of Forestry Products and Salt Industry Department and is responsible to the Director and the law for the activities of the Center and the tasks assigned.

b) Deputy Directors of the Technical Safety Inspection Center are appointed by the Director of the Processing of Forestry Products and Salt Industry Department upon the recommendation of the Director of the Technical Safety Inspection Center and are responsible to the Director and the law for the tasks they are assigned.

Section 2. Supporting staff includes:

a) Professional departments;

b) Representative offices;

c) Technical safety inspection stations for gas cylinders and liquefied gas containers.

Article 4. The Director of the Center decides on staffing, and establishes the organizational structure of the Center. Develops the Operational Regulations of the Center for approval by the Director General of the Processing and Product Development Department and organizes its implementation.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision shall take effect fifteen days from the date of publication in the Official Gazette and shall replace Decision No. 54/1998/QĐ-BNN-TCCB dated April 11, 1998 of the Minister of Agriculture and Rural Development on the issuance of the Organizational Structure and Operational Regulations of the Agricultural and Rural Development Technical Safety Testing Center.

2. The Heads of the Ministry's Office, the Personnel and Cadres Department, the Processing and Product Development Department, the Heads of relevant units under the Ministry, and the Director of the Agricultural and Rural Development Technical Safety Testing Center are responsible for implementing this Decision.
