Regarding the establishment of the National Committee for HIV/AIDS Prevention and Control and Drug Abuse and Prostitution Prevention and Control

In accordance with the Law on Anti-Narcotics dated December 22, 2000;

                             

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Considering the proposal of the Minister of Home Affairs and the Chairman of the Government Office;

Position and functions

DECISION:

Article 1. The National Committee for HIV/AIDS Prevention and Control and Drug Abuse and Prostitution Prevention and Control (hereinafter referred to as the National Committee) shall be established based on the National Committee for HIV/AIDS Prevention and Control and Drug Abuse and Prostitution Prevention and Control established pursuant to Decision No. 61/2000/QĐ-TTg dated June 5, 2000 of the Prime Minister.

The National Committee is an inter-ministerial organization with the function of assisting the Prime Minister in directing and coordinating activities related to HIV/AIDS prevention and control and drug abuse and prostitution prevention and control.

Tasks and powers of the National Committee

Article 2. 1. Assist the Prime Minister in formulating strategies, policies, programs, and plans for HIV/AIDS prevention and control and drug abuse and prostitution prevention and control.

2. Assist the Prime Minister in directing, implementing, supervising, inspecting, and evaluating the activities of ministries, sectors, and localities regarding HIV/AIDS prevention and control and drug abuse and prostitution prevention and control.

3. Assist the Prime Minister in organizing and directing the coordination of activities among ministries, sectors, localities, and mass organizations; integrating and coordinating programs, plans, and resources for HIV/AIDS prevention and control and drug abuse and prostitution prevention and control according to common requirements and goals.

4. Direct ministries, sectors, central-level mass organizations, provincial People's Committees, and municipal People's Committees under the Central Government to implement assigned tasks and report on the implementation and results of HIV/AIDS prevention and control and drug abuse and prostitution prevention and control.

5. Assist the Prime Minister in directing international cooperation activities in the field of HIV/AIDS prevention and control and drug abuse and prostitution prevention and control.

6. Aggregate and periodically report to the Prime Minister on the implementation of HIV/AIDS prevention and control and drug abuse and prostitution prevention and control activities.

Article 3. 1. Chairperson: Deputy Prime Minister

- Minister of Public Security;

- Minister of Defense;

- Minister of Labor, Invalids and Social Affairs;

- The Minister of Health;

3. Members:

- One Deputy Director of the Government Office, permanent member;

- One Deputy Minister of Finance;

- One Deputy Minister of Planning and Investment;

- One Deputy Minister of Culture, Sports and Tourism;

- One Deputy Minister of Education and Training;

- One Deputy Minister of Justice;

- One Deputy Minister of Agriculture and Rural Development;

- One Deputy Minister of Industry and Trade;

- One Deputy Director of the State Ethnic Affairs Commission;

- One leader of the Police General Corps, Ministry of Public Security;

- One leader of the Customs General Department, Ministry of Finance;

- One leader of the Border Guard Command, Ministry of National Defense;

- One leader of the Navy Command, Ministry of National Defense.

- Invite:

+ One leader of the Communist Youth Union Central Committee;

+ One leader of the Vietnam Farmers' Association;

+ One Vice-Chairperson of the Vietnam Women's Union;

+ One Vice-Chairperson of the Vietnam General Confederation of Labor.

4. Standing members of the National Committee include:

The Chairperson, Vice-Chairpersons, and permanent members.

Article 4. Organization and operation of the National Committee

1. Members of the National Committee work on a part-time basis. Heads of agencies specified in Article 3 of this Decision shall appoint representatives to participate as members of the National Committee, subject to approval by the Prime Minister.

2. Documents signed by the Chairperson of the National Committee shall bear the seal of the Prime Minister.

3. Operating funds of the National Committee shall be provided from the state budget and allocated in the annual budget of the Government Office.

4. The Chairperson of the National Committee shall issue regulations on the operation of the National Committee, management mechanisms, information and reporting systems; relationships between the National Committee and sectoral steering committees at ministries, sectors, and localities to ensure close coordination and unified direction from the central level to the local level.

4. The Chairman of the National Committee shall issue the Rules of Operation of the National Committee, management mechanisms, information systems, and reporting procedures; the relationship between the National Committee and the Steering Committees of ministries, sectors, and localities to ensure close coordination and unified direction from central to local levels.

Article 5. The machinery to assist the National Committee

1. The Government Office shall assist the Chairman of the National Committee in drafting the program and work plan of the National Committee; coordinate, harmonize, and supervise the inspection and urging of the implementation of tasks assigned to ministries, sectors, and localities; compile and report on common activities in the fields of HIV/AIDS prevention and control, and drug abuse and prostitution prevention and control; perform other tasks assigned by the Chairman of the National Committee.

2. The Social Affairs Department of the Government Office shall directly implement the tasks set forth in Clause 1 of this Article, including a specialized unit staffed with dedicated civil servants under the direct leadership of a Department-level cadre. The staffing of this specialized unit shall be decided by the Chairman of the National Committee based on the proposal of the Minister and Head of the Government Office.

Article 6. Specific responsibilities of agencies that are members of the National Committee for HIV/AIDS Prevention and Control and Drug Abuse and Prostitution Prevention and Control

1. Ministry of Public Security:

As the permanent agency for drug abuse prevention and control, it shall take the lead and coordinate with ministries, sectors, and localities in formulating and implementing strategies, policies, programs, and plans for preventing and controlling drug-related crimes and monitoring drug-related crimes nationwide; coordinate with the Ministry of National Defense, the Ministry of Finance, and related agencies in combating, detecting, investigating, prosecuting individuals who violate laws on drug abuse and prostitution prevention and control; issuing and revoking permits for transporting drugs, precursor chemicals, narcotic drugs, and psychotropic substances through Vietnam's territory; issuing and revoking import and export permits for drugs used in combating drug-related crimes. It shall conduct statistics and evaluate the situation regarding drug prevention and control; manage information on drug-related crimes. It shall compile the results of drug prevention and control plans implemented by ministries and sectors and submit them to the Government and the Prime Minister.

2. The Ministry of Labor, Invalids and Social Affairs:

As the permanent agency for prostitution prevention and control, it shall take the lead and coordinate with relevant ministries and sectors in formulating and directing the implementation of policies, programs, and plans for preventing and controlling prostitution nationwide; take the lead in organizing and managing treatment, rehabilitation, education, vocational training, job creation, and community reintegration for drug addicts and sex workers at medical facilities and in the community.

Conduct statistics and evaluate the situation of drug rehabilitation and the situation of prostitution prevention and control.

3. The Ministry of Health:

As the permanent agency for HIV/AIDS prevention and control, it shall take the lead and coordinate with relevant ministries and sectors in formulating and coordinating the implementation of strategies, mechanisms, policies, programs, and plans for HIV/AIDS prevention and control nationwide; conduct statistics and evaluate the HIV/AIDS infection situation in localities and throughout the country; organize medical examinations and treatments for people infected with HIV/AIDS, social medical examinations and treatments for drug addicts and sex workers infected with HIV/AIDS at healthcare facilities, treatment centers, and in the community; research types of drugs and treatment regimens for drug addiction; manage the production, sale, and use of narcotic and psychotropic drugs for medical purposes and drug addiction support.

4. The Ministry of National Defense:

Direct the Border Guard Command and the Coast Guard Bureau to take the lead or coordinate with the Ministry of Public Security, the Ministry of Finance, the Ministry of Agriculture and Rural Development, the Committee for Ethnic Minorities, the General Customs Department, and related ministries, sectors, and localities in preventing and combating drug-related crimes, controlling and preventing illegal drug transportation across borders and at sea; participating in eliminating the cultivation of drug-producing plants; organizing rehabilitation for border and island residents and at sea; participating in controlling and preventing the trafficking of women and children across borders.

5. The Ministry of Public Security, the Ministry of National Defense, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Health shall utilize their respective machinery to assist the Minister and Deputy Chairman of the National Committee in performing tasks according to the areas of work assigned.

6. The Government Office:

a) Assist the Chairman of the National Committee in guiding, directing, inspecting, and urging the integration and coordination of programs, plans, and resource utilization for HIV/AIDS prevention and control and drug abuse and prostitution prevention and control in accordance with overall requirements and objectives; assist the Chairman of the National Committee in organizing the coordination of activities between ministries, sectors, and mass organizations; compile common activities on HIV/AIDS prevention and control and drug abuse and prostitution prevention and control to report to the Prime Minister;

b) Submit legal regulations and mechanisms/policies on HIV/AIDS prevention and control and drug abuse and prostitution prevention and control to the Government and the Prime Minister based on proposals from relevant ministries and sectors.

7. The Ministry of Finance:

a) Take the lead in preparing the state budget estimate and ensure sufficient and timely funding annually for HIV/AIDS prevention and control and drug abuse and prostitution prevention and control; take the lead in inspecting, supervising the use of funds, and finalizing accounts according to current regulations;

b) Direct the General Customs Department to take the lead and coordinate with the Ministry of National Defense and the Ministry of Public Security in monitoring and preventing the illegal transportation of drugs and narcotic substances into Vietnam and out of Vietnam.

8. The Ministry of Planning and Investment:

a) Coordinate with the Ministry of Finance and related ministries and sectors in preparing the annual state budget for HIV/AIDS prevention and control and drug abuse and prostitution prevention and control for submission to the competent authority as prescribed;

b) Take the lead and coordinate with ministries and sectors in actively mobilizing other resources to serve these tasks; develop management mechanisms to ensure effective use of resources.

9. The Ministry of Justice:

Coordinate with related ministries and sectors in researching and proposing improvements to the legal system on HIV/AIDS prevention and control and drug abuse and prostitution prevention and control; organize the dissemination, popularization, and education on laws concerning HIV/AIDS prevention and control and drug abuse and prostitution prevention and control.

10. The Ministry of Culture, Sports and Tourism:

Take the lead and coordinate with related agencies in directing the implementation of information and publicity campaigns on HIV/AIDS prevention and control and drug abuse and prostitution prevention and control.

11. The Ministry of Education and Training:

Shall take the lead and coordinate with relevant agencies to direct and organize educational work on preventing and combating AIDS and drug abuse and prostitution in educational institutions.

12. The Ministry of Agriculture and Rural Development:

Shall take the lead and coordinate with the Ministry of National Defense, the Committee for Ethnic Minorities, and localities to direct the dissemination and mobilization to eliminate opium poppy cultivation and promote crop restructuring to replace opium poppy cultivation.

13. The Ministry of Industry:

Shall take the lead and coordinate with related ministries and sectors to promulgate and implement regulations on managing precursor chemicals, addictive substances, and psychotropic substances in industrial production; issue and revoke permits for the import and export of precursor chemicals used in industrial production.

14. The Committee for Ethnic Minorities:

Shall coordinate with the Ministry of Agriculture and Rural Development and the Ministry of National Defense to direct the restructuring of production to replace opium poppy cultivation; coordinate with the Ministry of Public Security, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of National Defense to direct the prevention and control of AIDS and drug abuse and prostitution in mountainous areas and ethnic minority regions.

15. The Vietnam Fatherland Front:

Shall take the lead in mobilizing all strata of the people across the country to implement the prevention and control of AIDS and drug abuse and prostitution, closely linked to the nationwide movement to build a civilized lifestyle in residential communities.

16. The General Confederation of Labor of Vietnam, the Vietnam Women's Union, the Ho Chi Minh Communist Youth Union, the Vietnam Farmers' Association, and other political and social organizations shall, based on their functions and tasks, implement the prevention and control of AIDS and drug abuse and prostitution among their members; coordinate with ministries, sectors, and localities to mobilize the entire people's strength to participate in the prevention and control of AIDS and drug abuse and prostitution.

Article 7. Organization to Direct Work on Preventing and Controlling AIDS and Drug Abuse and Prostitution at Central Ministries and Sectors and Localities

1. Central Ministries and Sectors:

Shall establish a Steering Committee for Preventing and Controlling AIDS and Drug Abuse and Prostitution based on the specific characteristics and requirements of each sector and agency to assist the head of the ministry or sector in directing, implementing, and coordinating the prevention and control of AIDS and drug abuse and prostitution within their respective ministries and sectors.

The Steering Committee shall be headed by a leader from the ministry or sector. In cases where a Steering Committee is not established, the head of the agency must assign a leader to oversee this work and allocate a full-time or part-time civil servant to assist the leadership in monitoring and summarizing the overall situation.

The heads of central ministries and sectors shall decide on the establishment of the Steering Committee, define its functions and responsibilities, membership, and promulgate the operational rules of the Steering Committee for Preventing and Controlling AIDS and Drug Abuse and Prostitution.

2. At provincial level:

a) Establish a Steering Committee for Preventing and Controlling AIDS and Drug Abuse and Prostitution at the provincial level (hereinafter referred to as the Provincial People's Committee) to assist the Chairman of the Provincial People's Committee in directing, implementing, and integrating the prevention and control of AIDS and drug abuse and prostitution within the province, with the Chairman or Vice-Chairman of the Provincial People's Committee serving as the Head of the Committee;

The Steering Committee and its members shall be decided by the Chairman of the Provincial People's Committee.

b) Establish a specialized unit located at the Office of the Provincial People's Committee to assist the Steering Committee in coordinating, integrating, inspecting, and urging activities related to the prevention and control of AIDS and drug abuse and prostitution (part of the staff of the Office of the Provincial People's Committee), and assign a Deputy Director of the Office of the Provincial People's Committee to oversee this unit;

c) Based on the functions, responsibilities, composition, and operational rules of the National Committee, the Chairman of the Provincial People's Committee shall define the functions, responsibilities, organizational structure, and promulgate the operational rules of the Provincial Steering Committee and guide subordinate units to develop appropriate, consistent, concise, and effective operational rules for their Steering Committees.

3. At district level:

a) Establish a District Steering Committee for Preventing and Controlling AIDS and Drug Abuse and Prostitution headed by a leader from the District People's Committee. The Steering Committee and its members shall be decided by the Chairman of the District People's Committee;

b) The Office of the District People's Committee shall assist the Steering Committee. Depending on the nature, characteristics, and specific requirements of each locality, a specialized unit may be organized or a full-time civil servant may be allocated within the Office of the People's Council and People's Committee at the district level to monitor and summarize the overall situation, and a Deputy Director of the Office shall be assigned to directly oversee this work;

c) Based on the functions, responsibilities, composition, and operational rules of the District Steering Committee and guidance from the Provincial People's Committee, the Chairman of the District People's Committee shall define the functions, responsibilities, organizational structure, and promulgate the operational rules of the District Steering Committee.

4. At commune level:

a) Based on the specific characteristics and requirements of the prevention and control of AIDS and drug abuse and prostitution in each locality, the Chairman of the Commune People's Committee shall decide to establish a Commune Steering Committee for Preventing and Controlling AIDS and Drug Abuse and Prostitution;

b) In cases where a Steering Committee is not established, a leader from the Commune People's Committee shall be assigned to oversee and direct this work generally. The assisting unit shall be handled by the Office of the People's Council and Commune People's Committee.

5. Operating Expenses:

The operating expenses of the Steering Committees for Preventing and Controlling AIDS and Drug Abuse and Prostitution at central ministries and sectors and localities shall be guaranteed by the state budget according to the current provisions of the State Budget Law.

Article 8. Effectiveness

This Decision shall take effect fifteen days after its publication in the Official Gazette and shall supersede Decision No. 61/2000/QĐ-TTg dated June 5, 2000, of the Prime Minister regarding the establishment of the National Committee for Preventing and Controlling AIDS and Drug Abuse and Prostitution.

Article 9. Responsibility for implementation

Various The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairmen of Provincial People's Committees, and Members of the National Committee are responsible for implementing this Decision./.
