Chapter I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability

||| This Decision applies to enterprises producing, importing, consumers, and organizations and individuals related to the activities of recovery and disposal of waste products within the territory of Vietnam.
Article 2. Interpretation of Terms
In this Decision, the following terms shall be understood as follows:
||| 1. Waste products are products that have exceeded their useful life or products discarded after use.
||| 2. Recovery of waste products is the act of enterprises producing, importing collecting back products that have exceeded their useful life or products discarded after use.
||| 3. Disposal of waste products is the process of reusing, recycling, or destroying products that have exceeded their useful life or products discarded after use.
||| 4. Collection points are places receiving waste products in accordance with the provisions of the law on environmental protection.
||| 5. Collection and disposal facilities for waste products are enterprises operating in accordance with the provisions of the law on environmental protection.
||| Article 3. List of waste products, recovery and disposal time points
||| The list of waste products, recovery and disposal time points is issued in the Appendix attached to this Decision.
Chapter II
||| RESPONSIBILITIES AND RIGHTS OF ENTERPRISES PRODUCING, IMPORTING, CONSUMERS, DISTRIBUTORS,
||| COLLECTION AND DISPOSAL FACILITIES FOR WASTE PRODUCTS

||| 1. Establish collection points for waste products.
||| 2. Accept waste products from enterprises producing, importing which have sold such products to the Vietnamese market.
||| 3. Agree with consumers on the method of transferring and accepting waste products at collection points.
||| 4. Transport waste products from collection points to disposal facilities.
||| 5. Dispose of waste products.
||| 6. Notify in writing the Ministry of Natural Resources and Environment about collection points and disposal facilities for waste products.
||| 7. Publicize information related to collection points and disposal facilities for waste products on the Ministry of Natural Resources and Environment's Electronic Information Portal and the enterprise's website.
||| 8. Annually report the quantity of products produced or imported and sold to the Vietnamese market; results of waste product recovery and disposal according to the guidelines of the Ministry of Natural Resources and Environment.
||| Article 5. Responsibilities of consumers, distributors, collection and disposal facilities for waste products
||| 1. Consumers are responsible for transferring waste products at collection points.
||| 2. Distributors are responsible for participating in the recovery of waste products.
||| 3. Collection and disposal facilities for waste products must comply with the provisions of the law on environmental protection when performing contracts with enterprises producing, importing to recover and dispose of waste products.
||| Article 6. Rights of enterprises producing, importing, consumers, collection and disposal facilities for waste products
||| 1. Enterprises producing, importing, consumers, collection and disposal facilities for waste products enjoy preferential policies and support in accordance with the law.
||| 2. Enterprises producing, importing establishing collection points to accept hazardous waste are exempted from registering as hazardous waste generators.
||| 3. Enterprises producing, importing directly recovering and transporting hazardous waste must meet the following conditions to be exempted from registering as hazardous waste management practitioners:
||| a) Registering business operations in products included in the list of waste products issued together with this Decision;
||| b) Submitting a report on direct recovery and transportation of waste products confirmed by the Ministry of Natural Resources and Environment;
||| c) Having equipment and technical measures to control pollution and protect the environment at collection points;
||| d) Having specialized equipment and means for recovery and transportation of waste products;
||| đ) Having technical staff specializing in recovery and transportation of waste products.
||| 4. Enterprises producing, importing may collaborate with other enterprises producing, importing to jointly implement the recovery and disposal of waste products.
||| 5. Enterprises producing, importing may contract with collection and disposal facilities meeting the legal requirements to recover and dispose of waste products.
Chapter III
||| RESPONSIBILITIES OF STATE MANAGEMENT AUTHORITIES ON THE RECOVERY AND DISPOSAL OF WASTE PRODUCTS
Article 7. Responsibilities of the Ministry of Natural Resources and Environment
1. Take the lead and coordinate with relevant ministries and sectors to submit to the Prime Minister for amending and supplementing the List of waste products, recovery deadlines, and disposal methods issued together with this Decision.
2. Take the lead and coordinate with relevant ministries and sectors to develop and issue detailed guiding documents for this Decision.
3. Promote awareness within the community regarding the activities of recovering and disposing of waste products.
4. Establish and manage data on the recovery and disposal of waste products.
5. Inspect, supervise, and handle organizations and individuals who violate regulations concerning the recovery and disposal of waste products.
Article 8. Responsibilities of Ministries and Sectors
Within their respective functions, tasks, and authorities, ministries and sectors shall cooperate with the Ministry of Natural Resources and Environment to develop guiding documents, incentives, and support for the activities of recovering and disposing of waste products.
Article 9. Responsibilities of People's Committees of provinces and centrally governed cities
1. Promote awareness among consumers to participate in the activities of recovering and disposing of waste products.
2. Support enterprises engaged in production and importation to establish collection points for waste products at appropriate locations within their jurisdictions.
3. Implement management of waste products in accordance with environmental protection laws.
Chapter IV
IMPLEMENTING PROVISIONS

The Ministry of Natural Resources and Environment shall take the lead and coordinate with ministries, sectors, and People's Committees of provinces and centrally governed cities to implement this Decision.
Article 11. Effective Date
1. This Decision takes effect from September 25, 2013.
2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally governed city People's Committees, and related organizations and individuals are responsible for implementing this Decision./.
