Amending and supplementing Article 2 of Circular No. 31/2010/TT-BGTVT dated October 1, 2010 on the waters of the seaport within the jurisdiction of Haiphong city and the management area of Haiphong Port Maritime Administration
Based on the opinions of the People's Committee of Danang City at Official Letter No. 5570/UBND-QLĐTh dated July 21, 2015;

Pursuant to the Maritime Code of Vietnam dated June 14, 2005;
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 21/2012/NĐ-CP dated March 21, 2012 of the Government on management of seaports and maritime channels;
Based on the opinions of the People's Committee of Haiphong City at Document No. 7258/UBND-GT dated October 26, 2012;
At the proposal of the Director of the Legal Department and the Director General of the Vietnam Maritime Administration;
The Minister of Transport hereby promulgates this Circular amending and supplementing Article 2 of Circular No. 31/2010/TT-BGTVT dated October 1, 2010 of the Minister of Transport on the waters of the seaport within the jurisdiction of Haiphong city and the management area of Haiphong Port Maritime Administration.
Article 1. Amending and supplementing Article 2 of Circular No. 31/2010/TT-BGTVT dated October 1, 2010 of the Minister of Transport on the waters of the seaport within the jurisdiction of Haiphong city and the management area of Haiphong Port Maritime Administration
1. Clause 2, Article 2 shall be amended and supplemented as follows:
"2. The landward boundary is delineated as follows:
- From point HP14 running along the right bank of Luong Lach Huyen to points HP15, HP16 with the following coordinates:
HP15: 20°50'01"N, 106°54'17"E;
HP16: 20°50'11"N, 106°52'21"E (right bank edge of Cai Trap Channel towards Lach Huyen);
- From point HP16 running along the right bank of Cai Trap Channel to point HP17 with the following coordinates: 20°49'10"N, 106°50'17"E (end of the right bank of Cai Trap Channel, adjacent to Bach Dang River);
- From point HP17 running along the right bank of Bach Dang River to point HP18 with the following coordinates: 20°56'46"N, 106°46'18"E;
- From point HP18 running across Giay River to point HP19 with the following coordinates: 20°56'46"N, 106°45'51"E;
- From point HP19 running along the right bank of Giay River to point HP20 with the following coordinates: 20°57'08"N, 106°44'33"E;
- From point HP20 running along a straight line across Giay River 200 meters downstream from the center of Minh Duc Dam to point HP21 on the left bank of Giay River with the following coordinates: 20°56'54"N, 106°44'33"E;
- From point HP21 running along the left bank of Giay River, left bank of Bach Dang River to point HP1;
- From the entrance of Dien Vu Canal running along both banks of Cam River to a straight line across the river 200 meters downstream from the base of Kien Bridge."
2. Supplement Clause 3 after Clause 2 of Article 2 as follows:
"3. The coordinates of points HP16, HP17, HP18, HP19, HP20, HP21 are applied according to the VN-2000 coordinate system and converted to corresponding coordinate systems as follows:

Article 2. Effective Date
1. This Circular takes effect from February 1, 2014.
2. The boundaries of the seaport waters specified in this Circular are determined on Chart No. IA-100-03 of the Vietnam Navy, second edition 2009.
Article 3. Implementation Organization
The Head of the Ministry’s Office, the Inspector General of the Ministry, Heads of Departments under the Ministry, the Director of the Vietnam Maritime Administration, the Director of the Vietnam Inland Waterways Administration, the Director of the Department of Transport of Haiphong City, the Director of the Department of Transport of Quang Ninh Province, the Director of Haiphong Port Maritime Administration, the Director of Quang Ninh Port Maritime Administration, Heads of agencies, organizations, and individuals related to this Circular shall be responsible for its implementation./.
