Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to the Fisheries Law dated November 21, 2017;
At the proposal of the Minister of Agriculture and Rural Development;
The Prime Minister issues this Decision to specify key aquaculture species.
Article 1. Scope of Regulation and Applicability
1. Scope of regulation: This Decision specifies in detail Clause 4, Article 38 of the Fisheries Law, which stipulates key aquaculture species.
2. Applicability: This Decision applies to organizations and individuals related to the business activities of key aquaculture species within the territory of Vietnam.
Article 2. Criteria for determining key aquaculture species
Key aquaculture species must meet the following criteria:
1. Included in the list of aquatic species permitted for business in Vietnam.
2. Create many jobs and high income for workers; effectively utilize natural resources and conditions of the country and have the ability to adapt to climate change.
3. Have high productivity and production efficiency; have the ability to attract investment to create large-scale concentrated production areas applying advanced technology.
4. Produce high-value products; have the ability to compete with aquatic species from other countries in the domestic market and export, with a minimum export value of 100 million USD per year.
Article 3. List of key aquaculture species
1. Black tiger shrimp (Penaeus monodon Fabricus, 1798).
2. Pacific white shrimp (Litopenaeus vannamei Boone, 1931).
3. Striped catfish (Pangasianodon hypophthalmus Sauvage, 1878).
Article 4. Organization of Implementation
1. The Ministry of Agriculture and Rural Development shall be responsible for:
a) Implementing state management; developing and directing the implementation of strategies, plans, and projects for the development of key aquaculture species nationwide;
b) Guiding the development of key aquaculture species to integrate them into the national sector planning system, regional planning, and provincial planning;
c) Managing information updates on the production of key aquaculture species based on the national database on fisheries;
d) Annually compiling and reporting to the Prime Minister the results of the development of key aquaculture species;
đ) Based on actual circumstances and development requirements, the Ministry of Agriculture and Rural Development shall propose to the Prime Minister adjustments to the regulations on key aquaculture species.
2. Provincial People's Committees are responsible for:
a) Implementing state management; developing and directing the implementation of strategies, plans, and projects for the development of key aquaculture species at the local level;
b) Guiding the development of key aquaculture species in district-level land use planning;
c) Updating information on the production of key aquaculture species based on the national database on fisheries;
d) Annually reporting to the Ministry of Agriculture and Rural Development the results of the production of key aquaculture species.
3. Organizations and individuals engaged in the business of key aquaculture species:
a) Registering aquaculture according to current regulations;
b) Enjoying policies as prescribed by law; receiving information from competent authorities about environmental monitoring results and the development situation of key aquaculture species upon request.
Article 5. Implementation Provisions
1. This Decision takes effect from January 30, 2019.
2. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairmen of provincial People's Committees, and relevant agencies, organizations, and individuals are responsible for implementing this Decision./.
