THE MINISTER OF TRANSPORT ISSUES THIS CIRCULAR TO REGULATE THE CONFERMENT OF THE AWARD MEDAL "FOR THE DEVELOPMENT OF VIETNAMESE TRANSPORTATION".
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
THIS CIRCULAR REGULATES THE SUBJECTS, PRINCIPLES, CRITERIA, PROCEDURES FOR CONSIDERING AND BESTOWING THE AWARD MEDAL "FOR THE DEVELOPMENT OF VIETNAMESE TRANSPORTATION".
Article 2. Applicability
1. OFFICIALS, CIVIL SERVANTS, STATE EMPLOYEES, VOLUNTEERS AGAINST THE FRENCH AND AMERICANS IN DEFENDING THE COUNTRY, WORKERS WHO HAVE BEEN OR ARE CURRENTLY WORKING IN THE VIETNAMESE TRANSPORTATION SECTOR (HEREINAFTER REFERRED TO AS INDIVIDUALS IN THE VIETNAMESE TRANSPORTATION SECTOR), INCLUDING:
a) OFFICIALS, CIVIL SERVANTS, STATE EMPLOYEES, AND WORKERS WHO HAVE BEEN OR ARE CURRENTLY WORKING IN ADMINISTRATIVE AUTHORITIES AND PUBLIC SERVICE UNITS UNDER THE MINISTRY OF TRANSPORT;
b) OFFICIALS, CIVIL SERVANTS, AND STATE EMPLOYEES WHO HAVE BEEN OR ARE CURRENTLY WORKING IN POSITIONS RELATED TO TRANSPORTATION WITHIN SPECIALIZED AUTHORITIES ON TRANSPORTATION OF PROVINCES (INCLUDING SPECIALIZED AUTHORITIES ON TRANSPORTATION UNDER THE PEOPLE'S COMMITTEE OF PROVINCES AND MUNICIPALITIES DIRECTLY UNDER THE CENTRAL GOVERNMENT, AND SPECIALIZED AUTHORITIES ON TRANSPORTATION UNDER THE PEOPLE'S COMMITTEE OF COUNTIES, DISTRICTS, TOWNS, AND MUNICIPALITIES UNDER PROVINCES);
c) MANAGERS OF ENTERPRISES, WORKERS WHO HAVE BEEN OR ARE CURRENTLY WORKING IN THE VIETNAMESE TRANSPORTATION SECTOR AT ENTERPRISES THAT ARE JOINT STOCK COMPANIES WITH 100% STATE CAPITAL OR JOINT STOCK COMPANIES WITH MORE THAN 50% STATE CAPITAL.
2. OTHER INDIVIDUALS NOT COVERED BY THE PROVISIONS OF CLAUSE 1 OF THIS ARTICLE (INCLUDING VIETNAMESE RESIDENTS ABROAD OR FOREIGN NATIONALS) WHO HAVE MADE SIGNIFICANT CONTRIBUTIONS TO THE CONSTRUCTION AND DEVELOPMENT OF THE VIETNAMESE TRANSPORTATION SECTOR (HEREINAFTER REFERRED TO AS INDIVIDUALS OUTSIDE THE VIETNAMESE TRANSPORTATION SECTOR).
3. ASSOCIATED ORGANIZATIONS INVOLVED IN THE APPLICATION FOR CONSIDERATION AND BESTOWING OF THE AWARD MEDAL.
ARTICLE 3. THE AWARD MEDAL "FOR THE DEVELOPMENT OF VIETNAMESE TRANSPORTATION"
1. THE AWARD MEDAL "FOR THE DEVELOPMENT OF VIETNAMESE TRANSPORTATION" (HEREINAFTER REFERRED TO AS THE AWARD MEDAL) IS A FORM OF RECOGNITION BY THE MINISTRY OF TRANSPORT FOR INDIVIDUALS WHO HAVE MADE SIGNIFICANT CONTRIBUTIONS TO THE CONSTRUCTION AND DEVELOPMENT OF THE VIETNAMESE TRANSPORTATION SECTOR.
2. THE AWARD MEDAL HAS A SHAPE, SIZE, AND COLOR THAT REFLECT THE CHARACTERISTICS OF THE VIETNAMESE TRANSPORTATION SECTOR AND COMPLY WITH THE GENERAL REGULATIONS OF THE STATE. ACCOMPANYING THE AWARD MEDAL IS A CERTIFICATE OF RECEIPT OF THE AWARD MEDAL ISSUED BY THE MINISTRY OF TRANSPORT (IN ACCORDANCE WITH THE MODEL REGISTERED BY THE MINISTRY OF TRANSPORT).
Article 4. Principles for awarding Commemorative Medals
1. THE AWARD MEDAL IS CONFERRED ONCE TO AN INDIVIDUAL.
2. THE CONSIDERATION FOR THE AWARD MEDAL IS CONDUCTED ANNUALLY, ENSURING FAIRNESS, DEMOCRACY, TRANSPARENCY, TIMELINESS, AND COMPLIANCE WITH THE SPECIFIED CRITERIA, PROCEDURES SET FORTH IN THIS CIRCULAR.
3. IN CASE AN INDIVIDUAL WAS DISCIPLINED IN THE PAST, THE PERIOD OF DISCIPLINE SHALL NOT BE COUNTED TOWARDS THE ELIGIBILITY PERIOD FOR THE AWARD MEDAL, AND CONSIDERATION FOR THE AWARD MEDAL SHALL BE CONDUCTED ONE YEAR AFTER THE END OF THE DISCIPLINARY PERIOD.
Chapter II
CRITERIA FOR CONSIDERING THE AWARD MEDAL
Article 5. Regarding individuals in the Vietnam Transport Industry
Individuals specified in Clause 1, Article 2 of this Circular who have good moral character and have fulfilled their assigned tasks during their period of service shall be awarded a Commemorative Medal when they meet one of the following criteria:
1. Time of dedication to the Vietnam Transport Industry, specifically:
a) Individuals working in the Vietnam Transport Industry with at least 20 years of service for males and at least 15 years for females.
b) Individuals from other industries transferred to the Vietnam Transport Industry or from the Vietnam Transport Industry transferred to other industries with continuous service of at least 25 years, including at least 10 years of service in the Vietnam Transport Industry for males and at least 8 years for females.
c) For cases stipulated in points a and b of this Clause, if there is service time in remote areas, mountainous regions, islands, and areas entitled to regional allowances of 0.5 or more according to regulations, the actual service time in these areas will be multiplied by a factor of 1.5.
d) In the case of leaders of the Ministry of Transport (currently serving, retired on policy terms, or transferred), when awarding the Commemorative Medal, the length of service is not considered.
2. For civil servants with at least 5 years in leadership positions at the Department, General Department, or Bureau under the Ministry of Transport (or equivalent) or as leaders of Provincial Transport Departments: Having significant contributions and achievements in building and developing the Vietnam Transport Industry recognized and confirmed in writing by the Minister of Transport or the People's Committee of the province.
3. Individuals in the industry who have made significant contributions or provided resources contributing to the construction and development of the Vietnam Transport Industry recognized and confirmed in writing by the Minister of Transport or the Chairman of the People's Committee of the province, meeting one of the following criteria:
a) Having initiatives or scientific research projects with practical value and effectiveness for the development of the Vietnam Transport Industry;
b) Making contributions through labor, human resources, financial or other material resources with practical value and effectiveness for the development of the Vietnam Transport Industry.
Article 6. Regarding individuals outside the Vietnam Transport Industry
Individuals specified in Clause 2, Article 2 of this Circular shall be eligible for the Commemorative Medal when they meet one of the following criteria:
1. Having outstanding achievements in leadership, guidance, and management contributing to the construction and development of the Vietnam Transport Industry and recognized and confirmed in writing by the People's Committee of the province or the Ministry or sector.
2. Having initiatives, solutions, or scientific research projects with practical value and substantial contributions and effectiveness for the development of the Vietnam Transport Industry recognized and confirmed in writing by the People's Committee of the province or the Ministry or sector.
3. Providing resources (intellectual, financial, or material) contributing to the construction and development of the Vietnam Transport Industry recognized and confirmed in writing by the People's Committee of the province or the Ministry or sector.
4. Making contributions to establishing and consolidating cooperative relationships between Vietnam and other countries, international organizations, contributing to the construction and development of the Vietnam Transport Industry.
5. Other special cases determined by the Minister of Transport.
Article 7. Subjects not eligible for the Commendation Medal
Clause 1. Individuals within the Industry who voluntarily leave their jobs, are disciplined with termination, or are criminally prosecuted.
Clause 2. Individuals during the period of disciplinary review or investigation, prosecution, trial, or serving disciplinary sanctions.
Chapter III
FILES, PROCEDURES, RESPONSIBILITIES FOR CONSIDERING AND BESTOWING THE COMMENDATION MEDAL
AND AWARDS OF THE COMMENDATION MEDAL
Article 8. Files for considering the awarding of the Commendation Medal
1. Components of the documents, including:
a) A proposal from the proposing unit according to Model 01 issued together with this Circular (one original copy);
b) A list of proposed recipients according to Model 02 issued together with this Circular (one original copy);
c) A summary of achievements and work history of the individual confirmed by the proposing unit and the head of the directly managing agency or unit (one original copy). For individuals within the Vietnam Transport Industry, the summary should follow Model 03 issued together with this Circular. For individuals outside the Vietnam Transport Industry, the summary should follow Model 04 issued together with this Circular;
d) Decisions (copies) related to the awarding of the Commendation Medal for those who have retired under regulations and subjects as stipulated in Point c, Clause 1 and Clause 2, Article 5 of this Circular;
đ) For subjects as stipulated in Clause 2 (excluding leaders at the Department level or higher under the Ministry of Transport) and Clause 3, Article 5 of this Circular, there must be a commendation agreement letter from the provincial People's Committee or the main managing ministry or sector;
Clause 2. The file shall be established in one set and sent directly or through postal service or other means to the Ministry of Transport.
Article 9. Procedures for considering andresponsibilities SOVEREIGN , process, formalities prescribed in request awarding the Commendation Medal
- Heads of agencies and units within the Transport Industry shall examine files, compile lists, and propose the awarding of the Commendation Medal to individuals under their management (including those who have retired according to regulations; in cases where agencies or units are dissolved or merged, the receiving agency or unit shall be responsible for reviewing and proposing) and subjects meeting the conditions and criteria stipulated in Clause 2 and Clause 3, Article 6 of this Circular.
Clause 2. Directors of Provincial Departments of Transport shall examine files, compile lists, and propose the awarding of the Commendation Medal to individuals under their management and subjects meeting the conditions and criteria stipulated in Clause 1, Clause 2, and Clause 3, Article 6 of this Circular.
Clause 3. The Director of the International Cooperation Department shall lead and coordinate with the Permanent Office of the Competition and Reward Council of the Ministry to examine files, compile lists, and propose the awarding of the Commendation Medal to foreign individuals, overseas Vietnamese, or individuals working for foreign organizations.
Clause 4. The Permanent Office of the Competition and Reward Council of the Ministry shall consolidate, review, examine files, seek opinions from the Standing Board, and submit to the Minister for decision.
Clause 5. In special cases, the Permanent Office of the Competition and Reward Council of the Ministry may propose and establish files for submission to the Minister of Transport for decision.
Article 10. Time for submitting files and processing deadlines
Clause 1. Annually, agencies and units within the Transport Industry, Provincial Departments of Transport shall consider, compile lists, and submit files for the awarding of the Commendation Medal to the Ministry of Transport before June 1st (including subjects as stipulated in Articles 5 and 6 of this Circular, except for special cases).
The Permanent Office of the Competition and Reward Council of the Ministry shall check and process files:
For incomplete files as required, within ten working days from the date of receipt, a notification will be issued and the files returned to the proposing unit;
For complete files as required, they shall be submitted to the Minister for decision before October 30th annually (except for special cases).
Clause 2. Within ten days from the date of the reward decision, the Permanent Office of the Competition and Reward Council of the Ministry shall notify the proposing agency or unit in writing of the results of the reward consideration.
Clause 3. Within ten days from the date of notification, the proposing agency or unit shall send representatives to the Permanent Office of the Competition and Reward Council of the Ministry to collect the Decision, Commendation Medal, Certificate of Recognition, and sign the management file.
Clause 1. The Ministry of Transport shall organize the presentation of the Commendation Medal to Party and State leaders, leaders of ministries, sectors, localities, central political social organizations, and other special cases decided by the Minister.
Article 11. Awarding Commemorative Medals
Clause 2. The Ministry of Transport shall request leaders of ministries, sectors, and localities to organize the presentation of the Commendation Medal to individuals under their management.
Clause 3. Heads of agencies and units within the Vietnam Transport Industry shall organize the presentation of the Commendation Medal to individuals under their management.
RIGHTS, RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS AND
Chapter IV
REVOKING DECISIONS ON BESTOWING THE COMMENDATION MEDAL, RECALLING PRESENTS
Rights

Clause 2. Individuals awarded the Commendation Medal shall have the following responsibilities:
a) To preserve, maintain, and use the Commendation Medal on traditional festivals and events of the Vietnam Transport Industry;
b) To serve as a model in implementing the policies and laws of the Party and the State, continuing to promote the traditions of the Vietnam Transport Industry;
c) Not to lend the Commendation Medal to others.
Clause 3. Organizations and individuals proposing the awarding of the Commendation Medal shall be responsible for the accuracy and truthfulness of the proposed files and have the right to make recommendations regarding the proposal and awarding of the Commendation Medal in accordance with the law on complaints and denunciations.
3. Organizations and individuals proposing to be considered for the award of a Commemorative Medal shall be responsible for the accuracy and honesty of the application dossier, and have the right to make recommendations regarding the proposal and awarding of the Commemorative Medal in accordance with the provisions of the law on complaints and denunciations.
Article 13. Revocation of Decision to Award Commemorative Medal and Recovery of Physical Items
1. An individual's decision to award a Commemorative Medal shall be revoked and physical items recovered if they violate any of the following cases:
a) Misrepresentation in declaring or confirming achievements or standards for receiving a Commemorative Medal;
b) False confirmation or fabrication of documents to be considered for awarding a Commemorative Medal;
c) Engaging in conduct that insults or affects the reputation of the Transport Industry.
2. Based on the conclusion of the competent authority determining that an individual has violated one of the cases stipulated in Clause 1 of this Article to receive a Commemorative Medal, the commendation proposing agency shall have the responsibility to request the Ministry of Transport to issue a decision revoking the decision to award the Commemorative Medal and recover the physical items.
Chapter V
IMPLEMENTING PROVISIONS
Article 14. Effective Date
This Circular takes effect from February 15, 2020, and replaces Circular No. 40/2011/TT-BGTVT dated May 18, 2011, of the Ministry of Transport on procedures for considering and awarding the Commemorative Medal "For the Development of Vietnam's Transport Industry".
Article 15. Implementation Organization
1. The Cadre and Civil Servant Department is the Permanent Office of the Ministry of Transport's Competition and Reward Council and is responsible for:
a) Organizing guidance, inspection, and urging agencies, units, and Provincial Transport Departments to implement this Circular;
b) Annually preparing a budget estimate for making Commemorative Medals, frames, and printing Certificates of Commemorative Medals to send to the Ministry's Office for consolidation into the annual state budget expenditure plan according to regulations.
2. Heads of agencies and units under the Ministry of Transport, Directors of Provincial Transport Departments of provinces and centrally-administered cities, and related agencies, units, and individuals shall be responsible for organizing and implementing this Circular./.
