DECREE
Regulations on the Acceptance, Management, and Utilization of International Emergency Aid for Relief and Mitigation of Natural Disasters
to rescue and mitigate the consequences of natural disasters

Pursuant toLaw on Government Organization June 19, 2015;
Pursuant toLaw on Prevention and Control of Natural Disasters June 19, 2013;
At the proposal of the Minister of Agriculture and Rural Development;
The Government promulgates this Decree stipulating regulations on the acceptance, management, and utilization of international emergency aid for relief and mitigation of natural disasters.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree stipulates the procedures for accepting, managing, and utilizing international emergency aid for relief and mitigation of natural disasters in Vietnam.
Article 2. Applicability
1. The donor is a foreign government, an international organization, an organization authorized by a foreign government, a non-governmental organization, or other foreign organizations and individuals directly providing non-reimbursable emergency aid aimed at rescuing and mitigating the consequences of natural disasters.
2. The recipient of aid is organizations established under Vietnamese law; having functions, tasks, and activities consistent with the objectives and contents of the aid, including:
a) Ministries, agencies at the ministerial level, agencies under the Government; People's Committees of provinces and centrally governed cities;
b) Central agencies of political-social organizations;
c) Vietnam Red Cross Society.
3. Beneficiaries of aid.
Agencies, organizations, households, individuals, enterprises affected by natural disasters.
4. Other agencies, organizations, and individuals related to the acceptance, management, and utilization of international emergency aid for relief and mitigation of natural disasters in Vietnam.
Article 3. Explanation of Terms
In this Decree, the following terms are understood as follows:
1. "International emergency aid for relief" refers to non-reimbursable, non-profit aid provided by the donor to implement relief activities as prescribed in Clause 1, Article 32 of the Law on Prevention and Control of Natural Disasters, approved and implemented within three months from the date of occurrence of the disaster.
2. "International emergency aid for disaster aftermath recovery" refers to non-reimbursable, non-profit aid provided by the donor to implement activities for recovering from the aftermath of natural disasters as prescribed in Clause 1, Article 30 of the Law on Prevention and Control of Natural Disasters, approved and implemented within nine months from the date of occurrence of the disaster.
3. "Managing agency" refers to the agencies mentioned in Clause 2, Article 2 of this Decree.
4. "Aid account holder" refers to organizations assigned by the managing agency to accept and manage the aid account.
5. "Aid utilization unit" refers to agencies and organizations assigned by competent authorities to utilize the aid.
6. "Decision on accepting emergency aid for relief" is the decision document of the competent authority regarding the acceptance of international emergency aid for relief, including the main contents: Name of the aid account; donor; managing agency; aid account holder; purpose of the aid; total value of the aid; allocation plan; responsibility for implementation.
7. "Decision on the policy of accepting international emergency aid for disaster aftermath recovery" is the decision document of the Prime Minister regarding the policy of accepting international aid for disaster aftermath recovery, including the main contents: Name of the aid account; donor; aid recipient; purpose of the aid; total value of the aid; allocation plan for aid.
8. "Disaster aftermath recovery international emergency aid documentation" is the document presenting: context; necessity; objectives; main content of the aid account; results, economic, social, environmental effects; total aid capital, capital structure; aid method; donor conditions (if any); form of organization and management of the aid account implementation.
State budget revenue aid includes material and monetary aid managed and spent by Vietnam according to laws on state budget and related documents.
Article 4. Principles for receiving, managing, and using aid
1. Receiving, managing, and using aid must be transparent, clear, purposeful, timely, effective, and targeted; there must be coordinated and tight cooperation among relevant ministries, sectors, localities, organizations, and individuals.
2. Do not accept goods that are prohibited from importation under the provisions of the law, aid that adversely affects the environment, public health, political security, social order, and safety, or that harms the interests of the State and the people.
3. The receipt, management, and use of aid must comply with Vietnamese laws and commitments made to the donor.
Article 5. Funding for the task of receiving aid
1. 2. For grants not from state budget revenues, the grant receiving units shall arrange on their own.
Chapter II
PROCEDURE FOR RECEIVING INTERNATIONAL URGENT GRANTS FOR RELIEF
Article 6. Procedure for receiving international urgent grants for relief
The procedure for receiving international urgent grants for relief includes:
1. Preparing to receive grants.
2. Approving the receipt of grants.
3. Implementing the receipt of grants.
Article 7. Preparing to receive grants
1. Within no more than one working day from the date of receiving information from the donor, the managing agency shall assign a subordinate unit to be the grant recipient.
2. The grant recipient shall coordinate with the donor to agree on the main contents of the international urgent grant for relief, including: form of grant, value of the grant, quantity and allocation value, method and location of receipt, and other related contents.
Article 8. Approval of the receipt of international urgent grants for relief
1. Authority to approve the receipt of international urgent grants for relief:
a) The Prime Minister approves the receipt of grants related to national security, defense, religion, grants without designated managing agencies, and grants involving import of goods within the Prime Minister's authority under the law;
b) Heads of agencies and organizations specified in Clause 2, Article 2 of this Decree have the authority to approve the receipt of grants not covered by point a of this clause.
2. Procedure for approving the receipt of international urgent grants for relief within the Prime Minister's authority:
a) The managing agency sends a document along with the application file for approval of the receipt of international urgent grants for relief to the Ministry of Agriculture and Rural Development;
b) The Ministry of Agriculture and Rural Development takes the lead in organizing opinions from relevant agencies through meetings or written consultations or other forms of consultation, and compiles the opinions to submit to the Prime Minister within a maximum of three days from the date of receiving valid files;
c) The Prime Minister reviews and approves the receipt of international urgent grants for relief.
3. Procedure for approving the receipt of international urgent grants for relief within the authority of heads of agencies and organizations specified in Clause 2, Article 2 of this Decree:
a) The grant recipient prepares the file for receiving international urgent grants for relief and submits it to the managing agency;
b) The managing agency leads in organizing opinions from relevant agencies through meetings or other forms of consultation;
c) The managing agency reviews and approves the receipt of international urgent grants for relief;
d) The time for reviewing and approving the decision to receive international urgent grants for relief shall not exceed three days from the date the managing agency receives all valid files.
4. Documents submitted to the competent authority for approval of the receipt of international urgent grants for relief include:
a) A proposal for approval of the receipt of international urgent grants for relief (content in Appendix I issued together with this Decree);
b) A document from the donor notifying or agreeing to provide the grant, list of grants (with a Vietnamese translation attached);
c) Other relevant documents concerning the grant as prescribed by law.
Article 9. Implementation of receiving international emergency aid for relief
1. After the receipt of aid has been approved by the competent authority, the recipient of the aid shall perform the following tasks:
a) Notify the Donor about the decision to receive international emergency aid for relief that has been approved by the competent authority;
b) Submit to the supervising agency for issuance of a notification document to relevant agencies to coordinate in receiving the aid;
c) Inform related agencies and localities about the plan of activities concerning the emergency aid for relief provided through the provision of experts and accompanying support animals;
d) For international emergency aid for relief provided in the form of goods: The recipient of the aid shall carry out specialized inspection procedures and customs clearance procedures in accordance with the provisions of the law;
đ) For international emergency aid for relief provided in the form of money: The recipient of the aid shall open an account to receive the aid (in cases where there is no existing aid-receiving account) or notify the aid-receiving account to the Donor (in cases where there is an existing aid-receiving account) to receive the financial support. Emergency aid for relief in foreign currency must be transferred into a foreign currency account at a credit institution licensed or sold to a licensed credit institution in accordance with the provisions of the law.
2. Based on the Decision on receiving international emergency aid for relief, the recipient of the aid shall take the lead and coordinate with relevant agencies to receive and implement the emergency aid for relief.
Chapter III
PROCEDURE FOR RECEIVING INTERNATIONAL EMERGENCY AID TO MITIGATE THE AFTERMATH OF NATURAL DISASTERS
TO MITIGATE THE AFTERMATH OF NATURAL DISASTERS
Article 10. Procedure for receiving international emergency aid to mitigate the aftermath of natural disasters
The procedure for receiving international emergency aid to mitigate the aftermath of natural disasters includes:
1. Preparing to receive grants.
2. Decision on the policy of receiving international emergency aid to mitigate the aftermath of natural disasters for cases within the approval authority of the Prime Minister.
3. Approval of the Aid Document for international emergency aid to mitigate the aftermath of natural disasters.
4. Implementation of receiving, managing, and implementing the aid.
Article 11. Preparation for receiving aid
1. The supervising agency assigns a subordinate unit to be the recipient of the aid to unify with the Donor on the main contents of the international emergency aid to mitigate the aftermath of natural disasters.
2. The recipient of the aid coordinates with the Donor to establish the Aid Document for international emergency aid to mitigate the aftermath of natural disasters according to the Model attached at Appendix II of this Decree.
Article 12. Decision on the policy of receiving international emergency aid to mitigate the aftermath of natural disasters for cases within the approval authority of the Prime Minister
1. The Prime Minister approves the policy of receiving international emergency aid to mitigate the aftermath of natural disasters for the following cases:
a) Aid with content related to national security, defense, and religion;
b) Aid for purchasing and providing goods that require the Prime Minister's permission;
c) Aid without identified supervising agencies.
2. Procedures and formalities for deciding on the policy of receiving international emergency aid to mitigate the aftermath of natural disasters within the authority of the Prime Minister
a) The supervising agency sends a document requesting approval of the policy to receive aid along with the Aid Document for international emergency aid to mitigate the aftermath of natural disasters to the Ministry of Agriculture and Rural Development for review;
b) Within three working days from the date of receipt of the document from the supervising agency, the Ministry of Agriculture and Rural Development sends a document seeking opinions from relevant agencies on the main contents including: necessity, objectives, aid funding sources, donor conditions (if any), and Vietnam's capacity to respond. The maximum time limit for relevant agencies to reply with a document is five working days from the date of receipt of the document;
c) The Ministry of Agriculture and Rural Development is responsible for reviewing and submitting to the Prime Minister for consideration and decision on the policy of receiving international emergency aid to mitigate the aftermath of natural disasters or replying to the supervising agency within a maximum of five working days from the date of completion of collecting opinions from relevant agencies for draft documents requiring explanation and revision;
d) Within a maximum of five working days from the date of receipt of the review opinion of the Ministry of Agriculture and Rural Development, the supervising agency shall provide explanations, incorporate feedback, perfect the dossier, and resubmit it to the Ministry of Agriculture and Rural Development. Within a maximum of five working days from the date of receipt of the complete dossier, the Ministry of Agriculture and Rural Development shall consider and submit to the Prime Minister;
đ) The Prime Minister considers and decides on the policy of receiving international emergency aid to mitigate the aftermath of natural disasters.
Article 13. Approval of Emergency International Aid Documents to Mitigate the Consequences of Natural Disasters
1. For emergency international aid amounts within the authority of the Prime Minister to decide on receiving: The managing agency shall approve the Emergency International Aid Documents to Mitigate the Consequences of Natural Disasters based on the Decision on the Policy for Receiving Aid.
2. For emergency international aid amounts not specified in Clause 1 of Article 12 of this Decree:
a) The managing agency shall seek opinions from the Ministry of Agriculture and Rural Development, the Ministry of Planning and Investment, the Ministry of Finance, and other relevant agencies and localities.
b) The content of the opinions includes: The appropriateness of the emergency international aid amount to mitigate the consequences of natural disasters with the specific context of the ministry, sector, or locality; the appropriateness of the implementation method of the emergency international aid amount to mitigate the consequences of natural disasters; sources of funds; commitments and conditions of the donor and participating parties (if any); the ability to meet the donor's requirements and conditions; effectiveness and sustainability after the completion of the aid amount.
c) The dossier for seeking opinions shall include: The document submitted by the managing agency to approve the Emergency International Aid Document to Mitigate the Consequences of Natural Disasters; the document of the sponsor agreeing with the content of the emergency international aid amount to mitigate the consequences of natural disasters (notification or agreement on aid); the draft of the Emergency International Aid Document to Mitigate the Consequences of Natural Disasters.
d) The relevant agencies shall have a maximum of five working days to respond in writing from the date they receive the document from the managing agency.
đ) Based on the opinions of the ministries, agencies, and localities concerned, the managing agency shall instruct the managing agency of the aid to complete the document, submit it for review and approval by the managing agency to approve the Emergency International Aid Document to Mitigate the Consequences of Natural Disasters.
e) After the Emergency International Aid Document to Mitigate the Consequences of Natural Disasters has been approved, the managing agency shall notify the Ministry of Agriculture and Rural Development, the Ministry of Planning and Investment, the Ministry of Finance, and other relevant agencies and localities.
Article 14. Adjustment of Content in the Decision on the Policy for Receiving Aid and the Decision Approving the Emergency International Aid Document to Mitigate the Consequences of Natural Disasters
1. Adjustment of Content in the Decision on the Policy for Receiving Aid
a) The managing agency shall submit a written request to adjust the content of the Decision on the Policy for Receiving Emergency International Aid to Mitigate the Consequences of Natural Disasters to the Ministry of Agriculture and Rural Development.
b) The Ministry of Agriculture and Rural Development shall take the lead in seeking opinions from the Ministry of Finance and other relevant agencies, with a maximum of five working days for the relevant agencies to respond in writing from the date they receive the opinion-seeking document from the Ministry of Agriculture and Rural Development.
c) The Ministry of Agriculture and Rural Development shall compile the opinions and submit them to the Prime Minister for consideration and decision to adjust the policy for receiving emergency international aid to mitigate the consequences of natural disasters.
2. Adjustment of the Emergency International Aid Document to Mitigate the Consequences of Natural Disasters
a) For emergency international aid amounts specified in Clause 1 of Article 12: The managing agency shall base its adjustment of the Emergency International Aid Document to Mitigate the Consequences of Natural Disasters on the Decision of the Prime Minister adjusting the policy for receiving emergency international aid to mitigate the consequences of natural disasters.
b) For emergency international aid amounts not specified in Clause 1 of Article 12:
In case there is a change in the content regarding the objectives, scale of aid, or the aid-receiving unit: Within five working days, the managing agency shall seek opinions from the Ministry of Agriculture and Rural Development and other relevant agencies on the changed contents. Based on the opinions of the Ministry of Agriculture and Rural Development and other relevant agencies, the managing agency shall decide to approve the adjustment of the Emergency International Aid Document to Mitigate the Consequences of Natural Disasters.
In case there are changes in other contents: The managing agency shall examine and decide to approve the adjustment of the Emergency International Aid Document to Mitigate the Consequences of Natural Disasters.
Article 15. Implementation of receiving, managing, and utilizing aid
Based on the content of the international emergency aid document to mitigate the consequences of natural disasters that has been approved by the competent authority, the recipient of the aid implements the receipt, management, and utilization of the aid according to the regulations. Supplement
Chapter IV
MANAGEMENT OF INTERNATIONAL EMERGENCY AID FOR RELIEF AND
MITIGATION OF THE CONSEQUENCES OF NATURAL DISASTERS
Article 16. Principles for financial management of international emergency aid for relief and mitigation of the consequences of natural disasters
1. For international emergency aid for relief and mitigation of the consequences of natural disasters from state budget revenue and expenditure tasks, it shall be implemented in accordance with the laws on state budget management.
2. For international emergency aid for relief and mitigation of the consequences of natural disasters not from state budget revenue, the recipient manages and uses the aid according to the aid agreement signed with the donor, in compliance with Vietnamese law, the charter and operational rules of the recipient, and accounting regulations.
Article 17. Opening an account to receive aid
1. According to the aid agreement or management requirements, the recipient may open an account at the State Treasury where transactions take place to receive and utilize the aid funds directly managed and used by the recipient.
2. The procedures for opening an account and the management and use of the account shall be carried out in accordance with the regulations of the State Treasury.
3. For aid not from state budget revenue, the recipient may open an account at a commercial bank in Vietnam.
Article 18. Financial planning for aid from state budget revenue
1. For aid within the scope of the state budget, annually in accordance with the laws on state budget management, the recipient prepares the budget estimate of non-reimbursable aid revenue and expenditure, reports to the competent authority for decision-making, and sends to the same-level finance agency for consolidation into the state budget estimate, submitted to the authorized body for approval.
2. In cases where new non-reimbursable aid arises but is not included in the budget estimate allocated and assigned by the authorized body, the recipient prepares supplementary estimates in accordance with the state budget law or includes them in the next year's budget estimate as the basis for recording income and expenditure in the state budget.
3. For aid not from state budget revenue, the recipient prepares the budget estimate and reports to the authorized body for decision-making.
Article 19. Management of monetary and in-kind aid for aid from state budget revenue
1. For non-reimbursable monetary aid:
a) The recipient implements expenditures according to the provisions of the aid agreement;
b) The State Treasury implements expenditure control according to the state budget management regulations;
c) Monthly or each time expenses occur, the recipient prepares the necessary documentation to record non-reimbursable aid revenue and state budget expenditure according to the budget classification.
2. For in-kind aid:
a) Based on relevant documents and actual goods delivery, the recipient prepares the necessary documentation to send to the State Treasury for recording state budget revenue and expenditure;
b) Based on documents and records, the State Treasury implements expenditure control and records state budget revenue and expenditure;
c) Customs documents and customs procedures for non-reimbursable aid imports from abroad shall be carried out in accordance with the customs law.
Article 20. On Tax Policies for Aid Goods
1. Tax, fee, and charge policies for non-repayable aid capital shall be implemented in accordance with the laws on tax, fees, and charges.
2. Procedures and documents for tax exemption/refund for non-repayable aid shall be carried out in accordance with the laws on tax administration and customs.
Article 21. Accounting, Bookkeeping, and Settlement
1. Accounting, bookkeeping, and settlement for aid funds from state budget revenues shall be conducted in accordance with the laws on state budget management.
2. Accounting, bookkeeping, and settlement for aid funds not from state budget revenues shall be conducted in accordance with the laws on accounting and the charter of the recipient organization's operations.
Article 22. Audit of Aid Reports
1. Non-repayable aid funds from state budget revenues shall be subject to audit according to the laws on state audit.
2. Non-repayable aid funds not from state budget revenues shall be audited by independent auditing organizations for entities within the scope defined by the laws on independent auditing or at the request of the donor and must comply with Vietnam’s laws on auditing.
Chapter V
INSPECTION, EVALUATION OF RECEIVING, MANAGING AND USING AID AND INFORMATION REPORTING SYSTEMS
GRANTS AND INFORMATION, REPORTING SYSTEMS
Article 23. Principles for Inspection and Evaluation of Receiving, Managing and Using Aid
1. Inspection and evaluation of aid implementation shall be comprehensive, systematic, and objective to promptly identify and address issues, difficulties, and violations during the process of receiving, managing, and using emergency international aid for disaster relief and aftermath recovery.
2. In accordance with the objectives, targets, scope, and content of the approved aid.
3. Information for inspection and evaluation of receiving, managing, and using aid must be complete, timely, accurate, truthful, and transparent.
4. Inspection and evaluation results must be publicized and properly stored.
Article 24. Content of Inspection and Evaluation
1. Implementation status of receiving, managing, and using aid as approved by competent authorities.
2. Information reporting systems.
3. Difficulties, obstacles, and emerging issues during the process of receiving, managing, and using aid.
4. Solutions for existing difficulties, obstacles, and emerging issues during the process of receiving, managing, and using aid.
Article 25. Methods and Procedures for Conducting Inspections and Evaluations
1. Inspection and evaluation of receiving, managing, and using aid shall be conducted through the following methods:
a) Through reports.
b) Establishing an Inspection and Evaluation Team.
2. Inspection and evaluation work shall be conducted regularly (before, during, and after receiving aid) and ad hoc (when necessary).
3. The procedure for inspecting and evaluating the receiving, managing, and using of aid includes:
a) Drafting and submitting for approval the Inspection and Evaluation Plan.
b) Establishing the Inspection and Evaluation Team (if necessary).
c) Notifying the Inspection and Evaluation Plan and requesting preparation of documents for inspection.
d) Conducting the inspection and evaluation.
đ) Summarizing and reporting the results of the inspection and evaluation.
e) Announcing the inspection results and concluding the inspection and evaluation.
Article 26. Responsibility for inspecting and evaluating the acceptance, management, and use of aid
1. The managing agency shall take the lead in coordinating with relevant agencies to inspect and evaluate the acceptance and implementation of aid grants.
2. The aid-using entity shall be responsible for providing information and data related to serving the inspection and evaluation of the acceptance, management, and use of aid.
3. The managing agency shall be responsible for covering all expenses incurred in conducting inspections and evaluations, including travel expenses for staff assigned to perform inspection and evaluation tasks and other related costs funded from the managing agency's budget.
Article 27. Information and Reporting System
1. Information Disclosure System:
a) The aid provider shall publicly disclose information about approved aid grants on their official website or electronic portal.
b) People's Committees at all levels shall publicly disclose the beneficiaries, support policies, and support levels for beneficiaries through mass media or by posting information at their offices.
2. Reporting System:
a) Aid-using entity: report to the aid provider on the progress of receiving and using aid within five working days from the completion of the aid implementation and provide ad hoc reports as requested by the aid provider;
b) Aid provider: report to the managing agency on the situation of receiving, managing, and using aid within a maximum of five working days from the date of receipt of the aid-using entity's report;
c) Managing agency: report to the Ministry of Agriculture and Rural Development, the Ministry of Planning and Investment, and the Ministry of Finance on the content of received aid within a maximum of three working days from the date of approval of the decision to accept and allocate aid;
d) The Ministry of Agriculture and Rural Development shall be responsible for compiling and reporting to the Prime Minister on the situation of receiving and implementing emergency aid due to natural disasters when required.
Chapter VI
RESPONSIBILITIES OF THE AGENCIES IN RECEIVING AND IMPLEMENTING INTERNATIONAL EMERGENCY AID FOR RELIEF AND MITIGATION OF NATURAL DISASTER AFTERMATHS
AND IMPLEMENTATION OF INTERNATIONAL URGENT GRANTS FOR RELIEF
AND MITIGATION OF DISASTER AFTERMATH
Article 28. Responsibilities of the managing agency
In addition to the responsibilities stipulated in Chapters I, II, III, IV, and V of this Decree, the managing agency shall also be responsible for:
1. Directing subordinate units to cooperate with functional agencies to understand and contact the donor to seek and secure aid.
2. Directing, guiding, and inspecting the aid provider in the process of accepting, managing, and implementing aid according to current regulations and fulfilling commitments to the donor.
3. Monitoring and evaluating the acceptance and implementation of aid grants; promptly identifying and addressing any issues, difficulties, or violations during the implementation of aid reception and usage processes, or reporting to competent authorities for handling.
4. Timely allocating sufficient funds for aid reception as decided and approved.
5. Being accountable to the Government for the quality, effectiveness, and progress of aid implementation in accordance with legal provisions.
6. Fully complying with the reporting system as prescribed in Clause 2 of Article 27 of this Decree.
Article 29. Responsibilities of the Recipient of Aid
In addition to the tasks and authorities stipulated in Chapters I, II, III, IV, and V of this Decree, the recipient of aid shall have the following tasks and authorities:
1. To receive, manage, and implement the aid according to current regulations and in accordance with the commitments made with the Donor. For aid in the form of goods, the recipient of aid must complete all necessary procedures for customs clearance within 48 hours from the time the goods arrive in Vietnam to promptly allocate the goods to localities (except for goods that require specialized inspection).
2. To promptly report to the supervising authority any difficulties, obstacles, violations during the process of receiving and implementing aid, or to notify relevant authorities to handle such issues.
3. To be responsible before the supervising authority for the quality, effectiveness, and progress of implementing aid in compliance with legal provisions.
4. To fully comply with reporting requirements as stipulated in Clause 2, Article 27 of this Decree.
Article 30. Tasks of Relevant Authorities in Receiving and Implementing Aid
1. Ministry of Agriculture and Rural Development:
a) Is the lead agency for state management of international emergency aid for disaster relief and recovery;
b) To submit to the Prime Minister for consideration and approval the receipt of international emergency aid for disaster relief under the Prime Minister's decision-making authority;
c) To compile and submit to the Prime Minister for consideration and decision on the policy of receiving international emergency aid for disaster recovery related to national security, defense, religion, and procurement of goods requiring the Prime Minister's permission;
d) To take the lead and coordinate with relevant agencies to submit to the Prime Minister for consideration and decision on the policy of receiving emergency aid for disaster recovery when the managing agency has not been determined;
đ) To direct units to resolve as quickly as possible cases involving goods subject to quarantine for animals and plants, veterinary drugs, vaccines for disease prevention, equipment and tools for veterinary work, and other items under the management of the Ministry of Agriculture and Rural Development as prescribed by law;
2. Ministry of Finance:
a) To appoint a focal point to provide guidance and support on procedures to facilitate the rapid customs clearance of aid goods;
b) To guide financial management for international emergency aid for disaster relief and recovery included in state budget revenue and expenditure as stipulated in this Decree within its authority;
c) To inspect the implementation of financial management systems by the managing agencies and aid users;
d) To participate in opinions on the receipt of aid as prescribed;
đ) To manage state finances for aid included in state budget revenue.
3. Ministry of National Defense:
a) To participate in coordination with relevant agencies in assessing and receiving aid related to national defense;
b) To grant permission for foreign military ships and aircraft to transport aid goods into Vietnam in accordance with legal provisions;
c) To coordinate with competent agencies in managing and controlling foreign personnel involved in transporting aid goods on foreign military ships and aircraft to Vietnam.
4. Ministry of Public Security:
a) To participate in coordination for inspections of aid involving national security and confidentiality under the management of the Ministry of Public Security when required;
b) To coordinate in inspecting and handling violations of laws related to the management and use of international emergency aid for disaster relief and recovery.
5. The Ministry of Health:
a) To direct units to carry out specialized inspections of aid goods under the management of the Ministry of Health as prescribed by law in the shortest time possible;
b) To participate in opinions on the receipt of aid as prescribed.
6. Ministry of Industry and Trade:
To resolve cases related to the receipt of aid goods under the management of the Ministry of Industry and Trade as prescribed by law.
7. Ministries, ministerial-level agencies, government agencies, provincial People's Committees directly under the central government, according to their assigned functions and tasks, mobilize donations and receive emergency aid for disaster relief and recovery; coordinate in the receipt of aid goods under their management as prescribed by law.
8. Provincial People's Committee shall be responsible for:
a) To coordinate with the managing agency in determining the need for assistance and implementation plans for the aid;
b) To direct competent agencies to receive and distribute aid to beneficiaries;
c) To monitor and inspect the distribution of aid to ensure it is prompt, appropriate, and in compliance with legal provisions;
d) To fully comply with information and reporting requirements as prescribed.
Chapter VII
IMPLEMENTING PROVISIONS
Article 31. Effective Date
This Decree takes effect from June 15, 2020.
Article 32. Responsibility for Implementation
The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under central cities, and related agencies, organizations, and individuals shall be responsible for implementing this Decree./.
