DECISION OF THE MINISTER OF HOME AFFAIRS
REGULATIONS ON THE FUNCTIONS, DUTIES, POWERS AND ORGANIZATION OF THE DEPARTMENT OF ORGANIZATIONAL STAFF
THE MINISTER OF THE MINISTRY OF HOME AFFAIRS
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No. 45/2003/NĐ-CP dated May 9, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
At the proposal of the Director of the Cadre and Civil Servant Department,
DECISION:
Article 1. Position and Functions
The Department of Organizational Staff is an organization under the Ministry of Home Affairs, with the function of advising the Minister to manage organizational structures and cadres, civil servants, and public officials of the Ministry of Home Affairs and some tasks related to the construction and development of the State Organization sector according to the regulations of the Party and the State and within the scope of state management authority of the Ministry.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Assist the Minister in drafting documents for competent authorities to promulgate legal normative documents on organizational structures and cadres, civil servants, and public officials of the Ministry and sector.
2. Draft regulations on functions, duties, powers, and organizational structure of units under the Ministry for approval by the Minister. Research, propose, and implement projects to improve the organizational structure of the Ministry.
3. Take the lead and coordinate with units within the Ministry to draft documents and projects on cadre work for approval by the Minister and guide their implementation:
a) Cadre planning;
b) Training and capacity building plans for the cadre workforce of the Ministry;
c) Projects on the division of management responsibilities among cadres, civil servants, and public officials of the Ministry's organizations;
d) Internal management regulations on organizational staff work, working relationships between organizations under the Ministry, authorities, and responsibilities of heads of organizations within the Ministry's structure;
đ) Guide and organize the implementation of documents after they have been approved.
4. Review and submit to the Minister for decision within his/her authority issues concerning the appointment, dismissal, reappointment, rotation, resignation of leading cadres and civil servants; recruitment, hiring, acceptance, transfer, assignment, promotion, salary grade adjustment, dispatch for work, study, training both domestically and abroad, rewards, disciplinary actions, termination of employment, retirement... for cadres and civil servants of the Ministry; regulations on professional standards and positions for the cadre and civil servant workforce of the Ministry. Guide and organize the implementation of decisions after the Minister has issued them.
5. Implement certain tasks related to the construction and development of the State Organization sector:
a) Draft regulations on professional standards for heads of specialized agencies under provincial People's Committees and municipal People's Committees directly under the Central Government according to current general regulations of the State;
b) Draft and implement annual plans for training and capacity building in professional knowledge and updating information on State organizational work for the cadre and civil servant workforce of the Ministry and the State Organization sector.
c) Implement certain policies for cadres, civil servants, and public officials of the State Organization sector (including retired cadres, civil servants, and public officials of the Ministry) according to State regulations and directives from the Minister.
d) Monitor the situation and compile statistics on the quantity and quality of professional knowledge and skills of the cadre and civil servant workforce of the State Organization sector to serve the development of the sector.
6. Draft and submit to the Minister for approval and allocation of staffing levels and implement annual staffing and salary plans of the Ministry.
7. Implement regulations on the evaluation and summary assessment of the annual performance of cadres, civil servants, and public officials under the Ministry of Home Affairs according to general State regulations and those of the agency.
8. Organize and coordinate with units under the Ministry to implement regulations of the Party and State and those of the agency regarding measures to strengthen discipline, anti-corruption, thrift, bureaucracy, and negative manifestations among cadres, civil servants, and public officials of the Ministry.
9. Implement political internal security work, security work, and total people's defense work of the agency according to the directives of the Minister.
10. Carry out the work of the Office of the Party Committee of the Ministry of Home Affairs and the Party Committee of the Ministry of Home Affairs.
11. Assist the Minister in researching and resolving complaints and accusations about organizational and cadre work of the Ministry and the State Organization sector according to the division of labor and directives of the Minister.
12. Implement reporting systems on organizational and cadre work of the Ministry to relevant agencies according to general regulations of the Party and State.
13. Lead or participate in scientific research according to assigned functions and tasks. Apply information technology in professional work. Implement statistical and data compilation work on organizational structures and cadres, civil servants, and public officials of the Ministry and sector and cooperate with the Information Technology Center to apply information technology in managing, exploiting, and using data to serve leadership and management by the Ministry.
14. Compile content for mid-term and final reports on organizational and cadre work of the Ministry and sector to serve mid-term and final reviews by the Ministry.
15. Organize the management of cadre, civil servant, and public official files of the agency according to State and agency regulations.
16. Perform other tasks assigned by the Minister.
Article 3. Organization and Working System
1. The Department has a Director, several Deputy Directors, and civil servants;
2. The Director shall be responsible to the Minister for organizing and implementing the tasks specified in Article 2 and shall have the following specific duties and powers:
a) Organizing and directing the implementation of the Department's tasks and being accountable to the Minister for all aspects of the Department's work;
b) Assigning tasks, supervising, urging, and inspecting the implementation of tasks by Deputy Directors and civil servants in the Department;
c) Sign on behalf of the Minister to respond, clarify, provide guidance on business matters, and request the provision of information from organizations with functions and tasks related to the management of organizational and cadre work of state agencies or individuals regarding issues related to the management of organizational and cadre work;
d) Coordinate with organizations within the Ministry and relevant agencies in resolving issues related to the Department's functions, tasks, and powers;
đ) Implement information dissemination for civil servants in the Department according to the Ministry's working regulations;
e) Decide on the contents of reports, summaries, conclusions, and recommendations to the Minister regarding policies and solutions in implementing the Department's tasks;
f) Implement the Ministry's regulations; manage civil servants and assets allocated according to the Ministry's delegation;
3. The Deputy Department Head performs professional tasks and assists the Department Head in managing one or several aspects of work as assigned by the Department Head; is responsible to the Department Head for the assigned tasks.
4. Civil servants carry out specialized tasks assigned by the Director and are accountable to the Director for performing those tasks.
5. The Department operates under a specialist system combined with a chief executive system; in cases where the Ministry leadership works directly with Deputy Department Heads or specialists, Deputy Department Heads and specialists are responsible for implementing the leadership's opinions and promptly reporting back to the Department Head thereafter.
Article 4. Effectiveness and Responsibility for Implementation
1. This Decision takes effect fifteen days from the date of signing;
2. The Director of the Department of Organizational Staff, the Director of the Ministry's Office, Heads of related organizations under the Ministry, and civil servants are responsible for implementing this Decision./.
