||| JOINT CIRCULAR NO. 51/2003/TTLT-BTC-BTTĐCTUBTWMTTQVN OF THE MINISTRY OF FINANCE - THE STANDING COMMITTEE OF THE NATIONAL FRONT FOR THE STRUGGLE FOR PEACE AND NATIONAL DEFENSE ON GUIDELINES FOR FUNDS TO DIRECT AND OPERATE THE PEOPLE'S INSPECTION BOARD AT THE COMMUNE, WARD, AND TOWN LEVELS
Pursuant to the Inspection Law issued by the State Council on March 29, 1990;
Pursuant to Decree No. 241/HĐBT dated August 5, 1991 of the Council of Ministers (now the Government) on the organization and operation of the People's Inspection Board.
To create favorable conditions for the People's Inspection Board at the commune, ward, and town levels to operate effectively; the Ministry of Finance and the Standing Committee of the National Front for the Struggle for Peace and National Defense issue guidelines for funds to direct and operate the People's Inspection Board at the commune, ward, and town levels as follows:
2. Individuals who have registered as the principal investigator of a Research Project or Pilot Production Project and those participating in its implementation shall not participate in the Evaluation and Selection Council for that Research Project or Pilot Production Project (hereinafter referred to as the Council). In necessary cases, members of the Council may be staff members of the organization registering as the principal investigator of the Research Project or Pilot Production Project, but not more than one person and they cannot serve as Chairperson, Vice-Chairperson, or reviewing member.
1. Each year, based on the budget estimate for organizing and directing people's inspection work at all levels of the Vietnam Fatherland Front, the state budget at the same level shall ensure sufficient funding for the Vietnam Fatherland Front to organize and direct people's inspection work.
2. The operating expenses of the People's Inspection Board at the commune, ward, and town levels (hereinafter referred to collectively as the commune level) shall be submitted by the provincial People's Committee to the same-level People's Council for balancing and allocating to the commune budget so that the commune People's Committee can provide sufficient funding for the People's Inspection Board to operate and transfer management of the funds to the commune-level Vietnam Fatherland Front.
3. Based on current financial and budget management regulations and the provisions of this Circular, the provincial People's Committee shall take the lead and coordinate with the same-level Vietnam Fatherland Front to guide, direct, urge, and inspect the commune level to ensure sufficient funding for the People's Inspection Board. The use of funds by the People's Inspection Board at the commune level must comply with regulations, serve the intended purpose, be economical, and be effective.
II. SPECIFIC PROVISIONS
1. Expenditure items.
1.1. Expenditures for directing and organizing people's inspection activities by the Vietnam Fatherland Front at all levels.
a. Expenditures for implementation work: Propaganda among the people about the Party's policies, state laws on the organization and operation of people's inspection (holding meetings, printing and purchasing materials, publishing products, publicizing through mass media about people's inspection work...).
b. Expenditures for training the business skills of members of the People's Inspection Board.
c. Expenditures for regular monthly coordination meetings of the provincial and district-level Vietnam Fatherland Front; supervision and urging during the process of directing lower levels according to established regulations.
d. Expenditures for annual mid-year and end-of-year reviews on people's inspection work.
đ. Expenditures for rewarding individuals and organizations with outstanding achievements annually.
1.2. Expenditure items for the operation of the People's Inspection Board at the commune level.
a. Expenditures for purchasing office supplies and expenditures for communication work: Work diaries, pens, writing paper, stamps...
b. Conference fees and travel expenses.
c. Payment for remuneration to inspectors directly implementing inspection work according to approved plans.
d. Expenditures for meetings to discuss cases of law violations.
đ. Expenditures for training inspectors when collaborating with state inspection organizations upon request.
1.3. The minimum expenditure for each People's Inspection Board at the commune level is 1,500,000 VND/year (one million five hundred thousand dong per year).
2. Budget preparation, execution, and settlement.
The preparation, execution, and settlement of the budget are carried out in accordance with the State Budget Law and the guiding documents of the Government and the Ministry of Finance regarding the decentralization, preparation, execution, and settlement of the state budget and commune budget. This Circular provides additional guidance on the following matters:
2.1. Each year, along with preparing the budget for the operation of the Vietnam Fatherland Front, the Standing Committee of the Vietnam Fatherland Front at all levels shall prepare a budget to ensure the organization and direction of people's inspection work according to the guidance in Section II - Point 1.1 of this Circular and submit it to the finance department at the same level for consolidation and submission to the competent authority for decision.
2.2. Each year, based on the plan of activities of the People's Inspection Board at the commune level, the Standing Committee of the Vietnam Fatherland Front at the commune level shall prepare a budget together with the regular operational budget of the commune-level Vietnam Fatherland Front according to the guidance in Section II - Point 1.2 of this Circular and submit it to the same-level People's Committee for consolidation and reporting to the district-level People's Committee for consolidation and reporting to the provincial People's Committee for submission to the same-level People's Council for decision. After the budget is allocated, the commune People's Committee shall report to the same-level People's Council for specific decisions on the commune-level Vietnam Fatherland Front budget, including the budget for the People's Inspection Board.
The Standing Committee of the commune-level Vietnam Fatherland Front is responsible for settling the expenditure of the People's Inspection Board together with the expenditure of the commune-level Vietnam Fatherland Front and submitting it to the finance department for consolidation and reporting to the commune People's Committee for approval in the commune budget settlement according to current regulations.
III. IMPLEMENTATION
1. Financial authorities at all levels shall regularly and urgently conduct inspections of the allocation, management, and use of funds to ensure that the funds allocated for the organization and operation of the People's Inspection Board at the commune level are used in accordance with the expenditure items, comply with regulations, and are effective.
2. The Vietnam Fatherland Front at the provincial level is responsible for coordinating with the same-level financial authorities to inspect the use of funds for the organization and operation of the People's Inspection Board at the commune level in accordance with this Circular and report annually to the Ministry of Finance and the Central Committee of the Vietnam Fatherland Front on the situation and results of implementation.
3. This Circular takes effect 15 days from the date of publication in the Official Gazette. During the implementation period, if there are difficulties, the provincial People's Committees and Vietnam Fatherland Fronts shall compile opinions and send them to the Ministry of Finance and the Standing Committee of the Central Committee of the Vietnam Fatherland Front for consideration and resolution.
