Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Information Technology dated June 29, 2006;

Pursuant to Decision No. 246/2005/QĐ-TTg dated October 6, 2005 of the Prime Minister approving the Strategy for the Development of Information Technology and Telecommunications until 2010 and orientations until 2020;

Considering the proposal of the Minister of Posts and Telecommunications,

DECISION:

Clause 4 of Article 6Approves the Program for the Development of the Software Industry in Vietnam until 2010 with the following main contents:

I. VIEWS AND DEVELOPMENT OBJECTIVES

Clause 1. Views

The software industry is a knowledge-based economy sector, high technology, with significant added value, generating high export values, making important contributions to the industrialization and modernization cause. The State particularly encourages and creates all favorable conditions to attract investment and develop this industry into a key economic sector in the national economy.

Developing human resources in both quantity and quality is the decisive condition for the success of the software industry. The State strengthens investment and encourages socialization of training activities, development of information technology human resources, while intensifying research and development activities in the software industry, closely combining training, scientific research, technological development, and production.

It is necessary to focus on information technology services, initially outsourcing software and services for foreign countries, while simultaneously expanding domestic markets, concentrating on developing some key software products that yield high socio-economic benefits, replacing imported software products, and meeting the needs of applying information technology in Vietnam.

Clause 2. Objectives

By 2010, the Vietnamese software industry will achieve the following basic goals:

- Average growth rate reaching about 35-40% per year. Total revenue from software and software services exceeding $800 million per year, with export value accounting for at least 40%;

- Total number of software development and software service personnel reaching approximately 55,000 to 60,000 people, with average product value reaching $15,000 per person per year;

- Establishing more than 10 software enterprises with workforce scale over 1,000 people and 200 software enterprises with workforce scale over 100 people;

- Belonging to the leading group of countries attracting direct foreign investment in the software sector and entering the list of the top 15 countries providing attractive outsourcing software services worldwide;

- Reducing the rate of intellectual property rights violations in the software sector to the regional average level.

II. POLICIES AND SOLUTIONS FOR DEVELOPMENT

1. Improving the legal environment, enhancing state management capacity, and supporting the development of the software industry

- Building and promulgating specific regulations on preferential investment for the development of the software industry and information technology services;

- Studying and building and promulgating management regulations and norms for information technology projects, especially software projects;

- Building and promulgating regulations on the export and import of software products and services consistent with the integration roadmap and commitments of Vietnam;

- Strengthening and enhancing the operational capacity and staff strength of state management agencies for the software industry;

- Establishing the Vietnam Institute of Software Industry and Digital Content - a public institution under the Ministry of Posts and Telecommunications, with the function of coordinating and supporting state management agencies in researching, building, and implementing mechanisms, policies, solutions, and measures to support the development of the Vietnamese software industry;

- Concentrating on perfecting legal provisions on intellectual property rights in the software sector, including registration for protection of intellectual property rights, regulations on acts of infringement, forms, and sanctions for punishment;

- Enhancing the effectiveness of enforcement to protect intellectual property rights in the software sector. Building and implementing training programs, upgrading, and disseminating knowledge of intellectual property laws in the software sector for judicial officials, legal advisors, organizations, agencies, enterprises, and citizens. Strictly handling violations of intellectual property rights in the software sector according to the law;

- Perfecting the system of statistical indicators for the software industry according to the national economic classification system.

2. Vigorously developing human resources for the software industry

a) Increasing the quantity and improving the quality of information technology training in university and college systems

- Accelerating the implementation progress of the Program for the Development of Information Technology Human Resources until 2010 issued by Decision No. 331/QĐ-TTg dated April 6, 2004 of the Prime Minister;

- Expanding the scale of training and rapidly increasing enrollment quotas for information technology majors in universities, colleges, and vocational schools. Improving the quality of information technology training, strengthening courses on analysis, design, system architecture, application development, and management skills in information technology departments of universities and colleges. Closely linking training with industrial production. Updating and modernizing information technology training programs according to international standards; transferring information technology training programs from advanced countries; enhancing the qualifications of lecturers; investing in equipment and network systems to ensure practical training conditions for students;

- Encouraging organizations, individuals, and businesses, both domestic and foreign, to invest in establishing information technology training institutions; promoting the establishment of private high-quality information technology universities; attracting and creating favorable conditions for international universities to establish information technology training facilities in Vietnam;

- Implementing the program of training information technology engineers/bachelors in foreign languages according to the 1+4 model (one year of language training and four years of specialized training in that language);

- Strengthening second-degree training programs in information technology for graduates from other fields;

- Increase the quota for information technology students participating in overseas training programs funded by the state budget according to Project 322 of the Ministry of Education and Training.

b) Promote non-formal and short-term training programs on information technology.

- Encourage the expansion of scale and enhancement of quality of information technology training at private training institutions. Develop and standardize non-formal training programs, textbooks, certificates, and diplomas for information technology training; organize evaluations, recognitions, and equivalency certifications for certificates and diplomas issued by international information technology training organizations.

- Develop curricula and organize short-term advanced and specialized training courses on skills and technologies for software human resources teams.

- Implement the 4+1 program, under which graduates from foreign language, science, engineering, and economics fields will receive an additional year of information technology training to become information technology specialists.

- Strengthen international cooperation, implement programs and projects aimed at developing software human resources oriented towards key markets.

- Prioritize, support, and create favorable conditions for information technology businesses to invest in developing software human resources; encourage the implementation of training and research models integrated with production in information technology businesses.

- Promote labor export programs in information technology, enhance international cooperation to exchange experts, transfer technology, and implement training programs linked to work with foreign partners.

3. Enhance investment capital for the software industry.

- Mobilize domestic resources to the maximum extent possible, including resources from businesses, society, and the state budget to invest in developing the software industry.

- Encourage localities, especially cities where many information technology training institutions are concentrated, to increase budgetary investment for the development of the software industry; create all favorable incentives and support for business development; build infrastructure to attract investment in the software industry and develop information technology human resources.

- Promote activities to attract foreign investment and investments from overseas Vietnamese in building software product and service development centers in Vietnam.

- Focus on investing in and upgrading centralized software industrial parks, particularly in major cities with numerous universities and colleges specializing in information technology.

- Study the establishment of a software industry development fund from contributions by software businesses and support from the state budget.

- Encourage the development of venture capital funds in the information technology sector; establish mechanisms to insure risks for software industry development investments.

4. Develop domestic and international information technology markets.

- Promote the application of information technology and software solutions in operational processes and production lines of agencies, organizations, and businesses.

- Conduct surveys to collect information about the domestic information technology application market and publish it on the software industry portal. Agencies, units, organizations, and businesses that have information technology projects funded by the state budget or state-originated funds must publicly disclose project information on the software industry portal.

- Concentrate investment and research and development on key Vietnamese software products and services, and support the development of markets for these key products.

- Conduct surveys, assessments, and regularly update lists of domestically produced information technology products and solutions to recommend their purchase and use in information technology application projects funded by the state budget or state-originated funds.

- Establish a multilingual software industry portal to provide information about Vietnamese software businesses and products to customers and partners both domestically and internationally, while providing market information to software businesses.

- Research and develop certification and evaluation schemes for software quality to assist agencies, organizations, and businesses in evaluating and selecting products.

- Promote trade promotion and foreign investment attraction activities for the software industry; support businesses in researching, understanding markets, marketing, and promoting software products and services abroad; build a brand image for the Vietnamese information technology industry, particularly the software industry.

5. Support and enhance competitiveness for software businesses.

- Encourage joint ventures and collaborations among small and medium-sized software businesses, support the development of some large software businesses to build reputable brands capable of competing in the international market.

- Establish and support the development of connections between software businesses and information technology training and research institutions; between software businesses and financial, banking, and insurance organizations to create support for human resource development, increase investment capital, and insure risks for software businesses.

- Encourage and support software businesses to invest in applying international quality management processes (such as CMM, CMMI, ISO). Prioritize businesses with international quality assurance process certifications when bidding for information technology projects of government agencies. The state will partially fund software businesses with projects to develop international quality assurance processes such as CMM, CMMI, or equivalent standards. Research and develop Vietnamese software industry standards and processes based on international standards and support businesses interested in implementing them.

- Prioritize investment in research and development projects for software products of research institutions and enterprises that meet the criteria of creating high-value-added products and services, satisfying market demands, especially export markets;

- Support software enterprises in technology transfer;

- Allow Vietnamese enterprises with open-source software research and development projects and application software projects serving state agencies to enjoy preferential credit policies from the State. Vietnamese enterprises with software outsourcing contracts and software service contracts for foreign countries shall benefit from preferential export credit policies from the State;

- Develop and promote implementation of programs and projects to support, develop, and enhance the competitiveness of software enterprises in localities with sufficient human resources and infrastructure, particularly in Ho Chi Minh City, Hanoi, and Da Nang. Utilize funding sources, especially ODA funds, to support the development of small and medium-sized software enterprises;

- Increase the proportion of foreign personnel in wholly foreign-owned software enterprises;

6. Promote the application and development of open-source software;

- Vigorously implement the overall project on the application and development of open-source software in Vietnam approved by Decision No. 235/QD-TTg dated April 6, 2004 of the Prime Minister;

- Prioritize the use of open-source software in information technology projects funded by state budget or derived from state budget funds. Establish a list and database of open-source software products to recommend their purchase and use to organizations, agencies, and enterprises;

- Organize seminars, training courses, and compile and distribute materials to raise awareness about the benefits and guide the use of open-source software for civil servants, public officials, and citizens;

- Invest in research and development and encourage the use of key open-source software products capable of replacing commercial software and applications on open-source platforms;

- Support and develop businesses engaged in open-source software and related services. Provide incentives and encourage organizations and enterprises to provide support services for the use of open-source software;

- Support and promote the training and development of human resources for open-source software and Vietnamese open-source software communities. Organize training programs on the application of open-source software for civil servants, public officials, and IT users at national IT training centers;

7. Strengthen telecommunications and Internet infrastructure for the software industry;

- Focus on investing in modern and advanced technologies to develop broadband telecommunications and Internet infrastructure to meet the quality and cost requirements of the software industry's development;

- Offer preferential Internet bandwidth for concentrated software industrial parks and enterprises with large software outsourcing and service revenues for foreign countries. Study allowing key software industrial parks to establish direct connections to the international Internet system;

III. BRANCH PROGRAMS AND KEY PROJECTS;

1. Branch Programs;

- The program to support, develop, and enhance the competitiveness of software enterprises in localities with adequate human resources and infrastructure, particularly in Hanoi, Da Nang, and Ho Chi Minh City, to be established and implemented by the People's Committees of these localities and directed by the Posts and Telecommunications Departments;

- The program to build and promote the development of concentrated software industrial parks in Ho Chi Minh City, Hanoi, and Da Nang, to be established and implemented by the People's Committees of these cities and directed by the Posts and Telecommunications Departments;

2. Key Projects;

- The project to accelerate the development of human resources and strengthen the quantity and improve the quality of IT training, to be jointly implemented by the Ministry of Education and Training and the Ministry of Posts and Telecommunications;

- The project to build a brand image for the Vietnamese software industry, enhance trade promotion, and develop the market for software outsourcing and exports, to be jointly implemented by the Ministry of Posts and Telecommunications and the Ministry of Trade in collaboration with the Vietnam Software Association (VINASA);

- The project to develop key software products and services in Vietnam, to be jointly implemented by the Ministry of Posts and Telecommunications and the People's Committees of provinces and centrally-administered cities in collaboration with VINASA;

- The proposal to establish a fund for the development of the software industry, to be jointly developed and submitted to the Prime Minister for consideration and decision by the Ministry of Posts and Telecommunications and VINASA;

- The project to enhance the capabilities of software enterprises and support the adoption of production processes ensuring international standards, to be jointly implemented by the Ministry of Posts and Telecommunications and the People's Committees of provinces and centrally-administered cities;

- The project to invest in building the Institute of the Software Industry, to be led by the Ministry of Posts and Telecommunications;

- The project to build and operate the portal for the software industry, to be jointly implemented by the Ministry of Posts and Telecommunications and VINASA;

IV. FINANCIAL RESOURCES FOR IMPLEMENTATION OF THE PROGRAM;

The State prioritizes the allocation of financial resources for the implementation of the Program. The total financial resources required for the Program amount to approximately 70 million USD, of which 30% comes from the central government budget, 30% from local government budgets, and 40% is raised from enterprises, associations, ODA funds, and other sources;

1. The Ministry of Posts and Telecommunications shall take the lead and coordinate with relevant ministries, ministerial-level agencies, governmental agencies, and provincial and centrally-administered city people's committees to organize the implementation of this Program.

2. The ministries, ministerial-level agencies, agencies under the Government, provincial People's Committees, and centrally governed cities, in addition to implementing the branch programs and key projects listed in Part III of Article 1, must also base their actions on the contents of the Program, particularly the policies and measures set forth in Part II of Article 1, to develop and implement appropriate programs, projects, and plans. The implementation of these programs, projects, and plans must ensure effective coordination and integration with other information technology programs, projects, and plans.

3. Specific responsibilities of ministries, sectors, and localities

a) The Ministry of Posts and Telecommunications shall take the lead and coordinate with the Ministry of Planning and Investment, the Ministry of Finance, the Ministry of Justice, the Ministry of Trade, the Ministry of Education and Training, and related ministries and sectors to implement measures aimed at perfecting the legal environment, enhancing state management capacity, and supporting the development of the software industry; promoting trade, building brands for the software industry, expanding the domestic market for information technology; establishing a portal for the software industry; supporting the enhancement of competitiveness for businesses; strengthening telecommunications and Internet infrastructure; developing and implementing short-term training programs on software skills and technologies; standardizing non-formal education programs, diplomas, and certificates in information technology; establishing a fund to support the development of the software industry;

b) The Ministry of Education and Training shall take the lead and coordinate with the Ministry of Posts and Telecommunications, the Ministry of Labor, Invalids and Social Affairs, and related ministries and sectors to implement measures, programs, and projects aimed at accelerating the development of human resources in the field of information technology, increasing the number and improving the quality of information technology training; promoting the use of open-source software in teaching and learning activities across all fields and levels;

c) The Ministry of Planning and Investment shall take the lead and coordinate with the Ministry of Finance, the Ministry of Posts and Telecommunications, municipal people's committees, and related ministries and sectors to mobilize funds to ensure financial resources for the program, especially from the state budget and ODA loans; balance and integrate resources into the annual national plan for projects and programs of ministries, sectors, and localities for the development of the software industry; organize the implementation of measures to concentrate resources and attract strong domestic and foreign investment for the development of the software industry;

d) The Ministry of Finance shall take the lead and coordinate with the Ministry of Planning and Investment, the Ministry of Posts and Telecommunications to establish and promulgate preferential regulations on tax, credit, loans, land leasing, and infrastructure for organizations and enterprises engaged in the software industry; establish and promulgate regulations on import duties for software products and services from abroad; prioritize the allocation of funds, especially from the state budget and ODA loans, to implement programs and projects for the development of the software industry by ministries, sectors, and localities;

đ) The Ministry of Trade shall support and coordinate with the Ministry of Posts and Telecommunications, the Ministry of Foreign Affairs, and related ministries and sectors to implement measures, programs, and projects aimed at promoting trade, strengthening export processing activities for software, building brands for Vietnam's software industry; creating favorable conditions to attract overseas Vietnamese to invest in software production and business in Vietnam, as well as to cooperate and support domestic organizations and individuals in market promotion, knowledge and technology transfer in software;

e) The Ministry of Science and Technology shall take the lead and coordinate with the Ministry of Posts and Telecommunications and related ministries and sectors to promote research and development activities in the software industry; prioritize investment in research and development projects and technology transfer in software; accelerate the implementation of plans for the application and development of open-source software; invest in researching and developing some high-economically and socially beneficial open-source software products that meet the needs of applying information technology in Vietnam;

g) The Ministry of Culture, Sports and Tourism shall take the lead and coordinate with relevant agencies to quickly establish and promulgate detailed regulations of the Intellectual Property Law in the field of information technology, including software; implement measures and solutions to reduce the rate of software copyright violations in Vietnam; enhance the capacity and effectiveness of intellectual property management and enforcement agencies for software; guide and improve procedures to facilitate the publication, export, and import of software;

h) The Ministry of Labor, Invalids and Social Affairs shall take the lead and coordinate with the Ministry of Posts and Telecommunications and related ministries and sectors to establish mechanisms and policies to strengthen the export of software labor;

i) The State Bank of Vietnam shall coordinate with the Ministry of Finance and related ministries and sectors to establish and promulgate mechanisms and policies to support software companies in obtaining collateral-based loans for activities such as export processing, human resource development, research and development, technology transfer, and enhancing competitiveness;

k) Provinces and centrally governed cities, particularly Ho Chi Minh City, Hanoi, and Da Nang, shall base their actions on the contents of the Program to develop and implement branch programs and projects for the development of the software industry; prioritize allocating local budget funds to implement the Program; enhance the competitiveness of software companies; support the acceleration of export processing activities for software; establish and strengthen investment in concentrated software industrial zones.

l) The Vietnam Software Business Association (VINASA) shall cooperate with the Ministry of Posts and Telecommunications, relevant ministries, sectors, and localities to develop and implement programs and projects for business development, trade promotion, product and market development, and mobilize contributions from organizations, businesses, and individuals to promote the software industry.

Article 3. This Decision shall take effect fifteen days after its publication in the Official Gazette.

Article 4. THE MINISTERS, HEADS OF GOVERNMENT-LEVEL MINISTRIES, HEADS OF GOVERNMENT-LEVEL AGENCIES, AND CHAIRMEN OF PROVINCE AND CITY PEOPLE'S COMMITTEES DIRECTLY UNDER THE CENTRAL GOVERNMENT SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION./.
