PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Rational and Efficient Energy Use dated June 28, 2010;
Pursuant to Decree No. 21/2011/ND-CP dated March 29, 2011, issued by the Government, detailing and providing measures to implement the Law on Rational and Efficient Energy Use;
Considering the proposal of the Minister of Industry and Trade,
DECISION:
Article 1. The List of Equipment and Devices Required to Bear Energy Labels and Apply Minimum Energy Efficiency Levels
1. Household appliances group includes: Straight fluorescent lamps, compact fluorescent lamps, electromagnetic and electronic ballasts for fluorescent lamps, air conditioners, refrigerators, household washing machines, rice cookers, electric fans, television sets.
2. Office and commercial equipment group includes: Photocopiers, computer monitors, printers, commercial refrigeration units.
3. Industrial equipment group includes: Distribution transformers, electric motors.
4. Transportation vehicles group includes: Passenger cars (up to seven seats).
Article 2. Schedule for implementing energy efficiency labeling
1. For the household appliances group and industrial equipment group:
a) Voluntary energy labeling is encouraged until December 31, 2012;
b) From January 1, 2013, mandatory energy labeling shall be implemented.
2. For the office and commercial equipment group:
a) Voluntary energy labeling is encouraged for this group of equipment;
b) From January 1, 2014, mandatory energy labeling shall be implemented for commercial refrigeration units.
3. For the transportation vehicles group:
a) Voluntary energy labeling is encouraged until December 31, 2014;
b) From January 1, 2015, mandatory energy labeling shall be implemented.
4. Encouragement for voluntary energy efficiency labeling for equipment and devices not included in the list specified in Article 1 of this Decision.
Article 3. Schedule for implementing minimum energy performance standards
Energy efficiency must not be lower than the minimum energy performance standards specified in the following National Technical Regulations (NTRs):
As of January 1, 2014, it is not permitted to import and produce equipment with energy efficiency lower than the minimum energy efficiency level.
2. For the industrial equipment group, office and commercial equipment group:
As of January 1, 2015, it is not permitted to import and produce equipment with energy efficiency lower than the minimum energy efficiency level.
3. For round light bulbs (incandescent lamps):
As of January 1, 2013, it is not allowed to import, produce, and circulate bulbs with power greater than 60 watts.
Article 4. Measures to support the implementation of energy labeling and the application of minimum energy performance standards
1. Invest in building specialized testing facilities and equipment to conduct inspections, tests, and certifications of energy efficiency for equipment and devices required to bear energy labels according to the phased implementation schedule.
2. Train and enhance the professional skills of management staff, technicians, and skilled workers responsible for conducting energy efficiency inspections and tests for equipment and devices required to bear energy labels.
3. Organizing extensive promotional activities to disseminate information about devices and equipment required to be labeled and the application of minimum energy performance standards.
4. Developing projects to promote energy labeling activities for target groups as specified in this Decision's schedule.
5. Support part of the funding from the National Target Program on Energy Saving and Efficiency for production facilities transitioning and improving production of energy-saving products to implement the phased energy labeling schedule and apply minimum energy efficiency levels.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. The Ministry of Industry and Trade shall be responsible for:
a) Guide, inspect, and supervise energy labeling for groups of equipment and devices required to bear energy labels as stipulated in Clauses 1 and 2, Article 2 of this Decision;
b) Take the lead and coordinate with relevant ministries and sectors to submit
c) Develop and implement solutions to support the phased implementation of energy labeling and application of minimum energy efficiency levels as stipulated in Article 4 of this Decision.
2. The Ministry of Transport is responsible for guiding, inspecting, and supervising energy labeling for equipment and devices specified in Clause 3, Article 2 of this Decision.
3. The Ministry of Science and Technology shall be responsible for:
a) Take the lead and coordinate with relevant ministries and sectors to develop and promulgate national standards on energy efficiency and minimum energy efficiency levels for equipment and devices consistent with the phased energy labeling schedule;
b) Issue energy efficiency standards for equipment and devices listed in the list of equipment and devices required to bear energy labels and apply minimum energy efficiency levels before December 21, 2012;
c) Reviewing and announcing national energy efficiency standards and minimum energy performance standards every five years.
4. The Ministry of Finance shall be responsible for:
a) Taking the lead and coordinating with the Ministries of Planning and Investment, Industry and Trade to establish a mechanism for budgetary support to implement the energy labeling schedule and apply minimum energy performance standards;
b) Taking the lead and coordinating with relevant agencies to guide procedures for importing devices and equipment required to be labeled and applying minimum energy performance standards.
5. Provincial People's Committees under the Central Government shall direct specialized agencies and local energy conservation agencies to cooperate with relevant ministries and sectors to inspect and supervise the implementation of energy labeling and application of minimum energy efficiency levels for equipment and devices within their jurisdiction according to the phased implementation schedule stipulated in this Decision.
Article 6. Effectiveness
1. This Decision takes effect from November 1, 2011.
2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and municipal people's committees under the central government; Heads of agencies, units, organizations, and individuals related have the responsibility to implement this Decision./.
