Article 1. Scope of Regulation and Applicability

Maritime telecommunication network infrastructure is property, architectural structures, and equipment directly serving the Vietnamese Coastal Information System, invested by the State and entrusted to the Vietnam Maritime Electronic Information Joint Stock Company Limited for management and operation, including:

1. Coastal Information Stations;

2. The Marine Information Processing Center in Hanoi;

3. The Inmarsat Ground Earth Station in Haiphong (LES);

4. The Cospas-Sarsat Local User Terminal/Vietnam Maritime Rescue Coordination Center (LUT/VNMCC);

5. Long Range Identification and Tracking (LRIT) Station.

Article 3. Contents of Expenditure from Financial Resources for Maritime Economic Public Services Information Procurement

1. Financial resources for maritime economic public services are allocated to procure public services for the coastal information system, including:

a) Provision of maritime rescue and distress information under the Global Maritime Distress and Safety System (GMDSS): Continuous monitoring, processing, and transmission of rescue and distress information 24/7;

b) Provision of maritime safety information under GMDSS;

c) Connection of maritime industry information;

d) Reception, processing, and distribution of Cospas-Sarsat alert data from the Vietnam Cospas-Sarsat Mission Control Center (VNMCC) to Search and Rescue Points of Contact (SPOC) in Laos and Cambodia;

e) Management, operation, maintenance of the Long Range Identification and Tracking (LRIT) station, including the cost of using LRIT information paid to the service provider after offsetting the cost of using Vietnamese LRIT information collected by the Vietnam Maritime Electronic Information Joint Stock Company Limited.

2. Implementation Method: The provision of public service information maritime as stipulated in Clause 1 of this Article shall be carried out through procurement.

b) Provide maritime safety information in accordance with the Global Maritime Distress and Safety System (GMDSS);

c) Connect maritime industry information;

d) Receive, process, and distribute Cospas-Sarsat distress alert data from the Vietnam Cospas-Sarsat Mission Control Center (VNMCC) to Search and Rescue Points of Contact (SPOC) in Laos and Cambodia;

đ) Manage, operate, and maintain the Long Range Identification and Tracking (LRIT) Information Station, including the payment for LRIT information usage fees to service providers after offsetting with the LRIT information usage fees collected by the Vietnam Maritime Electronic Information Joint Stock Company Limited;

2. Implementation method: The provision of public services of coastal information as stipulated in Clause 1 of this Article shall be carried out through the procurement method.

Article 4. Price of coastal information public service

1. Based on the economic-technical norms for operation, exploitation, maintenance, and repair of coastal information stations issued by the Ministry of Transport, based on the general pricing method for goods and services issued by the Ministry of Finance, and current policies, Vietnam Maritime Electronic Information Joint Stock Company shall develop a pricing plan (including basic depreciation of the maritime telecommunication network infrastructure system) to be reviewed by the Vietnam Maritime Administration and reported to the Ministry of Transport with a request to the Ministry of Finance to issue the maximum price.

2. On the basis of the maximum price issued by the Ministry of Finance, the Ministry of Transport shall approve the specific price of coastal information public service as the average price for one hour of operation of one station (calculated by dividing the price of one hour of operation of the entire system by the number of stations providing the service).

3. The pricing plan documentation shall be implemented according to Appendix 2a issued together with Circular No. 56/2014/TT-BTC dated April 28, 2014, of the Ministry of Finance guiding the implementation of Decree No. 177/2013/NĐ-CP dated November 14, 2013, of the Government detailing and guiding the implementation of certain provisions of the Law on Prices.

Article 5. Establishment and allocation of budget estimates for ordering provision of coastal information public service

1. Establishment of budget projections:

a) Based on the volume of public services, the items of expenditure specified in Clause 1, Article 3 of this Circular, the specific price of coastal information public service in the previous year that has been issued, and the forecasted changes in input cost factors, Vietnam Maritime Electronic Information Joint Stock Company shall develop a budget plan for providing coastal information public service for the following year to be submitted to the Vietnam Maritime Administration, the Ministry of Transport, and the Ministry of Finance before June 30 each year.

b) Based on the proposal of Vietnam Maritime Electronic Information Joint Stock Company as stipulated in paragraph a of Clause 1 of this Article, the Vietnam Maritime Administration shall prepare the state budget estimate from the economic affairs fund for ordering coastal information public service for the following year to be submitted to the Ministry of Transport before July 15 each year. The Ministry of Transport shall review and consolidate it into the state budget revenue and expenditure estimate of the Ministry of Transport, and submit it to the Ministry of Finance for review and consolidation to be presented to the competent authority for decision.

Article 16. Settlement of State Budget Funds for Support

a) Based on the annual budget estimate for providing coastal information public service allocated by the competent authority, the Ministry of Transport shall implement the steps for allocating the budget estimate according to the provisions of the State Budget Law.

b) After receiving the comments from the Ministry of Finance regarding the budget estimate allocation plan, the Ministry of Transport shall allocate the state budget estimate to the Vietnam Maritime Administration for the provision of coastal information public service; at the same time, it shall send it to the Ministry of Finance and the State Treasury where the Vietnam Maritime Administration maintains its transaction account for coordination in implementation.

Article 6. Ordering Contract for Provision of Coastal Information Public Service

1. Based on the state budget estimate allocated by the Ministry of Transport and the specific price of coastal information public service in the previous year that has been approved, the Vietnam Maritime Administration shall enter into an ordering contract for provision of coastal information public service with Vietnam Maritime Electronic Information Joint Stock Company in accordance with regulations. After the specific price of coastal information public service for the implementation year is approved, the Vietnam Maritime Administration shall sign a supplementary agreement to adjust the value of the ordering contract with Vietnam Maritime Electronic Information Joint Stock Company in accordance with regulations.

2. The ordering contract must include the following main contents:

a) List of coastal information public services as stipulated in Clause 1, Article 3 of this Circular;

b) Volume of coastal information public services;

c) Quality of performance;

d) Price of coastal information public service (average price for one hour of operation of one station) and the value of the ordering contract for coastal information public service to be implemented in the year;

đ) Duration of the contract;

e) Advance payment and recovery methods;

g) Acceptance and payment methods;

h) Responsibilities and obligations of the parties involved in the contract;

i) Liability of the parties due to breach of contract;

k) Other related contents concerning the provision of coastal information public service but not contrary to legal provisions;

l) Model contract as stipulated in Appendix 01 attached to this Circular.

3. Adjustment of the ordering contract for provision of coastal information public service shall be carried out in accordance with Article 23 of Decree No. 130/2013/NĐ-CP dated October 16, 2013, of the Government on production and supply of public utility products and services.

Article 7. Acceptance of the provision of coastal public service information

The acceptance shall be carried out according to the list of services specified in Clause 1, Article 3 of this Circular.

1. Time for acceptance:

a) The acceptance of coastal public service information shall be conducted quarterly throughout the year;

b) Within ten days from the end of each quarter, the Vietnam Maritime Electronic Information Joint Stock Company shall be responsible for preparing a report on the implementation of the provision of coastal public service information in that quarter and submitting it to the Vietnam Maritime Administration;

c) Within fifteen days from the date of receiving the report from the Vietnam Maritime Electronic Information Joint Stock Company, the Vietnam Maritime Administration shall be responsible for organizing the acceptance of the quantity and quality of the completed coastal public service information supply under the signed contract as the basis for payment of the ordered service fees as stipulated in Clause 2, Article 8 of this Circular.

2. Quantity acceptance:

The acceptance of the quantity of completed coastal public service information supply shall be based on the results of checking the following contents:

a) The time spent on monitoring, processing, and transmitting emergency, urgent, search and rescue, maritime safety-security information, etc., of each station;

b) The number of maritime safety information bulletins provided by each station;

c) The operation of maritime industry information connectivity;

d) The reception, processing, and distribution of Cospas-Sarsat distress alert data from VNMCC to the SPOCs of Laos and Cambodia;

đ) The operation of the long-range identification and tracking (LRIT) station;

3. Service quality acceptance:

The acceptance of service quality shall be in accordance with current service standards and the extent and results of assigned tasks.

Article 8. Advance payment and settlement of coastal public service information

1. Based on the state budget estimate for ordering the provision of coastal public service information allocated, the Vietnam Maritime Administration shall implement the withdrawal of the budget estimate at the State Treasury to make advance payments and settlements to the Vietnam Maritime Electronic Information Joint Stock Company according to the ordering contract; the State Treasury where the Vietnam Maritime Administration conducts transactions shall check the documents and perform expenditure control before making advance payments and settlements according to the ordering contract.

2. Advance payment for ordering coastal public service information

a) After signing the ordering contract, the Vietnam Maritime Administration shall proceed with the procedures for advance payment to the Vietnam Maritime Electronic Information Joint Stock Company. The maximum advance payment amount shall not exceed thirty percent of the value of the ordering contract for the provision of coastal public service information.

b) Advance payment documents:

- The State budget estimate withdrawal form (advance payment) of the Vietnam Maritime Administration;

- The ordering contract between the Vietnam Maritime Administration and the Vietnam Maritime Electronic Information Joint Stock Company;

- The decision on the allocation of the state budget estimate for expenditures of the Ministry of Transport to the Vietnam Maritime Administration.

3. Settlement of ordering costs for coastal public service information

a) Quarterly, the Vietnam Maritime Administration shall settle the value of completed coastal public service information for the Vietnam Maritime Electronic Information Joint Stock Company and recover the advance payment according to regulations. Recovery of the advance payment begins from the first settlement, with the recovery ratio of each settlement corresponding to the proportion of the settlement amount to the contract value, and the full recovery of the advance payment when settling the final payment of the implementation year.

b) Payment documents:

- The allocation decision of the Ministry of Transport for the Vietnam Maritime Administration;

- The ordering contract for the provision of coastal public service information already signed between the Vietnam Maritime Administration and the Vietnam Maritime Electronic Information Joint Stock Company;

- The acceptance record of the provision of coastal public service information under the ordering contract between the Vietnam Maritime Administration and the Vietnam Maritime Electronic Information Joint Stock Company;

- The request for advance payment settlement (in cases where there is advance payment);

- The State budget estimate withdrawal form (actual expenditure) of the Vietnam Maritime Administration together with other lawful supporting documents as prescribed.

Article 9. Handling of Excess and Shortfall in Contracted Funding for Provision of Coastal Information Public Services

1. In cases where the volume of provision of coastal information public services increases due to the requirements of the ordering agency, leading to an increase in the value to be paid compared to the signed procurement contract, the Vietnam Maritime Administration shall propose additional budget allocation within the year to address this; if the annual budget is exhausted, the Vietnam Maritime Administration shall propose using the next year's procurement budget to handle the situation.

2. When allocating the annual budget for contracted funding for the provision of coastal information public services, the Ministry of Transport shall proactively reserve funds to pay for the increased volume from the previous year, with the remaining budget allocated to fulfill current-year procurement tasks.

Article 10. Settlement of Public Service Information Coastal Task Execution

1. Annually, the Vietnam Maritime Electronic Information Joint Stock Company Limited shall prepare the settlement report of the procurement contract for the provision of coastal information public services and submit it to the Vietnam Maritime Administration as prescribed. The company and related individuals must bear responsibility before the state and law for the accuracy and honesty of the settlement data and shall be responsible for compensation when the settlement does not comply with regulations.

2. The Vietnam Maritime Administration shall take the lead and coordinate with relevant units under the Ministry of Transport and the Ministry of Finance to organize inspections on the execution of public service tasks by the Vietnam Maritime Electronic Information Joint Stock Company Limited as prescribed.

3. The Vietnam Maritime Administration shall be responsible for preparing the settlement report on the contracted funding sourced from the state budget according to the provisions of the State Budget Law; consolidate this in the Vietnam Maritime Administration’s overall settlement report and submit it to the Ministry of Transport. The Ministry of Transport shall review the Vietnam Maritime Administration’s settlement and consolidate it in the Ministry of Transport’s overall settlement, submitting it to the Ministry of Finance for review according to the provisions of the State Budget Law and guiding documents.

Article 11. Responsibilities of the Vietnam Maritime Electronic Information Joint Stock Company Limited

1. Management and Use of Contracted Funding from the State

a) The Vietnam Maritime Electronic Information Joint Stock Company Limited shall provide coastal information public services in accordance with the signed contracts and the laws, international agreements, and maritime safety communication practices.

b) The state-funded procurement for providing coastal information public services constitutes the revenue from the company's public service operations, which the Vietnam Maritime Electronic Information Joint Stock Company Limited uses to offset costs incurred in fulfilling public service obligations; record business results from public service operations, declare and pay taxes as prescribed; manage finances in compliance with current laws suitable for the type of business registered.

2. Management of State Marine Telecommunications Infrastructure

a) The Vietnam Maritime Electronic Information Joint Stock Company Limited shall be invested by the state with necessary capital, assets, and personnel to continuously and stably provide coastal information public services. Besides fulfilling the public service tasks assigned by the state, the company may utilize capital, assets, and other resources to conduct business activities in accordance with the law without affecting the assigned public service tasks and shall be responsible for the efficiency of state capital and asset usage.

b) The Vietnam Maritime Electronic Information Joint Stock Company Limited shall be responsible for managing and utilizing the marine telecommunications infrastructure mentioned in Article 2 of this Circular in accordance with current regulations on the management and use of fixed assets in enterprises. At the same time, it must manage and use assets in accordance with regulations on managing state-owned information infrastructure systems. The company shall not mortgage, pledge, or contribute capital; the liquidation or sale of assets must be approved by the Ministry of Transport.

c) The Vietnam Maritime Electronic Information Joint Stock Company Limited shall be responsible for managing and utilizing the basic depreciation included in the cost of coastal information public services to invest in, replace, and maintain the marine telecommunications infrastructure that has been invested in by the state.

3. Annually, the Vietnam Maritime Electronic Information Joint Stock Company Limited shall prepare financial reports and reports on the fulfillment of public service tasks and submit them to the Vietnam Maritime Administration, the Ministry of Transport, and the Ministry of Finance in accordance with current regulations.

4. The Vietnam Maritime Electronic Information Joint Stock Company Limited shall be subject to inspection, supervision, and monitoring by financial agencies, asset owners' representatives, and tax authorities regarding the use of state-provided contracted funding and the company's production and business activities in accordance with current laws.

Article 12. Effective Date

1. This Circular takes effect from November 10, 2015, and applies from the 2015 fiscal year.

2. This Circular replaces Circular No. 81/2010/TT-BTC dated May 31, 2010, issued by the Ministry of Finance, guiding the mechanism for procuring the provision of coastal information public services.

3. In case the referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the provisions of the amended, supplemented, or replacing documents.

4. During implementation, if there are difficulties, related units shall report to the Ministry of Transport and the Ministry of Finance for appropriate amendments and supplements./.
