DECREE
Amending and Supplementing Certain Articles of Decree No. 143/2013/NĐ-CP
dated October 24, 2013 of the Government on Scholarship Reimbursement and Training Costs
The Government hereby promulgates this Decree amending and supplementing certain articles of Decree No. 143/2013/NĐ-CP dated October 24, 2013 of the Government on scholarship reimbursement and training costs.
Article 1. Amending and Supplementing Point b Clause 2 Article 1
“b) Students are eligible to participate in domestic training programs funded by the state budget or under procurement training projects approved by the Prime Minister with the use of the state budget;”
Article 2. Amending and Supplementing Clause 1 Article 7
“1. Within the latest period of 120 (one hundred twenty) days from the date of receiving the decision of the competent state agency, the student or the family of the student residing in Vietnam shall be responsible for fully repaying the amount due.”
Article 3. Supplementing Article 7a following Article 7
“Article 7a. Waiving or Exempting Reimbursement Costs
1. In cases where students are entitled to have their reimbursement costs waived or exempted:
a) Waiving reimbursement costs in cases where the student has died or been declared dead by a court according to the law;
b) Exempting reimbursement costs in one of the following cases:
The student is certified by a competent medical facility as being unable to work;
The student fulfills the obligation to work for less than the required time but is subsequently transferred, rotated, detailed, or reassigned to another position by a competent authority;
The student is unable to fulfill the work assignment due to an unforeseen and irresistible event. The competent state authority decides on the reimbursement and determines whether to waive or exempt the reimbursement costs for such cases.
2. Competent Authority and Procedures for Waiving or Exempting Reimbursement Costs:
a) The competent state authority or the head of the management agency has the authority to decide on reimbursement according to Article 6 of Decree No. 143/2013/NĐ-CP and has the authority to decide on waiving or exempting reimbursement costs (hereinafter referred to as the competent authority);
b) Documents include:
Application for waiving or exempting reimbursement costs (according to Form No. 01 attached to this Decree);
A copy of one of the types of documents proving entitlement to waiving or exempting reimbursement costs according to Clause 1 of this Article: death certificate or death registration or extract of death registration issued by a competent state authority or a court's decision declaring the student dead; certification by a competent medical facility in Vietnam or abroad that the student is unable to work (if the certification is in a foreign language, it must be translated into Vietnamese); decision on transfer, rotation, detail, or reassignment issued by a competent authority; document from a competent state authority certifying the objective and irresistible reasons preventing the student from fulfilling the work assignment.
If the competent authority can obtain the above information from specialized databases or other state agencies, the student or the family of the student does not need to provide these documents and only need to provide information for comparison and data extraction purposes;
c) Implementation Procedure:
The competent authority deciding on reimbursement informs the student or the family of the student about the obligation to repay. If the case falls within the scope of waiving or exempting reimbursement costs according to Clause 1 of this Article, the student or the family of the student submits one set of documents according to Clause b of this Article through postal service, directly, or online to the competent authority according to Clause a of this Article within 20 working days from the date of notification.
Within three working days from the date of receiving the application for waiving or exempting reimbursement costs, if the documents are not valid, the competent authority notifies the student or the family of the student to supplement and complete according to regulations.
Within 20 working days from the date of receiving valid documents, the competent authority according to Clause a of this Article examines and issues a decision to waive or exempt reimbursement costs for the student; if the conditions for waiving or exempting reimbursement costs are not met, it issues a decision to reimburse training costs. The decision to waive or exempt reimbursement costs, the decision to reimburse training costs (according to Form No. 02 attached to this Decree) is sent to the student or the family of the student and published publicly on the website of the competent state authority deciding on reimbursement of training costs;
d) After the 20-day period from the date of notification, if no documents or evidence from the student or the family of the student are received, the competent authority issues a decision to reimburse training costs for the student. The payment and recovery of reimbursement costs are carried out according to the provisions of Article 7 of Decree No. 143/2013/NĐ-CP.”.
The competent authority shall decide on compensation notification to be communicated to the student or the student's family regarding the student's obligation to compensate. If it falls under the case of cancellation or exemption from compensation costs as stipulated in Clause 1 of this Article, the student or the student's family shall submit one set of documents in accordance with Point b of this Clause via postal service, directly, or online to the competent authority as stipulated in Point a of this Clause within twenty working days from the date of notification issuance.
Within three working days from the date of receiving the application for cancellation or exemption from compensation costs, if the documents are not valid, the competent authority shall notify the student or the student's family to supplement and complete the documents in accordance with regulations.
Within twenty working days from the date of receiving valid documents, the competent authority as stipulated in Point a of this Clause shall review and issue a decision to cancel or exempt compensation costs for the student; in cases where the conditions for cancellation or exemption from compensation costs are not met, a decision to compensate training costs shall be issued. The decision to cancel or exempt compensation costs, and the decision to compensate training costs (according to Model No. 02 attached as an appendix to this Decree) shall be sent to the student or the student's family and published publicly on the website of the competent state authority deciding on compensation for training costs.
d) At the end of twenty working days from the date of notification issuance, if no documentation or evidence from the student or the student's family is received, the competent authority shall issue a decision to compensate training costs for the student. The payment and recovery of compensation costs shall be carried out in accordance with Article 7 of Decree No. 143/2013/NĐ-CP.”
Article 4. Implementation Provisions
1. This Decree takes effect from March 26, 2026.
2. The Minister, Head of a ministry-level agency, Head of a government agency, Chairman of provincial people's committees, and relevant agencies, organizations, and individuals shall be responsible for implementing this Decree.
Article 5. Transitional Provisions
1. Students who must reimburse training costs according to decisions made by authorized state agencies before the effective date of this Decree shall continue to implement the provisions set forth in Decree No. 143/2013/NĐ-CP.
2. From the effective date of this Decree, students currently undergoing review for cost reimbursement and without a decision from an authorized agency regarding cost reimbursement shall apply the provisions set forth in Decree No. 143/2013/NĐ-CP and Articles 2 and 3 of this Decree.
