THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

Based on Decree No. 171/2004/NĐ-CP dated September 29, 2004 of the Government stipulating the organization of specialized agencies under provincial People's Committees and Decree No. 172/2004/NĐ-CP dated September 29, 2004 of the Government stipulating the organization of specialized agencies under district, town, city, and provincial-level People's Committees;

Pursuant to Decision No. 161/2003/QĐ-TTg dated August 4, 2003 of the Prime Minister on the issuance of the Regulation on training and capacity building for civil servants and public officials;

Considering the proposal of the Director of the Department of Cadre Training and Civil Servant Development under the State;

Pursuant to …;

Article 1. This Decision promulgates the Regulation on the examination of training programs, textbooks, and training materials for civil servants and public officials attached hereto.

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette. The Ministers, Heads of ministerial-level agencies, Chairpersons of provincial People's Committees under the central government, and Heads of relevant units shall be responsible for implementing this Decision.

REGULATIONS

Examination of Training Programs, Textbooks, Training Materials

for Capacity Building for Civil Servants and Public Officials

(Issued together with Decision No. 32/2004/QĐ-BNV dated July 26, 2004 of the Minister of Home Affairs)

This Regulation stipulates the organization and procedures for examining training programs, textbooks, and training materials for capacity building in state management knowledge; professional knowledge and skills for civil servants and public officials.

Chapter 1:

GENERAL PROVISIONS

Article 1. All training programs, textbooks, and training materials for capacity building in state management knowledge; all training programs and materials for capacity building in professional knowledge and skills must be examined and approved before being put into use. The examination must be carried out in accordance with the provisions of this Regulation.

Article 2. The conclusion of the Examination Board is one of the bases for the Head of the competent state agency to decide on the issuance of training programs, textbooks, and training materials for capacity building.

Article 3. ORGANIZATION OF THE EXAMINATION BOARD AND EXAMINATION PROCEDURES

Chapter 2:

The Examination Board is an organization tasked with advising the Head of the competent state agency, evaluating the results of compilation, and making recommendations regarding the issuance of training programs, textbooks, and training materials for capacity building.

Article 4. The Examination Board is established and dissolved by the decision of the Head of the competent state agency after completing its tasks.

Article 5. The Examination Boards for training programs, textbooks, and training materials for capacity building in state management knowledge as prescribed in this regulation shall have:

1. The Examination Boards for training programs, textbooks for capacity building in state management knowledge according to civil service ranks:

a. The Examination Board for training programs, textbooks for capacity building in state management knowledge for the Senior Specialist rank.

b. The Examination Board for training programs, textbooks for capacity building in state management knowledge for the Principal Specialist rank.

c. The Examination Board for training programs, textbooks for capacity building in state management knowledge for the Specialist rank.

d. The Examination Board for training programs, textbooks for capacity building in state management knowledge for the Cadre rank.

e. The Examination Board for training programs, textbooks for capacity building in state management knowledge for prospective civil servants.

2. The Examination Boards for training programs and materials for capacity building in state management knowledge according to positions:

a. The Examination Board for training programs and materials for sourcing and capacity building for leadership and management positions at the department level and above.

b. The Examination Board for training programs and materials for capacity building for representatives of People's Councils at all levels.

c. The Examination Board for training programs and materials for capacity building in state management knowledge for cadres and civil servants at commune, ward, and town levels.

The Examination Boards prescribed in this Article shall be established by the Decision of the Minister of Home Affairs.

The Appraisal Councils provided for in this Article shall be established by a Decision of the Minister of Home Affairs.

Article 6. The Appraisal Boards for training programs and materials to enhance knowledge and skills for civil servants of ministries, sectors, and localities shall have the following responsibilities:

1. Appraising training programs and materials for enhancing knowledge and skills for civil servants under ministries, sectors, and localities and specialized staff of vertical sectors.

2. Appraising training programs and materials for cadre development and management training at the department level for ministries, sectors, and localities.

3. Appraising training programs and materials for enhancing knowledge and skills for cadres and leaders managing at the ministry-level departments, provincial-level departments, and sectoral agencies according to specialized vertical sectors.

The Ministers of Ministries, Agencies Equivalent to Ministries, Heads of Government Agencies, and Chairpersons of People's Committees of provinces and centrally-administered cities shall decide on the establishment of the Appraisal Boards specified in Clauses 1, 2, and 3 of this Article.

4. For training programs and materials to update knowledge and skills for a period of 1 to 3 days, the Ministers of Ministries, Agencies Equivalent to Ministries, Heads of Government Agencies, and Chairpersons of People's Committees of provinces and centrally-administered cities shall approve and issue them upon the proposal of the program and material drafting agencies after receiving the opinion of the Cadre and Civil Servant Organization Department of Ministries and Sectors, Provincial Personnel Departments, and provinces and centrally-administered cities.

Article 7. Composition of the Appraisal Board

1. The composition of the Appraisal Board for training programs and materials to enhance state administrative management knowledge as stipulated in Article 5 of this Regulation includes seven or nine members, including:

a. The Chairman of the Board is a representative from the leadership of the Ministry of Home Affairs.

b. The Vice-Chairman of the Board is a representative from the leadership of the National Academy of Public Administration.

c. The Secretary of the Board is a civil servant from the Training and Cadre Development Department of the Ministry of Home Affairs.

d. The remaining members are Board Appraisal Members. Board Appraisal Members must be managerial leaders; scientific researchers, experts, and teachers with qualifications and experience from central agencies, ministries, sectors, and localities.

For Appraisal Boards for training programs and materials, two Board Members shall also serve as reviewers.

2. The composition of the Appraisal Board for training programs and materials to enhance knowledge and skills for civil servants under ministries, sectors, and localities as stipulated in Clauses 1, 2, and 3 of Article 6 of this Regulation includes five or seven members, including:

a. The Chairman of the Board is a representative from the leadership of the ministry, sector, or locality.

b. The Vice-Chairman of the Board is a representative from the leadership of the Cadre and Civil Servant Organization Department of ministries, sectors, and Provincial Personnel Departments.

c. The Secretary of the Board is a representative from the leadership of the training and cadre development institution of ministries, sectors, and Political Schools of provinces and centrally-administered cities.

In cases where ministries and sectors do not have training and cadre development institutions, a civil servant from the Cadre and Civil Servant Organization Department shall serve as the Secretary of the Board.

d. The remaining members are Board Appraisal Members. Board Appraisal Members must be managerial leaders; scientific researchers, experts, and teachers with qualifications and experience from academies, institutes, schools, ministries, sectors, and localities.

For Appraisal Boards for training programs and materials, two Board Members shall also serve as reviewers.

Article 8. Duties of the members of the Appraisal Council:

1. The Chairman of the Council shall be responsible to the Minister of Home Affairs, Ministers of Ministries, Agencies at the ministerial level, Heads of government agencies, Chairmen of People's Committees of provinces and centrally governed cities for the activities of the Appraisal Council, specifically:

a. Chairing meetings of the Council: organizing appraisals and evaluating the results of compiling programs, textbooks, training materials in accordance with the prescribed content and time.

b. Assigning tasks and urging members of the Council to fulfill their assigned tasks well.

2. The Vice-Chairman of the Council assists the Chairman in managing tasks assigned by the Chairman.

3. Members of the Council shall be responsible for researching programs, textbooks, and materials they are tasked to appraise according to the prescribed contents: providing clear appraisal reports and being accountable for the results of their appraisals.

4. The Secretary of the Council shall assist the Chairman in performing the following tasks:

a. Urging the preparation of materials and related documents for members of the Council to study.

b. Recording minutes of Council meetings.

c. Serving as the point of contact between the Chairman of the Council and its members, with the assisting agency in the appraisal process, and performing other tasks as assigned by the Chairman.

Article 9. Principles and working regulations of the Council:

1. The Council shall organize appraisals when at least two-thirds of its members participate.

2. The Council operates on the principle of democratic centralism, where the minority obeys the majority, and appraisals are conducted through secret ballot.

3. In cases where the number of votes for different opinions is equal, the conclusion of the Appraisal Council shall be the opinion of the side with the Chairman's vote.

Article 10. Procedures for organizing appraisals.

1. A representative from the assisting agency of the Appraisal Council reads the decision on the establishment of the Appraisal Council.

2. The Appraisal Council works under the control of the Chairman of the Council.

a. The Chairman of the Council briefs the Council on its tasks; the Council approves the work program.

b. A representative from the unit tasked with compiling the program, textbook, or material provides a summary of the content and explains issues that need clarification.

c. Members of the Council read the Appraisal Report; the explanations provided by the unit tasked with compiling the program, textbook, or material.

d. The Council discusses.

e. Conduct voting procedures, counting votes, and announcing the voting results.

g. The Chairman concludes, and the Council approves the minutes of the appraisal.

Article 11. Assisting agencies include:

1. The Training and Cadre Development Department of the Ministry of Home Affairs assists in appraising Councils established by the Minister of Home Affairs.

2. The Organization and Cadre Department of the Provincial Home Affairs Department assists in appraising Councils established by the Ministers of Ministries, Agencies at the ministerial level, Heads of government agencies, and Chairmen of People's Committees of provinces and centrally governed cities.

Article 12. Duties of the assisting agency:

1. Advising and preparing necessary procedures for the competent authority to issue a Decision establishing the Appraisal Council.

2. Preparing and transferring relevant materials for the activities of the Appraisal Council to its members at least ten working days before the Council conducts the appraisal.

3. Preparing plans, locations, procedures, and other related contents for the Appraisal Council's activities and according to the Chairman's requirements.

4. Summarizing and studying appraisal documents and conclusions of the Appraisal Council: advising and presenting to the Minister of Home Affairs, Ministers of Ministries, Agencies at the ministerial level, Heads of government agencies, and Chairmen of People's Committees of provinces and centrally governed cities regarding the issuance of programs, textbooks, and training materials; organizing implementation or urging and monitoring implementation after receiving instructions.

5. Retaining all materials related to the Appraisal Council's activities.

Article 13. Within five working days from the date of the appraisal results, the assisting agency shall report to the Minister of Home Affairs, Ministers of Ministries, Agencies at the ministerial level, Heads of government agencies, and Chairmen of People's Committees of provinces and centrally governed cities. The report includes:

1. Minutes of the Appraisal Council meeting attached with voting result minutes and appraisal forms of Appraisal Council members.

2. Appraisal reports of Appraisal Council members.

3. A proposal detailing the assisting agency's advice on issuing or requesting further revisions and improvements to the programs, textbooks, and training materials that have been appraised.

Article 14. The appraisal activity expenses are covered by the budget for compiling programs, textbooks, and training materials provided by the unit tasked with compilation.
