At the proposal of the Minister of Labor - Invalids and Social Affairs,iThis Circular applies to enterprises engaged in labor dispatch (hereinafter referred to as labor dispatch enterprises), employers leasing workers, leased workers, and other organizations, individuals related to labor dispatch activities.;

Article 1. Scope of Regulation
This Decision stipulates policies for job creation and vocational training for workers whose agricultural land has been reclaimed throughout the country when the State reclaims land according to Article 22 of Decree No. 69/2009/ND-CP dated August 13, 2009 of the Government promulgating additional regulations on land use planning, land prices, land reclamation, compensation, and resettlement assistance (hereinafter referred to as Decree No. 69/2009/ND-CP). trWorkers belonging to households directly engaged in agricultural production whose agricultural land has been reclaimed by the State without receiving land compensation (hereinafter referred to as workers whose agricultural land has been reclaimed) must meet the following conditions:No. Have permanent residence registration at the household with agricultural land being reclaimed;
a) National centralized procurement unit: A centralized procurement unit under the Ministry of Finance to perform the task of centralized procurement of assets within the national centralized procurement list (excluding medicines for human disease prevention and treatment, abbreviated as medicines);nationalThe amount of fees collected for food safety and hygiene work shall be implemented according to the schedule of fees attached to this Circular.
1. Be within working age;
a) Have a need for vocational training, career change, job search, and loan for job creation.
b) Households and individuals whose agricultural land in residential areas, gardens, and ponds is reclaimed and not recognized as residential land according to Article 21 and the cases specified in Clause 3, Clause 4, and Clause 5 of Article 16 of Decree No. 69/2009/ND-CP are not subject to this Decision.
c) Duration of support
Workers whose agricultural land has been reclaimed according to Clause 1 of Article 2 of this Decision shall enjoy support policies for a period of three years, starting from the date of the land reclamation decision.to Article 4. Vocational Training Support
Article 3. Handover time, lease purchase term for relocated housingThis Resolution takes effect from the date it is adopted by the National Assembly.Workers whose agricultural land has been reclaimed who have a need for vocational training and learning a trade shall be admitted to vocational training institutions and receive support for costs as follows:
Short-term vocational training (primary level and training under three months) shall be supported by the State for training fees according to Decision No. 1956/QD-TTg dated November 27, 2009 of the Prime Minister approving the Project on vocational training for rural workers until 2020 (hereinafter referred to as Decision No. 1956/QD-TTg);
Intermediate and college-level vocational training shall be paid for by the State for one course. The amount of tuition paid by the State shall be equal to the actual tuition fee of the training institution but shall not exceed the maximum tuition fee for public intermediate and college-level vocational training institutions as prescribed by law.
1. The funding for intermediate and college-level vocational training support shall be allocated from the funding for occupational transition within the training and occupational transition plan and shall be included in the total funding of the investment project or the approved compensation and resettlement assistance plan.For workers belonging to households whose agricultural land has been reclaimed and also fall under the borrowing target according to Decision No. 157/2007/QĐ-TTg dated September 27, 2007 of the Prime Minister on credit for students and trainees, they may borrow credit applicable to students and trainees according to current regulations.on c sspecialized agency under the People's Committee of the province/city. Workers belonging to households whose agricultural land has been recovered and also eligible for loans under Decision No. 157/2007/QĐ-TTg dated September 27, 2007 of the Prime Minister on credit for students and trainees shall be entitled to apply for such credit according to current regulations.
a) The Ministry of Labor, Invalids and Social Affairs:Shall take the lead and coordinate with relevant agencies to inspect and supervise the implementation of this Decision;ySummarize and report to the Prime Minister on the situation of vocational training and job placement for workers whose agricultural land has been recovered; lCoordinate with the Vietnam Bank for Social Policies to monitor the process of identifying beneficiaries and guide workers in applying for loans.
b) The Ministry of Planning and Investment shall take the lead and coordinate with relevant ministries and sectors:uSupplement the budget for the National Employment Fund;
Balance and supplement capital for the Vietnam Bank for Social Policies to provide loans for job creation as stipulated in Point b Clause 1 Article 5 of this Decision and for loans for temporary overseas work as stipulated in Point d Clause 1 Article 6 of this Decision.°The Ministry of Finance shall take the lead and coordinate with the Ministry of Labor, Invalids and Social Affairs and other relevant ministries and agencies to guide the financial mechanism for implementing this Decision..
2. The Vietnam Bank for Social Policies shall be responsible for:
Article 5. Employment Support 1. The contents and levels of expenditure from the state budget to support the implementation of initiatives as stipulated in Chapter II of this Circular are maximum levels. Based on the ability to balance resources, the Ministers of Ministries, Heads of central agencies, Provincial People's Councils, and centrally governed cities shall decide on specific contents and levels of expenditure for initiative activities that ensure appropriateness.
1. Workers whose agricultural land has been reclaimed and who seek employment shall be supported as follows:
a) Vocational training advice,concerning the classification and determination of state management authority in the field of crop production job counseling, and free job placement services at provincial-level Labor and Social Services Centers;
b) Priority access to loans from the National Employment Fund in accordance with the provisions of the law.
Production and business establishments that hire many workers whose agricultural land has been reclaimed shall enjoy preferential policies on land, credit, and taxes as stipulated by the law.
Article 6. Support for Working Abroad under Contracts
1. Workers whose agricultural land has been reclaimed and who wish to work abroad shall be supported as follows:
a) Full reimbursement of vocational training, language learning, and necessary knowledge enhancement fees in accordance with the law on Vietnamese citizens working abroad under contracts;nationalFull coverage of health examination, passport, visa, and criminal record check expenses before going to work abroad at the current state-prescribed levels;
b) Daily meal allowance during study periods as specified in Decision No. 1956/QĐ-TTg;
c) Travel subsidy for one round trip from place of residence to the training location for trainees living more than 15 kilometers away from the training site based on the regular fare of public transportation at the time of payment;national e) Eligibility for subsidized loans with preferential interest rates from the Social Policy Bank to cover necessary expenses for working abroad for a limited period;No. The maximum loan amount equals the total necessary expenses that the worker must pay according to the contract for each labor market;
d) The interest rate on the loan is equivalent to the current interest rate for workers not residing in poor districts when working abroad for a limited period at the Social Policy Bank;For power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract.The maximum loan term is equal to the duration of working abroad as stipulated in the contract;
Funding for supporting workers going to work abroad as prescribed in Points a, b, c, and d of Clause 1 of this Article shall be allocated from the local land development fund in accordance with Point d of Clause 1 of Article 34 of Decree No. 69/2009/NĐ-CP.aWorkers belonging to poor districts as defined in Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government regarding the Program to Rapidly Reduce Poverty Sustainably in 61 Poor Districts, when working abroad shall benefit from policies as stipulated in Decision No. 71/2009/QĐ-TTg dated April 29, 2009 of the Prime Minister approving the Plan to Promote Labor Export from Poor Districts to Contribute to Sustainable Poverty Reduction during the 2009-2020 Period. lWorkers shall be supported once for each support item as prescribed in this Article.
Article 7. Responsibilities of the Ministry of Labor, Invalids and Social Affairs:
To take the lead and coordinate with relevant agencies to inspect and supervise the implementation of this Decision;
To compile and report to the Prime Minister on the situation of vocational training and employment resolution for workers whose agricultural land has been reclaimed;nationalp contract.
2. To coordinate with the Social Policy Bank to monitor the process of identifying beneficiaries and guide workers in borrowing funds.The Ministry of Planning and Investment shall take the lead and coordinate with relevant ministries and sectors:developmentTo supplement the budget for the National Employment Fund;developmentTo balance and supplement capital for the Social Policy Bank to provide loans for creating employment as stipulated in Point b of Clause 1 of Article 5 of this Decision and for working abroad for a limited period as stipulated in Point đ of Clause 1 of Article 6 of this Decision.developmentThe Ministry of Finance shall take the lead and coordinate with the Ministry of Labor, Invalids and Social Affairs and relevant ministries and agencies to guide the financial mechanism for implementing this Decision.PointThe Social Policy Bank shall be responsible for:
3. Developing procedures and guiding workers in borrowing funds; 1Directing the Social Policy Bank at the local level to implement loans for workers whose agricultural land has been reclaimed.to 5. Provincial People's Committees directly under the Central Government shall be responsible for:Directing the formulation and implementation of plans for vocational training and employment creation for workers whose agricultural land has been reclaimed;on Guiding and allocating funding for implementing Point b of Clause 1 of Article 4 and Clause 2 of Article 6 of this Decision;periodDirecting the provincial Department of Labor, Invalids and Social Affairs to implement and report annually on the situation of vocational training and employment resolution for workers whose agricultural land has been reclaimed as required by the Ministry of Labor, Invalids and Social Affairs.
4. This Decision shall take effect from January 1, 2013.u Add
Heads of ministerial-level agencies, heads of government-affiliated agencies, Chairmen of provincial People's Committees directly under the Central Government, Chairmen of the Management Boards, and General Directors of the Social Policy Bank are responsible for enforcing this Decision./., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP The Head of the Office of the Ministry, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Highway Corporation, the Directors of Provincial Department of Transport under central cities and provinces, the Heads of agencies, organizations and individuals related shall be responsible for implementing this Circular.
1. Developing procedures and guiding workers in applying for loans;
a) Directing local branches of the Vietnam Bank for Social Policies to implement loans for workers whose agricultural land has been recovered.
b) Provincial People's Committees directly under the Central Government shall be responsible for:
specialized agency under the People's Committee of the province/city.Directing the establishment and implementation of plans for vocational training and job creation for workers whose agricultural land has been recovered;
2. Guiding and allocating funds for implementing Point b Clause 1 Article 4 and Clause 2 Article 6 of this Decision;
a) Directing the Department of Labor, Invalids and Social Affairs to implement and report annually on the situation of vocational training and job placement for workers whose agricultural land has been recovered as required by the Ministry of Labor, Invalids and Social Affairs.
b) This Decision shall take effect from January 1, 2013. financial Heads of ministerial-level agencies, heads of government-affiliated agencies, Chairmen of provincial People's Committees directly under the Central Government, Chairmen of the Management Councils, and General Directors of the Vietnam Bank for Social Policies are responsible for enforcing this Decision./.
3. The Ministry of Finance shall take the lead and coordinate with the Ministry of Labor, Invalids and Social Affairs and other relevant ministries and agencies to guide the financial mechanism for implementing this Decision.
4. The Vietnam Bank for Social Policies shall be responsible for:
a) Developing procedures and guiding workers on borrowing funds;
b) Directing provincial Vietnam Banks for Social Policies to provide loans to workers whose agricultural land has been reclaimed.
5.Provincial People's Committees directly under the central government shall be responsible for:
a) Directing the establishment and organization of implementation of vocational training programs and job creation for workers whose agricultural land has been reclaimed;
b) Guiding and allocating funds for the implementation of Point b Clause 1 Article 4 and Clause 2 Article 6 of this Decision;
c) Directing the Department of Labor, Invalids and Social Affairs to implement and report annually on the situation of vocational training and employment resolution for workers whose agricultural land has been reclaimed according to the requirements of the Ministry of Labor, Invalids and Social Affairs.
Article 8. Effective Date
1. This Decisiony shall take effect from January 1, 2013.
2. Article 1. Amending and supplementing some articles of Circular No. 21/2023/TT-BTTTT dated December 31, 2023 of the Ministry of Information and Communications on functions and technical features of the Administrative Procedure Handling Information System at the ministerial and provincial levels (hereinafter referred to as Circular No. 21/2023/TT-BTTTT) as follows:, Heads of ministerial-level agencies, heads of government agencies, Chairpersons of provincial People's Committees directly under the central government, Chairpersons of the Board of Directors and General Directors of the Vietnam Bank for Social Policies are responsible for enforcing this Decision./.
