PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular jointly issued hereby provides guidance on the payment regime for medical examination and treatment fees, allowances, and policy benefits equivalent to those for war invalids when injured, and recognition as martyrs when deceased, for persons directly mobilized and called upon to extinguish fires and provide fire-fighting support; wages, allowances, subsidies, and social insurance regimes when injured or deceased for cadres and members of civilian defense teams, grassroots fire prevention and firefighting teams, and specialized fire prevention and firefighting teams during their participation in training and professional development in fire prevention and firefighting as stipulated in Point d, Point đ, and Point e Clause 1, Clause 4, and Clause 5 Article 35 Decree No. 79/2014/ND-CP dated July 31, 2014 of the Government detailing implementation of certain provisions of the Law on Fire Prevention and Fighting and the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Fighting (hereinafter referred to as Decree No. 79/2014/ND-CP).

Article 2. Applicability

1. Persons directly mobilized and called upon to extinguish fires and provide fire-fighting support as prescribed by laws on fire prevention and fighting.

2. Cadres and members of civilian defense teams, grassroots fire prevention and firefighting teams, and specialized fire prevention and firefighting teams.

3. The authority responsible for mobilizing and calling upon persons directly to extinguish fires and provide fire-fighting support.

4. The authority responsible for mobilizing and calling upon cadres and members of civilian defense teams, grassroots fire prevention and firefighting teams, and specialized fire prevention and firefighting teams to participate in training and professional development in fire prevention and firefighting.

5. Agencies, units, and organizations directly responsible for managing persons directly mobilized and called upon to extinguish fires and provide fire-fighting support, cadres, and members of civilian defense teams, grassroots fire prevention and firefighting teams, and specialized fire prevention and firefighting teams (hereinafter referred to as direct management units).

6. Other agencies, organizations, and individuals related to the implementation of the provisions of this Joint Circular.

Chapter II

REGIME FOR PERSONS DIRECTLY MOBILIZED AND CALLED UPON TO EXTINGUISH FIRES AND PROVIDE FIRE-FIGHTING SUPPORT WHO ARE INJURED OR DECEASED

Article 3. Treatment for persons directly mobilized and called up to extinguish fires and serve firefighting who are injured

1. Payment of medical examination and treatment costs

a) Persons participating in health insurance who are injured shall have their medical examination and treatment costs paid by the social insurance agency according to the laws on health insurance; they shall also be reimbursed for co-payment costs and medical expenses not covered by health insurance by the direct managing unit.

b) Persons not participating in health insurance who are injured shall have all medical examination and treatment costs paid by the direct managing unit.

2. Allowance system

a) Persons participating in social insurance who are injured shall have a one-time allowance or monthly allowance paid by the social insurance agency based on the degree of reduced working capacity and the number of years of social insurance contributions according to the laws on social insurance.

b) Persons not participating in mandatory social insurance, persons currently receiving pension or monthly social insurance allowances, or those who have received a one-time social insurance benefit, if they suffer from a reduced working capacity of 5% to 30%, shall be entitled to a one-time allowance (excluding the allowance calculated based on the number of years of social insurance contributions), or a monthly allowance (excluding the allowance calculated based on the number of years of social insurance contributions) if they suffer from a reduced working capacity of 31% or more, by the direct managing unit.

The amount of the allowance shall be equivalent to the one-time allowance or monthly allowance for workers with reduced working capacity as stipulated by the laws on social insurance.

Article 4. Treatment for persons directly mobilized to extinguish fires and provide fire-fighting services who die

1. Persons participating in social insurance, persons currently receiving monthly pension or social insurance allowances who die due to firefighting or serving firefighting, or die during the initial treatment period due to accidents while firefighting or serving firefighting, their dependents shall be entitled to a monthly or one-time survivor's allowance paid by the social insurance agency; organizations, entities, or individuals organizing funerals shall be entitled to funeral allowance paid by the social insurance agency according to the laws on social insurance.

2. Persons not participating in social insurance or those who have received a one-time social insurance benefit who die due to firefighting or serving firefighting, or die during the initial treatment period due to accidents while firefighting or serving firefighting, the direct managing unit shall pay the following benefits:

a) A one-time survivor's allowance equal to 36 times the minimum wage or a monthly survivor's allowance for the dependents of persons directly mobilized and called up to extinguish fires and serve firefighting who died.

Conditions for receiving a one-time survivor's allowance, conditions for receiving and the level of monthly survivor's allowance shall be implemented according to the provisions of the laws on social insurance for persons participating in mandatory social insurance;

b) Funeral allowance for organizations, entities, or individuals organizing funerals; the level of funeral allowance is ten times the minimum wage;

c) The minimum wage referred to in points a and b of Clause 2 of this Article is the minimum wage at the month when the person directly mobilized and called up to extinguish fires and serve firefighting died.

Article 5. Consideration for war invalid status or equivalent to war invalid status

1. Persons directly mobilized and called up to extinguish fires and serve firefighting who are injured and meet the conditions to be recognized as war invalids or persons enjoying policies equivalent to war invalids according to Clause 1, Article 27 of Decree No. 31/2013/NĐ-CP dated April 9, 2013 of the Government detailing and guiding the implementation of certain provisions of the Ordinance on Preferential Treatment for Persons Contributing to the Revolution shall be considered for war invalid status or equivalent to war invalid status by the competent authority.

2. The direct managing unit shall be responsible for preparing files and procedures to request consideration for war invalid status or equivalent to war invalid status for persons directly mobilized and called up to extinguish fires and serve firefighting who are injured.

The files and procedures for requesting consideration for war invalid status or equivalent to war invalid status shall be carried out according to the provisions of the laws on preferential treatment for persons contributing to the revolution for cases recognized as war invalids or persons enjoying policies equivalent to war invalids.

Article 6. Recognition as烈士

1. Persons directly involved in firefighting and firefighting support who die and meet the conditions for recognition as烈士in accordance with Clause 1, Article 17 of Decree No. 31/2013/NĐ-CP dated April 9, 2013 of the Government detailing and guiding the implementation of certain provisions of the Ordinance on Preferential Treatment for Those Contributing to the Revolution shall be considered and recognized as烈士by competent authorities.

2. The direct managing unit shall be responsible for establishing files and processing procedures to request recognition as烈士for persons directly mobilized and dispatched to participate in firefighting and firefighting support who died.

The procedures for requesting recognition as烈士shall be carried out in accordance with the provisions of the laws on preferential treatment for those contributing to the revolution.

Chapter III

REGIME FOR STAFF AND MEMBERS OF THE POPULAR GUARD FIRE PREVENTION AND FIGHTING TEAM, FIRE PREVENTION AND FIGHTING BASE AND SPECIALIZED TEAMS WHEN PARTICIPATING IN TRAINING AND PROFESSIONAL DEVELOPMENT IN FIRE PREVENTION AND FIGHTING

Article 7. Allowance during participation in training and professional development in fire prevention and fighting

Staff and members of the popular guard team shall be paid an allowance equal to 1.5 times the base daily wage for each day of training and professional development in fire prevention and fighting by the direct managing unit.

The base daily wage is determined by dividing the monthly base wage (as stipulated by the Government) by 22 days.

Article 8. Salary and allowance during participation in training and professional development in fire prevention and fighting

Staff and members of the fire prevention and fighting base and specialized teams shall be paid salary and allowance during their participation in training and professional development in fire prevention and fighting as follows:

1. Salary (including basic wage, allowances, and other supplementary amounts if applicable) for the days of participation in training and professional development in fire prevention and fighting. The salary to be paid for these days shall be implemented according to the laws on wages and the wage payment regulations of the direct managing unit.

2. An allowance of 0.5 times the daily wage for each day of participation in training and professional development in fire prevention and fighting.

The daily wage for calculating the allowance is determined as follows:

a) For units implementing the state wage system based on salary coefficients and allowances (if any) currently enjoyed in the wage scale issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for cadres, civil servants, public officials, and armed forces personnel, divided by the base wage and then by 22 days;

b) For units implementing the wage system decided by the employer, which is the current daily wage of the employee as stipulated by labor laws on wages.

Article 9. Regime for staff and members of the popular guard fire prevention and fighting team, fire prevention and fighting base and specialized teams who suffer accidents during participation in training and professional development in fire prevention and fighting

1. Persons participating in compulsory social insurance who suffer accidents or health damage during training and professional development in fire prevention and fighting shall have their work injury benefits paid by the insurance agency in accordance with the laws on social insurance.

2. Persons not participating in compulsory social insurance or receiving monthly pension or social insurance benefits, or those who have received one-time social insurance benefits, who suffer injuries during training and professional development in fire prevention and fighting shall be entitled to the following benefits by the direct managing unit:

a) Assessment of the degree of reduced working capacity;

b) One-time allowance according to the degree of reduced working capacity for persons with a reduced working capacity from 5% to 30%. The amount of the allowance is calculated as follows: a reduction of 5% in working capacity entitles them to five times the base wage, and for every additional 1%, they are entitled to an additional half time the base wage;

c) Monthly allowance according to the degree of reduced working capacity for persons with a reduced working capacity of 31% or more. The amount of the allowance is calculated as follows: a reduction of 31% in working capacity entitles them to thirty percent of the base wage, and for every additional 1%, they are entitled to an additional two percent of the base wage;

d) Provision of living aids and orthopedic devices according to the age limit based on the condition of disability;

đ) Service allowance at the level of the base wage for persons with a reduced working capacity of 81% or more who are paralyzed, blind in both eyes, amputated or paralyzed in both limbs, or suffering from mental illness;

e) Rest and recuperation for 5 to 10 days after treatment stabilizes the injury but health has not recovered. The benefit for one day is 25% of the base wage if resting and recuperating at home; 40% of the base wage if resting and recuperating at a centralized facility.

3. The time of entitlement to allowances under points b, c, and đ Clause 2 of this Article shall be counted from the month when the injured person completes treatment and is discharged from the hospital. In cases where the wound recurs and a new assessment of the degree of reduced working capacity is conducted, the time of entitlement to allowances shall be counted from the month when the Medical Assessment Council issues its conclusion.

Article 10. Treatment for civilian defense officers, firefighting team members participating in fire prevention and firefighting training and enhancement who die

1. In case a person who is currently participating in social insurance or receiving monthly pension or social insurance allowance dies due to participating in fire prevention and firefighting training or enhancement, or dies during the first treatment period due to an accident while participating in such activities, their dependents shall be entitled to receive monthly or one-time survivor's benefit from the social insurance agency; the organization or individual responsible for funeral arrangements shall be entitled to receive funeral allowance from the social insurance agency according to the laws on social insurance.

2. In case a person who has not participated in social insurance or who has received a one-time social insurance benefit dies due to participating in fire prevention and firefighting training or enhancement, or dies during the first treatment period due to an accident while participating in such activities, the directly managing unit shall pay the following benefits:

a) A one-time death benefit equal to 36 times the minimum wage level.

b) One-time or monthly survivor's benefit, and funeral allowance as stipulated in Point b Clause 2 Article 4 of this Joint Circular.

Chapter IV

EXPENSES FOR IMPLEMENTATION OF REGULATIONS

Article 11. Sources from the Health Insurance Fund and Social Insurance Fund

1. The Health Insurance Fund shall cover the cost of medical examination and treatment expenses as prescribed by the laws on health insurance at Point a Clause 1 Article 3 of this Joint Circular.

2. The Social Insurance Fund shall cover the benefits prescribed at Point a Clause 2 Article 3, Clause 1 Article 4, Clause 1 Article 9, and Clause 1 Article 10 of this Joint Circular.

Article 12. Sources from the State Budget

The Central Budget shall ensure allocation in the annual budget of the Ministry of Labor, Invalids and Social Affairs to implement the benefits for those mobilized or called up directly to fight fires and provide fire services who are injured or killed and meet the conditions to enjoy policies for war invalids as prescribed in Article 5 or recognized as martyrs as prescribed in Article 6 of this Joint Circular.

The preparation, execution, and settlement of the budget shall be carried out according to the laws on state budget for persons with meritorious service to the revolution.

Article 13. Sources from the Directly Managing Unit

1. The directly managing unit shall pay the benefits prescribed in this Joint Circular as follows:

a) Co-payment costs and other costs not covered by the health insurance fund as prescribed at Point a Clause 1 Article 3; medical examination and treatment costs as prescribed at Point b Clause 1 Article 3;

b) Benefits as prescribed at Point b Clause 2 Article 3; Clause 2 Article 4; Article 7;

c) Salary and allowances as prescribed in Article 8;

d) Benefits as prescribed in Clause 2 Article 9; Clause 2 Article 10.

2. For directly managing units whose operating funds are guaranteed by the state budget, the funds for paying the benefits prescribed in Clause 1 of this Article shall be guaranteed by the state budget according to the allocation in the annual budget of the unit. The preparation, execution, and settlement of the budget shall be carried out according to the laws on state budget.

3. For directly managing units whose operating funds are not guaranteed by the state budget, the funds for paying the benefits prescribed in Clause 1 of this Article shall be recorded as reasonable expenses of the unit.

Chapter V

IMPLEMENTING PROVISIONS

Article 14. Effective Date

1. This Joint Circular takes effect from January 28, 2016.

2. The benefits prescribed in Clause 1 Article 3; Article 4; Article 7; Article 8; the assessment of work capacity reduction, convalescence, and recovery of health for civilian defense officers, firefighting team members participating in fire prevention and firefighting training and enhancement prescribed in Article 9; Article 10 of this Joint Circular shall be applied from the date Decree No. 79/2014/ND-CP takes effect.

Article 15. Responsibility for Implementation

1. The authority responsible for mobilization and call-up shall be responsible for reporting, investigating, and statistically reporting accidents, confirming cases of accidents, injuries, and deaths; coordinating with the directly managing unit and relevant agencies to establish files and carry out procedures to implement benefits for those mobilized or called up directly to fight fires and provide fire services and civilian defense officers, firefighting team members participating in fire prevention and firefighting training and enhancement according to this Joint Circular.

2. The directly managing unit shall take the lead and coordinate with relevant agencies, organizations, and individuals to establish files for benefit application; ensure funding sources and implement benefit payments within the responsibility of the unit.

3. The Vietnam Social Security shall guide the directly managing unit, agencies, organizations, and individuals related to file establishment, procedures, and processes for benefit enjoyment; implement benefit payments within the responsibility of the Social Security Agency according to this Joint Circular.

During implementation, if there are difficulties, please report to the Ministry of Labor, Invalids and Social Affairs, the Ministry of Public Security, and the Ministry of Finance for timely supplementation and guidance.
