Pursuant to the Law on Government Organization dated June 19, 2015;

At the proposal of the Minister of Information and Communications;

The Prime Minister issues this Decision on the Regulations on the Operations of Primary Information Services.

Article 1. These Regulations are promulgated together with this Decision.

Article 2. This Decision takes effect from February 1, 2017.

Article 3. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under central cities, organizations, units, and individuals related thereto are responsible for implementing this Decision.

 

REGULATIONS

GRASSROOTS INFORMATION ACTIVITIES
(PROMULGATED TOGETHER WITH Decision No. 52/2016/QĐ-TTg dated December 6, 2016 of the Prime Minister)"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."Government)

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. These Regulations prescribe the contents of primary information services operations, the responsibilities of state management over primary information services operations; the rights and obligations of agencies, organizations, and individuals participating in managing and implementing primary information services operations.

Article 2. These Regulations apply to agencies, organizations, and individuals participating in managing and implementing primary information services operations.

Article 2. Interpretation of Terms

In this Regulation, the following terms shall be understood as follows:

Point 1. Primary information services operations refer to activities providing essential information as prescribed in Article 3 of these Regulations to residents at communes, wards, and towns through radio broadcasting activities of commune radio stations; primary information bulletins; non-commercial publications serving primary information services operations; direct information provision through primary information service speakers and propagandists; public notice boards and other forms of primary information services operations.

Point 2. Primary information bulletins are periodic press products using news formats to provide essential information as prescribed in Article 3 of these Regulations to residents at communes, wards, and towns through printed materials or via the Internet.

Point 3. Non-commercial publications serving primary information services operations are publications not intended for sale, aimed at providing essential information as prescribed in Article 3 of these Regulations to residents at communes, wards, and towns.

Point 4. Primary information service speakers and propagandists are individuals directly conducting oral propaganda to deliver essential information as prescribed in Article 3 of these Regulations to residents at communes, wards, and towns.

Point 5. Public notice boards include electronic public notice boards and those made from other materials fixed at a location and used to disseminate essential information as prescribed in Article 3 of these Regulations in writing and images to residents at communes, wards, and towns.

Article 3. Contents of primary information services operations

Point 1. Providing information on state policies and laws, international and domestic events directly related to local residents.

Point 2. Providing essential knowledge relevant to daily life of local residents suitable to the target groups and economic-social conditions of each region, including:

Subpoint a. Information on economic, cultural, and social development projects and programs at the locality;

Subpoint b. Information related to politics, economy, culture, and society of the locality and scientific and technical knowledge;

Subpoint c. Information related to social order, safety, security, and defense of the locality;

Subpoint d. Information on emergencies occurring at the locality or affecting it;

Subpoint đ. Information on exemplary collectives and individuals in various fields;

Subpoint e. Information on products, goods, and services serving production and daily life of local residents.

Point 3. Serving the directive and administrative tasks of local authorities and grassroots agencies.

Article 4. Principles of basic information activities

Clause 1. Adhering to the Party’s guidelines and policies, state laws, and healthy customs and traditions of the locality.

Clause 2. Ensuring that essential information is timely and accurate for residents, prioritizing residents in rural areas, mountainous regions, remote areas, border areas, islands, and areas with difficult economic and social conditions.

Clause 3. Funding for primary information services operations comes from the state budget; mobilized from organizations, individuals, and other legitimate sources.

Article 5. State Management Responsibilities for Basic Information1. Ministry of Information and Communications

The Ministry of Information and Communications shall be responsible before the Government for state management of basic information, including the following responsibilities:

a) Leading and coordinating with relevant agencies to develop, guide, and organize the implementation of strategies, plans, policies, and regulatory documents on basic information activities;

b) Organizing the provision of information and managing the content of the basic information system nationwide;

c) Leading and coordinating with relevant agencies to disseminate and educate laws related to basic information;

d) Leading and coordinating with relevant agencies to direct research and application of science and technology in basic information activities;

đ) Leading and coordinating with relevant ministries, sectors, and provincial People's Committees to organize training, capacity building, and training of human resources in basic information activities;

e) Leading and coordinating with relevant agencies to implement international cooperation in basic information activities;

g) Leading and coordinating with relevant ministries, sectors, and provincial People's Committees to implement reporting, statistics systems of the basic information system; preparing and submitting reports on basic information activities to the Prime Minister;

h) Leading and coordinating with relevant ministries, sectors, and provincial People's Committees to organize commendation and reward activities in basic information activities;

i) Inspecting, supervising, handling complaints and accusations, and dealing with violations in basic information activities within their authority.

2. Ministries and Equivalent Agencies

Ministries and equivalent agencies shall cooperate with the Ministry of Information and Communications in state management of basic information, including the following responsibilities:

a) Developing planning for subordinate basic information systems;

b) Organizing the provision of information, managing the content of information, and specialized basic information activities;

c) Cooperating with provincial People's Committees to provide timely specialized information to localities;

d) Implementing the reporting, statistics system of subordinate basic information systems according to the guidance of the Ministry of Information and Communications; regularly or urgently providing information, reports, and statistics to the Ministry of Information and Communications to support state management.

Provincial People's Committees are state management bodies for basic information at the local level, including the following responsibilities:

3. Provincial People's Committees, Municipal People's Committees directly under the Central Government

a) Developing and organizing the implementation of planning, policies, and development strategies for basic information in accordance with the guidance of the Ministry of Information and Communications and the provisions of the law;

b) Developing, organizing the implementation, guiding, and inspecting the implementation of regulatory documents, policies, regulations, and rules on basic information; disseminating and educating laws on basic information in the locality;

c) Organizing the provision of information and managing the content of the basic information system in the locality;

d) Cooperating with the Ministry of Information and Communications and relevant agencies in researching and applying science and technology in basic information activities in the locality;

đ) Leading and coordinating with the Ministry of Information and Communications and relevant agencies to organize training, capacity building, and training of human resources in basic information activities in the locality;

e) Implementing the reporting, statistics system of the basic information system in the locality according to the guidance of the Ministry of Information and Communications; regularly or urgently providing information, reports, and statistics to the Ministry of Information and Communications to support state management;

g) Leading and coordinating with the Ministry of Information and Communications and relevant agencies to organize commendation and reward activities in basic information activities in the locality;

h) Inspecting, supervising, handling complaints and accusations, and dealing with violations in basic information activities within their authority.

District People's Committees are state management bodies for basic information at the local level, including the following responsibilities:

4. District People's Committee

a) Organizing the implementation of planning, policies, and development strategies for basic information in the locality according to the guidance of the Ministry of Information and Communications and the provincial People's Committee;

b) Organizing the implementation and inspecting the implementation of regulatory documents and policies on basic information; disseminating and educating laws on basic information in the locality;

c) Organizing the provision of information and managing the content of the basic information system in the locality;

d) Implementing the reporting, statistics system of the basic information system in the locality according to the guidance of the provincial People's Committee; regularly or urgently providing information, reports, and statistics to the provincial People's Committee to support state management;

đ) Inspecting, supervising, handling complaints and accusations, and dealing with violations in basic information activities within their authority.

Commune People's Committees have the responsibility to:

a) Organize the implementation of planning, policies, and development strategies for basic information in the locality according to the guidance of the provincial and district People's Committees;

d) Implement the reporting, statistics system of the basic information system in the locality according to the guidance of the district People's Committee; regularly or urgently providing information, reports, and statistics to the district People's Committee to support state management.

c) Organizing the provision of information and managing the content of the basic information system in the locality;

d) Cooperating with the Ministry of Information and Communications and relevant agencies in researching and applying science and technology in basic information activities in the locality;

COMMUNITY RADIO BROADCASTING OF COMMUNE RADIO STATIONS

Chapter II

GRASSROOTS INFORMATION ACTIVITIES

Section 1. RADIO BROADCASTING OF THE COMMUNITY RADIO STATION

Article 6. Radio Broadcasting Activities of Commune Radio Stations

1. Producing radio programs in Vietnamese and ethnic languages for broadcasting on the radio transmission and broadcasting system of the Commune Radio Station.

2. Cooperating with Provincial Radio and Television Stations and District Radio Stations to produce radio programs for broadcasting on the radio transmission and broadcasting systems of the Provincial Radio and Television Stations and District Radio Stations.

3. The content of radio programs of Commune Radio Stations focuses on providing information about the guidance and management activities of commune-level authorities; supplying essential information and knowledge for daily life of local residents suitable to the socio-economic conditions of the locality; providing information on state policies and laws directly related to local residents; regulations of commune authorities and political, economic, and social activities at the locality and grassroots level.

4. The production and broadcasting of radio programs by Commune Radio Stations shall comply with legal provisions on content information and not violate legal provisions on radio transmission and broadcasting.

Article 7. Radio Transmission Activities of Commune Radio Stations

1. Depending on actual conditions, Commune Radio Stations implement relay broadcasting and rebroadcasting of news programs and other radio programs of Vietnam Voice Radio, Radio Stations, Provincial Radio and Television Stations, District Radio and Television Stations, and District Radio Stations to meet the essential information needs of local residents on the radio transmission and broadcasting system of the Commune Radio Station.

2. Broadcasting radio programs serving national and local essential political tasks, information, and propaganda according to the requirements of competent state management agencies on the radio transmission and broadcasting system of the Commune Radio Station.

3. Managing and operating specialized technical equipment systems to implement relay broadcasting and rebroadcasting of radio programs of Vietnam Voice Radio, Radio Stations, Provincial Radio and Television Stations, District Radio and Television Stations, and District Radio Stations in accordance with the Radio and Television Transmission and Broadcasting Plan up to 2020.

Article 8. Provisions on the Activities of the Radio Station Commune

The People's Committee of the commune shall specify the content of the program, time, location, duration, and volume of radio and television broadcasts suitable to the unique characteristics of each locality and grassroots level; ensuring the requirements to serve essential political tasks, information, and propaganda of the grassroots information system; meeting the information needs of people in the area; complying with the provisions of this Regulation and relevant legal provisions.

Section 2. BASIC INFORMATION BULLETIN

Article 9. Publishing Grassroots Information Bulletins

The publication of grassroots information bulletins to provide essential information as stipulated in Article 3 of this Regulation shall comply with the provisions of the Press Law and guiding documents implementing the Press Law.

Article 10. Publishing ElectronicInformation Bulletins (Information Websites) electronic (information pagen electronic)

The publication of electronic grassroots information bulletins (information websites) to provide essential information as stipulated in Article 3 of this Regulation shall comply with the provisions of the Press Law and current legal provisions on the management, provision, and use of internet services and information on networks, as well as the provision of information and online public services on information websites or government portals of state agencies.

Section 3. NON-PROFIT MATERIALS TO SUPPORT GRASSROOTS INFORMATION ACTIVITIES

Article 11. Publishing Non-commercial Materials for Community Information Activitiesat the grassroots level

The publication of non-commercial materials to provide essential information as stipulated in Article 3 of this Regulation shall be carried out in accordance with the provisions of Article 25 of the Law on Publishing and guiding documents implementing the Law on Publishing.

Section 4. DIRECT INFORMATION THROUGH COMMUNITY REPORTERS AND PROPAGANDISTS

Article 12. Standards for Community Reporters and Propagandists

The standards for community reporters and propagandists recognized by competent authorities shall be specifically defined in accordance with the requirements of the information and propaganda tasks of such agencies, but must meet the following conditions:

1. Possess good moral qualities, firm ideological stance, trustworthiness in work; not currently under disciplinary measures ranging from reprimand upwards as prescribed by laws on civil servants, public officials, and labor laws.

2. Have communication skills; fluently use the spoken language, either Vietnamese or local ethnic minority languages.

3. Master the specialized field in which the community reporter or propagandist conducts oral propaganda activities.

4. Have at least three consecutive years of activity in the specialized field in which the community reporter or propagandist conducts oral propaganda activities.

Article 13. Content and Form of Direct Information Through Community Reporters and Propagandiststhrough direct reports from grassroots propagandists and communicators

1. The information provided by community reporters and propagandists includes policy and legal information of the State, international and domestic events directly related to local residents; regulations of local authorities and political, economic, and social activities at the local level; guidance on implementing directives and management activities of local authorities and leadership of grassroots units; essential knowledge for daily life of local residents; receiving information from residents to serve the directive and management activities of the Party committee, local authorities, and leadership of grassroots units in accordance with the functions and responsibilities of the managing agency or unit.

2. The activities and content of information provided by community reporters and propagandists must not violate legal provisions.

3. The form, scale, time, and location of conducting oral propaganda activities to the people must ensure effective information dissemination and comply with relevant legal provisions.

Article 14. Rights and Obligations of Community Reporters and Propagandists

1. Rights of community reporters and propagandists:

a) To be provided with legal normative documents, information, and materials serving the performance of their information and oral propaganda duties according to the functions and responsibilities of their agency or unit;

b) To receive training and supplementary knowledge serving the performance of their information and oral propaganda duties according to the functions and responsibilities of their agency or unit;

c) To be equipped with appropriate technical means to perform their information and oral propaganda duties;

d) To enjoy remuneration and benefits as prescribed by law.

2. Obligations of community reporters and propagandists:

a) To carry out information and oral propaganda tasks assigned by authorized agencies or units; convey complete, accurate, and timely information to the intended audience;

b) Not to disclose state secrets and refrain from other prohibited acts as prescribed by law;

c) To strictly adhere to relevant provisions of this Regulation;

d) To have the responsibility to report periodically and urgently about their information and oral propaganda activities and the results of feedback information received from the people to authorized agencies or units.

Article 15. Responsibilities of agencies and units managing reporters and grassroots propagandists

Agencies and units managing reporters and grassroots propagandists shall be responsible for ensuring necessary material conditions and means for oral propaganda work in accordance with the provisions of the law.

Section 5. PUBLIC NOTICE BOARD

Article 16. Subjects and Conditions for Establishing Public Notice Boardsis permitted to establish public notice boards

1. The subjects permitted to establish public notice boards include state agencies, organizations, military units, residential communities, residential areas, schools, and hospitals.

2. The establishment of public notice boards must comply with the legal regulations on construction and must adhere to the regulations on the protection of historical and cultural relics; traffic safety corridors, dikes, national power grids, without obstructing traffic signals, public guidance signs; not hanging across roads affecting traffic safety; not impacting architectural aesthetics and landscapes, and must conform to local planning and standards issued by competent authorities.

3. Sound shall not be used to transmit information on public electronic notice boards.

Article 17. Content and Presentation Form of Public Notice Boards

1. The content of information on public notice boards shall announce state policies and laws, international and domestic events directly related to local residents; local government regulations and activities; political, economic, and social activities at the grassroots level; directives and management activities of local governments and leaders of grassroots agencies; essential daily life information suitable for the functions and tasks of the agency or unit establishing the public notice board.

2. The content and presentation form of public notice boards shall not violate legal provisions.

3. The head of the agency or organization establishing the public notice board shall be responsible for the content of the information on the public notice board.

4. The subjects permitted to establish public notice boards may cooperate with businesses to invest in building, operating public notice boards, and allocate appropriate proportions according to legal provisions on the public notice board for advertising purposes. Advertising on public notice boards must comply with legal regulations on advertising.

Article 18. Management of Public Notice Boards

The People's Committee of the commune where the public notice board is located shall be responsible for managing the establishment of public notice boards and the content of information on public notice boards in accordance with legal provisions.

OTHER FORMS OF GRASSROOTS INFORMATION

Article 19. Other forms of grassroots information of each type of aircraft of the Vietnam Coast Guard

1. Depending on actual conditions, the State uses other forms of grassroots information to provide essential information as stipulated in Article 3 of this Regulation to residents in communes, wards, and towns.

2. The State may mobilize assets and material conditions of agencies, organizations, and enterprises to serve grassroots information activities based on mutual agreement; ensuring harmony between the interests of the State, people, and those of agencies, organizations, and enterprises.

3. Agencies, organizations, and enterprises shall have the responsibility to coordinate and support the State in disseminating essential information to a large number of grassroots residents.

Chapter III

IMPLEMENTING PROVISIONS

Article 20. Implementation

1. The Minister of Information and Communications, Ministers, Heads of Ministries equivalent to ministries, agencies under the Government, and Chairpersons of People's Committees at all levels shall be responsible for directing and organizing the implementation of this Regulation in accordance with their assigned functions, tasks, and authority.

2. Ministries, agencies equivalent to ministries, agencies under the Government, Provincial People's Committees, County People's Committees, Commune People's Committees, and organizations implementing grassroots information activities shall be responsible for ensuring funding for the construction of material conditions and the maintenance of grassroots information activities from the state budget according to the current state budget classification and other legitimate financial sources.

Article 21. Guidance on implementation and reporting

The Minister of Information and Communications shall take the lead and coordinate with the Ministers, Heads of ministerial-level agencies, agencies under the Government, and Chairpersons of People's Committees at all levels to guide, urge, inspect, monitor, evaluate, compile, and report to the Prime Minister on the situation and results of implementing this Regulation./.
