ORDINANCE
ESTABLISHING THE ORDER OF MERIT AND MEDAL FOR OUTSTANDING SOLDIERS
Pursuant to Article 53 of the Constitution of the Democratic Republic of Vietnam;
To promote the spirit of patriotic competition among cadres and soldiers in building the People's Army and the People's Armed Police, aiming to protect the construction of socialism in the northern region and establish a solid foundation for the struggle to achieve national reunification and peace;
The Standing Committee of the National Assembly of the Democratic Republic of Vietnam establishes the Order of Merit and Medal for Outstanding Soldiers and stipulates the awarding procedures as follows:
Article 1
The Order of Merit and Medal for Outstanding Soldiers shall be awarded to cadres and soldiers who have made contributions in building the People's Army and the People's Armed Police after the restoration of peace (July 20, 1954).
Article 2
The Order of Merit for Outstanding Soldiers has three classes: first class, second class, and third class.
The Medal for Outstanding Soldiers has only one class.
Article 3
The Order of Merit and Medal for Outstanding Soldiers shall be awarded to cadres and soldiers meeting the following conditions:
1. After July 20, 1954, they have served continuously in the military for the period specified in Article 4 below:
2. They have actively worked and studied, successfully completing their tasks during their service.
3. They remain loyal to the revolution and have not committed major errors during their service or after discharge.
Article 4
Cadres and soldiers meeting the conditions set out in Article 3 shall be awarded the Order of Merit or Medal according to the following service duration criteria:
a) The First Class Order of Merit for Outstanding Soldiers shall be awarded to those who have served continuously in the military for 15 years.
b) The Second Class Order of Merit for Outstanding Soldiers shall be awarded to those who have served continuously in the military for 10 years.
c) The Third Class Order of Merit for Outstanding Soldiers shall be awarded to those who have served continuously in the military for 5 years, or those who have served continuously for 3 to 4 years and were rated as excellent in all aspects during that time.
d) The Medal for Outstanding Soldiers shall be awarded to those who have served continuously in the military for 3 years, or those who have served continuously for 2 years and were rated as excellent in all aspects during that time.
Article 5
Cadres and soldiers who have passed away shall be posthumously awarded the Order of Merit or Medal according to the provisions of Articles 3 and 4 above.
Article 6
For martyrs who died in combat or in work, the posthumous awarding is regulated as follows:
a) Those who meet the criteria for receiving the Second Class Order of Merit shall be posthumously awarded the First Class Order of Merit.
b) Those who meet the criteria for receiving the Third Class Order of Merit shall be posthumously awarded the Second Class Order of Merit.
c) Those who meet the criteria for receiving the Medal shall be posthumously awarded the Third Class Order of Merit.
d) Those who have served continuously in the military for 2 years, or those who have served continuously for less than 2 years but were rated as excellent in all aspects during their service, shall also be posthumously awarded the Medal.

The awarding of the Order of Merit for Outstanding Soldiers shall be decided by the Standing Committee of the National Assembly.
The awarding of the Medal for Outstanding Soldiers shall be decided by the Council of Ministers.
Article 8
The Council of Ministers shall provide detailed regulations for implementing this Ordinance.
This Ordinance was adopted by the Standing Committee of the National Assembly of the Democratic Republic of Vietnam on September 12, 1961.
